PUBLIC HEARING Vice President Fitzgerald opened the public hearing. ANNAND HILL PLANNED DEVELOPMENT —PDR2015-00008, SUB2015-00013, SLR 2015-00008, ADJ 2015-00002 REQUEST: Planned Development Concept Plan and Detailed Development Plan approval are requested for a 30-lot single family residential planned development/subdivision on 4.53 acres with a public street connection, utilities, and a 0.9-acre city park. Sensitive lands review is requested for steep slopes and a special street adjustment is requested for a cul-de-sac in excess of 200 feet serving more than 20 lots. APPLICANT: Windwood Construction, Inc. November 2, 2015 Page 1 of 4 QUASI-JUDICIAL HEARING STATEMENTS Vice President Fitzgerald read the required statements and procedural items from the quasi-judicial hearing guide. There were no abstentions; there were no challenges of the commissioners for bias or conflict of interest. Ex-parte contacts: None. Site visitations: Commissioners Feeney,Lieuallen & Schmidt. No one wished to challenge the jurisdiction of the commission. STAFF REPORT Associate Planner, Gary Pagenstecher went over the staff report (staff report is on-line one week before each hearing.) To date, no written or verbal comments on the application had been received. STAFF RECOMMENDATION Staff recommends that Planning Commission find that the proposed Planned Development Concept Plan, Detailed Plan, Subdivision, Sensitive Lands Review, and Adjustments will not adversely affect the health, safety and welfare of the City and meet the Approval Standards as outlined in Section VI of the staff report. Therefore, Staff recommends APPROVAL, subject to the Conditions of Approval. QUESTIONS There was a question on Condition 14 (page 5) wanting a clarification about who would be signing the plan - the geo-tech? Gary deferred to the applicant to address the question during his presentation. There is an existing driveway to the west side that enters Pacific Hwy - 75% of it is in the ODOT Right-of-Way. Yes —it will be left open but only for pedestrian access. Who will maintain that on the ODOT ROW? The Homeowner's Association likely would because usually they're responsible for frontage, sidewalk, planter strip, etc. All the way down to the highway?Yes. APPLICANT'S PRESENTATION Matt Sprague, Pioneer Design Group representing the applicant—gave his presentation. He noted this is a planned development and that he was the land use planner back in 2006 when this was approved as a 42 lot planned development; it's a 30 lot planned development now. He said there will be fewer units and of high quality. He said they'd met with the Tigard Parks Department, brought them a plan and gave them some options for locations if they were interested in having land for a park. They were very amenable to it and are happy to have it so we put the park along 109th Ave where it's most accessible to all of the neighbors within the area. There's a lot of multi- family development in the area so this would be an added amenity that many people would be able to enjoy and this is the location the Parks Dept. wanted it to be. He addressed Condition 14— "It's not all that uncommon for the civil engineer to prepare the plans, and stamp the grading plans. Obviously before anything is stamped they send that plan to the geotechnical engineer (geotech) —he reviews it—if he has any changes that are needed, he makes those changes, redlines them, and sends them back to us. We modify them so that, although the plans are created by the civil engineering firm, the geotech has reviewed it, and any changes he wants are made on that plan -which allows him to be able to sign that plan. The only clarification I'd want to make tonight is that the geotech isn't going to sign all the plans in the plans set—which it appears to indicate;but he'll only be responsible for those that relate to his specific knowledge which would be the grading and erosion control—which are within his area of expertise. November 2, 2015 Page 2 of 4 QUESTIONS How many on-street parking spaces are there? Twenty eight. Each house will have a 2 car garage and 2 parking spaces. Will there be walk through traffic?Yes. The site is located right at the top of the hill. There will be a lot of opportunity for people to zoom straight on down there — take their bike right down to the highway and the bus stop—or walk down. TESTIMONY IN FAVOR—None. TESTIMONY IN OPPOSITION Teresa Velasco —14862 SW 109th Ave., Secretary of the Calvary Hill HOA said she spoke on behalf of the HOA President who was out of town, as well. Their main concern is the parking and traffic. They find it hard to believe a traffic study hasn't been done— especially at peak hours. As it is now, she notes that people are parking up and down 109th Avenue —there's not enough room for parking and suggests that what's going to happen when this development goes in—the overflow parking from the apartments and the new homes is going to end up on 106th Ave—just three blocks from this proposed development. She's also concerned about water pressure. She says there's already not enough water pressure into their upstairs units and she would like to know what the progress on that would be. Greg Berry, Development Review Engineer, spoke to the concern about water pressure. He said that one of the conditions of approval is as recommended from the Tigard Water Division that the line in 109th along the frontage of the project will be increased from a four to a twelve inch line. He said he can't predict whether that would help the pressure on higher floors in apartments but they are doing their piece of the required water improvements. APPLICANT REBUTTAL Matt Sprague, Pioneer Design Group — said "The parking is good for a project like this —at almost one additional space on-street for each unit. If they have existing problems up there, they'll probably continue to have them at the apartments. It is likely that maybe those people will then wander down into Annand Court and utilize some of those parking spaces... there's a possibility that perhaps that may help alleviate some of the 106th Avenue parking problems. No way of knowing. Regarding the water—yes,we are modifying the line in 109th to a 12 inch line. There are a lot of different factors that go into whether it will provide increased pressures or not. The City of Tigard's master plan is to ultimately replace that line entirely with a 12 inch line increasing capacity, and probably pressure in the meantime. PUBLIC HEARING — CLOSED No further testimony or questions from the audience are allowed. CONCEPT PLAN DELIBERATION No issues to note. November 2, 2015 Page 3 of 4 CONCEPT PLAN MOTION Commissioner Lieuallen made the following motion: "I recommend the Planning Commission find that the proposed Planned Development Concept Plan PDR2015-00008 will not adversely affect the health, safety and welfare to the City and meets the Approval Standards as outlined in Section Six of this report; therefore, Planning Commission recommends APPROVAL, subject to the Conditions of Approval." Commissioner Schmidt seconded the motion and a vote was taken. ALL IN FAVOR—None opposed—No abstentions. MOTION PASSES UNANIMOUSLY DETAILED PLAN DELIBERATION No issues to note. DETAILED PLAN MOTION Commissioner Lieuallen made the following motion: "I recommend the Planning Commission find that the proposed Planned Development Detailed Plan Subdivision (SUB2015-00013), Sensitive Lands Review (SLR2015-00008), and Adjustments (ADJ2015-00002) will not adversely affect health, safety and welfare to the city and meets the approval standards as outlined in section six of this report; therefore, Planning Commission recommends APPROVAL, subject to the conditions of approval and modifying Condition 14 to replace the words "final construction plans" to "grading and erosion control plans" Commissioner Feeney seconded the motion, and a vote was taken. ALL IN FAVOR—None opposed. No abstentions. MOTION PASSES UNANIMOUSLY OTHER BUSINESS —Tom McGuire noted some possible changes to the upcoming calendar.
