FROM: Randy Woole � SUBJECT: SDR 91-0004 (Dibbayawan/Scandia Motors) On November 1 , 1991 , I spoke with Regina Dibbayawan about the 24" storm drain line required at the subject project . She was concerned about the cost of the line, alleging that the City had previously indicated that they could hook to an existing 24" line in a differant location but that the line turned out not to exist . Some time after they began work on the site, they learned of the additional expense required to bring the storm drain system to standards . I discussed the situation with Chris Davies and read the SDR Decision and report . it appears that the information provided to the applicant at the time of. the SDR decision was very misleading. First , th^ as-built drawings for thin location have proven to be extraordinarily inaccurate. Second, the SDR report provided inaccurate information, wherein comments from Operations indicate that a 24" line existed at the east end of the property and recommending that the applicant connect to the line to avoid work in Commercial Street ; subsequent investigation indicates that the + 24" line does not exist . Due to the unusual situation in which incorrect City records and incorrect interpretation of records by staff have caused the applicant to proceed with a project without knowledge of the full costs of the project , we (Chris , Cliff Scott and I) have agreed that it is appropriate for the City to share a portion of the cost of replacing an existing non-standard 10" line . Therefore , today I called Ms . Dibbayawan and offered to assist in two ways : 1 . If Scandia supplies the materials (pipe and gravel) , the City will install the portion of the new storm drain pipe crossing their property (the portion between the street and the railroad -- approximately 160 feet) . Installation of the storm drain within Commercial Street would still b the responsibility of Scandia . 2. Upon completion of the project: when all costs are known, she could apply for creation of a .reimbursement district , requiring the adjoining property owner to repay a share of the cost at the time of future development . d= She is going to explore this offer with her engineer and her contractor. Toni proceeded to tell me about their frustrations dealing with the City on their new building. Specifically, that they couldn't get any time commitments out of Jim Jaqua and Chris Davies and in general were feeling as though Jim and Chris had been unresponsive. The applicant requests Site Development Review approval to allow the construction of an approximately 9,250 square foot automobile repair facility with an office. This development is proposed to provide 24 parking spaces located along the northwest and southeast portions of the site. The applicant proposes 15. 18 percent landscaping coverage with four Flowering Dogwoods to be located along the street frontage of the site. Ten Mugo Pines will also be located on the interior portion of the site. 4. Agency and NPO Comments The Engineering Division has reviewed tho request and provides the following comments: 1. Streets: The site fronts S.W. Commercial Street which is classified as a minor collector and is within the Central Business District which requires a 60 foot right-of-way, with a pavement width of 40 feet and 5 foot sidewalks. This site currently has no improvements and bhould be required to install standard half-street improvements. 2. Sanitary Sewer: The site currently has a 10 inch sanitary sewer line .located in SW Commercial Street along the frontage of the property. This line is adequate to serve the site. In addition, there is an existing 12 inch sanitary sewer lin- that .runs along the westerly property line within a 20 foot easement which is also adequate to serve the site. 3. Storm Sewer: The site has a existing 10 inch storm drainage line that runs along the front of the site and then crosses along the westerly, portion of the property. Based on the information in the Engineering Department's "as•- built" file there is a 60 foot wide easement for the storm drainage system which appears to start from the westerly edge of T.L. 1202 . In addition, based on the plan that was submitted by the, applicant, it appears that the proposed building does not encroach upon this easement. Requiring surface water quality facilities on ,small sites would result in numerous facilities that would become a maintenance burden to the City. Furthermore, the applicant has not proposed any such facilities and there are no natural depressions or other areas of this site that are particularly suitable for water quality such facilities. Regional facilities, funded by fees-in-lieu of construction of these facilities, would provide the required treatment with improved reliability and less maintenance. Consequently a fee-in-lieu of the construction of on-site water quality facilities should be assessed. 4. Traffic Impact Fee (TIF) : Washington County has established, and the City has agreed to enforce, (Resolution No. 90-65) Traffic Impact. Fees . The purpose of the fee ; s to ensure that new development contribut(!s to extra-capacity transportation impro.amer.ts needed to accommodate additional traffic generated by .such L velopment. The applicant shall be ia,;uired to pay the fee. Based on the applicants submittal, there currently iR no identified use for trip determination as outlined in the Traffic Impact Fee Procedures Manual. Therefore, the fee shall be based on either actual trip generation of a same or similar use verified by a registered engineer or on a use most similar in traffic generation as determined in Appendix "A" of the Traffic Impact Fee Procedures Manual. The City of Tigard Building Department has reviewed this proposal and has offered the following comments: The shop area will be constructed as an H-4 occupancy (as per State Building Code) and should be designed as such. The Tualatin Valley Fire and Rescue District has reviewed the proposal and has the following comments: This structure will exceed the allowable fire flow of 3,000 GPM. The structure will either require upgrading, subdividing or protection with automatic sprinklers. Hydrant location approval will be coordinated with Tigard Water District. NOTICE OF DECISION - SDR 91-0004 - DIBBAYAWAN PAGE 3 4" IL The City of Tigard Field Operations Division has reviewed this proposal aad offers the following comment: The site plan indicates a proposed connection to the storm sewer located in the front of the site and crossing SW Commercial Street. Operations proposes connecting to the 24 inch storm sewer line which runs along the east side of the site, thereby eliminating the need to cross SW Commercial. The City of Tigard Parks Maintenance Division, Tigard Water District, General Telephone, and Portland General Electric have reviewed the proposal and have issued no comments or objections. No other comments have been received. B. ANALYSIS AND CONCLUSION Code Section 12 .66 .050(A) (4) (Central Business District) of. the Community oevelopment Code (CDC) allows a maximum building height of 80 feet. The height of the automotive repair facility and office is proposed to be approximately 27 feet and therefore is within the building height allowed in this zoning district. The CBD zoning district requires a 30 foot minimum setback where a commercial use abuts a residential zoning district. This development does not abut a residential zoning district on any side and therefore no setback requirements apply to this site. The applicant has indicated that approximately 7, 150 square feet of the building will be used for the repair of automobiles. The balance of the building (approximately 2, 100 square feet) will be available for office, lunchroom, parts storage, and customer service uses. These uses are classified in Cade Section 13.42 (Use Classifications) as Automotive and Equipment: Repairs, Light Equipment) . Under this classification the parking requirement of Automotive Repair requires one parking space for every 500 square feet of gross floor area. The proposed building's size of approximately 9,250 square feet necessitates a minimum of 19 vehicular parking spaces . The site plan proposes 24 parking spaces and therefore provides an adequate number of parking spaces which satisfies the code requirements for this proposed use. +I NOTICE OF DECISION - SDR 91-0004 - DIBBAYAWAN PAGE 4 I State of Oregon House Bill 2084, which became effective September 1, iy90, requires two disabled persoi, parking spaces if 26 to 50 parking spaces are provided. The proposed plan provides for one disabled person parking space. Therefore, this code requirement is satisfied. The site plan does not indicate an allocation of space for the provision of bicycle parking. Code Section 18. 106 (P) requires one bicycle parking space for each 15 vehicular parking spaces in any development. Therefore, space for two bicycles shall be provided. Therefore, this code standard has not been satisfied. Subsequently , the site plan should be .revised to provide for the requir A two bicycle parking spaces. The site meets the minimum access standards through the provision of one 30 foot wide a(-,cess driveway from SW 72nd 1►venue. Code Section 18. 108.080(A) requires that commercial u.se parking areas with less than 100 parking spaces be provided with one access drive with a minimum access width of 30 feet. The accessway must be paved to a minimum width of 24 feet. The applicant is proposing d 40 foot wide accessway and therefore surpasses this access requirement. Code Section 18. 108 .050 requires that a walkway extend from -the ground floor entrances or from the ground floor landing of stairs of all commercial ar.d industrial uses, to the istreets which provide the required access and egress. The proposed site plan does not indicate that a walkway has been provided. Therefore, the si.te plan should be revised to provide the required pedestrian v-alkway. Code Section 18 . 100. 110 (Screening: Special Provisions) states that trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed and on the basis on one tree for each seven parl.ing spaces in order to provide a canopy effect. The proposed landb�•;aping plan i has approximated this placement by providing .five interior parking lot trees whereas the Code only requires four parkinci lot trees for a parking lot of this capacity. Developments within the CBD zoning district are required to i provide a minimum of 15% landscaping on the site. Of the approximately 25, 110 square foot site, the applicant has proposed to landscape 3,812 square feet. This surpasses the minimum landscaping requirement by providing approximately 15,. 18 percent landscaping whereas the Code requires only 3, 767 square feet for this site. Section 18. 102 (Visual Clearance Areas) requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of-ways or the { NOTICE OF DECISION - SDR 91-0004 - DIBBAYAWAN PAGE 5 intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanei,�t obstruction exceeding 3 feet in height; except that obstructions which may be located in this area shall be visually clear between 3 and 8 feet in height (trees may be placed within this area provided all branches below 8 feet are removed) . Visual clearance areas shall be that triangular area formed by measuring a 30 foot distance along each of the right-of-way or property lines and then connecting these two 30 foot distance points with a straight line. The proposed landscaping plan identifies Flowering Dogwood trees as the suggested street trees. Although this tree is a good aesthetic choice for this site, the relatively short stature of these trees does provide some conc:-?rn with the compliance of the vision clearance area. Therefore, alternative trees should be proposed to replace the dogwoods which are within the vision clearance area. In addition to being zoned CBD, this site is also within the City-Is Action Area overlay zone. Code Section 10.86 .030 st*.ates that outdoor storage of materials, products, or supplies is prohibited for new development within the overlay zone area. TLerefore, there shall be no outdoor storage of these items, incI.uding the long-term storage of op:ttable or inoperable vehicles, on the premises . C.
