� After filing an appeal the Walker's le:gal representative �
' � inquired about the flexibility the City might have in meeti�g (:
the contested condition. Both �he Planning and Building F
Divisions agreed that iF a bond was posted for the driveway �;
which would guarantee its construc:tion� the City would allow
? one year for its construction from the time of occupancy �`
for the first house on one of the lots (see attached letter '
� from Paul Norr) . However, it was felt that this arrangement � '

�" was anly appropriate if the appeal was withdrawn. • _?

As indicated on the letter of acknowl�dgement signed by me
regarding the understanding xeached by ths City and Mr. Norr
for meeting condition # 3� such an agreement will be nullified
if the appeal to the Planning Commission is not withdrawn.
This is to avoid a situation of getting a eompromise by the
City and using that as leverage when appealing a condition
outright.

Once again, thank yau for your time in trying to arrange for
the minor partition of Richard and Shirley Walker "s property.
The purpose of this letter is to confirm my understanding caf
our conversations of this morning regarding Condition #3 of the
Director's approval of this partition dated June 29, 1987.
My understandinq is that Condition #3 will be satisfied if
the Walkers (or subsequent owners) provide a b�nd in an amount
sufficient to cover the cost of the driveway construction, to
guarantee that the easement driveway will be paved ( 1) at least
to the access point of the first house built, with paving to
occur within one year of occupancy of that first house, or ( 2)
that the entire driveway will be paved at the time both houses
are ready for occupancy, whichever occurs first.
It is also my understan�ling that this bend �i11 be requi.red
at the time buxlding permits are requested f or the f irst house to
be built on either parcel 1 or 2.
Please acknowledge below to indicate that this arrangement
will satisfy Condition #3 , and return a copy to me in the

I represent Richard and Shirley Walker, the applicants in
the above numbered cases .
The purpose of this letter is to appeal th� decision of th�
Director of Community Development dated June 29 , 1987 , wherein
the Director approved the applicants " requests, subject to
certain conditions.
Enclosed is the required appeal fee. ;,
The Walker "s qualify as parties to this case by virtue of
being the applicants, by being entitled to notice of the
Director "s Decision under CDC 18 .32 . 120, and by being adversely
affected and aggrieved by certain of the conditions of approval
as fixrther set forth below.
The applicants appreciate that their general reCUest has
been agproved, hawever they do object to certain of the
conditions imposed by the Director, in particular, c�nditions
number 1 , 3, 4 and 6 .

�ondition Na. 1
The applicants object to the requirement of construction of
the propo�ed driveway of approximately 400 feet prior to the
recording of the par•tition with Washington County. There is no
factual basis or need for this requirement.
The applicants request that the actual construction of the -
driveway not be required until construction of a residence on
either of the newly created lots serviced by this new driveway.
Condition No. 3
The applicants object to the requirement that the driveway
serving the 2 new lots be paved with asphalt for a length of
approximately 400 feet. The applicants propose that the driveway
be overlaid with a heavy rock all weather surface, and requested
a variance to CDC 18. 108 tc� allow the rock rather than asphalt
surface.
The surface proposed by the applicants to serve 2 lots will
provide a sa�f e and efficient access and egress on the site. All
entry and exit can be in a forward motion. The appiicants will ,
construct the hammerhead turnaround as required by the fire !
department. j
A rock surface will not cause or increase any hazardous '',
traffic and. will provide adequate access for emergency vehicles. '�,
The Director�s Decision does not provide any factual basis I
for, or di�cussion of, the requirement of asphalt, other than to
state "a rock or gravel overlay is unacceptable" .
In discussions with the planning staff, I was told that the I
asphalt surface was desirable in case any future development ,
occurred on the prc�perty adjacent to this site. The applicants �
believe that requiring them to pave their drivewa� at this time
just in case some as yet unknown development occurs on adjacent
Froperty is unnPCessary and un�eas�nable.
If some potential developm�nt is ever proposed for the
adjacent propert�y at some time in the future, then tha� would be
th� apgrapriate �i�ne to design and establish a paver3 rcadway. I

Th� applicants object to the open ended nature of Condition j,
No. 4 . The City staff has interpreted this condition to require

street waivers for all present and future streets anywhere in the
vicinity, including Bull Mountain Road, Gaarde Road, and some as
yet unknawn connector between Gaarde and Bu11 Mountain roads.
The applicants understand the nature of the waiver for S.W.
125th, i�nd any other potential streets abutting their property,
but object to an open ended waiver for all. streets generally in
the vicini�y.
Condition No. 6
The applicants do not object to Condition No. 6 as written,
provided the joint use maintenance agreement required applies
only to the newly created approximately 40U foot driveway to be
located on this site and shared by the 2 new lots. This is the
inter.pretation given by the City engineering st3ff.
Unfortunately, the City planning staff �.nterpreted this
Condition to r�quire a new joint use maintenance agreement for
the entire existing approximately 1600 foot S.W. T2Sth. The
applicants do object to such a requirement.
Conclusion '
The applicants request that Conditions 1, 3, 4 and 6 of the
Director's Decision be amended to satisfy the objections raised
by this letter of appeal .
