there is adaqua�e acaese to th� site evsn wi�h thie cloaure.
o Commia�aioner Barber was concerned that the Fire Department did not favor
the request, however, because a£ the strong support of the neia�hb�rhood
she felt she eould aupport their requeet.
o Commiaeioner Fyre euppoxted the appellante proposal. I
o Commisaioner Ca�tile felt a rod iron fence would be a good alternative,
however, since the resident nppoeed, he supported their r�queat.

The Summerfielci planned community received its first City development ,
approval in 1972 and hae developed in a s�riee of phases aince that I
time. The �'ountaine at Summexfi�ld cnndominium develppment waa I
approved by the Planning Commission oa August 7, 1984 (PD 3-84). The
Fountaine have aince be�n daveloped in 16 phases. ',

SW Naev� Street and two �ingle ;Eamily residences border the Fo�.intains
at Summ�rfield development on the north. Three relatively large,
mostly undeveloped parcels zaned R--25 (PD) (Residential, 25
units/acre�Planned Developmen�) and R-12(PD) (Residential, 12
unita/acre-Planned Development) are located on the north side of SW
Naeve Stre�t. SW Naeve Street ie functionally cLassified by the City's
Traneportation Plan Map as a minor collec:tor street. At present, the
street is underaized and gravel �urfaced between S.W. 109th Avenue and
Pacific Highway except along the Naeve Street frontage of the Fountains.

condominiums on their southern edge. SW Summer£ield Drive intersects

Hom�ownere Assoaiation, have requested permission to close the Naeve
Street access to the Fouatains by continuing an exiati.ng �2 inch ta11
brick wall on the develo�ment'a Naeve Street frontage acrose the
exiating driveway. Because the proposal chang�e accesswa3�a to an
existing development in a vaay that could affect off-aite traffic, the
proposal ie required to be reviewed ae a major modi.fication to an
aggroved site plan S:hrough the Site Developanent Review proces�.

The Engineering Divieion ha� reviewed the progosal and has prowided ths
following comments:
a. The Fountaine ie a 110 unit develogxnent currently sezved by 4
accesses. The Cnmmunity Develog�ment Code requires a minimum
of three acceas pointa for a development of this �size.
b. Closure of the access to Naeve Street would reault in the
nor�hernmoet dwelling units within the Fountsine being
approximately 900 feet from either S.W. 114th Court or S.W.
109th Avenue, botli public atreets. Being this far from a
public acceae� ia not a �ieeirable eituation for roat►ergenoy

facilities would not be affected� since these utility providers

Waehington County Fire Distric� �l has reviewed the original
proposal �and haa co►�mented that the Dietrict strongly objects to
the propased elimination of the S.W. Naeve Street accees to �he
Fourxtains. The Dirstrict has commented that emergency vehiclee
already face dif:Eicult maneuvering within this development during
non�emergency situations and closing the S.W. Naeve 5tre�t exit
would further reduce response tim�a to units within the narthern
portion of the development. In addition, the District hae
commented that b�cauee both of the acaess points from SW 114th
Cour� are off of one short street, this situation shauld
effectiv�ly be conside�ed one acaess.
The Planning Division contacted the Fir� Dietrict regarding whether
the Fire Aiatrict wpuld be amenable tco having the acce�� clased to
all hut emergency veYZicles through use of a gate with an emergency
opening device. The Fire Di�tri.ct commented that euch gates often
become problem� becauae of ].ack of maintenance and later congusion
regarding who has responstbility for an.aintaa.ning th� gate.
Neverthele�e, the District will agree to a gate provi.ding em�ergency
access to the Fountain.� from S.W. Naev� Street if the Uxetrict haa
the opportunity to review the gat� plans priar tca construction and
i� the Homenwner'e Ae�ocia�fon agrees to the long terna ma:tntenance

�he �ummerfield Civir Associat5.on Soaxd has aomm�nted that they
have no objection tn the progosal.
The Building Division had reviewed the pro�osal and had offered no

B. ANALYSIS AND CONCLUSION
Section 18.120.070(B) (6) of the Community Develo�ment Code atates that a
proposal �o alter �n existing devslopment by changing aaceesways such
that oft-etreet traffic would be affected constitutes a enajor
modification to an appraved site plan. Major nnQdifications to a.pproved
site plans are required to be zeviewed s+ub�ec� to alJ, standarde and
requirementa of the Site Develapment Review section of the Code. The
only aubsection of Section 18.120.1�0 (Site Development Rev�.ow -
Approval Standarda) which staff has founcl to apply to the present
application is subsection 18.120.1�0{A) (al).

northern and of SW 114th Court; and 4) on the west side of SW 114th
Court approximately 200 feet south of the other SW 114th Court driveway.
Closing the 5W Naeve Street driveway access would leave the development
eerved by three accesa driveways i.n confr�rmanc� with this Code �caess
requirement.
The original internal circulation plan for the Fountains d�velogxnent
appropriately pxovides �or 24 foot wide p�ivate accessways throughout
the development in conforcnance with Code standards, The narrative
submitted with the original planned development applioation for the
Fountains nnted that:
"To minimize the t�n�lency of off �ite traffs.c to
use the private streeta as a short cut such a� the
street connecting S.W. Summerfield Dr3.ve to Naeve
Raad, two landseaped and fountain �acented
turn-around struatures have b�en created. The
primary functione nf theee etructures ia to slow
vehicles down and discpurage thru traffic... ."
( Although the residen�s apparently feel that 'the turn-around structure�
do not do ennugh to discouxage through traffic and �1ow traffio
movements, the Fire Diatrict finds that the turn-around etructures along
wiL-h the narrow streets slow vehicles down, �specially large emergenay
v�hiclee. The Fire District has commented that emergency vehi.clee
aurrently have a difgicult time maneuvering thrvugh the aite and that
closing the Naeve Streeic exit will significantly increase the District�s
�mergency reaponse timea to buildinge in tlxe northern portion of the
development that would normally be accessed from Naeve Stree�. The
northernmast buildinge within the development would be in excess of 900
feet from th@ neareat accese point from a public street if the accesa
would be closed as proposed.
The Planning Commisaion concludes that the proposal to totally close the
S.W. Naeve Street acceae to the Fountains would provide an adequate
circulation pattern throughout the development designed to accommodate
emergency vehiclee as re�uired by the Site Aevalopment Review approval
criteria. Howevero becauae it haa besn found that the proposed aacess
claeure would nat atfec� the development°s conformanc� wi�lh Code

APPLICIiTION: A request by the Condominium Homeowner's Association of t'he
Fountains at Summerfield condominiums for admini�trative approval of a major
modification to an existing development's site plan and si�e improvements.
The applicants request permission to close the SW Naeve Street acc�ss to the
FountaiY�s condominiums. Closure is groposed to be accomplished through
coni:inuation of the development's exist`xng brick wall along SW Naeve Stre�t
across the �xisting driv�way. Zoning: R-25 (PD) (R�sidential, 25 units/acae

1. Background
The Summerfield planned conununity reaeived its first City development
approval in 1y72 and has develnped iii a series of phases sitice that
time. The Fountains at Summerfi,eld condominium rlevelopment was
appruved by the Plannii�g Commission on August 7, 19�4 (PD 3-84) . The
routitains have since been developed in 16 ptiases.
2. Vicinity Infot-nlation
SW Naeve Street and two single £amily residences bord�r th� Fountains
at Sununerfield davelopment on the north. Three relatively large,
mostly undeveloped parcels zoned R-25 (PD) (Resi�i�ntial, 25
units/acre-Platitied Development) and R-12 (PD) (R�sideittial, 12
units/acze-P1anYied Development) arE located Un the iiorth si�e of SW
Naeve Street. SW Naeve Str�et is functionally classified by th�
Cit;y's Trattsportation Plan Map as a minuc coi.Zectot street. At
present, ttie stceet is undersized and gravel surfae�� between S.W. I

Development) are located to the west of the Fountains at Summerfiela.
Commercial operations on some of these paxcels ar� located on the
western edges of the properties.
3. Site Information and Propc�sal Description
The Fountains condominium development includes 110 condominium units
located on approximately 9.3 acres. Access to the Fountains from
public stxeets is provided at four locations: SW Naeve Street
approximately 7�A feet east of Pacific Highway; SW X09th Avenue; and
�wo driveways off of SW ].14th Avenue. The apylicants, t'he Condomin.ium
Homeowners Association, have requested permission to close the Naeve
Street access to the Fountains by continuing at� existiiig 42 inch tall
brick wall on the deveZopment°� Naeve Street £rontage across the
existing driveway. Bec�use �the prop�sal changes acces�ways ta an
existing development in a way that coulci af£ect off-site traffic, the
proposal is required to be reviewed as a major modification ta an
approved site plan through the Site Development R�view process.

The Planning Division contacted the B'ire District regarding whether
the Fire District w�uld be ame�.able to having the access closed to all
but emergency vehicles througli use of a gate with an emergency opetiing
device. The Fixe District commented �hat such gates often become
problems because of lack of maintenance and later confusion regarding
who has responsibility for maintaining the gate. Nevertheless, the
District will agree to a gate providing emergency access to the
Fountains from S.W. Naeve Street if the District h.as the opportuni.ty
to �review the gate plans prior to construction and if the Homeowner's
Association agrees to the long term maintenance of the ga�e.
The Sununerfield Civic Association Boa�d has conunented that they have
no obje.,tion to the proposal.
The Building Division had reviewed the propos�al and had offered tio
comments or object�.ons.
No other comments have been received.
B. ANALYSIS AND CONCLUSION

an approved site plan. Major modi€icatioYis to approved site pl.ans are
required to be reviewed subject to al]. standards and requirements of the
Site Development Review sec�ion of the Code. The only subsection of
Section ].8.120,�.80 (Site Development Iteview - Approval Standards) which
sta£f has found to apply to the present application is subsection
1$.120.180(A)(11) .
Acc�ss and Circulation:

Section 18.108.070(D) requires tt�at a development containing between
100 and 200 dwelling units be servr�d by a mini.mum of three access
driv�ways. The 109 unit Fountains developm�nt is served by four access
drivew�ays: 1) oii S.W. Na�ve Street; 2) un S.W. 309th Av�nu�; 3) at the
northern end of SW 114th Court; and 4) on the west side of SW 114th Court
approximately 200 feet south of the other� SW 114t1i Court driveway.
Glosing the SW Naeve Street driveway acr_ess wauld leave the development
served by three access driveways in coY�fuL�niaYice with this Cude ae�ess
requirement.

Although the residents apparently feel that the turn-araund stt•uctures do
not do enough to discourage through tca£fic and slow tiaffic movemeitts,
the Fire District finds that the turn-around structures along with the
narLOw stY•eets sl�w vehicles down, especiaYly large emergency vehicles.
The E'ire District has commented that emer.gensy vehi�cles currently have a
difficult tim� ntaneuvering through the site and that closing the Naeve
Street exit urill significantly increase the District's emesgency response
times to buildiags in the northe�rl portion of khe development �hat would .
normally be accessed from Naeve S�:reet. The nar�.hernmost buildings within
the development would be in exc�ss of 900 feet from the t�earest 3CC0SS
point from a public street i.f th� access worald be c2osed as proposed.
Because of the concerx�s raised by the Fire District, the Plann�ng Division
is unable to conclude that the pro�osal to to'tally close the S.W. Naeve
Street access to tra� Fountains wauld provide an adequate circulatian
pattern throughout the development designed to accommodate emergency
vehicles as required by the Site Development kevi�w approval criteria.
However, because it has been found that the proposed access closure would
not affect the devp2opment's conformanc� with Code requirements for number
of acc�ss points, and would aiat �ignifi�antly affeit off-site traffic, the
Planning Division finds that an altet-native �.o the proposed tsatal clasure
shuuld be considered. An alternative that would attaiYi .+.he tiomeowners
A�sociatian's primary objective of prohibitiY�g thsough access woulcl be to
revise the access closure plan to iticorporate some method of assuritig
emergenc>y vehicle acc�ss to ttie Fountaitis from S.W. Na�ve Street. Such a
propasal might include a gate with a breakaway loeking mechanism or an
electronically controlled emergeticy opening mechanism. The applicants
should contact Washington County Fire District ��1 ai�d the City of Ti�ard
Police Department regarding appr�peiate teehniques fur closing the access
to all but emergency traffic.

I object to appeal of the subject Plannfng Department decision. Zhey have
made a conclusion which fulfills our desire to restrict external tra£fic from .

If the Naeve Road entrance i� blocl:ed by a bricl: wall rather than a gate

Norther�n vortion of The Po�ntains is tots�lly isolated.

a majosity of the develoPment is not affected by restricted emergency access
to only the Northern port±on of th� development thfs is understandabl�. For-
tunately �he Planning Denartment has taken into account e�ch in3ividual's ,.
needs. I will count on them to continue to prot2ct our interest.
r�y recomnendation is to get a gate designed which meets the criteria as
approved in SDR 89-10� then hold uP on construction. At a time sufiEfeiently
early to allow nec�ssary aetion� seek extensions to tt►e SDR $9-10 aPproval,
Only when activity ror�h of Naeve Rd or inability to obtain gurther extensions
of SDR 89-10 authorization dictates should actual canstruction o�cur.

My name is Mel Tennent. I am chairman of the Board �f
Director5 of The Fountains Condominiums Association at Summerfi�ld.
This presentation refers to your Fa.Ze No. SDR 89--10, NPO #6,
and involves Sec. 18 .120v070 of the Community Development Coc�e.
As your records will indicate, our association consists of 110
condos occu ied b 150 men and women most of whom are re�ired.

We appxeciate y�ur taking �his time tonight to hear us and
to reconsider aur application far a modif.ication to the existing
site plan at The Fountains. A11 of the details of our area are
well-covered in your "Notice af Decision" signed on May 25, 1989
so I will not repeat any of that information. We all appreciate
having receivec� copies of. that decision.
Our parcel of land consists of 9 . 3 acres. Thi� is private
property awned by us and, as you kn.ow, we are responsible for all
of our awn costs of street main.tenance, landscaping, street lights
and standards, water and sewer costs, all a,t no expPnse to the
city. We are currently budgeting each anonth fram our monthly
membership dues for future costs of street repair and maintenance.
This entire project, as it was developed by the Hillman Cor-
poration in several phases, was inspected an� approved by the
city of Tigard' s various building departments, street engineering
departments, and other concerned agencies.
Most all of us chose Th� Fountains due to i�ks location, �

unique architectural design, unusual layout and beautiful landscaping. ;

Also it provide� an iiicreased degree of safety for all of us as �

compared to other similar areas. �

Your Commission is familiar with the projected building
programs slated for the property just north �f us across Naeve
Str�et. These projects as they are developed will subject our
area ta an extrsme increase in both motor vehicular and foot traffic

as raell as bicycles, motorcycles, skateboards and a possible
� hor.seback .rider.
�ur four entrances� have all been posted for almost two years
now with groper signs indicating that this is private property
for residents and guests only. We have a11 been watching as we
sustain an increase in the number a� ca:�s and large �rucks through
our area without �egard to the signs. This traffic is avoiding
the Durham-Pacific Highway interchange and using our street as a
through street. �
Th� basic proposal presented in our �pplication was appxoved
by your Commission subject to some modification noted from the
Washington County Fire District. It was their recommendation
that �,re install some form of emergency gate that would allow only
emergency vehicles onto our propert��,,,_

This proposal is not only beyond our fina•ncial budget but
does not accomplish wha�t I have previousl.y sta�ted as oixr goal�
At a cost of only $1,450 we can build a brick tence that conforms
to our existing fence and �liminates all of �I�e previc�usly x�o�ec�
forms of traffic from Na�ve Str�et. We are n�t anti-s}cate boards,
bicycles, or any other small vehicles, bu� we are involved in
' a possible liability situatian and, as owners af this property,

we f�el that we should be entitled to regulate caho enters trom
our access roads.
Mr. Birchall of f.he [�Tashington County Fire Distric� during
our interview on the subject indicated that in the event of an
emergency situation in our upper area (noted in �ellow on your
sketch which we provided) the permanent closure of the Napve
Street exit would isolate that area to only one access road for
his v�ehicles arzd if by some unusual circumstanc� and time frame
�here was a vehicul.ar accident a� th.at acces� road, his 911 vehicles
could nAt respond into that area without undue d�lay.
We do not feel this argument is valid compared to what we
as property owners are proposing for the benefit of the entire
asso�iation.

objection is th.e fact that in the event af fire alI of hi.s heavy
equipmerit could respond and establi.sh. fi.re lines alqng Naeve
Street and negotiate a 42" solid brick fence and �ith the.ir
600 feet of 5" hose and 600 feet of 3" hnse fight any fire si_tua-
tion a1i tk�.e way down into the middle of ou� property. Thsre
are two hydrants, ane at each end of our property on Naeve S�reet
not mor� than 200 feet from buildings in the "isolated" areas.
We have five other hydran�Ls throughout our eondos.
I can possibly understand the Fire Department's concern
about an evergency situation involving an illness or accident;
�, howev�r, the projection of there being a respons� d�lay due to
an accident at our I'ountain area certainly is not a valid reason

" As your decision points out our property does conform to
the Code inasmuch as we still pravide three access roads after
the closure of Naeve Street.
Sec. 18 .108.070, Paragraph P, County Development Code on
minimum req_uirements for driveways states th.at 50-100 units
require only two driveways; 100+ require three driveways. The
Fountains ccnsist of 110 units.
The Fir�e District' s main objection is that our upper area
has only one aacess raad af�er the clos�re of Naeve Street. We
have only 26 condos in the upper area that would be dependent on
this access road in the event of fire or injury. An additional 10

eondas in this upper area could be serviced from our lower main
streets and an additional 8 condos in our upper area have their
own access street off. 114th Ct. We feel we are well within th�
access code reguirements.

citizens, we do not wish to do anything to jeapardize anyon�' s
life or �roperty and we wish �p support your Planning Pr�grazn.
We ar� well-pleased with what you have accomplished; however, we
feel that as ovaners of The Fountains, we are desexving o£
further review by your Commission and respectfully request a
favorable decision to our a��ication.
