We are quite familiar with this area, as well as the adjoining property along the track to the northwest, as It has been a source of drainage problems over the years. The Railroad's side ditch was designed to carry only run-off from our right-of-way and not that of adjoining property. Often this ditch will slit in and not drain properly, allowing they water to stand, which in turn saturates the roadbed. This creates a maintenance problem which If left unchecked could seriously damage the track structure. This original parking lot construction was done before the City of Tigard Implemented their present drainage review policy, so the Railroad was never con- tacted and asked to approve the drainage plan. We realize this situation has existed for sos 1me and you are asking for a continuance of the present condition, however, we feel the Railroad should not be burdened with this ongoing problem. Because of this development, the City of Tigard is requesting that my client, Magno-Humphries, receive written permission from Southern Pacific that allows for the continuation of surface water run off to drain onto the neighboring tracks. My client will in fact be reducing the amount of impervious area by adding several thousand square feet of landscape area to the existing parking lot. The amount of water run off spread over several hundred feet of frontage has had minimal effect and the proposed reduction will certainly continue to minimize this condition.
