CITY OF TIGARD NOTICE OF DECISION VARIANCE (VAR) 95-0015 TIGARD CARE CENTER - INTERLAND INVESTMENTS APPLICATION: A request by Tigard Care Center for a variance approval to allow the construction of an enclosed pedestrian walkway to cross the property line between two (2) parcels, whereas, the Code requires a ten (10) foot sideyard setback in the R-12 zone (Residential, 12 units per acre) and a 20 foot setback in the C-G (General Commercial) zone where it abuts a residential zone. LOCATION: 14145 SW 105th Avenue (WCTM 2S1 10AA, tax lot 300) and 14050 SW Pacific Highway (WCTM 2S1 10AA, tax lot 900). Southwestern terminus of SW 105th Avenue, south of SW McDonald Street and east of SW Pacific Highway. ZONE: R-12 (Residential, 12 units per acre), C-G (General Commercial). SECTION I - DECISION; Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section III. CONDITIONS OF APPROVAL THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS. 1. The applicant shall provide a written authorization from the property owner of the Davis Building to allow the walkway connection and variance. The applicant shall provide in the lease agreement that the walkway shall be removed when the lease expires and the Davis building is no longer used for the physical therapy needs of the care center residents. 2. A revised site plan shall be submitted which provides screening of the new parking area from the adjacent residences. The plan shall also provide two (2) parking lot trees, located on each end of the new parking area. The landscaping shall be installed prior to restriping the parking area. As an alternative, the applicant may construct a minimum six (6) foot fence in place of the landscaping screen. NOTICE OF DECISION VAR 95-0015 TIGARD CARE CENTER PAGE 1 • • 3. Impervious surface/landscaping calculations. The minimum landscaping requirements in the R-12 zone are 20% and a minimum 15% in the C-G zone. At a minimum, the applicant shall demonstrate that there will be no net loss of landscaping with the proposed changes in the site plans. A revised site plan shall be provided which indicates the new landscaping in the parking area that will be removed. 4. Written approval from Tualatin Valley Fire and Rescue that the proposal complies with Fire Access Standards and the Uniform Fire Code. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE DATE OF THE FINAL DECISION. SECTION II. FINDINGS OF FACT Background: 14145 SW 105th Avenue has previously received a Minor Land Partition (MLP 13-77) approval and Site Development Review (SDR 36-77) approval. 14050 SW Pacific Highway has previously received Site Development Review approvals (SDR 1-75) and (SDR 43-76). No other land use or development applications have been found to have been reviewed by the City of Tigard. Vicinity Information: The subject site is located at the southwestern terminus of SW 105th Avenue , south of SW McDonald Street and east of SW Pacific Highway. The surrounding properties to the northeast, east, and south are zoned R-12 (Residential, 12 units per acre). The surrounding properties to the north and west are zoned C-G (General Commercial). The surrounding properties are generally developed with a mix of residential and commercial uses. Site Information and Proposal Description: The subject site is currently developed with the "Tigard Care Center." The applicant is requesting an Administrative Variance to allow the construction of an enclosed pedestrian walkway to cross the property line between two parcels. The Code requires a ten (10) foot sideyard setback in the R-12 zone. The code also requires a 20 foot side or rearyard setback where the C-G abuts a residential zone. The Tigard Care Center (R-12 zone) has leased the adjoining Davis building (C-G zone). The pedestrian walkway will allow the care facility residents to walk between these two (2) buildings, in order to receive physical therapy. The walkway will block off an existing 12 parking spaces on the care NOTICE OF DECISION VAR 95-0015 TIGARD CARE CENTER PAGE 2 • • facility property. This parking area will be replaced with approximately 3,400 square feet of landscaping. An existing parking area located on the eastern portion of the site will be restriped to accommodate the 12 spaces. Agency Comments: Tualatin Valley Fire and Rescue states that the proposed pedestrian walkway will cut off required emergency vehicle access. The walkway cannot be built unless access is provided from some other point. Access shall comply with the Uniform Fire Code. SECTION III. ANALYSIS AND CONCLUSION COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS; ' Community Development Code Section 18.134.050 provides standards for granting a variance as indicated in italics below: The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other_applicable policies and standards, and to other properties in the same zoning district or vicinity; The applicant is requesting a variance , to allow an enclosed pedestrian walkway to cross a property line to allow a direct connection with a building on an adjoining property. Section 18.120.180.A.2(iii) Site Development Review states that; buildings shall be located to provide adequate distance between adjoining buildings for adequate light, air circulation and fire fighting. The proposed walkway is defined as a building as described in Section 18.26.030.C. The setbacks are intended to provide a separation of uses on adjoining properties and provide light and air between structures. The requested reduction will generally not be detrimental to the purposes of this intent. The variance is limited to allowing a seven (7) foot-wide, ten (10) foot-tall enclosed pedestrian walkway. The variance will not effect the separation provided by the existing buildings. The walkway is intended to connect the two (2) uses on the two (2) properties in question. The encroachment into the setback therefore, has a negligible impact on the purpose of the setback related to providing light and air circulation. The variance will not have a detrimental impact on other adjoining properties in the area as the walkway is located within the middle of the two (2) properties, between the two (2) existing buildings. The walkway may, however, have an effect on fire fighting capabilities. Section 18.120.180.A.20ii)Site Development Review states that buildings shall be located to provide adequate distance between adjoining buildings for adequate light, air circulation and fire fighting. The applicant shall provide a written approval from Tualatin Valley Fire and Rescue demonstrating that this proposal will still allow adequate fire fighting capabilities and emergency vehicle access. NOTICE OF DECISION VAR 95-0015 TIGARD CARE CENTER' PAGE 3 • The proposed restriping of the parking area on the east side of the building will have an impact on the adjoining residential development. The restriping would orient parking such that headlights would shine directly into the adjoining residences. Section 18.100.110(A) Screening: Special Provisions requires the screening of parking and loading areas. Landscaped parking areas shall include special design features which effectively screen the parking lot areas from view. Planting materials to be installed should achieve a relative balance between low lying and vertical shrubbery and trees. Trees shall be planted in landscaped islands in all parking areas, and shall be equally distributed on the basis of one (1) tree for each seven CO parking spaces in order to provide a canopy effect. The minimum dimension on the landscape islands shall be three(3)feet and the landscaping shall be protected from vehicular damage by some form of wheel guard or curb. In order to screen the adjacent residences from the new parking area, the applicant shall submit a revised plan which provides screening of these parking spaces. This screen shall be installed prior to the restriping of the parking area. As an alternative, the applicant may construct a minimum six (6) foot fence in place of the landscaping screen. The applicant shall also provide for parking lot trees on each end the new parking area. There are special circumstances that exist which are peculiar to the lot size or shape,topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The special circumstances which exist include lack of space in the existing facility, close proximity to available office space and the need to provide shelter for residents of the care facility. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; The requested variance will in no way affect the permitted use status of the care facility or office building. All other City standards will be maintained. The applicant shall provide screening of the parking area in accordance with section 18.100.110. Further, Section 18.54.050 R-12 Dimensional Requirements states that the minimum landscape requirement shall be 20 percent. The applicant shall provide impervious surface/landscape calculations which indicate the amount of landscaping provided on site. Given the fact that this development dates back some 30.years, the site may not be able to accommodate the minimum 20 percent landscape requirement. In which case, the applicant shall demonstrate that at a minimum, there will be no net loss of landscaping with the proposed relocation of the parking area. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms, or parks will not be adversely affected any more than would occur if the development were located as specified in this title; and ... Existing physical and natural systems will not be adversely affected any more than would occur if the.variance were not requested. The subject properties are currently developed. Drainage and traffic generation will not be effected. The impact of this variance will be limited to an encroachment of a required setback. NOTICE OF DECISION VAR 95-0015 TIGARD CARE CENTER PAGE 4 • The hardship is not self-imposed and the variance requested is the minimum variance which would alleviate the hardship. The hardship related to this variance is not self-imposed as it is brought about through changing patient needs and health regulations. The pedestrian walkway cannot be constructed without an uninterrupted heated environment without the property line setback variance. The requested variance is the minimum variance which would alleviate the hardship. SECTION V. Sunrise Healthcare wishes to provide an enclosed pedestrian walkway between the buildings through an existing parking lot, in order for patients to have access to the Davis Building. This connection will remain in place as long as the lease agreements are in place. There are 39 existing parking places on the care center site. There are 19 existing parking spaces on the Davis Building site and 24 spaces on an adjacent lot north of the Davis Building, which are part of the Davis building leased premises, for a total of 82 spaces. The Davis Building requires 38 spaces (13119 sq.ft. _ 350 = 38). The Davis Building has an excess of 6 spaces above code requirements. 12 parking spaces of the 39 care center parking spaces will be blocked off by the enclosed walk.
