SUMMARY 1. Jeff Peck filed the application on behalf of the City of Tigard (the"applicant"). The applicant requests sensitive lands review approval to construct a sanitary sewer main between an existing 12-inch sewer line in Fanno Creek Park and an existing sewer main in Main Street, in the City of Tigard. The new sewer line will replace a portion of an active sewer line that crosses Fanno Creek under the Main Street Bridge. The existing sewer line beneath the bridge is supported by piers that could be damaged during flood events, allowing sewage to flow into Fanno Creek. Construction of the new sewer line will occur on two separate parcels. However only one parcel involves sensitive lands subject to City review. The legal description of the parcel subject to review is Washington County Tax Assessor's Map 2S102AC,Tax Lot 204. Additional basic facts about the site and surrounding land and applicable approval standards are provided in the Staff Report to the Hearings Officer dated April 26, 2012 (the " Staff Report"), incorporated herein by reference. 2. Tigard Hearings Officer Joe Turner(the "hearings officer") conducted a duly noticed public hearing to receive testimony and evidence in this matter. At the public hearing, City staff recommended conditional approval of the application. A representatives of the applicant testified in support of the application. Two members of the public testified with questions about construction impacts on their property. Other than service providers, no one else testified orally or in writing. Disputed issue in this case include: a. Whether construction impacts to the Diamonds' property are relevant to the approval criteria for this application for Sensitive Lands Review. 3. The hearings officer concludes that the applicant sustained the burden of proof that the proposed sensitive lands review does or will comply with the applicable criteria of the Community Development Code, provided development that occurs after this decision complies with applicable local, state, and federal laws and with the condition of approval warranted to ensure such compliance occurs in fact. Therefore the application should be approved subject to the condition of approval proposed in the Staff Report. . t B. HEARING AND RECORD 1. The hearings officer received testimony at the public hearing about this application on May 14, 2012. All exhibits and records of testimony are filed with the Tigard Department of Community Development. At the beginning of the hearing, the hearings officer made the declaration required by ORS 197.763. The hearings officer disclaimed any ex parte contacts, bias or conflicts of interest. The following is a summary by the hearings officer of selected testimony offered at the public hearing in this matter. 2. City planner Cheryl Caines summarized the Staff Report. She noted that construction of the sewer line will impact two properties. However only one of the properties includes sensitive lands that are subject to City review. The proposed sewer line will replace an existing sewer line located beneath the Main Street Bridge over Fanno Creek. The applicant will decommission the existing sewer line beneath the bridge. The applicant proposed to construct the sewer line beneath the existing Fanno Creek Trail. The applicant will restore the trail to its existing elevation, so the project will have no impact on the 100-year flood. 3. City senior engineering technician Jeff Peck testified on behalf of the applicant, the City of Tigard. He summarized the location of the existing and proposed sewer lines. He noted that this project is intended to replace the aging 8-inch cast iron sewer line beneath the Main Street Bridge. The existing sewer line sits on piers beneath the bridge and could be damaged during a flood event, allowing sewage to leak into Fanno Creek. The applicant will construct the new sewer line within the existing 9- to 10-foot wide paved pathway of the Fanno Creek trail. The applicant will close sections of the trail during construction. After installing the new sewer line, the applicant will restore the trail to its current elevation. The applicant expects to begin construction of the sewer line in the spring of 2013. a. He testified that the City intends to use a portion of the back parking lot of the Diamond's property as a construction staging area for the sewer line. The City intends to construct the sewer line and a proposed water line concurrently. However the City will not use the Diamond's property as a staging area for waterline construction. b. He waived the applicant's right to hold the record open to submit a final legal argument. 4. George and Paula Diamond expressed concerns with the project's impact on their commercial property, located at 12564, 12566, and 12568 Main Street. The City is in the process of negotiating acquisition of a temporary construction easement and a permanent sanitary sewer easement over portions of their property. They questioned how long construction of the sewer line will take. Long term impacts could affect their tenants' business. They questioned whether the City will use their property for construction staging for a proposed water main project. The hearings officer closed the public record at the end of the hearing and announced his intention to approve the applications subject to the recommended conditions of approval in the Staff Report. C. DISCUSSION 1. City staff provided basic facts about the site and its vicinity and existing and proposed uses in the Staff Report and recommended that the hearings officer approve the applications, subject to the condition of approval set out in the Staff Report. The applicant accepted the findings and recommended condition without exceptions. The hearings officer adopts the findings and conclusions in the Staff Report as his own except to the extent they are inconsistent with the findings and discussion in this final order. 2. The hearings officer understands the Diamonds concerns about the potential impacts on their property during construction of the sewer line. However those impacts are beyond the scope of this application and the hearings officer has no jurisdiction to address those concerns. This application is limited to the portion of the sewer line impacting sensitive lands. Although the Diamonds' property contains a small area of sensitive lands (100-year floodplain), no sewer line construction is proposed on that portion of the Diamond's property. The City will use a portion of the Diamond's property for construction staging (storage of equipment, pipes and gravel). In addition, the Diamonds' concerns, about the duration of construction impacts and potential impacts on their tenants' businesses, are not relevant to the applicable approval criteria for this application for Sensitive Lands Review. The Diamonds' concerns can be addressed through the negotiation process for acquisition of easements through the Diamonds' property. D. CONCLUSIONS Based on the findings and discussion provided or incorporated in this final order, the hearings officer concludes that the applicant sustained the burden of proof that the proposed sensitive lands review does or will comply with the applicable criteria of the Community Development Code, provided development that occurs after this decision complies with applicable local, state, and federal laws and with the condition of approval warranted to ensure such compliance occurs in fact. E. SECTION III. BACKGROUND INFORMATION Site/Vicinity Information The site is located within downtown Tigard and is zoned Mixed Use-Central Business District (MU-CBD). Surrounding properties are also zoned MU-CBD and developed with mostly commercial uses. However,a large multi-family development lies west of the site. Work is proposed on two parcels (2S102AC-01100 and 2S102AC-00204). Only tax lot 204 has sensitive lands and requires a land use review for work proposed within the 100-year floodplain. The work area is within Fanno Creek Park along the Fanno Creek Trail. Site History Staff conducted a search of City records for the subject property. In 2010 there were two sensitive lands requests for work to replace the Ash Avenue Bridge along the Fanno Creek Trail. Both applications were withdrawn. Two lot line adjustments (MIS2000-00010 & MIS2000-00011) were approved in June 2000. No other land use cases were found for this property. Proposal Description: The applicant is requesting to construct a new sewer main within the 100-year floodplain of Fanno Creek. An existing sanitary sewer pipe over Fanno Creek (under Main Street Bridge) is supported by concrete piers. These piers could be damaged by high water and debris during flood events, spilling sewage directly into Fanno Creek. The proposal is to eliminate the crossing by re-routing the public line along the west side of Fanno Creek. The new pipe will tie into an existing line on the west side of Fanno Creek. Construction activities include cutting a trench through the existing asphalt pathway on the Fanno Creek Trail for the new pipe and temporary impacts to the Fanno Creek vegetated corridor. Contractors will disassemble the concrete piers and remove and cap the pipe section. The pipe removal work under the bridge is exempt from sensitive lands review and will be done using hand tools to minimize disturbance. SECTION IV. DECISION MAKING PROCEDURES, PERMITS AND USE Use Classification: Section 18.130.020 Lists the Use Categories. The applicant is proposing to re-route an existing public sanitary sewer line. Utilities are an outright permitted use within the MU-CBD zone. Summary Land Use Permits: Chapter 18.310 Defines the decision-making type to which the land-use application is assigned. The proposal requires a Sensitive Lands Review within the 100-year floodplain, which is a Type III-A review type. SI.R.2(111 MAIN MUTT:T S1 iWER RE-ROUTE PAGE 2 OP 8 SECTION V. APPLICABLE REVIEW CRITERIA AND FINDINGS .1 summary of the applicable criteria in the Chapter order in which they are addressed arc as follows: A. 18.775 Sensitive Lands Review B. SENSITIVE LANDS REVIEW APPROVAL CRITERIA Sensitive Lands (Section 18.775): Section 18.775.020.F states that the Director shall have the authority to issue a sensitive lands permit in the following areas by means of a Type II procedure, as governed in Section 18.390.040, using approval criteria contained in Section 18.775.070 C-E: • Drainageways; • Slopes that are 25% or greater or unstable ground; and • Wetland areas which are not regulated by other local, state, or federal agencies and are designated as significant wetlands on the Comprehensive Plan Floodplain and Wetland Map. Section 18.775.020.G states that the Hearings Officer shall have the authority to issue a sensitive lands permit in the 100-yearfloodplain by means of a Type IIIA procedure, as governed by Section 18.390.050, using approval criteria contained in Section 18.775.070. General Provisions for Floodplain Areas 18.775.040. Special flood hazard: The areas of special flood hazard identified by the Federal Insurance Administration in a scientific and engineering report entitled "The Flood Insurance Study of the City of Tigard," effective February 18, 2005, with accompanying Flood Insurance Rate Maps effective February 18, 2005, is hereby adopted by reference and declared to be a part of this chapter. This Flood Insurance Study is on file at the Tigard Civic Center. The applicant and staff have reviewed these maps and agree that this site is within one of the identified special flood hazard areas. The application is being reviewed under this premise. Base flood elevation data: When base flood elevation data has not been provided in accordance with Section 18.775.040.B above, the Director shall obtain, review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source, in order to administer Sections 18.775.040.M and 18.775.040.N below). The base flood elevation for the subject site is shown to be between 149 and 151 feet according to the Flood Insurance Rate Maps of February 18th, 2005. Test of reasonableness: Where elevation data is not available either through the Flood Insurance Study or from another authoritative source, applications for building permits shall be reviewed to assure that the potential for flood damage to the proposed construction will be minimized. The test of reasonableness is a local judgment and includes use of historical data, high water marks, photographs of past flooding, etc.,where available. Failure to elevate at least two feet above grade in these sensitive land areas may result in higher insurance rates. Base flood elevation data is available and has been established between 149 and 150 feet by the FEMA Flood Insurance Maps. Therefore, this standard does not apply. Resistant to flood damage: All new construction and substantial improvements, including manufactured homes, shall be constructed with materials and utility equipment resistant to flood damage. "1'he purpose of the proposal is to remove a pipe that is now threatened by flooding events. New pipes will be installed underground. In addition, the pipe within the floodplain will be below an asphalt pathway S1.R2III I-(MMMW,NI\IN S'IRI:F f SIAVI;R ltt-R(WTI% PAGI;i 01.s • (Fanno Creek Trail). All improvements will be resistant to flood damage; therefore this requirement is met. Minimize flood damage: All new construction and substantial improvements, including manufactured homes, shall be constructed using methods and practices that minimize flood damage. This requirement is satisfied because the proposed sewer lines will be installed below ground which minimizes the possibility of flood damage. Equipment protection: Electrical, heating, ventilation, plumbing, and air-conditioning equipment and other service facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or accumulating within the components during conditions of flooding. The proposed sewer improvements are not electrical, heating, ventilation, plumbing or air-conditioning equipment or service facilities. This standard does not apply. Water Supply Systems: All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwater into the system. The proposal is the installation of sanitary sewer mains and not water supply systems. This standard does not apply. Anchoring: All new construction, all manufactured homes and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement of the structure. All new sewer pipes will be installed underground,covered by an asphalt pathway and attached to manhole structures thereby preventing flotation,collapse or lateral movement. This requirement is satisfied. Sanitary sewerage systems: New and replacement sanitary sewerage systems shall be designed to minimize or eliminate infiltration of floodwater into the systems and discharge from the systems into floodwater. To minimize or eliminate filtration and discharge the proposed pipe will be connected using flexible gasket joints,watertight/tamper proof manhole frames and covers. Manhole joints will be sealed with preformed gaskets. The work is proposed to remove a pipe section that is currently threated by flooding thereby eliminating the threat of discharge into the creek. The proposed design satisfies this requirement. On-site water disposal systems: On-site water disposal systems shall be located to avoid impairment to them or contamination from them during flooding. No water disposal systems are proposed with this project. This standard does not apply. Residential Construction: 1. New construction and substantial improvement of any residential structure, including manufactured homes, shall have the lowest floor, including the basement, elevated at least one foot above base flood elevation; 2. Fully enclosed areas below the lowest floor that are subject to flooding are prohibited, or shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwater. Designs for meeting this requirement must either be certified by a registered professional engineer or architect, or must meet or exceed the following minimum criteria: a. A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided; b. The bottom of all openings shall be no higher than one foot above grade; and c. Openings may be equipped with screens, louvers, or other coverings or devices, provided that they permit the automatic entry and exit of flood waters. 3. Manufactured homes shall be securely anchored to an adequately anchored permanent foundation system. Anchoring methods may include,but are not limited to, use of over-the-top or frame ties to ground anchors. Residential construction is not proposed with this development. This standard does not apply. SI,R2U11-IIIII04 MAIN S1RI?I:'lSEWER RF:ROUl7? 1) GE 4 OF 8 Nonresidential Construction: New construction and substantial improvement of any commercial, industrial, or other nonresidential structure shall either have the lowest floor, including basement elevated to the level of the base flood elevation, or together with attendant utility and sanitary facilities, shall: 1. Be flood-proofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water; 2. Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; 3. Be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting provisions of this subsection based on their development and/or review of the structural design, specifications and plans. Such certifications shall be provided to the Building Official as set forth in Section 18.775.030.E.2; and 4. Nonresidential structures that are elevated, not flood-pproofed must meet the same standards for space below the lowest floor as described in Section [8.775.040.L.2. Applicants flood-proofing nonresidential buildings shall be notified that flood insurance premiums will be based on rates that are one foot below the flood-proofed level (e.g., a building constructed to the base flood level will be rated as one foot below that level). This standard does not apply as this proposal is the installment of underground utilities. No structures are proposed. FINDING: Based on the analysis above, the proposal satisfies the General Provisions for Floodplain Areas. Sensitive Lands Permits —100-year floodplain 18.775.070.B states that the Hearings Officer shall approve, approve with conditions or deny an application request within the 100-year floodplain based upon findings that all of the following criteria have been satisfied: 1. Land form alterations shall preserve or enhance the floodplain storage function and maintenance of the zero-foot rise floodway shall not result in any encroachments, including fill, new construction, substantial improvements and other development unless certified by a registered professional engineer that the encroachment will not result in any increase in flood levels during the base flood discharge; The proposed improvements will be constructed underground beneath an asphalt path. The pathway will be restored at the existing surface elevation preserving the floodplain storage function. This criterion is met. 2. Land form alterations or developments within the 100-year floodplain shall be allowed only in areas designated as commercial or industrial on the comprehensive plan land use map, except that alterations or developments associated with community recreation uses, utilities, or public support facilities as defined in Chapter 18.120 of the Community Development Code shall be allowed in areas designated residential subject to applicable zoning standards; The development site lies within the Mixed Use — Central Business District zone, which is a commercial zone. Proposed work is for the installation of utilities. This criterion is met. 3. Where a land form alteration or development is permitted to occur within the floodplain it will not result in any increase in the water surface elevation of the 100-year flood; All pipes will be installed underground beneath a pathway. The pathway will be restored to the existing surface elevation resulting in no increase in the water surface elevation of the 100-year flood. This criterion is met. 4. The land form alteration or development plan includes a pedestrian/bicycle pathway in accordance with the adopted pedestrian/bicycle pathway plan, unless the construction of said pathway is deemed by the Hearings Officer as untimely; Proposed sewer improvements will be constructed under an existing portion of the Fanno Creek Trail. The affected portion of the pathway will be reconstructed, satisfying this criterion. 5. Pedestrian/bicycle pathway projects within the floodplain shall include a wildlife habitat assessment that shows the proposed alignment minimizes impact to significant wildlife habitat while balancing the community's recreation and environmental educational goals; Slit )1 1-011004 M.\IN SIREE"I'SEWER RE-ROUTE P:AGI'.5 01,8 This is not a new pathway project. The proposal includes removal and reinstallation of an existing pathway. No changes are proposed to the path location or alignment. A wildlife habitat assessment is not required; this criterion is not applicable. 6. The necessary U.S. Army Corps of Engineers and State of Oregon Land Board, Division of State Lands, and CWS permits and approvals shall be obtained; and The applicant states that all approvals and permits will be obtained prior to construction. The approval of the proposed development will be conditioned to ensure that necessary agency approvals are obtained prior to site work. With the condition this criterion is met. 7. Where land form alterations and/or development are allowed within and adjacent to the 100-year floodplain, the City shall require the consideration of dedication of sufficient open land area within and adjacent to the floodplain in accordance with the comprehensive plan. This area shall include portions of a suitable elevation for the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. This criterion is not applicable since the site area is currently part of the Tigard parks system with an existing pathway (Fanno Creek 'Frail). FINDING: Based on the analysis above, the approval criteria for a sensitive lands permit within the 100-year floodplain have not been fully met. However, if the applicant complies with the condition listed below,the criteria can be met. CONDITION: Prior to site work, the applicant shall submit to the city the applicable U.S. Army Corps of Engineers, State of Oregon Land Board, Division of State Lands, and Clean Water Services permits. 18.775.090 Special Provisions for Development within Locally Significant Wetlands and Along the Tualatin River, Fanno Creek, Ball Creek, and South Fork of Ash Creek A portion of the work is proposed along Fanno Creek. The standard setback distance or vegetated corridor area applies to all development proposed on property located within or partially within the vegetated corridors, except as allowed below: a. Roads, pedestrian or bike paths crossing the vegetated corridor from one side to the other in order to provide access to the sensitive area or across the sensitive area, as approved by the City per Section 18.775.070 and by CWS "Design and Construction Standards"; b. Utility/service provider infrastructure construction (i.e. storm, sanitary sewer, water, phone,gas, cable, etc.), if approved by the City and CWS; c. A pedestrian or bike path, not exceeding 10 feet in width and meeting the CWS "Design and Construction Standards"; d. Grading for the purpose of enhancing the vegetated corridor, as approved by the City and CWS; e. Measures to remove or abate hazards, nuisances, or fire and life safety violations, as approved by the regulating jurisdiction; f. Enhancement of the vegetated corridor for water quality or quantity benefits, fish, or wildlife habitat, as approved by the City and CWS; g. Measures to repair, maintain, alter, remove, add to, or replace existing structures, roadways, driveways, utilities, accessory uses, or other developments provided they are consistent with City and CWS regulations, and do not encroach further into the vegetated corridor or sensitive area than allowed by the CWS "Design and Construction Standards. The proposal is exempt from the standard setback distance and vegetated corridor standards because it involves the installation of a public utility approved by the City and CWS as allowed under exemption b. OTHER APPLICABLE DEVELOPMENT CODE STANDARDS STREET UTILITY IMPROVEMENT STANDARDS (18.810) 18.810.070 Sidewalks Bikeways and Pedestrian Pathways 18.810.110.C. requires: 1. Minimum width for bikeways within the roadway is five feet per bicycle travel lane. 2. Minimum width multi-use paths separated from the road is ten (10) feet. The width may be reduced to eight(8) feet if there are environmental or other constraints. 3. The minimum width for pedestrian only off-street paths is five (5) feet. 4. Design standards for bike and pedestrian-ways shall be determined by the City Engineer. The existing multi-use path is 9-10 feet wide. It will be replaced to existing or better condition at the current width following installation of the sanitary sewer. These requirements are met. C. IMPACT STUDY (18.390): Section 18.390.040.B.2.e states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standards, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. The proposed improvements will upgrade the sanitary sewer system and have no effect on the water and storm water system. There will be temporary closure of the Fanno Creek Park and trail in the areas of construction. During construction there will be noise. The applicant proposes minimizing the impacts on adjacent residential properties by completing work during day time work hours. SECTION VI. OTHER STAFF COMMENTS Tigard Police and the Building Official have reviewed the proposal and have no objections. The City Arborist has reviewed the proposal and has no objections. Sensitive Land Review does not require a Tree Plan per 18.790—Tree Removal. However, the site is city owned property and is subject to the regulations in Tigard Municipal Code 9.06 — Trees on City Property. In the narrative the applicant addresses these regulations and shows how trees will be protected. No removal is proposed. Tigard's Development Review Engineer commented that an erosion control plan is required if less than one acre is disturbed and that a 1200CN permit is required if the disturbance is more than one acre and less than 5 acres. SECTION VII. AGENCY COMMENTS Copies of the complete letters are found in the case file SLR2011-00004. All comments have been forwarded to the applicant. Clean Water Services commented that a CWS Storm Water Connection Permit Authorization must be obtained prior to any work on the site. A condition of approval will ensure this permit is obtained. Oregon Division of State Lands (DSL) has commented that there are mapped wetland/waterways on tax lot 204 but whether a permit is required could not be determined from the information provided. The applicant stated that all permit approvals will be obtained from other regulatory agencies, including DSL. A condition to obtain these permits has been placed on this approval. Frontier (formerly Verizon) wrote that there are possible conflicts with Frontier's conduit system. The applicant has coordinated with Frontier and has included Frontier duct bank and vaults on the construction plans to resolve conflicts. In addition, further location of conflicts will be examined after excavation and those conflicts will be resolved during construction. The goal of this notice is to invite interested parties to participate early in the decision-making process by submitting comments in writing during the open comment period or through oral testimony at the public hearing. The pipe is currently supported on concrete piers and is located under the Main Street Bridge. The piers for the pipe itself could be damaged by high water, scour and debris flowing down the creek during flooding events. The project proposes eliminating the crossing by rerouting the sewer along the west side of Fanno Creek. The project will eliminate the possibility of the creek and debris taking out the pipe and or its supports and releasing sewage directly to Fanno Creek. The significance of failing to proceed with this project includes: • The risk to public health, along with the health of the creek and habitat. • A raw sewage leak is a violation of the Federal Clean Water Act with fines up to $30,000 per day. • A break during a high water event makes it difficult to repair for days, if not weeks. • There are no other feasible solutions which both eliminate the risks to the creek from failure and have the smallest possible impact to Fanno Creek Park. The project proposes to construct a new sewer main between the sewer on Main Street and the sewer trunk line that runs along the west side of Fanno Creek. This land use action is focused on the portion of sewer line that will be constructed under the existing Fanno Creek Trail, see Figure 1. Project Impact Study per 18.390.050 The impact study quantifies the effect of the development on the public facilities and services. • Temporary closure and use of the park within the construction limits shown on the plans during construction. • Temporary closure and use of the bike and pedestrian trails within the limits shown on the plans during construction. Page I 1 • Public stormwater infrastructure will not be affected by the proposed sewer improvement project. • Public water infrastructure will not be affected by the proposed sewer improvement project. • Public sanitary sewer infrastructure will be upgraded by the proposed sewer improvement project. • Noise impacts will be unavoidable during the proposed sewer improvement project. The construction within the park will be completed during day time work hours to minimize the noise impacts on the adjacent multi-family property, Main Street Village at Fanno Creek. Proposed Construction Activities: • Construction activities within the park will consist of open cutting a trench through the existing asphalt pathway. Native materials will be removed from the trench along the alignment of the sewer line. Excavated material to be reused will be stockpiled on the property located at 12564 SW Main Street. The remainder of excavated material will be hauled-offsite to a receiving pit. Aggregate material will be placed in the sewer trench to be used as bedding for the sewer pipe. 12" sewer pipe will be installed from the downstream end of the alignment to Main Street. Granular backfill will be placed in the trench and brought up to existing ground grades. When the sewer improvements are completed, the existing asphalt pathway will be removed along the sewer alignment. New asphalt will be placed along the existing trail alignment to match the existing grades. A small paving machine and roller will be used to place and compact the asphalt. Temporary impacts to the vegetated corridor in the park are estimated to be 1,665 square feet. The impact areas will be replanted with CWS approved native plant seed. • Construction activities under the Main Street Bridge: Upon completion of the proposed sewer improvements, the contractor will use labor and hand tools under the Main Street Bridge to disassemble the existing cast iron sewer pipe and the three concrete piers that hold the sewer line in place. The contractor will access the existing sewer line by walking down the bank from the property located at 12562 SW Main Street. The sewer pipe will be removed in sections and hauled up onto the Main Street Bridge with the assistance of cables. The existing line will be disposed of by the contractor. The two ends of the sewer line sticking out from the bridge abutment will be capped with ductile iron plugs. Temporary impacts to the vegetated corridor (470 square feet) will be restored with CWS approved native plant seed. The vegetated corridor and 100-year floodplain boundaries are shown on the plans for reference. 18.775.040 General Provisions for Floodplain Areas A. Permit Review. The appropriate approval authority shall review all permit applications to determine whether proposed building sites will minimize the potential for flood damage. B. Special flood hazard. The areas of special flood hazard identified by the Federal Insurance Administration in a scientific and engineering report entitled "The Flood Insurance Study of the City of Tigard," effective February 18, 2005,with accompanying Flood Insurance Rate Maps effective February 18,2005,is hereby adopted by reference and declared to be part of this chapter. This Flood Insurance Study is on file at the Tigard Civic Center. C. Base flood elevation data. When base flood elevation data has not been provided in accordance with Section 18.775.040.B above, the Director shall obtain,review and reasonably utilize any base flood elevation and floodway data available from a federal, state or other source,in order to administer Sections 18.775.040.M and 18.775.040.N below. The known base flood elevation is between 149 and 151 within the project limits of Fanno Creek Park. D. Test of Reasonableness. Where elevation data is not available either through the Flood Insurance Study or from another authoritative source, applications for building permits shall be reviewed to assure that the potential for flood damage to the proposed construction will be minimized. The test of reasonableness is a local judgment and includes use of historical Page I 3 data, high water marks, photographs of past flooding, etc.,where available. Failure to elevate at least two feet above grade in these sensitive land areas may result in higher insurance rates. This application does not include any building construction. E. Resistant to flood damage. All new construction and substantial improvements, including manufactured homes, shall be constructed with materials and utility equipment resistant to flood damage. The proposed sewer improvements will be constructed of material resistant to flood damage. F. Minimize flood damage. All new construction and substantial improvements, including manufactured homes, shall be constructed using methods and practices that minimize flood damage. The proposed sewer improvements will be constructed of material resistant to flood damage. G. Equipment protection. Electrical, heating,ventilation,plumbing,and air-conditioning equipment and other service facilities shall be designed and/or otherwise elevated or located so as to prevent water from entering or accumulating within the components during conditions of flooding. This proposed sewer improvements are not considered electrical, heating, ventilation, plumbing, and air-conditioning equipment or other facilities that need to be elevated or located to prevent water from entering or accumulating within its components. H. Water supply systems. All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwater into the system. The proposed sewer improvements are not considered as part of the water supply system. This criterion is not applicable. I. Anchoring. All new construction, all manufactured homes and substantial improvements shall be anchored to prevent flotation, collapse, or lateral movement of the structure. The proposed sewer improvements will be installed underground, covered by an asphalt pathway and anchored between manhole structures to prevent floatation, collapse, or lateral movement. j. Sanitary sewerage systems. New and replacements sanitary sewerage systems shall be designed to minimize or eliminate infiltration of floodwater into the systems and discharge from the systems into floodwater. The proposed sewer pipe will be connected with flexible gasket joints. Watertight/tamper proof manhole frames and covers shall be used in the park. Manhole joints shall be sealed with pre formed gaskets such as Kent Seal No. 2, Ram-Neck, or approved equal to prevent infiltration. Page 4 K. On-site water disposal systems. On-site water disposal systems shall be located to avoid impairment to them or contamination from them during flooding. The proposed sewer improvements are not considered an on-site water disposal system. This criterion is not applicable. L. Residential construction. 1. New construction and substantial improvement of any residential structure, including manufactured homes, shall have the lowest floor,including the basement, elevated at least one foot above base flood elevation; The proposed sewer improvements are not considered residential construction. This criterion is not applicable. 2. Fully enclosed areas below the lowest floor that are subject to flooding are prohibited, or shall be designed to automatically equalize hydrostatic flood forces on exterior walls by allowing for the entry and exit of floodwater. Designs for meeting this requirement must either exceed the following minimum criteria: a. A minimum of two openings having a total net area of not less than one square inch for every square foot of enclosed area subject to flooding shall be provided; b. The bottom of all openings shall be no higher than one foot above grade; and c. Openings may be equipped with screens, louvers, or other coverings or devices, provided that they permit the automatic entry and exit of flood waters. The proposed sewer improvements are not considered residential construction. This criterion is not applicable for 2.a, b., or c. 3. Manufactured homes shall be securely anchored to an adequately anchored permanent foundation system. Anchoring methods may include, but are not limited to, use of over-the-top or frame ties to ground anchors. The proposed sewer improvements are not considered residential construction. This criterion is not applicable. M. Nonresidential construction. New construction and substantial improvement of any commercial,industrial, or other nonresidential structure shall either have the lowest floor, including basement, elevated to the level of the base flood elevation, or together with attendant utility and sanitary facilities, shall: 1. Be flood-proofed so that below the base flood level the structure is watertight with walls substantially impermeable to the passage of water; The proposed sewer improvements are not considered commercial, industrial or other nonresidential structure. This criterion is not applicable. 2. Have structural components capable of resisting hydrostatic and hydrodynamic loads and effects of buoyancy; Page I 5 This proposed sewer improvements will be constructed under an asphalt pathway. The proposed sewer lines will be rigid and anchored down by manholes to resist hydrostatic loading and effects of buoyancy. 3. Be certified by a registered professional engineer or architect that the design and methods of construction are in accordance with accepted standards of practice for meeting provisions of this subsection based on their development and/or review of the structural design, specifications and plans. Such certifications shall be provided to the Building Official as set forth in Section 18.775.030.E.2; and The design of the proposed sewer improvements will be certified by a professional engineer. The proposed improvements do not fall under the review of the Building Official. Plans and specifications will not be submitted to the Building Department. 4. Nonresidential structures that are elevated, not flood-proofed, must meet the same standards for space below the lowest floor as described in Section 18.775.040.L.2. applicants flood-proofing nonresidential buildings shall be notified that flood insurance premiums will be based on rates that are one foot below the flood-proofed level (e.g., a building constructed to the base flood level will be rated as one foot below that level). The proposed sewer improvements are not considered nonresidential building construction. This criterion is not applicable. N. Subdivisions and partitions in 100-year floodplain. Subdivisions and partitions in the 100-year floodplain shall meet the following criteria: 1. The design shall minimize the potential for flood damage; 2. Public utilities and facilities such as sewer, gas, electrical, and water systems shall be located and constructed so as to minimize flood damage; 3. Adequate drainage shall be provided to reduce exposure to flood damage; and 4. For subdivisions or partitions which contain more than 50 lots or 5 acres and where base flood elevation data is not available from the Federal Emergency Management Agency (FEMA) or another authoritative source, the applicant shall generate base flood elevation data to be reviewed as part of the application. The proposed sewer improvements do not fall under the criteria of subdivisions or partitions. The criteria identified under N.1, N.2.,N.3., and N.4. are not applicable. O. Recreational vehicles. Recreational vehicles placed on sites within Zones A1-A30, AH, and AE on the community's Flood Insurance Rate Map either: 1. Are on the site for fewer than 180 consecutive days; 2. Are fully licensed and ready for highway use: a. Are on wheels or jacking system, Page 16 b. Are attached to the site only by quick disconnect type utilities and security devices, and have no permanently attached additions, or c. Meet the requirements of Subsections E, F, I, and L above and the elevation and anchoring requirements for manufactured homes. (Ord. 05-01) The proposed sewer improvements do not fall under the criteria of recreational vehicles. This criterion identified under 0.1, 2.a., 2.b., 2.c., and 2.d. are not applicable. 18.775.070 — Sensitive Land Permits A. Permits required. An applicant,who wishes to develop within a sensitive area, as defined in Chapter 18.775,must obtain a permit in certain situations. Depending on the nature and intensity of the proposed activity within a sensitive area, either a Type II or Type III permit is required, as delineated in Sections 18.775.020.F and 18.775.020.G. The approval criteria for various kinds of sensitive areas, e.g., floodplain, are presented in Sections 18.775.070.B-18.070.E below. B. Within the 100-year floodplain. The Hearings Officer shall approve, approve with conditions or deny an application request within the 100-year floodplain based upon finding that all of the following criteria have been satisfied: 1. Land form alterations shall preserve or enhance the floodplain storage function and maintenance of the zero-foot rise floodway shall not result in any encroachments, including fill, new construction, substantial improvements and other development unless certified by a registered professional engineer that the encroachment will not result in any increase in flood levels during the base flood discharge; The sewer improvements will be constructed underground beneath the existing pathway. The pathway will be restored to match existing surface elevations preserving the floodplain storage function. 2. Land form alterations or developments within the 100-year floodplain shall be allowed only in areas designated as commercial or industrial on the comprehensive plan land use map, except that alterations or developments associated with community recreation uses, utilities, or public support facilities as defined in Chapter 18.120 of the Community Development Code shall be allowed in areas designated residential subject to applicable zoning standards; The proposed sewer improvements are considered public support facilities. The improvements will not create a land form alteration. 3. Where a land form alteration or development is permitted to occur within the floodplain it will not result in any increase in the water surface elevation of the 100-year flood; Page 17 The proposed sewer improvements will not create a land form alteration. The improvements will be constructed underground beneath the existing pathway. The pathway will be restored to match existing surface elevations preserving the floodplain storage function. 4. The land form alteration or development plan includes a pedestrian/bicycle pathway in accordance with the adopted pedestrian/bicycle pathway plan, unless the construction of said pathway is deemed by the Hearings Officer as untimely; The proposed sewer improvements will not create a land form alteration. A pedestrian/bicycle pathway already exists and will be reconstructed within the project area. 5. Pedestrian/bicycle pathway projects within the floodplain shall include a wildlife habitat assessment that shows the proposed alignment minimizes impacts to significant wildlife habitat while balancing the community's recreation and environmental educational goals; The proposed sewer improvements will be constructed under the existing pedestrian/bicycle pathway, minimizing impacts to the park, and eliminating the need for a wildlife habitat assessment. 6. The necessary U.S. Army Corps of Engineers and State of Oregon Land Board, Division of State Lands, and CWS permits and approvals shall be obtained; and All necessary approvals and permits will be obtained prior to construction. 7. Where land form alterations and/or development are allowed within and adjacent to the 100-year floodplain, the City shall require the consideration of dedication of sufficient open land area within and adjacent to the floodplain in accordance with the comprehensive plan. This area shall include portions of a suitable elevation for the construction of a pedestrian/bicycle pathway within the floodplain in accordance with the adopted pedestrian/bicycle pathway plan. Dedication of sufficient open land area within the floodplain will not be necessary as the property is currently part of the City of Tigard Parks system. A pedestrian/bicycle pathway exists within the project limits. 18.775.090 Special Provisions for Development within Locally Significant Wetlands and Along the Tualatin River, Fanno Creek, Ball Creek, and the South Fork of Ash Creek A. In order to address the requirements of Statewide Planning Goal 5 (Natural Resources) and the safe harbor provisions of the Goal 5 administrative rule (OAR 660-023-0030) pertaining to wetlands, all wetlands classified as significant on the City of Tigard "Wetlands and Streams Corridors Map" are protected. No land form alterations or developments are allowed within or partially within a significant wetland, except as allowed/approved pursuant to Section 18.775.130. Page I 8 No land form alterations or developments are proposed within or partially within a significant wetland. B. In order to address the requirements of Statewide Planning Goal 5 (Natural Resources) and the safe harbor provisions of the Goal 5 administrative rule (OAR 660-023-0030) pertaining to riparian corridors, a standard setback distance or vegetated corridor area, measured horizontally from and parallel to the top of bank, is established for the Tualatin River, Fanno Creek, Ball Creek, and the South Fork of Ash Creek. Fanno Creek is a perennial stream. The vegetated corridor setback was established at 50 feet from the top of bank along the project area. The proposed sewer improvements are an allowed use within the vegetated corridor. Mitigation will be provided for disturbance within the corridor per the conditions in the CWS Service Provider Letter. 1. The standard width for "good condition" vegetated corridors along the Tualatin River is 75 feet, unless wider in accordance with CWS "Design and Construction Standards", or modified in accordance with Section 18.775.130. If all or part of a locally significant wetland (a wetland identified as significant on the City of Tigard "Wetlands and Streams Corridor Map") is located within the 75-foot setback area, the vegetated corridor is measured from the upland edge of the associated wetland. The vegetated corridor is not located along the Tualatin River. This criterion is not applicable. 2. The standard width for"good condition"vegetated corridors along Fanno Creek, Ball Creek, and the South Fork of Ash Creek is 50 feet, unless wider in accordance with CWS "Design and Construction Standards", or modified in accordance with Section 18.775.130. If all or part of a locally significant wetland (a wetland identified as significant on the City of Tigard 'Wetlands and Streams Corridors Map") is located within the 50-foot setback area, the vegetated corridor is measured from the upland edge of the associated wetland. The vegetated corridor was determined to be 50 feet from the top of bank, which is outside of the locally significant wetland. CWS concurs with the corridor setback. The proposed improvements are an allowed use within the vegetated corridor. Mitigation will be provided for disturbance within the corridor per the conditions in the CWS Service Provider Letter. 3. The minimum width for"marginal or degraded condition" vegetated corridors along the Tualatin River, Fanno Creek, Ball Creek, and the South Fork of Ash Creek is 50% of the standard width, unless wider in accordance with CWS Page I 9 "Design and Construction Standards", or modified in accordance with Section 18.775.130. The vegetated corridor setback was determined to be 50 feet from the top of bank. The proposed improvements are an allowed use within the vegetated corridor. Mitigation will be provided for disturbance within the corridor per the conditions in the CWS Service Provider Letter. 4. The determination of corridor condition shall be based on the Natural Resource Assessment guidelines contained in the CWS "Design and Construction Standards." The corridor is well established. The CWS service provider letter does not indicate the condition of the corridor. However, the mitigation work will be based on the assumption that the corridor is in good condition. 5. The standard setback distance or vegetated corridor area applies to all development proposed on property located within or partially within the vegetated corridors, except as allowed below: a. Roads, pedestrian or bike paths crossing the vegetated corridor from one side to the other in order to provide access to the sensitive area or across the sensitive area, as approved by the City per Section 18.775.070 and by CWS "Design and Construction Standards"; b. Utility/service provider infrastructure construction (i.e. storm, sanitary sewer, water, phone,gas, cable, etc.), if approved by the City and CWS; c. A pedestrian or bike path, not exceeding 10 feet in width and meeting the CWS "Design and Construction Standards"; d. Grading for the purpose of enhancing the vegetated corridor, as approved by the City and CWS; e. Measures to remove or abate hazards, nuisances, or fire and life safety violations, as approved by the regulating jurisdiction; f. Enhancement of the vegetated corridor for water quality or quantity benefits, fish, or wildlife habitat, as approved by the City and CWS; g. Measures to repair, maintain, alter, remove, add to, or replace existing structures, roadways, driveways, utilities, accessory uses, or other developments provided they are consistent with City and CWS regulations, and do not encroach further into the vegetated corridor or sensitive area than allowed by the CWS "Design and Construction Standards. The proposed sewer improvements are an allowed use as identified under 18.775.090.B.5.b. 6. Land form alterations or developments located within or partially within the Goal 5 safe harbor setback or vegetated corridor areas established for the Tualatin River, Fanno Creek, Ball Creek, and the South Fork of Ash Creek that meet the jurisdictional requirements and permit criteria of the CWS, U.S. Almy Corps of Page 110 Engineers, Division of State Lands, and/or other federal, stated, or regional agencies, are not subject to the provisions of Section 18.775.090.B. except where the: a. Land form alterations or developments are located within or partially within a good condition vegetated corridor, as defined in Sections 18.775.090.B.1 and 18.775.090.B.2; The proposed sewer improvements are located within a vegetated corridor. The provisions of Section 18.775.090.B will be met as if the corridor is in good condition. b. Land form alteration or developments are located within or partially within the minimum width area established for marginal or a degraded condition vegetated corridor, as defined in Section 18.775.090.B.3. The proposed sewer improvements are located within a vegetated corridor. The provisions of Section 18.775.090.B will be met as if the corridor is in good condition. 18.790—Tree Removal 18.790.050 Permit Applicability A. Removal permit required. Tree removal permits shall be required only for the removal of any tree which is located on or in a sensitive land area as defined by Chapter 18.775. The permit for removal of a tree shall be processed as a Type I procedure, as governed by Section 18.390.030, using the following approval criteria: 1. Removal of the tree must not have a measurable negative impact on erosion, soil stability, flow of surface waters or water quality as evidenced by an erosion control plan which precludes: a. Deposits of mud, dirt, sediment or similar material exceeding '/a cubic foot in volume on public or private streets,adjacent property, or into the storm and surface water system,either by direct deposit,dropping, discharge or as a result of the action of erosion; b. Evidence of concentrated flows of water over bare soils; turbid or sediment-laden water flows;or evidence of on-site erosion such as rivulets on bare soil slopes where the flow of water is not filtered or captured on site using the techniques of Chapter 5 of the Washington County Unified Sewerage Agency Environmental Protection and Erosion Control rules. No trees will be removed within the sensitive land area. This criterion is not applicable. 2. Within stream or wetland corridors, as defined as 50 feet from the boundary of the stream or wetland,tree removal must maintain no less than a 75% canopy cover or no less than the existing canopy cover if the existing canopy cover is less than 75%. Page 111 B. Effective date of permit. A tree removal permit shall be effective for one and one-half years from the date of approval. No trees will be removed. A tree removal permit will not be required. C. Extension. Upon written request by the applicant prior to the expiration of the existing permit,a tree removal permit shall be extended for a period of up to one year if the Director finds that the applicant is in compliance with all prior conditions of permit approval and that no material facts stated in the original application have changed. No trees will be removed. A tree removal permit will not be required. D. Removal permit not required. A tree removal permit shall not be required for the removal of a tree which: 1. Obstructs visual clearance as defined in Chapter 18.795 of the title; 2. Is a hazardous tree; 3. Is a nuisance affecting public safety as defined in Chapter 7.40 of the Municipal Code; 4. Is used for Christmas tree protection, or land registered with the Washington County Assessor's office as tax-deferred tree farm or small woodlands, but does not stand on sensitive lands. No trees will be removed. This criterion is not applicable. E. Prohibition of commercial forestry. Commercial forestry as defined by Section 18.790.020 A.2., excluding D.4. above, is not permitted. No trees will be removed. This criterion is not applicable. 18.810 —Street and Utility Improvement Standards 18.810.110 Bikeways and Pedestrian Pathways C. Minimum width. 3. Minimum width multi-use paths separated from the road is ten (10) feet. The width may be reduced to eight (8) feet if there are environmental or other constraints. The existing multi-use pathway is 9-10 feet in width. It will be replaced to existing or better condition upon the completion of the proposed sewer improvements and will match its current width. 4. Design standards for bike and pedestrian-ways shall be determined by the City Engineer. (Ord. 09-09 (Exh. B); Ord. 02-33; Ord. 99-22) The multi-use pathway is a pre-existing pathway. Design standards will be followed with respect to replacing the pathway upon completion of the proposed sewer improvements. Page 1 12 The following Project Narrative describes compliance with applicable sections of the Tigard Municipal Code (TMC), Section 9.06 Trees on City Property. 9.06.050 Tree Protection (1) Care of Trees on City Property. The City shall follow the Tree Manual in caring for and protecting trees on City property. (2) These requirements shall provide for the proper protection of tree roots, trunk(s) (or stems(s)), branches, and foliage within a tree's critical root zone for any tree on City property during any type of construction activity or project (excavation, demolition or any other type of disturbance); CITY OF TIGARD, OREGON RESOLUTION NO. 02-69 A RESOLUTION ADOPTING THE TIGARD TREE MANUAL 070 Tree Protection The tree protection provisions in this section apply to the protection of trees on City property. 1. Tree Protection Methods a. The protection of an individual tree's critical root zone shall be determined by the method listed below unless otherwise approved by the Public Works director or designee: The proposed sewer improvements within the park will be restricted to the sewer trench within the existing asphalt pathway. b. All tree protection devices shall be located on the Tree Protection Plan. Details and specifications are required as to how the trees will be protected on site; The proposed sewer improvements within the park will be restricted to the sewer trench within the existing asphalt pathway. No tree protection fencing is proposed because the trees will not be impacted. c. Tree protection devices shall be installed to protect the root zones of trees located on adjoining properties if any type of construction activity will be disturbing the critical root zone unless otherwise approved by the Public Works Director or designee; The proposed sewer improvements within the park will be restricted to the sewer trench within the existing asphalt pathway. Trees on adjoining properties will not be affected by the improvements on park property. d. A construction sequence shall be provided and shall include: (1) Installation and removal of tree protection devices; (2) Clearing, grading, or installation of sediment and erosion control measures; Page I13 (3) Other activities that may be required to implement the tree protection measures; Tree protection measures are not proposed for this project because the trees will not be impacted by the proposed improvements. Sediment and erosion control measures will be shown on the construction plans. They are currently identified on Sheet SS2. e. Include in the notes on the final set of plans: "equipment,vehicles, machinery, dumping or storage, or other construction activities, burial, burning, or other disposal of construction materials shall not be located inside of any tree protection device."; f. All tree protection devices shall be: (1) Visible; (2) Well-anchored; (3) Approved in the field by the Public Works Director or designee prior to clearing, grading, or the beginning of construction; (4) Remain in place and maintained until the project has shown compliance with development requirements from the City's Planning Department. g. The location of the stockpile and staging areas for construction shall be identified on the Tree Protection Plan; The location of the stockpile and staging areas for construction will be shown on the construction plans. They are currently identified on Sheets SS1 and SS2. h. All tree protection guidelines shall be included in the final Tree Protection Plan's notes or drawings; i. Guidelines for replacement. Replacement of a tree shall take place according to the following guidelines: (1) A replacement tree shall be an approved species taking into consideration site characteristics; (2) If a replacement tree of the size cut is not reasonably available on the local market or would not be viable, the Public Works Director or designee shall require replacement with more than one tree in accordance with the following formula: The number of replacement trees required shall be determined by dividing the caliper inches of the tree removed or damaged by the caliper size of the replacement tree(s) (no less than 1 inch and no more than 1.75 inches). The caliper inches shall be measured at six inches above the ground, on the uphill side if there is a slope. If the diameter is larger than four (4) inches in diameter at six inches above the ground then the measurement shall be taken at DBH. If this number of trees cannot be viably located on the subject property, the Public Works Director or designee may require one or more replacement trees to be planted on other property within the City, either on City property or,with the consent of the owner, on private property; Page 114 (3) The planting of a replacement tree shall take place according to guidelines set forth by the International Society of Arboriculture. The proposed sewer improvements will be restricted to the sewer trench in the existing asphalt pathway. No trees will be removed with the improvements. Replacement trees will not be necessary. 090 Replacement Trees 2. Tree plan required. A tree plan for the removal, planting, and protection of trees six inches at DBH or greater prepared by an International Society of Arboriculture Certified Arborist shall be provided for any development on City property. Widening of existing public streets will be exempted from tree mitigation requirements. Construction of new streets and extension of existing streets as shown in the Transportation System Plan maps are likewise exempted from the tree mitigation requirements. Protection is preferred over removal. The proposed sewer improvements will be restricted to the sewer trench in the existing asphalt pathway. Trees will not be impacted by the sewer improvements. As a result, a certified arborist is not necessary to prepare a tree protection plan.
