Your action to return the application provides us some concern ,as there doesn't seem to be a current standard, as to what "permission without a doubt" might entail. We are particularly concerned in regard to how this might apply to the "P.G.E." site at Mile Point 4.64 on Oregon Route 217, for which we have made application. As you have not yot processed this request, we would like to inform you that our permission to locate at this site IF BEYOND DOUBT. We believe doubt rRmoved for the following reasons: 1. ' 92 09117 NO. 4 PAGE 2 LEASE Thi: agreement is effective as of this day of July 1992, and is by and between Portland General Electric Company, an Oregon Corporation, hereinafter called the Lessor, and OBIE Outdoor Advertising .Incorporated, an Oregon Corporation, hereinafter called the Lessee. 1 . In consideration of the covenants and payments described below, to be performed and made by the Lessee, Lessor hereby leases to the Lessee forte the term beginni.ig on the c2,512* day of July 1992 and ending on July ate, 2002 or until terminated by either party, the Premises outlined in red on Exhibit A attached hereto. 2. Lessee agrees to hold harmless the lessor from any and all liens, fines, damages, penalties, forfeitures, or judgments in any manner accruing by reason of the use or occupation of said Premises by the Lessee; and also agrees to at all times protect the lessor from all injury, damage, or loss by reason of the occupation of the Premises by Lessee; or from any ' cause whatsoever growing out of said Lessee's use thereof. 6. The Lessee shall pay rent when due, and before any lien shall be attached to the Premises if the same may lawfully be asserted, pay all charges for all materials joined and affixed to the said Premises and shall pay in full all persons who perform labor cn said Premises and shall not permit or suffer any mechanics or- material or other lien of any kind or nature to be enforced against said Premises for work done or materials furnished thereon at the request, or in behalf of the Lessee; and the Lessee agrees to indemnify and hold harmless the Lessur and its property from and against all liens, claims, demands, costs, expenses of whatever nature in any wp;, connected with or growing out of the work done, labor performed, or materials or other things furnished. 7. The Lessee shall not locate nor permit the lccation or erection of any buildings or structures on or over the property of the Lessor except those shown on the attached Exhibit A without the written consent of the Lessor, and the Lessee covenants that he shall , during the continuance of his lease, keep the Premises in a neat and tidy condition free from all rubbish, debris, and other material which would tend to increase the risk of fire or give the premises an untidy appear-ance. Use of said Premises by the Lessee and agents, employees, or invitees; or b.
