City Attorney Jim Coleman provid�d a brief background of his experience �
in land use wark which dates back ta 19�5. In talking about hearings
procedures, h� stated that they were well covered in the code, �
4 Commissioner Fyre requested clarificatio�n pertaining to issues of b�as �

and conflict �f interest and ho►� Commissioners can determine when they �
should not participate in discussion or deliberations on such �tems. �
Discussion followed with A�torney +�o�emar� giming some example� of what �
constitutes bias and conflict of interest. There was discussian about ��
ho�r much influence a Commissi�ner's comments may ha�ve during a hearing � �
and what causes � dee�si�rri �V bz �alied �p ��^ �ppealed. ��

3.2 Discussi�n rith Le�al Counsel Jio Col�aa�n on �chool capacity as rei�ted
to r�vlew of d�velopment appfiications.
� City Attorr�ey �im Coleman discussed the proc�ss for bringing about a �
moratoriu� on �ew development. He cited, as an example, the experience F�
of the Lake Oswego City Council . !�e defined the difference of dealing �
with school over�ro�►►ding on a system-wide basis as opposed to a � ;
case-by-case basis. He nated that there are time limits se� for a ��
moratorium, and a soiutior� to the overcrowding must �e four�d by a set �
dead�ine. ' �

o Pat Biggs with the Schoo� District shared statist�cs on student �
enrollment. She explained the transfier zo�es, along with the drawbacks �
for students and families who are affected. She diSCUSSed the use of
portables as a temporary means of ineet3ng capacity. There was
discussia� about the number of students expected to enter school next
year, and th� cost of the ner� high school which wi11 be comp�eted in
1992.
A1 Zinanerman, Construction Pra�ect Manager for Tigard-Tualatin School
District, gave some pro3eetions of class sizes for the coming y�ars.
After the twa new schools are bu�lt, he stated that in 5 years they will
be ba�ck up to capac9ty, and ov�rcrowding wi11 again have to be addressed.
There was discussion about County ardinances and how the,v differed fr�m
Tigard ordinances, and why gro�th in �Me Caunty was hardest to deal witha
s.3 uiscussion witn sia�i� on upcan�ng projecti§. �

o Commissioners discussed the major concerns and issues they would like to
de�l with during the next 12 rnonths. Greenways and floadplains were �,
discussed along with the rela�Ced issues uf easements and deed dedica�ion. � j
' There r�as consideration of vawio�s methods for° funding open spac�s and I '
� natural areas, irocluding payment of mohey by developers in lieu of � '�
greenway. Funding fov° street trees was discc�ssed. a
5enior Pl�nner Ron Bunch advised that the new landscaping ordinance will �
. deal with soone of the issu�s. � '
o The top�c of �om� occupatians was raisQd. There was brief discussion �
cancerning bed and �reakfast businesses and which zones allowed these.

There was agreement that music teachers sfiould be allowed to operate as

o �he C�ntral 6usiness District was diseussed along with �he associated
tra�f�c issues. There was consideration given �o the suggesti�n that
the ar�a be re-zoned as Industrial Park, and ther� were conwnents on.
``� vari'ous pros and cons concerning different poss3ble commercial
designations. Tigard Triangle and Dartmouth extension wer� discussed.

'` Commissioners talked about the possib3lity of building a sports arer�a in
Tigard, but it rras noted that there was no tax base to support it. ;
o Commu�nity Devel�pment Direcior Ed Murphy provided the Commissioners with
i nfarmation abo�t the u�pc omi ng Pl�nn3 ng Commi ssi aner Trai ni ng Program on
March 1�6, at the Seaside Cor�vention Genter.
0 7ig�ird resident Kerry Stanley informed th� Commissioners and staff that
on Mar�h 11 , there will be a pu�liG hearing at DEQ to receive input
about their intend�d shut down of noise controi enforcement. The
equipmen� for me�suring noise levels has been used by Tigard in the past
and is mor�e s�ophisticated th�an Ci�y-owned equipment c�rrently on �and.

necessa�y to get rid of the PD ove�l�y zone on the Zoning Map and
create more of a sensitive lands section to deal with thos� issues
for whieh we now use the P.D. overlay to manage.
CDC - (Throuahout the Code) Public Improvement Requirements:
(Duane and Ron) The prim�ry issue here is whether the City should
address school capacity within the Dev�lopment Code. However, a�
determined by the City Attarney, there are several areas where the

consistent with the rest af the Code.

folloraing is a summary of what staff views a$ �he mos� important:
Parks and Recreation: Along with upcoming Parks 2000 Action Plan,
the City must become m�re active in the acquisition of park land
and open spac� areas. This may require amendment of th� Gaal 8
(Parks and Recreation) elem�nt of the Comprehensive P1an.
Economy - Policy 5.1.1: The City should elaborate upon this policy
so that it is clear what is really meant and what the desired
outcome is in regards to econ�mic diversity.
Hous�.ng - Estab3ished Resid�ntial Areas Section 6 .3: nel�te the
"Estak,lished Area" provisions. They are unxeasonably restrictive
for multi-family development without corresponding benefit. Other
techniques, such a� improved buffering and screening provisions
should be employed to achieve the comp�tibilit� riesired by these I
policies (6.3. 1, 6.3.2, and 6.�.3) . It may be necessary to look ,
clasely at Policy 6.4.1.
Transportation - Policy 8. 1. 1: This policy regarding °'safe and
