Senior Planner Liden revxewed the history of the application, iteme
aubmitted in the packet, and applicabl� eection� of the Code. S�aff is
recommending that th� Planning Commiseion uphold the Director's decision.
He aummarized a letter from James & Lucille Hick who originally aigned the
petition opposing the Temporary Use and now are in aupport of the Temporary
Use.

and when oppoeition etarted they offered �o meet with the people who were

concerned but nothing happened. They did circulate a letter and �alked
with some of the people, four of whom have withdrew their oppoaition. He
explained that their intent is to build the churclx and would like the
Temporary Use Fermit approved., Discusaion followed reqarding the number c�f
RV's that would be on the site, where they would be located on the eite,
and availability of other locati.ons to park the vehicles.

o Bill Gross, 3019 SW Iiampahire St., Portland, Or 97201, stated that he was �

concerned about the NPO's input aince the information had been sent �o
Chairman Jim Boylan, who had resigned from the NPO. When the NPO reviewed
the item there where only two members in attendance.
a Gary Kaaza, 3715 Sw Divisian Court, Lake oaw�go, 97034, Chairman of the
Building Committee fnr the church, explained that the group that they are
hiring to do the work, �abarers for Chris�, are retir�d individuals who
travel different �arte of the country working for minimum wage constructing
chu�ehe�. Th�y had baeed their budget on using this resource as it reeult�
in a substantial savingg in labor coe�t.
o Jam�e Hiiak, 12414 SW 134th Avenue, felt that they live the closeat and are
the mast impacted. Eie is a new praperty owner and had signed �he pedition
because they did not receive notice and they felt that they should have an
opportunity for input. He ie preeent toniqht t� reinforce their letter
that th�y have changed their position and suppdrt approval of the Temporary
Use.
o Harry L, S�hukart, 11910 SW Marning Fii].1 Drive, President of the Morninq
Hill Hlomeown�rs Aeeociation e�ated that the aseo�iation kaad held a meeting
and voted unanimouely to oppose and appe�l the Temporary Use. Their main
objection fe �that the Tempoxary Use violates their CC&R�s.
o Cal Waolerx, 12356 SW 1�2nd Court, did not oppoee the Conditional Use pnly
the Temporary Use. He did not feel there wae anything in the Code which
gave etaff the suthority to approve a Temporary Uee for a mobile home park
or fo� requiring these vehicles to be connected to se�er and water. If
this is not a RV park, why is staff recluiring a RV permit from the State?
He did not feel �hat thie was a proper uee of the land.
o Bill Gross, 3019 SW Hampshire St., Portland, OR 972Q1, read and submitted a
letter into th.e record opposing the Temporary Use permit.
o Bonnie Goldsmith, 12392 SW 133rd Avenue, felt that she was the most
impacted ae ehe livea directly acroes the street from the site. She felt
that the Church should be required to abide by the CC&R�a. Also, ahe had
ck�ecked into other alternativea and th�re are several churches willing to
help by allowing people to etay in their homea. She felt this would be
leae expeneive than paying for hookupa to the aewer and water.

sewer and water ae these are the aame lines tha� will connect to the
building. Discuesion foll�wed regarding location of the RV's and

inatalling sareening and landscape buffering prior to construction.
o Diecuseion followed regarding enforcement of CC&R°s, the Ci.ty Council
previoua deciaion, and the con�ition f�r hooking up to sewsr and water.

uee, riowever, he did feel this ie the type of use which could be approved
undex the Temporary U�e portion of the Code. He felt ther� could be some
type �f sight abscuring buffering.

Use TUP 90-0002.

the recording af the original plats, there have bQen no other
land use or development applicatians xeviewed by the City of
Tigard. !
Aue to a notification error, the City of Tigard issued an amended
adminietrative decieion on May 5, 1990 apprnving the proposed '
temparary use. This de�ision wae appealed by �gfected p�operty
ownere to be revi�wed hy the Planning Cornmis�iota.
3. Vicinitv Information
Propertiea north and east of the aite are zoned R-4.5 and are
develo�ed with eingle family residences. Six-foot tall wooden
fences aeparate theee parcels from the aubject aite. Prag>erties

with single family reaidences. SW iiart Street and SW 133rd
Street, both improved local street�a, separate the site from the�e
propertiea. Properties weat of the eite acrosa SW 135th Avenue
are a'lso zoned R-25 and are preeently vacant.

The applicant proposea temporary use approval to allow seven
epacer� for parking of motor homea to houae workexs fox the
construction mf Our Redeemer Lutheran Church from the preeent to
October 31, 1990. Theae spaces will be located in tlae southern
portion of the property within the propoaed parking area for tlxe
church.

The Building Divieion hae revi�wed the propoeaL and has offered
the following commen�e:

and to the public water service in a manner that is
acceptable �ta the city plumbing inspector. A perrni� and

inspectian will be required for ths hook-ups.
2. Electrical hoAkup shall conform to the requiremente of the
Waehington Coun�ty electrical department.
3. The temporary uae must be approv�d by the State of Oregon
Huilding Codes Agency RV Parks Section. The appZi��nt has
been notified to send a requeat to the State BCA, (3-23-9A) .
4. "Houaehold" waste eha].1 be dispased af in an accep�able
manner (i.e. weekly pick-up)q
The appellants o£ the Director�s Decie�an etated in the written appesi
and at the hearing that they felt it wae not the inten� of the Coda to
allow the use of temporary residencea or recreational vehiclea for
thia pro�ect.
B. ANALYSIS AND CONCLUSION
Community Dgvelopment Code Section 18.140.050. (B.5. ) allows the
Planning Commiaeion to appr�ove or approve with conditione uses
aeaociated with conatruction euch ae the atorage of equipment during
the conetruction of roads or development, but not a temporary eales
office or model home.

Th� applicant satisfies applicable criteria in that: The temgorary
uae ahall be limited in duration by th� purposes for which the perrmit
is ec�ugtxt; the temporary buildings eha11 be suk�ject to apprapriate
R-4.5 and R-25 ee�backs; there exists adequate and eafe ingrese and
egress when combined with other ueea of the property; there is
adequate parking for the temporary use; the uae wi11 nat result in
conqestion; the use will pose no hazaxd to padeetriane; tize uss will
not areate adverse off-site ic�pacts inaluding noiee, odore,
vibrations, glare car, liqhts which will affect ad�oining uses.
The dates of the approval ehall be adjueted to reflect the iseuance of
this amended decision. Therefore, the �►,ena�a aateB ehall be from
June 26, 1990 to November 9, 1990.
The Commiesion finds this interpretation of the Gommunity Dev�elnpment
Code to be can,sistent with a similar case decided by �he City Council
in 1986 where the temporary uae of recreational vehicles wa� permitted
to house workers during the construction of a church. The Temporar�y
Uee Chapter was amended in February, 1989, bu� the Commiseion finds
that the prnvieions ot �he Code remain the eame as they per�sin to
thie issue and the interpretation made by the City C�unci.l in 1986. j

in which the Director faund the issuanc� of the temporary uae permit to b�
consistent with the intent af Community Development Cod� Sectione 18.140.050.8
and 18.140.Q50.C. . This interprtation also included information concerning a i
pxevioua Qouncil deci�ion to allow a aimilar use in 1985 (CU 2-84) and an

The Planninq Division finds that thie type af t�porary uae ia permitted by the
Tiqasd �7oauaunity Developaaent Code based upoa the following�

As you know, Our Redeemer Lutheran Church has requested of the Cit7 of Tig�rd ��
a Conditional. Use Permit to �llow up to �even R.V. 's or F�fth-Wheel� to park
on a designated area of the property at 135�.h and Hart. These will house cpn-
struction workers who will be involved in the erection of our Church Building.
These people who wi.11 be dwe111n$ in the�e vehiclee are part of a ver� a.pecial
cadre of folks who are called Laboxer� for Christ. They are for the, most part
retired peopl.e who have been inv�lved in constX+uc*i.on i� t'�!e �?as* end hsvs, ti•c1-
unteered tu come to a Iocation where a new �hurch i�'s 'being� built an�,to provide
their, skills and expertisp, i,n, the �.�tag�r,uc,t.i,ar� .�ak�s�R!�..�f..*h� .k`��,���:+.r._g; '!'!<e� s_� ;
paid minimum wage which in turn saves the local 'congregation cons�.d�rable money.
They do this not because they could not command a far betxer wage �or their work '';
but because they want to help young congregations suchas Our Redeemer get a g9ad �
start.
This is a national program of the Lutheran �'hur�h - Mis�ouri Synod. a church body
of nearly three million r�embers. The I,aborera for Chris�. �re screened very eare-
fully before they are assigned to such pro�ecta. �im�.lar programs have been used
andare srill being used by some other denominations nationally.
Tf we are unable to hav� the�e vehicles parked An our propert}� during the con°
struction phase much of the m�ney �aaved will be ea�en up by the �aeed to ren�
spaces at a it.V. Park somewhere. This ia mon�y �k+at is dona�:ed by Chureh enem°
bers and is not that easy to come by.
Also, having folks such as these Laborer�s fox Christ on site d+�:�ing canstruction
will go a long way toward controllin$ vandalism not only� on our prop�rty but n18o
in the neighborhood�
The request ig for a temporar� use permit. They are limited to how long they
can be parked on site. By November 1 they will have to be off the.praper�v and
will not be comi.ng back. A1�o, since a praperty owner in the� neighborhood is .

Oregon explained to Council that he has an aption to purchase the
prop�rty r.o develop a 10 iot subdivision, but the cost of puCting in the

requested Council to waive the 1/2 sereet improvement requirement.

6. LITTLE LEAGUE FIELD MAINTENt1NCE DISCUSSION. 'The Cauncil and staff
t diacussed the failure of the LitKle League to properly notify park users
of the seeding program they started on the ball fields in Cook �ark.
Councilor Edwards �aid that he hoped the Park Board and City would not
be toa severe in their disc�ssions with Little League as the
relationship with them is better thaa it has ever beea. Little League
has done about �2,000 in lmpcov,��.�nts to the ball fields and the City
has only had to refund $90 in reservation fees. The Park Board will be
handling the sign up for next year with the Littie League.
7. SIDEWALK -•POLICX DISCUSSIQN. Cauncil discussed the Gity Attorney
recommendation on sidewalk maintenance and liability. The ordinance
will be presenCed to �ouncil again August 1.2, lyf�5.

As you know, Our Redeemer Lutheran Church has requested of the City of Tigasd
a Conditional Use Permit to allow up to seven R.V. 's or Fifth-Wheels to park
on a designated area of the property at 135th and Hart. These will house con- I
struction workers who will be involved in the erection of our Church Building. li
These people who will be dwelling in these vehicles are part of a verq special
cadre of folks who are called Laborers for Christ. They are £or the most part
retired people who have bPpn invo7.�P�! ;.n �onstr±�ct�.oa in .4he p��� a:.0 i���;e vc,I•-
unteered to come to a location where a new Church is being built and to provide
their skills and expertise in the construction phase of the buildin$. They are
pazd minimum wage which in turn saves�the local •congregation con�iderable mon�y.
They do this not because theq could not command a far better wage for their work
but bPCause they w�nt ta help young congregatian9 suchas Our Redeemer get s gomd
start. '
This is a national program of the Lutheran Church - Missouri 5ynod, a church body
of nearly three million members. Th� Laborers for Christ are scre�ned eery care-
fully before they are assigned to such projects. _Similar prograuns have been used
andare still being used by so�ne cther denominations. nationallq.
If we are unable to have these vehic?es parked on our property duri.ng th� con-
struction phase much of the money �saved will be esten up by the need to rent
spaces at a R.V. Park somewhe�e. This is monsy that is doz�ated by Church mem-
bers and is not that easy to come byo
Also, having folks such as these Laborers for Christ on site during constructian
� will go a long way toward controlling vand�l.ism not only• on our property but aleo
in the neighborhood.
The request is for a temporary use permit. They are limited to how long they
�an be parked on site. By November 1 they will have to be. off the property an�
will nat be coming back, Also� since a property owner in the neighborhood is
allowed to park an R.V, on site in order to build a home we feel that what we
propnse to do is in the same spirit of the ordinance.
We da pledge to the neighborhood that we will keep our property and everything
on it in good order throughou4: construction. We want ta be good neighbors and
foresee our building being open to use by neighborhood groups and organizations
in the future.
We ask, therefore, that you reconsider yot,ir opp�sition to our Conditional Use
