BACKGROUND INFORMATION Site and Vicinity Information The project is located at 6700 SW Oak Street and 10240 SW 69`h Avenue;north of SW Oak Street,east of SW 69th Avenue,and west of SW 66th Avenue.The 8.88-acre development site is made up of Tax Lot 201 (6.62 acres),which was formerly occupied by the National Guard Armory, and Tax Lot 301 (2.26 acres), which contains a detached, single-family dwelling. In 2014, the applicant was approved for a 38-lot subdivision (detached,single-family dwellings) under the Oak Street Estates Subdivision (SUB2014-00001). A public street is proposed to serve the development from SW Oak Street,which connects to SW 69th Avenue to the west of the site. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under the Oak Street Estates Subdivision (SUB2014-00001). This modification request is to remove one 35-inch Oregon White Oak (Quercus garryana) located on Lot 9 that was originally planned for preservation. This tree removal will help accommodate the construction of a new storm drainage pipe. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.790 Urban Forestry Plan: 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect(the project landscape architect) or a person that is both a certified arborist and tree risk assessor(the project arborist),except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; A revised Urban Forestry Plan that was coordinated and approved by a certified arborist and tree risk assessor(the project arborist) has been submitted.This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual (UFM); A revised tree preservation and removal site plan (Sheet 6) that meets the standards set forth in the Urban Forestry Manual has been submitted.This standard is met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual;and A revised tree canopy site plan (Sheet 15) that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition, the project arborist has included a signature of approval and statement attesting that the revised tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual.This standard is met. 4. Meet the supplemental report standards in the Urban Forestry Manual. A revised supplemental report wasrepared and submitted by the project arborist, Brandt D. Thissell of AKS Engineering & Forestry, LLC This report indudes the required inventory data for existing open grown trees, as outlined in Section 10, Part 3, Subsection D of the Urban Forestry Manual. The site is zoned R-4.5;accordingly, the minimum required effective tree canopy for the entire site is 40 percent,and 15 percent per lot (Section 10, Part 3, Subsection M of the Urban Forestry Manual). Through the supplemental report, the project arborist demonstrates how the effective tree canopy for the entire site exceeds 40 percent,and meets 15 percent per lot This standard is met. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be UFR2015-00003 Oak Street Estates Subdivision Urban Forestry Plan edification 2 processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan Component of the approved Oak Street Estates Subdivision (SUB2014-00001) does not meet any of the exemptions listed under subsection B; therefore, this modification shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist provided a report and statement (Written Narrative, dated June 8, 2015) certifying that the previously approved Urban Forestry Plan did not account for the circumstances that lead to the proposed modification. The applicant proposes to remove a 35-inch Oregon White Oak located on Lot 9 (Tree No. 31142) that was originally planned for preservation. On June 23, 2015, the project engineer submitted an addendum stating the project team encountered rocky soils during trench excavation, thereby requiring the storm line to be wider and deeper than originally anticipated. The applicant concludes that this tree removal is necessary to accommodate the revised storm drainage pipe. In addition to the applicant's submitted materials, a city-contracted arborist conducted a site visit and provided an assessment of Tree No. 31142. The city-contracted arborist's memorandum verifies that the change in design for the storm drainage pipe will cause severe impacts to the tree's health and stability,thereby necessitating its removal.This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist provided a revised report and statement (dated June 8,2015) certifying that there is no practicable alternative to the proposed modification. In addition, the city-contracted arborist's memorandum confirms that there is no practicable alternative to the tree's removal, due to the site's existing conditions, and the circumstances surrounding the storm drainage pipe's new design. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist submitted a revised Urban Forestry Plan and supplemental report that demonstrate compliance with Section 18.790.030,including tree preservation,protection and canopy standards. This criterion is met. FINDING: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Oak Street Estates Subdivision (SUB2014- 00001) meets all applicable approval criteria,and can be approved. AKS Engineering has requested a Type I Modification to the Urban Forestry Plan Component of the Oak Street Estatea Subdivision to remove tree 31142, a 35-inch DBH Oregon white oak (Quercus garrayana).The reason for the requested modification is unanticipated changes to the stormline excavation due to the presence of rocky soils. Below are my finding for the Type I Modification approval criteria: 1.The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist provided a report dated June 8, 2015 which did not clearly explain what conditions have changed that lead to the modification. The project engineer subsequently produced an addendum to the report dated June 23, 2015 stating that due to the presence of rocky soils, excavation for the stormline is required to be wider and deeper than typically required. Based on my field visit with City inspector, Mike White, the excavation will be within four feet of the face of trunk of tree 31142. Typical minimum setback requirements for trees range from six times the tree diameter to three times the tree diameter. This would equate to 17.5 feet to 8.75 feet for the subject tree. The setback for the excavation would be less than four feet from the tree, which would cause severe impacts to the tree's health and stability. 2.The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist indicated in his June 8, 2015 report that relocating the storm line to retain the tree is not a practicable alternative. I discussed with the City the alternative of relocating the stormline underneath the staircase or pathway to retain the tree. This option would require an additional manhole, which the City's Public Works staff has determined is not a practicable alternative due to maintenance difficulties on the steep slope. Therefore, it does not appear that there are any practicable alternatives to relocating the stormline to avoid impacting the tree. 3.The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The June 8, 2015 report includes a revised urban forestry plan that demonstrates compliance with Section 18.790.030. Do not hesitate to contact me with any questions or concerns. General provisions. Except as exempted in subsection B of this section, a modification to the urban forestry plan component of an approved land use permit shall be processed as a Type I land use decision as described below. C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. Response: The applicant is proposing to remove tree#31142, which was originally proposed for preservation in the project's approved urban forestry plan. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; Response: The design of the public storm drainage pipe adjacent to tree#31142 was modified during the final engineering and construction permitting phases of the project. The modified storm pipe design will result in significant impacts to the root zone of the tree,necessitating its removal. The approved urban forestry plan prepared and approved during the planning phase of the project did not account for the modified storm pipe design. The standards of this section have been met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification;and Response: The proposed storm pipe is located adjacent to a proposed concrete walkway and staircase. Relocating the storm pipe a sufficient distance to the west to preserve tree#31142 is not a practicable alternative as the storm pipe would conflict with the walkway and staircase. Additionally,these features(storm pipe,walkway,and staircase)pass through a tree grove. Modifying the locations of these features to preserve tree#31142 would necessitate the removal of several other trees,which is not a practicable alternative. No changes shall be made to any aspect of the approved urban forestry plan without written consent from the project arborist and city arborist. B. Timeline for clearing,grading,and installation of tree protection measures:Tree protection fence shall be installed prior to any ground disturbance work. C. Placing materials near trees: No person may conduct any activity within the protected area of any tree designated to remain,including,but not limited to,parking equipment,placing solvents,storing building material and soil deposits,dumping concrete washout and locating burn holes. D. Attachments to trees during construction: No person shall attach any object to any tree designated for preservation. E. Protective barrier. Prior to any ground disturbance by the contractor: 1. Shall erect and maintain readily visible tree protection fencing along the outer edge and completely surrounding the protected area of all protected trees or groups of trees as shown. Fences shall be constructed of 5 foot tall metal,secured to eight foot tall metal posts.Posts shall not be placed further than 8 feet o.c. Apart. 2. May be required to cover with mulch to a depth of at least six (6) inches,or with plywood or similar material,over the root zone of a tree in order to protect roots from damage caused by heavy equipment. 3. Shall prohibit excavation or compacting of earth or other potentially damaging activities within the tree protection zone. 4. May be required to minimize root damage by excavation of a two (2) feet deep trench,at the edge of the tree protection zone, to cleanly sever the roots of trees to be retained. 5. May be required to have corrective pruning performed on preserved trees in order to avoid damage from machinery or building activity. May be required to maintain trees throughout construction period by watering and fertilizing. 6. Shall maintain the tree protection fencing in place until the project arborist and city arborist authorizes their removal. 7. Shall ensure that any landscaping done in the tree protection zone subsequent to the removal of the barriers shall be accomplished with light machinery or hand labor. Use plant materials with compatible water requirements to tree to be preserved and direct spray irrigation away from trunks. F. G. If the grade adjacent to a preserved tree is raised such that it could slough or erode into the tree protection zone,it shall be permanently stabilized to prevent suffocation of the roots. H. An impervious surface shall not be installed within the tree protection zone of any tree to be preserved without the authorization of the project arborist. The project arborist may require specific construction methods and/or use of aeration devices to ensure the tree's survival and to minimize the potential for root induced damage to the impervious surface. I. To the greatest extent practical,utility trenches shall be located outside of the tree protection zone of trees to be preserved. The project arborist may require that utilities be tunneled under the roots of trees to be preserved if the project arborist determines that trenching would significantly reduce the chances of the trees survival. J. Directional felling of trees shall be used to avoid damage to trees designated for preservation. K. The project arborist may require additional tree preservation measures which are consistent with tree care industry standards. Root protection zone notes: Encroachment into the root protection zone may be allowed with project arborist approval as described in the following notes: 1. Excavation in the top 24" of the soil in the critical root zone area should begin at the excavation line that is closest to the tree. 2. The excavation should be done by hand/shovel or with a backhoe and a man with a shovel, pruning shears,and a pruning saw. 3. If done by hand,all roots 1" or larger should by pruned at the excavation line. 4. If done with a backhoe (most likely scenario),then the operator shall start the cut at the excavation line and carefully"feel" for roots/resistance.When there is resistance, the man with the shovel hand digs around the roots and prunes the roots larger than 1" diameter. Stand Preservation Specifications: No existing stand trees. Not applicable to this project. Soil Characteristics and Specifications for Improvement: Areas of Tree Growth Limiting Soils: There are no known areas of tree growth limiting soils identified. If soil compaction occurs,backhoe turning should be used to loosen soil. Remove any layers of good topsoil. Spread 3"-4" of organics (high-lignin) compost or ESCS (Expanded shale/Calcine Clay) amendment over the area prior to turning the soil. After turning,re-spread topsoil and add 3"-5" of yard waste organic amendment over the surface and lightly till to break the soil into texture suitable to fine grade. Removal.Storing.and Amended Soils for Planter Areas: Contractor shall removal all debris from planter areas and excavate to a depth of 36 inches. Slope sides of excavations at 1:1 slope or shore edges to prevent undermining of vehicle load areas and to provide a sloped profile transition between soil types and structural fill. Dispose of debris and subsoil. Stockpile excavated topsoil in approved area off site. Existing and imported topsoil amendments shall be determined by the Landscape Architect and approved by the City Arborist. Soil mixing shall be done in designated areas or in the supplier's yard. Mix amendments with topsoil when soil is in a friable condition only(damp and not muddy with adequate moisture to break into clods when turned and will not leave a mud stain on the hand when squeezed). Contractor to provide certificate of content and percent of soil mixes with all amended soil to the City prior to installation. Blended Soil Placement and Compaction: Soil shall be friable when placed and compacted. Place soil in layers of not more than 12" in depth. Provide 3 passes with a 2"compact plate vibrating compactor. Compact to 80- 85%maximum dry density as measured by the proctor test or as approved for specific blended soil mixes. Tree Planting Specifications: Tree plantings shall conform to the City of Tigard design standards and to American Nursery Standards ASN 1260.1.
