05/17/2004 - Minutes CITY OF TIGARD PLANNING COMMISSION Meeting Minutes May 17, 2004 1. CALL TO ORDER President Padgett called the meeting to order at 7:00 p.m. The meeting was held in the Tigard Civic Center, Red Rock Creek Conference Room, at 13125 SW Hall Blvd. 2. ROLL CALL Commissioners Present: President Padgett; Commissioners Bienerth, Buehner, Caffall, Haack, Meads, and Munro Commissioners Absent: Commissioner Sutton Staff Present: Julia Hajduk, Associate Planner; Jerree Gaynor, Planning Commission Secretary 3. PLANNING COMMISSION COMMUNICATIONS The secretary advised that the Volunteer Coordinator has posted the new Planning Commissioner and alternate positions. She also advised that Liz Newton is still seeking a youth member for the Commission. The next Planning Commission meeting is May 24th 4. APPROVE MEETING MINUTES It was moved and seconded to approve the April 26, 2004 meeting minutes as submitted. The motion passed by a vote of 5-0. Commissioners Caffall and Haack abstained. 5. GOAL 5 UPDATE Associate planner Julia Hajduk gave a PowerPoint update on Goal 5 (Exhibit A). She explained the Tualatin Basin program and the Goal 5 process. The purpose of the meeting is to discuss the larger picture of resource protection and to receive input from the Commissioners on potential program elements. She noted that there are trade offs with development and urbanization —what's important as a cultural value vs. what's important as an economic value. Hajduk advised that the Sensitive Lands Review standards in the Development Code regulates steep slopes, wetlands, and floodplains; Clean Water Services standards implement Title 3 and DEQ requirements for wetlands, streams, and stream buffers. The Development Code also has tree removal standards. Hajduk explained the Allow-Limit-Prohibit (ALP) map (Exhibit B). The map shows where the resource areas are and whether or not conflicting uses should be allowed, limited, or prohibited. She reported that the map is up to date and PLANNING COMMISSION MEETING MINUTES -May 17,2004-Page 1 accurate — Metro's inventory was based on 2002 data. The map has been adopted by the coordinating committee with the idea that it can be revisited. A final run of the map will be done before we have a public hearing. Hajduk compared the inventory done in 1996 to the current Goal 5 process and explained how the ALP map designations may impact Tigard. Hajduk asked the Commissioners to think about possible program tools for resource protection and how to carry the process forward. The Commissioners made the following comments: - Have joint meetings with Tualatin, Beaverton, etc., to look for overlapping areas. -- Compensation for resource protection — possibly increased density elsewhere on the property or reduced fees. There needs to be consistency with all Basin jurisdictions. - Tax write-offs for small parcels that are donated for greenspaces. — Free public relations publicity for people making donations. -- Require homeowners' associations to maintain greenspaces. - Don't isolate a resource area. - Identify more key areas region-wide. -- Mitigation for more valuable resources — allow some development with lesser valued resources. -- Provide more incentives for areas not requiring maintenance (natural areas). Leave the last 20' ± of affected properties as pathways or natural areas. It was acknowledged that the Basin Partners have not formally defined the levels of "limit". There were concerns about potential takings in some of the resource areas. Discussion was held on the importance of connecting resource areas so as to not have independent pockets of wildlife. Hajduk advised that Metro has looked at the habitat needs of wildlife and considered those components in their "limit" rankings. Audience member John Frewing, speaking on behalf of Take Back Tigard, Friends of Summer Creek, Friends of Fowler Open Space, and the Biodiversity Project of Tigard, submitted a supplemental map recommending changes to the ALP map (Exhibit C). The recommended changes include: • Protection for additional wetland areas that have been delineated since 1994. • Updating the conflicting use categories to reflect already committed uses (parks and greenspaces). Those areas should remain as open spaces. Hajduk advised that a "prohibit" designation may not be appropriate for parks. PLANNING COMMISSION MEETING MINUTES -May 17,2004-Page 2 • All Class 1 and 2 riparian habitats, including habitats of concern and floodplains, currently with moderately or lightly limit designations, should be classified as "strictly limit". • All Class A and B upland habitat should be strictly limited. Frewing believes things cannot improve if there are no "prohibit" zones. Commissioner Buehner asked if the group had given any thought to compensation for these "prohibit" zones. Frewing thinks that by zoning the areas, it will avoid takings. Frewing supports linking of areas to avoid isolating wildlife. 6. OTHER BUSINESS Norte 7.
