P10RTHVI�VN PARK MA sTEF2 PLAN John Roy and Matt StinF; gave a PowerPoint presentation on the Master Plan for Northview Park (Exhibit A). 1"he d�velopment of Northview Park is a r�sult of a 3.5 acre parcel of land donated to the Gity by Albertson's, Inc., in January 1999. A danation of $20,000 was also m�de at that tirne to the Castle Hill Homeowners Association by Matrix Development, Inc., the developer of the�Albertson's Shopping C�nter adjacent to the donated parcel. 1"he Assaciation gave that donation to th� City to begin development of fihe park. Since then, several improvements have been completed. !n June 1999, the Castle Hill Homeowners Association �fnrmed a park committee to work closely vrith the City on developing a Master Plan for the park. Severai ; meetings were held and the "iVorthview Park Master Plan" was finalized in � December 2000. Mr. Roy described the details of the plan as presented in Exhibit . «A„ i � The proposed landscaping of the park includes planting trees betw�en the park and � abutting properties. A majority of the adjacent property owners favor the plantings, + :; but four property owne�rs objected to any trees being planted directly behind their property because it would obstruct their views. A compromise was offered to plant different trees that are more slow growing and shorter in height, but they were un�ble to reach an agreement with the property owners. Commissioner Scolar asked if the trees planned for the objecting properties could be planted in a different location. Matt Stine explained that suitable areas to plant trees in this park are very limited, and the reasons for the recommended location of plantings include matter� involving slapes and delineation of the park perimeter. A discussion was held regarding the objections of fhe homeowners and the reasons for the reeommended location of trees. Pvlr. Roy stated that this has been an ongoing problem for the Parks Department, that ofiher property owners have objected in the past to tree plantings near their proper�y for various reasons, and they always work with property owners as much as they can to resolve the objections. In this situation, some af the properCy owners have been r�onresponsive to compromise offers, while others have worked out cornpromises and then later reverted to their objection to any plantings whatsoever behind their pro�e�ty. The Parks Department feels there is no other choice but to do what they think is be�t for the park and the community as a whole. They like to have citizen involvement, but the final decision should be m�de �y the City. Commissioner Topp asked about the donation of the land by Albertson's. Mr. Roy confirmed that it was an outright donation of surpfus land adjacent to the newly developed shopping center. Commission�r Topp also asked for an explanation of fl�e purpose of the trees and why they falt it was necessary to plant them over a prQperty owner's objections. Mr. Roy explained that due to the slope, or�e intent is for a natural boundary and barrier to keep balls, frisbees, etc., inside the park. The proposed location� �lso provide shade for the picnic and pl�y areas. The addition of trees provides larger benefits to the cammunity as well. Commissioner Scolar asked if there were any other�ays to place the trees to the hor�eowner's satisfaction. Mr. Stine responded that discussians wi#h homeown�rs re�arding different locations, such as placing the trees to the side;> of the property lines, as well as suggestions for different sizes and types of trees, were unsuccessful in resolving the objections or reaching a compromise. Commissioner Topp asked if the property owners were given notice of this Planning Commission meeting. Staff responded that the rneeting was not advertised as a public hearing. All homeowners were notified abo�t tonight's meeting at the last meetirig of the homeawners association. The members of the association attempted to resolve this among themselves and were unable tc� reach an agreement. Therefore, the associa�tion requests that the City make the decision. Upon Commissioner Munro's inquiry, the Commissioners were advised that there were no restrictions on the property or on funds from the homeowners association at the time of the donations. PLANTTING COMMISSION MEETING MINUTES—February 12,2001 —Page 2 ¢;�; � � A discussion was held regarding the location and types of trees to be planted, which includes 200 tree seedlings af various species and shrubs on the western slope toward the PGE transmission line right-of-way and 50 trees within the park consisting af cedar, fir, and redwo�ods, among others. Trees planned for the adjacent home areas include 2" caliper trees that are 6 ta 8 feet tall, with smailer shrubbery in some locations. Larger trees will be spaced approximateiy 50 feet apart, the smaller trees around 15 feet apart, and shrubs will be spaced cioser together. Type and placement of plantings was determined by considerations of growing conditions such as poor soil, exposur� to sun and wind, diversity, and the adaptability of a species to a specific area. President Wilson expressed concern abc�ut the seclusion of the western dead-end porfion of the park, which could create the passibility of illicit activity similar ta the situation at Jack Park. He asked if consideration had been given to some kind of access for that area. Mr. Roy advised that access to the area is nofi possible as it exists now and that ADA standards would be difFicult to meet for any type of acces� in that area. He added that most of the parks in Tigard have areas where problems could occur, but very few actually have any serious problems. Because the trees will be staggered and not placed closely together, he does not believe this area ofi the park will be secluded or pose any risk of problems with illicit activities. Commissioner Padgett pointed out that before this parcel was cionated, it was zoned as cornmercial and owned by Albertson's. As such, the shopping center could have been built closer to the adjaeent residences, which would have required large buffering walls resulting in much more of an obstructed view than the proposed trees. PtJ�LIC T�STIIVIONY W�sndy Read, 14100 SW Northview Dr., Tigard, OR 97223, Pre�ident of Castle Hill H�rrmeowner's Association, t�stifiE�d that area residents are aware that if fihis park was nnt developed, the parcel wauld most likely have been apartments or some other struc4ure that would be much more objectionable than the park. In spite of this realization, the objecting property owners contend they bought their property because of the empty field and open view, and are therefiore opposed to any trees being planted. Two of the four objecting homeowners are on the a�sociation's board, but they have not been willing to communicate with the board about the probl�m in order to come up with a solution. Other area residents want trees to be planted in and around the park. Sandee Coumes, 14268 SW Windsong, Tigard, OR 97223, �oard Member of Homeowner's Association and Chairman of the Northview Park Committee, testified that two of fihe objecting homeowners have declined to address the matter � in any way. The ather two homeowners not only object to trees being �lanted behind their prc�Lrty, they object to having any trees whatsoever in the park. Since the majority of area residents favor trees in the park and a compromise canr�ot be reached, the association is taking the position that the City, as the owner of the PLANNING COMMISSION MEETING MINUTES—February 12,2001—Page 3 � � property, should make the final decision on the matter. In response to an inquir� by Commissioner P�dgett, IV1s. Courv�es confirrned that the p�rk committee represents the association ir� this r�atker and recommends approval of the proposed master pian, inci�ading the location af trees as presented. In response to an inquiry by Commissioner Scolar, IVis. Cnumes �Iso confirmed that the objectinq homeowners who are on the association's board did not raise any issue regarding the planting of trees at the time the mao�ey was donated to�the City far development of the park. No other cancerns have been raised and the majority of area residents are in favor of the park as proposed. Upon further discus�ion, C�mmi�sioner Padgett moved to recommend to the City Council fio approve the Narthview Park Master Plan as submitted. CommissiQner Tapp seconded the motion. Along with the land donati.on,Martix Developanent I111c.,donated$20,000.00 to the Castle Hill Homeowners Association.In March of 1999,the Homeowners Associarion donated the money to the City for tlie purpose of being start-up money to utilize for the development of the park. In June of 1999 the park was given its official narne of Northview Park. In the last year the Castle Hill Homeowners Asaociation and the City has worked closely together in the utilization of the$2�D,000.00 donation. There is an extreme slope beriveen the park property and the Albertsons Shopping Center,and between the park and the Bonneville Power Line easement. Therefore,it was agreed that a six foot high chain link fence would be installed along those portions of the park for safety rea�ons. In addition,it was agreed that the park would be seeded and have irrigation installed. This work has already been performed and was funded from the donation money. A small swing set and a tire swing were also installed in the sumrner.of 2000,also funded from the donation money. There is currently a zero fiuid balance froin the original$20,000.00 donation. PU$LIC IIV�'OLVEMENT In June of 1999 the Castle Hill Homeowners Association formed the,"Northview Park CommitYee",for the purpose of working with the City an developing a master plan for the park. Several meetnigs were held in late 1999 and early 2U00 with City staff and the Northview Park Committee with members of the Homeov,+ners Association also in.attenclance. The outcome of the meatings is what is identified as the conceptual plan foz the"Northview Park Master Plan". A final rnaster plan meeting was held on Wednesiiay,December 6,2000. CONCEP'1'�7AI;I'LAN The resulting plan sesponds to the needs expressed by the community and tkie concerns articulated by City staff: The entrance to the park will be located off of Norhtview Drive. The entrance will be a paved patk►that will lead into the interior of the park where the play area is located. Because of the degree of slope of the property at this entrance it is planned that the path will zig zag oz meander up the slope so as to meet the requirements for ADA access. Located along the path and cl�se to Northview Dr.will be either a pex�cnanent restroom facility or a portable restroom. L•andscape scaeexling will be installed around the structure to decrease its visibility from Northview Dr. An ADA accessible drinking fountain will be located along the gath. The east interior of the park will have a children's playground located in close proximity to the existing swing set. Tb.e playground shucture will provide apparatus for children 2 years to 12 years of age. There will be a bench and picnic table with a bar-b-que located in the general vicinity of the play area. The west interior of the park will have a small soccer field that can be urilized for a soccer practice area or for pickup games. There will be a bench and picnic table located in clos�proximity to the soccer field. The area between the soccex field and the playground area will be left as an open grass fleld area for general play use. Landscaping will include trees and shrubs throughout the park. Approximately 50 trees are planned to be planted in the park this spring. Castle Hill Homeowner's Associarion members and other citizens have volunteered to participate with the tree planting. The western portion of the park property that slopes towards the PGE transmission line right-of-way will also be planted with approximately 200 tree seedlings and shrubs. : � The Urban Forester met several times with the representatives of the hozneowners association as well as th� property owners abutting the park to discuss tree plantings. Most homeowiners wanted tree plantings in tha. park but four property owners requested that there be no plantings in the park behind theirc praperties so that their views would not bc lost. The Urban Forester placed door hangers an the residences of the four property owners who did not want trees planted behind their property requesting that they contact the Forester ta resolve the issue of.txee plantings in the park. The Urban Forester contacted two of'the proper4y ov�mers(Boesen and Wilkson)and spoke t�vith them regarcling their concerns. They w�ere iniNally able to r�ach an amicable agreement on the planting location of taees. Then the Boesen's contacted the Urban Forester and informed him that they had changed their mind and had decided that they did not want any trees planted in the park behind their house, The other two property owners were mailed letters by certified mail xequesting that they.contact the Urban Forester to discuss their concerns and his attempt to work with the residents regarding tree planting in the park. Unfariunately,the residents did not respond by the date indicated in the correspondence. After the deadline for respanding to the correspondence one of the pro�erty owners has called the Urban Forester requesting a meeting, The Urban Fozester is in the process of arranging a meeting with the property owner.
