Co. Tax Map ISI 33CD, Tax Lot 3100) . DECISION: Notice is hereby given that. the Planniig Director for the City of Tigard has APPROVED the above described application subject to certain conditions. The Findings and conclusions on which the Director based his decision are as rioted below. A. FINDING OF FACT 1 . Background The property is one of the lots created by Cotswald Subdivision which was approved by the City in 1985 (S 3-85). 2. Vicinity Information The surrounding land iF, also zoned R-25 and contains a combination of developed and vacant lots. 3. Site Information and Proposal Description The lot contains a home that is under construction. When the footings were inspected by the contractor, it appeared that the house had a 20 foot setback in the front yard. When a survey check was done later, it was discovered that the garage only has a 18 foot setback. a . Agency and NPO Comments The Engineering Division and Building Inspection Office have no objection to the request . B. ANALYSIS AND CONCLUSION The following criteria in the Community Development Code apply to variance requests: I . The proposed variance will not be mat-rially detrimental to the purposes of this Code, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards; and to other properties in the same zoning district or vicinity; 2 . There are special circumstanceN that exist which are peculiar to the lot size or shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district ; NOTICE OF DECISION - V10-86 - PAGE I 3. The use proposed will he the same as permitted under this Code and City standards will be maintained to the greatest extent t'iat is reasonably possible, while permitting some economic use of the land; 4. Existing physical and natural systema, sucl. ar but not limited to traffic, drainage, dranatic land forms or parks will not be adversely affected any more than would occur if the development were loacted as specified in the Code; and 5. The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. Tile primary purpose of the setback standards for thr it-25 zone is to allow for adequate spacing, air, light, and privacy for resi.dential structures. The variance will not have an appreciable effect upon the existing or proposed residences in the area. The 18 foot distance between the garage and front property line will provide adequate spac: for parking vehicles on the driveway without blocking the public sidewalk. The lot is relatively small and if all setback requirements from the property lines and the house were enforced, the applicant would have to move the building or adjust the property line. The City has no objection to the 19 foot setback. D. DECISION The Planning Director approves V 10-86. D. PROCEDURE 1 .
