BACKGROUND INFORMATION Site Information: The project is located at 13058 SW Black Walnut Street. The subject property is Lot 159 of the Sumnut Ridge No. 5 Subdivision (SUB2015-00007), which was approved by the City of Tigard Planning Division in July 2015. The site is zoned Medium-Density Residential (R-7), as are surrounding properties to the north and east; properties to the south and west are under the jurisdiction of Washington County. Proposal Description: The applicant requests a Temporary Use Permit to construct a detached, single-family dwelling for use as a model home on Lot 159 (13058 SW Black Walnut Street; «QCT M 2S109DB, 1 ax Lot 1800) of the approved Summit Ridge No. 5 Subdivision (SUB2015-00007). In addition, the applicant proposes to utilize the dwelling's attached garage (approximately 400 square feet in size) as a temporary- sales office. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS CHAPTER 18.785 TEMPORARY USES: 18.785.040 Approval Criteria C. Temporary sales office or model home. By means of a Type I procedure, as governed by Section 18.390.030, the Director may approve, approve with conditions or deny the use of any real property within the City as a temporary sales office, offices for the purpose of facilitating the sale of real property, or model home in any subdivision or tract of land within this City, but for no other purpose,provided the following criteria are satisfied: 1. Temporary sales office. a. The temporary sales office shall be located within the boundaries of the subdivision or tract of land in which the real property is to be sold; and The proposed temporary sales office is located NNnthin the boundaries of the Summit Ridge No. 5 Subdivision (SUB2015-00007) on Lot 159, located at 13058 SW Black Walnut Street. The real property to be sold includes the subject lot. This criterion is met. b. The property to be used for a temporary sales office shall not be permanently improved for that purpose. The applicant proposes to utilize an approximately 400-square-foot garage as a temporary sales office. Once the temporary sales use expires, the space be utilized as a permanent garage for the attached single-family dwelling. This criterion is met. 2. Model house. a. The model house shall be located within the boundaries of the subdivision or tract of land where the real property to be sold is situated; and The proposed model house is located within the boundaries of the Summit Ridge No. 5 Subdivision (SUB2015-00007) on Lot 159, located at 13058 SW Black Walnut Street.
