VAR1995-00014 '1 • • EXHIBIT A CITY OF TIGARD NOTICE OF DECISION VARIANCE 95-0014 SITE DEVELOPMENT MINOR MODIFICATION REVIEW BROWN/MCVEY - OWNER/APPLICANT APPLICATION: A request by Jim and Christy McVey to reoccupy an existing developed property for a Paint Ball Use. The site has recently been capped due to concentrations of pesticides in excess of Department of Environmental Quality standards found in soils and groundwater supplies beneath the site. ZONE: Central Business District (CBD) LOCATION: 8900 SW Commercial Street. (WCTM 2S102AA, Tax Lot 4700) DECISION: Notice is hereby given that the Planning Director's designee for the City of Tigard has APPROVED the above request subject to Conditions of approval. THIS APPROVAL IS VALID IF EXERCISED WITHIN EIGHTEEN MONTHS OF THE FINAL DECISION DATE NOTED BELOW. A. FINDINGS OF FACT 1. Site Information and Proposal Description The site is presently developed and vacant. For years the structure was used as a warehouse and distribution use. Among the products which were stored on the facility were various pesticide products which eventually contaminated the soil and ground water beneath the site. Recently the site was capped and street improvements were constructed along the site's SW Commercial Street frontage. The applicant proposes to occupy the site with a Paint Ball Use. The applicant has requested a variance to provide a waiver from the 15% minimum landscape standard for commercial uses within the Central Business Zoning District. The applicant has also requested a Minor Modification Review of the approved Site Development Review for the property. 2. Other Staff Comments NOTICE OF DECISION VAR 95-0014/MINOR MODIFICATION BROWN/MCVEY PAGE 1 • • • The Engineering and Building Departments have reviewed the proposal and has offered no comments or objections. 3. Agency Comments Utility providers will be provided with a copy of this notice of decision and will be able to request that the decision be amended or set aside if the requested setback variance would conflict with the provision of necessary services or with existing utilities. B. ANALYSIS AND CONCLUSION A. COMPLIANCE WITH COMMUNITY DEVELOPMENT CODE SECTIONS: Use Classification: The applicant is proposing an indoor paint ball war game use in the Central Business District. The proposed use meets the definition of an Indoor Participants Sports as defined in Section 18.42 (Use Classifications). For this reason the proposed use is a permitted land use in this zoning district. Minimum Off-Street Parking: Section 18.106 requires a minimum of one parking space for each for each 300 square feet of gross floor area. The floor plan for the facility shows a gross floor area of 13,734 square feet, thereby requiring a minimum of 46 parking spaces. The site plan shows the provision of 32 parking spaces. The site plan shall also be revised to provide a minimum of a eight foot eight inch parking space width rather than the eight foot six inch presently shown on the site plan. It is expected that this may reduce the amount of parking on-site by 2-4 parking spaces. The applicant has also provided a letter from the tenant of the property across the street, the Calvary Church, permitting unlimited use of church parking lot facilities between the two parcels during business hours. The applicant states that the Calvary Church is primarily a Sunday morning use and that the business hours on Sunday's will not commence until after church has services have finished. Based on the parking demands of the church use it is expected that a minimum of 20 parking spaces will be available during all business hours. If the business hours are altered in the future or off-site parking is not available in the future the applicant shall provide a revised written agreement to provide a minimum of 46 total on-site and off-site parking spaces within 300 feet of the site in an alternative manner. If at such time as a new use occupies the church building the applicant shall provide a letter of agreement for shared parking for each successive user to ensure that the minimum required off-street parking is maintained at all times during business hours The Americans with Disabilities Act (ADA), which became effective the property lines to provide the required parking for each on January 26, 1992, requires two NOTICE OF DECISION VAR 95-0014/MINOR MODIFICATION BROWN/MCVEY PAGE 2 • • • disabled parking space if 26 to 50 parking spaces are provided. The proposed site plan shows the provision of one disabled person parking space. The site plan shall be revised to provide an additional parking space. Bicycle Parking: Section 18.106 requires one bicycle parking rack space for each 15 vehicular parking spaces in any development. Bicycle parking areas shall not be located within parking aisles, landscape areas, or pedestrian ways. A minimum of three bicycle parking spaces shall be provided for this development. The current site plan does not provide bicycle parking spaces. The site plan shall be revised to provide a minimum of three bicycle parking spaces preferably under cover for ease of use or the applicant shall demonstrate that it is impossible to place bicycle stands on this site due to the cap which has been constructed. Walkways: Section 18.108 requires that a walkway be extended from the ground floor entrance of the structure to the street which provides the required ingress and egress. The plan provides a paved walkway connection to SW Commercial Street, thereby satisfying this criteria. Landscaping Plan: Section 18.100 requires that the applicant submit a landscaping plan. The applicant has requested a waiver from landscaping the site. Due to soil and ground water cleanup issues a variance has been recommended to any requirement that the asphalt cap be opened to provide landscaping. The findings for this variance are reviewed elsewhere within this report. It is recommended that a minimum of three planter boxes be provided near the main entrance of the building. It is also recommended that a minimum of one boxed tree be provided for each seven parking spaces. Street Trees: Section 18.100.033 states that all development projects fronting on a public street shall be required to plant street trees in accordance with section 18.100.035. Section 18.100.035 requires that street trees be spaced between 20 and 40 feet apart depending on the size classification of the tree at maturity (small, medium or large). The proposed site plan does not provide street trees. It is recommended that boxed trees be provided along the SW Commercial Street frontage of sufficient spacing to meet street tree requirements. - Visual Clearance Areas: Section 18.102 requires that a clear vision area shall be maintained on the corners of all property adjacent to intersecting right-of- ways or the intersection of a public street and a private driveway. A clear vision area shall contain no vehicle, hedge, planting, fence, wall structure, or temporary or permanent obstruction exceeding three feet in height. The code provides that obstructions which may be located in this area shall be visually clear between three and eight feet in height (trees may be placed within this area provided all branches below eight feet are removed).. A visual clearance • NOTICE OF DECISION VAR 95-0014/MINOR MODIFICATION BROWN/MCVEY PAGE 3 • • • area is the triangular area formed by measuring a 30 foot distance along the street right-of-way and the driveway and then connecting these two 30 foot distance points with a straight line. The applicant shall submit a landscape plan for review of clear vision areas. Section 18.134.050 allows the Director to approve, or approve with conditions, a request for a variance based on the following findings: 1. The proposed variance will not be materially detrimental to the purposes of this title, be in conflict with the policies of the Comprehensive Plan, to any other applicable policies and standards, and to any other properties in the same zoning district or vicinity; The proposed variance will allow a contaminated site to be occupied and used by a Permitted Use without further spread of pesticides which have been found on the site. The site was capped as required by the State Department of Environmental Quality. The Comprehensive Plan does not provide specific policies relative to the re-use of an existing developed property which has been contaminated. 2. There are special circumstances that exist which are peculiar to the lot size, shape, topography or other circumstances over which the applicant has no control, and which are not applicable to other properties in the same zoning district; The site has been capped to limit further contamination of soil and ground water beneath or downstream of the site. A recent letter from the Department of Environmental Quality states that no disruption of the cap is • recommended at this time due to these contaminants. 3. The use proposed will be the same as permitted under this title and City standards will be maintained to the greatest extent that is reasonably possible while permitting some economic use of the land; An Indoor Participants Sports use such as that as has been proposed for this site is a permitted use through out the Central Business District. This variance permits the site to be occupied during the process of cleanup of existing pollutants. The applicant will provide interim boxed landscaping of sufficient numbers to meet City standards for numbers of street and parking lot trees. Additional boxed landscape planters will also be provided. 4. Existing physical and natural systems, such as but not limited to traffic, drainage, dramatic land forms or parks will not be adversely affected any more than would occur if the development were located as specified by this title; and NOTICE OF DECISION VAR 95-0014/MINOR MODIFICATION BROWN/MCVEY PAGE 4 • • The variance allows the applicant to avoid planting of permanent landscaping on a relatively small commercial site which is contaminated by pesticides. The nature of the variance is of a limited nature so that no traffic, drainage, land forms or parks will be affected by this change. The variance will allow use of the site given limitations which were the result of improper storage of materials by a previous unrelated use. 5. The hardship is not self imposed and the variance requested is the minimum variance which would alleviate the hardship. The potential new user has not proposed to re-establish the previous storage practices which contaminated the site. Because boxed street trees, parking lot trees and planter boxes will need to be provided the site will not be entirely devoid of landscaping. For this reason the variance will be the minimum amount necessary to use the site in a reasonable manner. Based on the preceding findings staff finds that the variance meets the applicable Development Code criteria and therefore recommends approval of a variance to the planting of any new landscaping by disruption of the protective cap which was developed on the property. The applicant shall provide a minimum of one parking lot tree for every seven parking spaces within a boxed planter. The applicant shall also provide a minimum of two to five street trees within planter boxes along the site's SW Commercial Street frontage. The exact number shall depend on the size of the tree at maturity. A minimum of three flower box type planters shall be provided on site near the main entrance of the building. SECTION I - DECISION: Notice is hereby given that the Planning Director for the City of Tigard has APPROVED the above request subject to certain conditions. The findings and conclusions on which the decision is based are noted in Section II. THE FOLLOWING CONDITIONS SHALL BE SATISFIED OR FINANCIALLY SECURED PRIOR TO THE ISSUANCE OF BUILDING PERMITS OR FOR CONTINUING OCCUPANCY OF THE STRUCTURE FOR THE PROPOSED USE. UNLESS OTHERWISE NOTED, THE STAFF CONTACT SHALL BE MARK ROBERTS OF THE PLANNING DEPARTMENT. 1. If the business hours are altered in the future or off-site parking is not available in the future the applicant shall provide a revised written agreement to provide a minimum of 46 total on-site and off-site parking spaces within 300 feet of the site in an alternative manner. The applicant shall also provide a minimum of two to five street trees within planter boxes along the site's SW Commercial Street frontage. The exact number shall depend on the size of the selected tree specimen at maturity. Also a minimum of three flower box type planters shall be provided. C. PROCEDURE 1. BUFFERING AND SCREENING In order to increase privacy and to either reduce or eliminate adverse noise or visual impacts between adjacent developments, especially between different land uses, the City requires landscaped buffer areas along certain site perimeters. Required buffer areas are described by the Code in terms of width. Buffer areas must be occupied by a mixture of deciduous and evergreen trees and shrubs and must also achieve a balance between vertical and horizontal plantings. Site obscuring screens or fences may also be required; these are often advisable even if not required by the Code. The required buffer areas may o y be occupied by vegetation, fences, utilities, and walkways. Additional information on required buffer area materials and sizes may be found in the Community Development Code. Street trees should be spaced 20 to 40 feet apart depending on the branching width of the proposed tree species at maturity.
