Meeting Minutes
December 13, 2000

1. Call to Order
The regular Meeting of the Intergovernmental Water Board was called to order at.5:30 pm.
2. Roll Call and Introductions
3. Approval of minutes October 25, 2000
Commissioner Patrick Carroll motioned to accept and approve the minutes of the
October 15, 2000, meeting. Commissioner Jan Drangsholt seconded the,motion. The
.motion was voted on and the minutes were unanimously accepted and approved:
• 4. Leak Adjustment Request
No response had been received from the water users. Therefore, the requests will be
handled at a later date.
5. SDC:Rate.Increase Mike Miller
•
Mr: Miller informed the Board that the Resolution was taken to City Council on
November 28, 2000. The IWB had previously approved the rate increase in May. The
Council approved the Resolution: There was,hardly any opposition..,The Homebuilder's
Association had some last minute questions. • _
Commissioner Scheiderich asked if they received a 60-day`prior notice'? Mr. Miller
stated that according to the City. Recorder there was no one on record of interest.
Notification of the Homebuilder's.Association was merely done as a courtesy to them.
They were notified more than 45 days before the hearing. An Open House was held on
October 30th to review the SDC Plan. No showed up.
Mr. Miller did not hear anything from the development community until. just before
Thanksgiving. He set up a meeting to discuss their issues regarding methodology. The
Homebuilder's Association is currently involved in litigation with the City of Newberg over
, their methodology. The meeting must have been successful because they did not show
up.at the Council meeting to.voice any concerns. The effective date for the increase will
be January 1,2001. Notices have been mailed informing of the increase.changes.
Commissioner Carroll asked if the Newberg case might have bearing on Tigard Water
Area. Mr, Miller stated that Art Griffith (CH2M Hill) worked on both SDCs, but even

though Newberg's SDC's are based on our methodology, Tigard's methodology is not •
flawed. Our legal council reviewed it as well as legal council for CH2M Hill.
Commissioner Carroll asked what the percentage of the increase represented. Mr.
Miller indicated it is 108% for the 410 system (main zone) and 80% in the Bull Mountain
area. The water supply project creates the major impact for the increase.
Commissioner Scheiderich said there would be 60 days to appeal, however, no appeals
are expected.
6. Long Term Water Supply Update— Ed Wegner
Mr. Ed Wegner brought the Board up to date on the progress with long term water
process. He said the progress is slowly moving forward.
Joint Water Commission -legal staffs have been meeting to coordinate a
Memorandum of Understanding to be available for the quarterly meeting of the JWC in
January 2001. Several key points are:
Existing stream flow rights for winter use available to Tigard now.
Currently purchasing just over 800,000 gallons daily.
Joint improvements by participating entities to expand those rights to
purchase more water from them. Paying $.44 perhundred from the JWC
compared with $.80 - .90 we pay to Portland, Lake Oswego and Tualatin
Valley.
They will sell during summer months when available. Improvements
needed to aid us in taking the water. , •
—> Participate in research ofsource development.
Act as junior partner on Capital Improvement Projects.and Plan
Expansions. Includes a buy-out if source development could not be
developed in the future.
Commissioner Jan Drangsholt asked if Scoggins Darn was the only source for
expansion. Mr. Wegner stated that Scoggins was not the only source. .
Scoggins Dam Feasibility Study—Technical group met to coordinate investigating the
feasibility of the dam and look at an alternative study.
:• Met with the Bureau of Reclamation several weeks ago to talk about a
feasibility study and look at alternative studies. It will take two to three years to complete
the study, then.additional'two to three years to go before Congress for appropriation.
It will take about five years to build the edam. The whole process is a seven to twelve
year project. Unified Sewage Agency and Hillsboro are very eager to move the project
along for their own needs. USA is taking the lead in getting this project moving.
We need to decide within the next three to six months what direction,we'will be taking
wiith`these organizations. They understand our need to look at more than one
alternative, but also need to know how much we will be willing to invest in the studies
and capital improvements. We need to make a decision to work with one or two
organizations as a primary source of water for the future.

Portland Contract—Our proposal was submitted to them in October. The negotiating
ink team (our consultants, Paul Matthews, IUG, Phil Smith,•.Murray Smith &Associates,
gir Clark Balfour, attorney) has been meeting With small groups from Portland to discuss our
. proposal in detail. s
• Phil Smith has also been working with the Portland,staff on CIPs to pull out things that
would be of cost to the Tigard Water Service Area in order to give us a figure on what we
would have to pay for,CIP costs,

• Clackamas River Water There is.a temporary setback on this. West Linn has,elected
a completely new City.Council. Their platform was'for no growth. They have told the
general manager of South Forkcthat they view adding new partners as a•potential
expansion growth for them.
Oregon City is divided in their support. Mayor Williams has three,council members in,
favor and.tvao against proceeding with the addition of partners. Mayor Williams is still

trying to push it :'On January 11`;.2001, there will'bea joint meeting of the new councils
from both West Linn and Oregon City to review the composition of South Fork and also
• discuss the possibility.of opening'South,Fork up to other members'.
•
In'the.meantime, a halt has been'made'to further negotiations until a better
understanding•is;received of what the.new councils want to do. The draft IGA has been •
• pulled off the table., On February 1_,,`2001, there will be an.elected official's workshop.,
In addition to the anti-growth sent
invents in West Linn; they want to retain control of the ,
water board The loss of waterirights is also.a concern to them. There are some people
in the West Linn/Oregon City'areas that simply do notwant to sell us,water because we
are outside of the Clackamas basin and are on the "other side" of the,river. They think
weshould be looking for partners on "our side", meaning the Joint Water Commission.
There are several issues:that will'have.to,be overcome with them. ,
Portland is not the only"show in town": A number Of cities are„'looking elsewhere,for
their water sources. •

Mike Miller will be taking the ASR issue before the City Council next week to approve a
contract with Montgomery Watson to do the for us.

An update on the Willametteplant developments will be received on Monday at the
WWSA meeting.
Water rates have gone up 3%. There are also SDC increases. The rate increase
should have been,increased 10%, but was held off due to the ballot measure. Mr.
Wegner asked if the IWB should revisit the additional 7% increase. There was a brief
discussion and it was decided to take the issue to the next meeting of the City Council
for approval of the additional increase.
The information packet includes a breakdown of the service connection report that is
provided annually. It is a chart that covers the growth in those areas.
Kim Swan, the Water Quality and Conservation Coordinator, has resigned. She will be
leaving us for the South Fork Water Board: We are recruiting for a replacement and
hope tohave the position filled by the end of next month.

Commissioner Scheiderich asked what the testing labs.charge for the lead content tests.
Mr. Miller said the charge is typically$15—20. Mr. Scheiderich wondered if it was worth
it to the City to contract with a testing lab. Mr. Miller indicated that Tigard does not have
a large need at thistime. .The testing is currently being done semi-annually or quarterly
and is being done with a pool consisting of everybody that buys water from.Portland.

Commissioner Scheiderich asked if a.successor to Councilman Paul Hunt had been
selected. The announcement should be made after the first of the year.
The next meeting of the IWB is scheduled for January 10, 2001..
