Goodrich , (Goodri-.-h) husband and wife, are the owners of the real property described in Exhibit "A" and commonly tailed 11885 S. W. Bull Mountain Road, and Walter C . Baker and Irene R. Baker, (Baker) husband and wife, are the owners of real property described in Exhibit "B" and comnonly celled 11925 S. W. 1,,J1. Mountain Road, both in Washington County, Oregon. WHEREAS Bak,,r has paid as consideration of the sum of NINE HUNDRED AND NO/101, DOLLARS ( $900.00) to the Goodrichs ' contractor for the specific purpose of increasing the Goodrich rivate sewer line from a four inch (4." ) diameter to a six inch (6n� diameter, and paid SIX HUNDRED AND 110/100 DOLLARS ($600.00) to Goodrich for work performed on thy: installation of the private sewer line running 220 feet, more or less, from the northerly line of the Goodrich property to the city sewer on Wildwood Avenue. Receipt of the above sums is hereby acknowledged. NOW, THEREFORE, IT IS AGREED that both the Goodrich and Baker parcel of real property are benefitted by this improvement, (the 6" diameter common sewer line which runs along an existing deeded easement) , and serves both properties. The parties hereto, for themselves, their successors, assigns and heirs , and all owners of the real property described in Exhibits "A" and "B" promise and agree to share equally the costs of maintaining the private common 6" diameter sewer line from the northwest corner of the property described in Exhibit "A" running first eEstE>rly, 60 feet more or less , then running 220 feet more or less, in L northerly dire-tion to the connection of the City of Tigard' s 8 ;rawer buried in Wildwood Avenue, from the time of the connection of c,Rir property to the private common 6" diameter sewer line. In consideration of the mutual promises herein con-:ained and the payments already received from Walter C . and Irene Baker, husband anJ wife, Robert L. and Claire B. Goodrich, husband and wife, (Grantor) , �rant aid convey to Walter C. and Irene R. Baker, husband and wife, Grantee) , their heirs, successors, and assigns, R perpetual non- exclusive easement to use a strip of land four feet, wide, the northerly boundary line of which is located at thq northwest corner of that property described in Exhibit "A" running i.n an --steely direction for sixty feet more or less, until it connects with the private 6" diameter sewer line running thence northerly 220 feet, more of less, to the Tigard city sewer buried in Wildwood Avenue. The terms and conditions of this easement and maintenance agreement are as follows: 1 . Grantee, his agents, independent contractors and invitees , shall use the easement strip for a buried underground sewer line only, and only for access from Grantee ' s property to the city sewer on Wildwool Avenue, and in conjunction with such use, may construct, reconstruct, maintain and repair the easement herein granted.
