APPLICATION SUMMARY FILE NAME: English Hayes Partition—Urban Forestry Plan Modification CASE NO.: Urban Forestry Review(UFR) UFR2015-00001 PROPOSAL: The applicant proposes to modify the Urban Forestry Plan approved under MLP2014-00004. The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. APPLICABLE REVIEW CRITERIA: The applicable Community Development Code Chapters for the proposed modification is 18.790. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request. The findings and conclusions on which the decision is based are noted in Section IV. UI:R2015-00001 English Mayes Urban Forestry Plan Modification 1 of 3 SECTION III. BACKGROUND INFORMATION Property History: According to County tax records, the subject property was developed with a single family dwelling in 1958. A three lot minor land partition (MLP2014-00004) was approved for the site in August 2014. The existing home on lot 2 will be retained and shadow-platted for an additional lot in the future. Site and Vicinity Information The 1.11 acre site is located north of SW Walnut Street between SW 123'd and 124th Avenues. The Brookway subdivision in 1969 shows the subject property as Lot 61. Lot 62 of Brookside, between the subject property and SW Walnut was later re-platted as Walmar Acres in 1976. The site is zoned R-4.5 (Low Density Residential), as are surrounding properties with the exception of Walmar Acres, which is zoned R-12. Proposal Description The applicant proposes to modify the Urban Forestry Plan approved under MLP2014-00004. The modification includes removing one tree planned for preservation on Lot 2 (tree 5436). This Japanese maple (acer japonicum) is in general good condition but is m the location of required franchise utility vaults. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Urban Forestry (18.790) 18.790.030 Urban Forestry Plan Requirements A. Urban forestry plan requirements. An urban forestry plan shall: 1. Be coordinated and approved by a landscape architect (the project landscape architect) or a person that is both a certified arborist and tree risk assessor (the project arborist), except for minor land partitions that can demonstrate compliance with effective tree canopy cover and soil volume requirements by planting street trees in open soil volumes only; 2. Meet the tree preservation and removal site plan standards in the Urban Forestry Manual; 3. Meet the tree canopy site plan standards in the Urban Forestry Manual; and 4. Meet the supplemental report standards in the Urban Forestry Manual. The application included a revised Urban Forestry Plan Supplemental Report (March 21, 2014) by Morgan Holen, the project arborist, a certified arborist and tree risk assessor. The revised plan meets the tree preservation and removal site plan standards, the tree canopy site plan standards, and the supplemental report standards in the Urban Forestry Manual as attested to by the project arbonst. 18.790.070 Modification to the Urban Forestry Plan Component of an Approved Land Use Permit C. Application procedures. Modifications to the urban forestry plan component of an approved land use permit that are not exempted by subsection B of this section shall be processed as a Type I procedure, using approval criteria contained in subsection D of this section. The proposed modification to the Urban Forestry Plan component of ML P2014-00004, English Hayes Partition, does not meet any of the exemptions of subsection B and therefore shall be processed as a Type I procedure using the following approval criteria: D. Approval criteria. The director shall approve the modification to the urban forestry plan component of an approved land use permit upon determining: 1. The project arborist or landscape architect has provided a report and statement certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification; UFR2015-00001 13n bsb Mayes Urban Forestry Plan Modification 2 of 3 The project arborist has provided a report and statement (Supplemental Report, dated March 21, 2015) certifying that the previously approved urban forestry plan did not account for the circumstances that lead to the proposed modification. Tree 5436 shown on Lot 2 is in generally good condition but with some dieback and included bark in the co-dominant stem juncture. The tree is located at the end of the proposed hammerhead turnaround, in the location of franchise utility vaults. The location of these vaults was not yet determined at the time of preliminary approval. This criterion is met. 2. The project arborist or landscape architect has provided a report and statement certifying that there is no practicable alternative to the proposed modification; and The project arborist has provided a revised report and statement (Supplemental Report, dated March 21, 2015) certifying that there is no practicable alternative to the proposed modification. This criterion is met. 3. The project arborist or landscape architect demonstrates through a revised urban forestry plan, compliance with Section 18.790.030. The project arborist has provided revised plans and a supplemental report showing compliance with 18.790.030, including preservation,protection and canopy standards. This criterion is met. FINDING: As shown in the analysis above, the proposed modification to the urban forestry plan component of MLP2014-00004 meets the applicable approval criteria and can be approved. SECTION V. Consulting Arbonsts and Urban Forest Management morgan holen @comcast.net Urban Forestry Plan - Supplemental Report 12600 SW 124th Avenue, Tigard, Oregon April 30, 2014 Revised: October 19, 2014 Revised: March 21, 2015 MHA1435 Purpose This Urban Forestry Plan for the three lot partition project located in an R-4.5 zoning district at 12600 SW 124th Avenue in Tigard, Oregon, is provided pursuant to the City of Tigard Urban Forestry Manual. This report describes the existing trees located on the project site, provides arborist recommendations for tree removal, retention and protection, and describes the effective tree canopy cover needed to meet City requirements.This report is based on observations made by International Society of Arboriculture (ISA)Certified Arborist and Qualified Tree Risk Assessor Morgan Nolen (PN-6145A) during a site visit conducted on April 22, 2014. General Description The existing site consists of one single-family home, a detached garage, pool and deck, with open space and trees scattered around the home and along property lines. The garage, pool and deck are planned for demolition, but the existing home will be retained on lot 2. Access to lot 2 will continue to be provided via the existing 15-foot access and utility easement along the southern boundary of lot 1, extending east from SW 124th Avenue.A new driveway is proposed west of SW 123rd Avenue to provide access to lot 3. In all, 33 existing trees measuring six inches and larger in diameter were inventoried, including 10(30%) trees located on the project site and 23 (70%)trees located on neighboring properties to the south and east. Sixteen different species were identified, including non-native and invasive English hawthorn (Crataegus monogyna), English holly(Ilex aquifolium), and Norway maple (Acer platanoides). The best existing tree feature is a 74-inch diameter redwood (Sequoia sempervirens) located in the rear of proposed lot 1,tree number 5655.The location of the future structure on lot 1 is recommended outside of the dripline of this tree. Four relatively small landscape trees are suitable for preservation at proposed lot 2. If the existing asphalt driveway for lot 2 will require reconstruction, we recommend coordinating with the project arborist to discuss measures to protect neighboring trees to the south prior to construction and to evaluate tree roots that may be exposed and document protection measures during construction. The original Urban Forestry Plan stated that five relatively small landscape trees were suitable for preservation on proposed lot 2. The Urban Forestry Plan was revised on March 21, 2015 because tree 5436, a codominant stemmed Japanese maple (Acer japonicum) in generally good condition but with some dieback and included bark in the codominant stem juncture must be removed.This tree is located at the end of the proposed hammerhead turnaround, in the location of franchise utility vaults.The previously approved urban forestry plan did not account for these circumstances and there is no practicable alternative to the proposed modification. Removal of this tree is necessary for construction. Urban Forest Plan—Supplemental Report 12600 SW 124th Avenue,Tigard,Oregon Page 2 There are no existing tree located on proposed lot 3, except in the right-of-way along SW 124th Avenue and one red maple on the neighboring property to the north. The red maple has a relatively narrow crown and adequate protection may be provided by installing protection fencing at the limits of proposed disturbance. The trees located in the right-of-way include a dense group of Douglas-firs (Pseudotsuga menziesii)and one bigleaf maple (Acer macrophyllum). These trees have grown up competing with and adapting to one another and are most suitable for retention as an intact group. However, driveway construction for proposed lot 3 necessitates removal of some of these trees which will negatively impact the remaining trees by exposing them and increasing their potential for failure. Therefore,the group as a whole is recommended for removal. One new Oregon white oak (Quercus garryana) is proposed for planting on lot 3. Note that neighboring tree 5358,a 36-inch diameter sweetgum (Liquidambar styraciflua) is in poor condition with poor structure, a history of major branch failure, dead and broken branches, and decay. This tree received a hazard risk rating of 10, with 4 points for probability of large branch or leader failure, 4 points for target potential, and 2 points for size of defective parts.Tree 5358 is recommended for removal because of high risk potential, but will require authorization from the neighboring property owner in order to remove this tree at the time of development. Of the 33 inventoried trees,five on-site trees and 11 off-site trees are recommended for removal and five on-site trees and 12 off-site trees are recommended for retention with protection during construction. A complete description of individual trees located on and adjacent to the project site is included in the enclosed existing tree inventory data (attachment A). Effective Tree Canopy Cover A summary of the effective tree canopy cover by lot and across the overall development site is included as attachment B. Attachment C,the planted tree inventory, describes five trees proposed for planting, including four in the right-of-way adjacent to lot 3 and one on lot 3. Lot 1 is 15,587 square feet and has 32%effective tree canopy cover. Lot 2 is 22,552 square feet and has 17% effective tree canopy cover. Lot 3 is 8,863 square feet and has 138% effective tree canopy cover. The minimum required effective tree canopy for lots 1, 2, and 3 is 15% each;therefore,the effective tree canopy cover requirement is met for each lot. The overall development site is 47,002 square feet and has 45% effective tree canopy cover.The minimum required effective tree canopy for the overall development site is 40%;therefore,the effective tree canopy cover requirement for the overall development site is also met. The Tree Preservation and Removal Site Plan and Tree Canopy Site Plan are enclosed as attachments D and E as required by Section 10 of the Urban Forestry Manual,which illustrate how the Urban Forestry Plan requirements are met. Tree Protection Zone.The project arborist shall designate the Tree Protection Zone (TPZ). Where feasible,the TPZ shall be established at the dripline of protected trees as a minimum. If infrastructure must be installed closer to the trees,the TPZ may be established within the dripline area if the project arborist determines that the trees will not be unduly damaged. The location of the TPZ shall be shown on construction drawings. 2. Protection Fencing.All trees to be retained shall be protected by orange plastic construction fencing or other fencing as approved by the project arborist. Protection fencing shall be secured to steel posts placed no further than 8-feet apart and shall be installed at the edge of the TPZ. 3. Preconstruction Conference.The project arborist shall be on site to discuss methods of tree removal and tree protection prior to any construction. 4. Pruning.The project arborist can help identify if and where pruning is necessary once trees recommended for removal have been removed and the site is staked and prepared for construction. Pruning shall be performed by a Qualified Tree Service. 5. Tree Protection Zone Maintenance.The protection fencing shall not be moved, removed, or entered by equipment except under direction of the project arborist. 6. Storage of Material or Equipment.The contractor shall not store materials or equipment within the TPZ. 7. Excavation. Excavation within the TPZ shall be avoided if alternatives are available. If excavation within the TPZ in unavoidable,the project arborist shall evaluate the proposed excavation to determine methods to minimize impacts to trees. All construction within the TPZ shall be under the on-site technical supervision of the project arborist. 8. Tree Protection Inspection.The project arborist shall inspect and verify the location of protection measures prior to construction, monitor tree protection measures regularly, and provide biweekly written reports to the City during periods of active construction. 9. Final Report. After the project has been completed, the project arborist shall provide a final report that describes the measures needed to maintain and protect the remaining trees. B. Soil Characteristics and Specifications for Improvement Native soils at the project site consist of Woodburn silt loam,which are deep and moderately well-drained.They are capable of supporting healthy tree growth and no improvements are proposed. If soil compaction occurs during construction,the project arborist shall provide additional recommendations as needed. Tree Planting Specifications New trees that are planted to meet the effective canopy requirements shall conform to the applicable standards in the Tigard Urban Forestry Manual. They shall be planted in accordance with the American National Standards Institute (ANSI) standards for tree planting(A300, Part 6)and additional standards adopted by the Oregon Landscape Contractors Board. Nursery stock shall meet the requirements of the American Association of Nurserymen for nursery stock(ANSI Z60.1)for Grade No.1 or better. Double stake trees if needed for stability.
