APPLICATION SUMMARY FILE NAME: Polygon at Bull Mountain—Urban Forestry Modification CASE NO.: Urban Forestry Review(UFR) UFR2015-00005 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under the Polygon at Bull Mountain Subdivision (SUB2014-00002). This modification request is to remove one 11 inch Red Alder and one 7-inch Sweet Cherry,which were originally planned for preservation. Removal is needed for construction of a retaining wall and grading within Tract H of the subdivision. APPLICANT: Polygon WLB,LLC OWNER: same 109 E 13th St. Vancouver,WA 98660 LOCATION: 15225 SW 150th Avenue; WCTM 2S10800, Tax lots 1500, 1501, 1504, 1505, and 1506 COMP. PLAN AND ZONING DESIGNATION: R-4.5: Low-Density Residential District. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Chapter 18.790 SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. U1122015-00005 Polygon at Bull Mountain Urban Forestry Plan Modification 1 SECTION III. BACKGROUND INFORMATION Site and Vicinity Information Located within the River Terrace Plan District, the 29.97 acre subdivision site is comprised of five parcels that front SW 150`'' Avenue. The existing single-family home and outbuildings have been removed to begin construction of the subdivision improvements. There are four wetland and two drainageways on the site, which slopes gently to the southwest. Some portions of the site had been used for agricultural purposes,as have many other sites within the River Terrace area. The site is zoned R-4.5 as are sites to the west. Properties to the south are zoned R-7 and those to the north and east are within unincorporataed Washington County. Development in the area is single-family homes on large lots or within subdivisions. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under the Polygon at Bull Mountain Subdivision (SUB2015-00005).This modification request is to remove one 11 inch Red Alder (#13155) and one 7-inch Sweet Cherry (#13161). Both trees are located within Tract H. Removal is needed for construction of a retaining wall and grading for lot 45. Protection is not feasible. These activities are not exempt from the Type I modification review outlined in the Tigard Community Development Code section 18.790.090 (Modification to the Urban Forestry Plan Component of an Approved Land Use Permit). Other proposed modifications to the plan are exempt from review, but are noted in order to have a comprehensive account of the revisions. Tree 13161 was identified in the original Urban Forestry Supplemental Report (February 6, 2015) as a Red Alder with a condition and preservation rating of 2 but is actually an invasive, Sweet Cherry that cannot be counted in the effective canopy coverage. A 9- inch Douglas Fir (#12548) with a condition and preservation rating of 3 was previously omitted and has been included in the effective tree canopy calculations. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS 18.790 Urban Forestry Plan: 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements.An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor(the project arborist),except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; A revised Urban Forestry Plan that was coordinated and approved by a certified landscape architect and certified arborist/tree risk assessor (the project arborist) has been submitted.This standard is met. 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual (UFM); A revised tree preservation and removal site plan that meets the standards set forth in the Urban Forestry Manual has been submitted.This standard is met. 3. Meet the tree canopy site plan standards in the Urban Forestry Manual;and A revised tree canopy site plan that meets the standards set forth in the Urban Forestry Manual has been submitted. In addition, the project landscape architect has included a signature of approval and statement attesting that the revised tree canopy site plan meets all of the requirements in Section 10, Part 2 of the Urban Forestry Manual.This standard is met. 4. Meet the supplemental report standards in the Urban Forestry Manual. The site is zoned R-4.5; accordingly, the minimum required effective tree canopy for the entire site is 40 percent, and 15 percent per lot (Section 10, Part 3, Subsection M of the Urban Forestry Manual). The UFR2015-00005 Polygon at Bull Mountain Urban Forestry Plan Modification 2 revised supplemental report (September 15, 2015) showed a site effective canopy of 60% and 152% for Tract H. This standard is met. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. Some of the proposed modifications to the Urban Forestry Plan Component of the approved Polygon at Bull Mountain Subdivision (SUB2015-00002) do not meet the exemptions listed under subsection B; therefore, this modification shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; The project arborist provided a report and statement certifying that the previously approved Urban Forestry Plan did not account for the circumstances that led to the proposed modification. The original plan assumed that adequate protection would be possible for the small trees. However, after the site was staked and prepared for construction, the project arborist determined that the two trees could not be retained. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist states that the previous plans did not account for the necessary amount of disturbance within close proximity to the two trees and there is no practicable alternative to the proposed modification. Removal is necessary for construction based on site inspection of proposed construction.This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist submitted revised effective tree canopy cover data and tree removal plan to demonstrate compliance with Section 18.790.030. This criterion is met. FINDING: As demonstrated in the analysis above, the proposed modification to the Urban Forestry Plan Component of the approved Polygon at Bull Mountain (SUB2015-00002) meets all applicable approval criteria,and can be approved. The Urban Forestry Plan was modified on September 15, 2015 to remove trees 13155 and 13161 for the purposes of construction.The original plan assumed that adequate protection would be possible for these small trees. However, now that the site is staked and prepared for construction, it is obvious that tree 13155 must be removed for retaining wall construction and tree 13161 must be removed for grading for building lot 45.Adequate protection is not possible for these two trees and removal is recommended. These trees are both located in proposed Tract H.Tree 13155 is an 11-inch diameter red alder(Alnus rubra) that is mostly dead and with trunk decay.Tree 13155 has condition and preservation ratings less than 2 and therefore does not provide any credit towards the effective canopy cover requirements. Tree 13161 is a 7-inch diameter invasive sweet cherry(Prunus avium) located directly adjacent to building lot 45 (note that this tree was previously identified as a red alder, but is definitely a sweet cherry).Tree 13161 received condition and preservation ratings of 2;this tree has an 8-foot crown radius which equates to 201 square feet of canopy cover. Existing trees planned for preservation provide double credit towards the effective canopy cover requirements.Therefore,this tree accounted for 402 square feet of effective tree canopy cover credit for Tract H in the original February 6, 2015 Urban Forestry Plan. The February 6, 2015 Urban Forestry Plan mistakenly omitted canopy cover credit for preserved tree 12548,a 9-inch diameter Douglas-fir with condition and preservation ratings of 3;this tree has a 10-foot crown radius which equates to 314 square feet of canopy cover.Since it is eligible for double credit, the February 6, 2015 report was mistakenly short 628 square feet of effective canopy cover in Tract H. The effective tree canopy cover summary was modified in the September 15,2015 Urban Forestry Plan to account for the removal of tree 13161 and incorporate the credit that should have been provided originally for tree 12548. Below is a summary of the Tract H Effective Tree Canopy Cover modifications. Lankford (#369) of Pacific Community Design. Revisions were made on August 12, 2015 based on modifications to the planted tree inventory and street tree soil volume calculations. Revisions were made on September 15, 2015 based on modifications to remove trees 13155 and 13161 for the purposes of construction, as well as modifications and corrections to the effective tree canopy cover summary. General Description The existing site includes one single family residential home, a barn and shed, but is primarily open field with trees scattered across the site in groups and individually. The project proposes an 82-lot subdivision, streets, and open space tracts. Existing individual trees measuring six inches and larger located on-site and within 25-feet of the development impact area were evaluated during a site visit conducted by Morgan Holen on January 22, 2015. In all, 461 trees were inventoried, including 388 (84%)trees located on-site and 73 (16%)trees located off-site. The off-site trees include more than this number as some were evaluated in groups as describe in the tree inventory and illustrated on site plans. Twenty-seven different tree species were identified, with Douglas-fir(Pseudotsuga menziesii) and bigleaf maple (Acer macrophyllum) being most prominent, accounting for 156(34%) and 114 (25%)of the inventoried trees each, respectively. Other trees included various pine species, non-native and invasive species, fruit trees,willows and alders in moister portions of the site, and English walnuts (luglans regia), amongst others. The northwest quadrant of the site is relatively natural and heavily treed. However, this area has been overgrown with non-native and invasive Himalayan blackberry (Rubus discolor) and English ivy(Hedera helix). The invasive vegetation was cleared for access and the trees were reasonably accessible for evaluation. Overall,the stand is in moderate condition as an intact group, but individual trees are mostly in poor condition, with poor structure, small live crowns, dead and broken branches, and decay. Opportunities for recommendations to preserve existing trees were limited by individual tree condition and suitability for preservation with adjacent tree removal for construction purposes. Urban Forest Plan—Supplemental Report Polygon at Bull Mountain,Southeast River Terrace,Tigard, Oregon Page 2 The best existing trees include two Douglas-firs located in proposed tract B, which measured 45- and 46- inches each in diameter,with no major defects observed.These trees are suitable for preservation with development. One 50-inch diameter English walnut and one 30-inch diameter black walnut (Juglans nigra) also received high condition and preservation ratings; however, adequate protection during construction is not possible because these trees are located within the proposed building footprint of lot 23 and within the limits of grading for the street and sidewalk adjacent to lots 2 and 3. Tree protection measures are recommended to avoid root zone impacts during construction for all 73 neighboring trees and for 10 on-site trees recommended for retention in tracts B and H. The remaining 378 trees are recommended for removal either because of invasive species, poor condition, hazard potential, or for the purposes of development, including new streets,grading, and home building. A complete description of individual trees located on and adjacent to the project site, as prepared by Morgan Holen &Associate, LLC is included in the enclosed existing tree inventory data (attachment A). Effective Tree Canopy Cover Seven of the 10 on-site trees recommended for retention are eligible for two times canopy cover credit; three trees are not eligible for canopy cover credit because they received a condition and/or preservation rating less than two points. In addition, 304 new trees are proposed to be planted.The planted tree inventory and street tree soil volume calculations, as prepared by Pacific Community Design, are enclosed as Attachment B. Attachment C provides a summary of the effective tree canopy cover, as prepared by Pacific Community Design in coordination with Morgan Holen & Associates, LLC. In the R-4.5 zoning district, effective tree canopy cover is required to be calculated on a lot/tract by lot/tract basis and for the overall development site. A standard percentage of effective tree canopy cover for each lot or tract shall be at least 15%, with a minimum standard of 40%for the overall development site. The site includes 82 building lots and nine tracts,totaling 991,486 square feet. Each lot and tract meets or exceeds the 15% required effective canopy cover. The overall effective tree canopy cover is 592,277 square feet, or 60%;therefore,the effective tree canopy cover requirement for the overall development site is also met. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual, which illustrate how the Urban Forestry Plan requirements are met. Please refer to the existing conditions,grading, and utilities site plans for complete information. Specifications A. Tree Protection Specifications 1. Tree Protection Zone.The project arborist shall designate the Tree Protection Zone (TPZ). Where feasible,the TPZ shall be established at the dripline of protected trees as a minimum. If infrastructure must be installed closer to the trees, the TPZ may be established within the dripline area if the project arborist determines that the trees will not be unduly damaged. Protection Fencing.All trees to be retained shall be protected by 5-foot tall 2-inch mesh chain link fencing secured to 1Y2-inch diameter steel or aluminum posts placed no further than 8-feet on center and shall be installed at the edge of the TPZ. 3. Preconstruction Conference.The project arborist shall be on site to discuss methods of tree removal and tree protection prior to any construction. 4. Pruning. The project arborist can help identify if and where pruning is necessary once trees recommended for removal have been removed and the site is staked and prepared for construction. Pruning shall be performed by a Qualified Tree Service. 5. Tree Protection Zone Maintenance.The protection fencing shall not be moved, removed, or entered by equipment except under direction of the project arborist. 6. Storage of Material or Equipment. The contractor shall not store materials or equipment within the TPZ. 7. Excavation. Excavation within the TPZ shall be avoided if alternatives are available. If excavation within the TPZ in unavoidable, the project arborist shall evaluate the proposed excavation to determine methods to minimize impacts to trees. All construction within the TPZ shall be under the on-site technical supervision of the project arborist. 8. Tree Protection Inspection.The project arborist shall inspect and verify the location of protection measures prior to construction, monitor tree protection measures regularly, and provide biweekly written reports to the City during periods of active construction. 9. Final Report.After the project has been completed, the project arborist shall provide a final report that describes the measures needed to maintain and protect the remaining trees. B. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of relatively deep and moderately well drained Cornelius and Kinton silt foams (^'60%), relatively shallow and somewhat poorly drained Cascade silt loam (-26%), and deep and moderately well drained Helvetia silt loam (-14%). Soil improvements are proposed as described in the plant specifications provided as Attachment F, as prepared by Pacific Community Design. If soil compaction occurs during construction,the project arborist shall provide additional recommendations as needed. C. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual. They shall be planted in accordance with the American National Standards Institute (ANSI) standards for tree planting(A300, Part 6) and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock(ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability.
