This presentation refers to your Fa.Ze No. SDR 89--10, NPO #6, and involves Sec. 18 .120v070 of the Community Development Coc�e. As your records will indicate, our association consists of 110 condos occu ied b 150 men and women most of whom are re�ired. P Y ► We appxeciate y�ur taking �his time tonight to hear us and to reconsider aur application far a modif.ication to the existing site plan at The Fountains. A11 of the details of our area are well-covered in your "Notice af Decision" signed on May 25, 1989 so I will not repeat any of that information. We all appreciate having receivec� copies of. that decision. Our parcel of land consists of 9 . 3 acres. Thi� is private property awned by us and, as you kn.ow, we are responsible for all of our awn costs of street main.tenance, landscaping, street lights and standards, water and sewer costs, all a,t no expPnse to the city. We are currently budgeting each anonth fram our monthly membership dues for future costs of street repair and maintenance. This entire project, as it was developed by the Hillman Cor- poration in several phases, was inspected an� approved by the city of Tigard' s various building departments, street engineering departments, and other concerned agencies. Most all of us chose Th� Fountains due to i�ks location, � i unique architectural design, unusual layout and beautiful landscaping. ; � Also it provide� an iiicreased degree of safety for all of us as � , compared to other similar areas. � � Your Commission is familiar with the projected building programs slated for the property just north �f us across Naeve Str�et. These projects as they are developed will subject our area ta an extrsme increase in both motor vehicular and foot traffic I` ' � 2. . as raell as bicycles, motorcycles, skateboards and a possible � hor.seback .rider. �ur four entrances� have all been posted for almost two years now with groper signs indicating that this is private property for residents and guests only. We have a11 been watching as we sustain an increase in the number a� ca:�s and large �rucks through our area without �egard to the signs. This traffic is avoiding the Durham-Pacific Highway interchange and using our street as a through street. � Th� basic proposal presented in our �pplication was appxoved by your Commission subject to some modification noted from the Washington County Fire District. It was their recommendation that �,re install some form of emergency gate that would allow only emergency vehicles onto our propert��,,,_ .._�....._._..._w.�.___...._��..__.._.___.�.... - - �- _ This proposal is not only beyond our fina•ncial budget but does not accomplish wha�t I have previousl.y sta�ted as oixr goal� At a cost of only $1,450 we can build a brick tence that conforms to our existing fence and �liminates all of �I�e previc�usly x�o�ec� forms of traffic from Na�ve Str�et. We are n�t anti-s}cate boards, bicycles, or any other small vehicles, bu� we are involved in ' a possible liability situatian and, as owners af this property, i . we f�el that we should be entitled to regulate caho enters trom our access roads. Mr. Birchall of f.he [�Tashington County Fire Distric� during our interview on the subject indicated that in the event of an emergency situation in our upper area (noted in �ellow on your sketch which we provided) the permanent closure of the Napve Street exit would isolate that area to only one access road for his v�ehicles arzd if by some unusual circumstanc� and time frame �here was a vehicul.ar accident a� th.at acces� road, his 911 vehicles could nAt respond into that area without undue d�lay. We do not feel this argument is valid compared to what we as property owners are proposing for the benefit of the entire asso�iation. Thsre are two hydrants, ane at each end of our property on Naeve S�reet not mor� than 200 feet from buildings in the "isolated" areas. We have five other hydran�Ls throughout our eondos. The Fountains ccnsist of 110 units. The Fir�e District' s main objection is that our upper area has only one aacess raad af�er the clos�re of Naeve Street. We have only 26 condos in the upper area that would be dependent on this access road in the event of fire or injury.
