1. President Tepedino called meeting to order at 8:10 P.M.
2. ROLL CALL: Tepedino, Speaker, Moen, Kolleas, Owens, Bonn, Christen (arriving 8:15)
Herron and Helmer excused.
STAFF: Associate Planner, Liz Newton; Planning Director, Frank Currie;
Attorney, Ken Elliott; Support Staff, Diane Jelderks.
3. The MINUTES of the December 1, 1981; meeting were considered. Commissioner Moen
stated, on page two, under. the Hearings Officer motion, the following items should
be reworded per discussion with Commissioners:
Item 1. Office to have a term of one year. (six month review then annually)
Item 2. Planning Commission to be able to review Office and Office Holder annually.
Also, because of the concern of Planning Commission regarding "0" foot floodway, the
motion should read: To recommend to City Council for a "0" foot floodway for Flood
Insurance purposes only and the present Ordinances regarding 100 year Floodplain and
Sensitive lands remains in effect.
SPEAKER MOVED adoption of the minutes submitted as corrected, seconded by BONN.
Motion carried unanimously.
4. COMMUNICATION: Chairman Te edino received communication from an organization known

as Oregon Friends in Real Estate, requesting input from the City of Tigard. Gave to
Staff to handle as appropriate.
5. The President opened the PUBLIC HEARING by reading the usual statement of authority
for and procedure to be followed in the meeting.
5.1A Comprehensive Plan Revision CPR 14-81 and Conditiona Use CU 15-81, Dr. Alva L.
Roberts - NPO # 7.
A request by Dr. Alva Roberts for a Comprehensive Plan Revision from A-12
(Multi-Family Residential) to CP (Commercial-Professional) and a request for
a Conditional Use for Small Animal Veterinary Hospital on 1.05 acres, located
at 12520 S.W. Scholls Ferry Rd. (WCTM 1S1 33AD lot 2500)
(a) Newton read memorandum regarding CPR 14-81.
(b) APPLICANTS PRESENTATION: None Given; felt everything was covered in Staff Report.
(c) PUBLIC TESTIMONY: no one appeared to speak
(d) COMMISSION DISCUSSION AND ACTION:
Owen commented Policy # 18 from NPO # 7 was cited but doesn't have much bearing
on issue because it does not involve Commercial Development West of the Cunningham
property. This application would serve as a nice buffer between Retail type
businesses and Multi-family dwellings, otherwise, property could become isolated
and awkward to deal with.

Owen MOVED for adoption of Comprehensive Plan Revision CPR 14-81 based on
Staff Findings and Recommendations from November 10, 1981 meeting and
Conditions from this meeting, seconded by Speaker.
Speaker questioned the distance existing buildings were from residential
property, Dr. Roberts replied approximately 150 feet. Moen questioned if
barn type building was on this property; Dr. Roberts stated "eye sore" was
not on his property. Tepedino questioned 30 foot Right-of- Way dedication
for both lot 2400 and 2500; Dr Roberts explained that the present roadway
will measure out almost exactly 30 feet and the lot is off center from
surroundings.
MOTION was adopted unanimously.
5.18 CONDITIONAL USE CU 15-81
(a) Newton read Staff Report for CU 15-81.
(b) APPLICANTS PRESENTATION: Waived
(c) PUBLIC TESTIMONY: No one appeared to speak
(d) COMMISSION DISCUSSION AND ACTION:
Owen inquired regarding condition # four requiring connecting to sewer service;
Currie clarified when sewer was within. 300 feet of site, connection would be
required.
Bonn MOVED for approval of CU 15-81 per Findings of Fact and Staff Recommendations.
Speaker added as a finding the Planning Commission does not find the site to be
inappropriate for the use requested. Motion modified. Seconded by. Wien':
Motion carried unanimously.
5.2 CONDITIONAL USE CU 19-81, Withdrawn
5.3 CONDITIONAL USE CU 17-81, John Vander Werf
A request to open a small pet shop on Main Street in Tigard (WCTM 2S1 2AB lot 4600) .
(a) Newton read Staff Report for CU 17-81.
(b) APPLICANTS PRESENTATION: Applicant stated Staff Report was complete and had
no presentation.
(c) PUBLIC TESTIMONY:
Margaret McDaid, 9225 S.W. Burnham, wanted to know if they planned on putting
in dog runs or kennels outside; applicant stated there would be nothing outside.
Another concern was drainage problem in parking area; Tepedi,no requested Staff
to handle drainage problem with Site Design Review.

(d) COMMISSION DISCUSSION AND ACTION:
Speaker MOVED approval of CU 17-81 based on Staff Findings and Recommendations
with the addition that the Planning Commission does not find the site to be
yinappropriate for the use requested, seconded by Bonn, carried unanimously.
5.4 CONDITONAL USE CU 18-81, ,INVEST-A-VENTURE, INC. NPO # 2
A request to allow one indoor, 18 hole minature golf course and several
electronic games for small arcade located at 8820 S.W. Center Street.

(b) APPLICANTS PRESENTATION:'
Merrill Haddon, 13545 S.W. Village Glenn, Tigard. Mr. Haddon emphasized that
this was a Family Recreation Center, not an amusement park, geared toward the
adult community. Addressed condition # 1 regarding sidewalk requirement and the
effects it would have on the parking lot area. Submitted a new drawing showing
parking configuration. Discussion followed between Commission, Staff and
applicant as how to best proceed with this application.
(c) PUBLIC TESTIMONY:
OPPONENT: Fred A.Anderson, Attorney 8865 S.W. Center, also representing
Tigard Plaza, Jan Bissett (Owner Dental Building next to his and shares
19 parking spaces) and Tigard Professional Center. Mr. Anderson suggested
applicant withdraw his application because of existing traffic and parking
problems on Center Street between Greenburg. Roadand the site and along, 87th
Avenue. He pointed out lack of parking for existing business, such as the
theater and bike shop, which were located near the proposed site. He
suggested possibly another retail type business would be better suited to
the proposed site.
(d) COMMISSION DISCUSSION AND ACTION:
Lenghty discussion followed between Commissioners, Staff and Applicant regarding
Sidewalk and Parking problem. Recognizing the fact that any business which is
allowed in a C3 Zone without a Conditional Use permit would not have to meet
the sidewalk improvements,"they would only need a Business License to begin
operation. Further discussion as how to proceed with this application in light
of new information.
Moen made a MOTION for continuance of this application, seconded by Speaker.
Motion carried unanimously for continuance.
Further discussion then continued as to how to handle application and problems
involved.

5.5 Preliminary Plan Review and Sensitive Lands M 2-81 Main :;Street Development.

A request by JB Bishop for a Sensitive Lands Permits which will allow
approved development of the east corner of the site and for a Preliminary
Plan Review between S.W. Main and S.W. Ash. Ave. (WOTM 2S1 2AC, lot 201,
1200, 1300, 1400, 1500, 1600, 2200 and 2301 Burnham Tract.)
(a) Currie summarized the Staff Report stating the two issues to be addressed by
the Planning Commission are the Traffic Circulation and accesses;and Sensitive
lands.
Chairman Tepedino requested the record show that section 18.56.021 (b),
4,8.57.040 and 18.57:070. were submitted ip the Staff Report.
Discussion between Commissioners and Staff as to what was being presented and if
it was being properly submitted.
(b) APPLICANTS PRESENTATION:
JB Bishop, 10505 S.W. Barbur Blvd. Suite 303, Portland, Oregon
Mr. Bishop summarized what has taken place since December 16, 1978, when he
first began this project. He explained the two issues before the Planning
Commission needing their consideration were Traffic Circulation and Sensitive
Lands. He stated he is now the sole owner of Main Street Land Corporation
and now has new Architects for his project. Mr. Bishop then introduced Larry
Abell, Architect, SRG Partnership to give the presentation.
Mr. Abell introduced the principals of SRG Partnership, Mr. Jon Schleuning;
and Gary Gorton, Consultant, McKenzie Engineering; Wayne Kittleson and Bob
Allen with CH2M-Hill, who were all present and available to answer questions
regarding Sensitive lands and Traffic Circulation.
Mr Abell supported the Staff Recommendations. He referred- to an aerial map,
showing the boundaries of the project,:+and with the use of another diagram,
showed how they proposed to access traffic. He stated they needed approval
for these accesses so they can begin designing the project. He placed an
overlay on the Aerial map showing the impact the Greenway and Sensitive
Lands would have on the sitehowever he agreed with the Staff Report to have
the Sensitive Lands Permit continued.
Discussion followed between Commissioners, Staff and Applicant as to what was
being specifically asked for or.needed to process this application.
Abell clarified the accesses on Main Street, Pacific Highway, Ash Street and
the access to cross the site. He stated that all of these accesses had been
reviewed by the Applicant, Staff, Oregon Department of Transportation, City's
Traffic Consultant and Applicants Traffic Consultant with the conclusion that
these accesses would be the most viable.
Mr. Kittleson with CH2M-Hill Traffic Engineer addressed other alternatives that
were suggested and the elements considered in determining the feasibility of
each alternative.

(c) PUBLIC TESTIMONY
Pat Hutchison, 8940 S.W. Edgewood, Chairman, Npp # 1. She read letters dated
April 15, 1981 and December 2, 1981 supporting Main Street Development project.
She requested the Commission give conceptual approval of the proposed traffic
plan as it relates to Main Street and Pacific Highway.
John McShange, resident of Tigard, expressed concern for the safety of the
Community. Wanted to know if the members of the Commission had a complete
detailed professional traffic study done by an independent, reputable
consultanting engineering firm? (Staff acknowledge they had) Wanted to know
if they had read the study and approved or accepted it? He was.lconcerned if
we were inviting the same type of traffic congestion problem into downtown
Tigard that are now being experienced in Beaverton.
JB Bishop explained, three years ago when this project was started, there was
a meeting between JB Bishop and his original partner, Planning Director, Public
Works Director and the State Transporation Department. During that meeting
they addressed concerns and specific directions on how the 'City wanted them to
proceed. They were instructed in writing by the City of Tigard to hire a
Traffic Consultant. JB submitted names of three companies and the City choose
CH2M-Hill. CH2M-Hill submitted to the Planning Commission copies of every
study from Spring of 1980 through March 1981. (Total of 7 studies)
(d) COMMISSION DISCUSSION AND ACTION
Speaker questioned possibility of using one of the existing lights on Pacific
Highway rather than installing a new light. Mr. Kittleson, Consultant, CH2M-Hill
responded with examples of what would happen, at alternative access and how new
light is the lesser of two evils.

Bob Allan, Consultant, CH2M-Hill, explained how his Company had done the Traffic
Circulation Study, investigating all possible alternativesand stated. this proposal
is the best workable solution. He offered to give a technical presentation if
necessary; however, he felt the Planning Commission had substantial information
for approving the traffic accesses.
Moen had some questions regarding proper handling of this application and realized
the applicant needed some input. He had some real concerns regarding the
Sensitive Lands issue. He had gotten the impression from previous meetings 'that
the applicant would be filling in some land on one side and taking land on the
otherside. He did not like the idea of losing park land. He had no problem with
traffic circulation but did not want to get locked into a specific layout.
Discussion between Commissioner and Staff as to what conceptual approval would
mean and the effect it would have on this project. Also discussed continuance
of Sensitive Lands.
Speaker MOVED for conceptual approval of traffic connections indicated on
sheet entitled "Proposed Conditions", dated November 20, 1981. Number one
and two as shown, (Main Street and signal at Pacific Highway) -
Avenue,at a point to be determined; and a public connector access between Main
Street through the project to Ash Avenue. Seconded by Owen.

Further discussion between Commissioners and Staff regarding handling of
issues forthcoming from this project.
Motion passed six to one, Moen voting no.

Motion carried unanimously.
6, NEW BUSINESS:
Tepedino MOVED to refer the Urban Renewal Agency recommendations to the City Council,
seconded by Christen;.~ Motion carried unanimously.
7. OTHER BUSINESS:
Chairman Tepedino informed Commission he had a meeting with Corps of Engineers on
the Floodplain issue. During their meeting they discovered an area the Planning
Commission had approved for development that appeared to be in the 100 year floodplain.
Staff was requested to investigate and report back to the Commission.
Tepedino submitted to Staff a card from William Akre, Corp of Engineers Flood Plain
management service. stating if the City contacted them they would perform studies
and give recommendations.

November 10, 1981, at the Planning Commission meeting, the Commission
voted unanimously to continue a request by Dr. Alva Roberts for a
Comprehensive Plan Revision from A-12 Multi-Family to CP Commercial
Professional. The Commission directed the applicant and Staff to
work out conditions appropriate for the approval of the Comprehensive
Plan Revision.
Staff recommends that the Planning Commission consider the following
conditions if this Comprehensive Plan Revision is approved.
1. A non remonstance agreement shall be signed for the future
improvement of S.W. Scholls Ferry Road and for the improvement
of a future street that will serve the site.
2. A dedication of Right of Way shall be made on Scholls Ferry
Road as required by the Oregon Department of Transportation.
A dedication shall also be made for Tax lots 2400 and 2500
for the future extension of Sorrento Road. The R.O.W.
dedication for lots 2400 and 2500 shall be 30 ' from the
extension of the center line of the Sorrento Road R.O.W. .
3. The septic system shall be inspected by the Washington County
Department of Sanitation prior to issuance of an Occupancy
Permit. The applicant shall request and receive annual
inspections of the septic system by the Washington County
Department of Sanitation. The applicant shall bear the cost
of these annual inspections.
4 . The site shall be connected to public sewer when service is
within 300 ' .
5. The applicant shall apply for Site Design Review for
landscaping, parking and site access prior to the isssuance of Occupancy
Permit.
6 . The applicant shall apply for a Sign Permit and a City of

FINDINGS OF FACT:
1. The Tigard Municipal Code allows Veterinary Hospitals as a Conditional Use
in a CP Commercial Professional Zone. (Reference Code Section 18.40.011.)
2. The Comprehensive Plan Revision request to CP will have to be approved to
allow the Veterinary Clinic to locate on the site.
3. The applicant received Conditional Use approval for the Animal Hospital on
the site to the North on April 17, 1979.
4. Applicable policies from the NPO # 7 Plan are as follows:
Policy 17. Development shall coincide with the provision of Public streets,
water and sewerage facilities. These facilities shall be (a)
capable of adequately serving all intervening properties as well
as the proposed development and (b) designed to meet City or
County standards.

CONCLUSIONARY FINDINGS:
1. The applicants request for a Comprehensive Plan Revision from A-12 to CP
will have to be approved prior to approval of this Conditional Use request.
A Veterinary Hospital is not allowed in an A-12 Zone (Reference Code Section
18.24 .)
2. The Washington County Health Department has agreed to make annual inspections
to the septic system. The applicant will have to request each inspection
and pay a $50.00 inspection fee. Provisions for the future connection to
sewer are as required under approval of Comprehensive Plan Revision CPR 14-81.
3. Access to the site shall be improved as required under Site Design Review.
STAFF RECOMMENDATION:
Staff recommends approval of CU 15-81 if the Planning Commission approves
CPR 14-81 based on Findings as follows:

PREVIOUS ACTION: On June 22, 1981 the Tigard City Council approved a Comprehensive
Plan Revision on this 16.6 acre site to the C-3MPD Main Street
Commerical Planned Development Designation.
FINDINGS OF FACT:
1. The site is designated Main Street Commercial Planned Development on the
City of. Tigard Comprehensive Plan. The site is zoned C-3M-PD
2. At the May 5, 1981 City of Tigard Planning Commission meeting, the applicant
was requested to review, with staff, four areas of concern prior to a
Preliminary Plan Review Hearing before the Planning Commission. The items
of concern were traffic circulation, density of development, land ownership
and sensitive lands.
3. Section 18.56.021(b) of the Tigard Municipal Code reads:
01(b) Approval in principle of the Preliminary Development Plan and
report shall be limited to the preliminary acceptability of the land
uses proposed and their inter-relationships, and shall not be construed
to endorse precise location of uses nor engineering feasibility. The
Planning Commission may require the development of other information
than that specified in Section 18.56.030 (General Plan Review) to be
submitted with the general development plan and report. However, the
applicant should be as specific as possible concerning such issues as

floodplain use, traffic circulation patterns, and density
calculations, etc. The more accurate the proposal, the easier
it will be for the Planning Commission to render a decision.
In many cases, the preliminary and general development plan
review process can be accomplished at one hearing."
4. The applicant, Staff, Oregon Department of Transportation, the City's
Traffic Consultant and the applicants Traffic Consulatant have reviewed
traffic circulation and site access alternatives in detail.
5. Staff and the applicant have reviewed the Sensitive Lands application as
it relates to floodway considerations. A portion of the applicants
property lies within the 100 year floodplain. The applicant intends to
fill on his property and excavate on adjoining property to compensate.
6. The Sensitive Lands Section of the Tigard Municipal Code address uses
and activities allowed in the floodplain as follows:
"18.57.040 Uses and activities allowed within a Special Use Permit
granted by the Planning Commission and based on the standards set forth
in Section 16.57.050:
"(1) Within drainageways/Green,zays and steeply sloping lands:
(A) Fill, grading, excavating;
(B) Structures;
(C) Off-street parking and maneuvering areas, accessways and
service drives located on the ground surface;
(D) Roadways, bridges or utility facilities;
(E) Removing any live vegetation other than poison oak, tansy
ragwort, blackberry or any other noixious vegetation.
(2) Within the floodplain/greenways only:
(A) Any temporary structure which by its nature cannot be
readily removed from the floodplain area during periods
of Flooding, and which would impede or interfere with the
flow of floodwaters within the district."
(B) Any change in the topography or terrain which would change
the flow of waters during flooding periods, or which would
increase the flood hazard or alter the direction or velocity
of the floodwater flow.
7. Section 18.57.070 of the Tigard Municipal Code dictates standards for
approval or denial of a Special Use Permit in a floodplain as follows:
"18.57.0{70 Standards. (a) Application for a Special Use Permit
in floodplain areas shall be .ranted or denied in accordance with
the following standards:
(1) No structure, fill, excavation, storage or other use shall be permitted
which alone or in combination with existing or proposed uses would
reduce the capacity of the floodplain area or raise either the flood
surface ele*ation or flow rates, or adversely affect flow- direction
on upstream or downstream properties, or create a present or foreseeable
hazard to public health, safety and general welfare.

(2) The applicant must obtain the permit required by the State of
Oregon under ORS Chapter 541 for removal of filling of waterways, or
demonstrate that the provision of this statute do not apply."
8. There is no maximum lot coverage requirement in the C-3M Zone (Reference
Code Section 18.30.030(3)).
9. The applicants has ownership to all of the land being considered under
this application.
CONCLUSIONS:
1. The site is zoned C-3M in conformance with the City of Tigard Comprehensive
Plan and carries a PD designation.
2. Traffic circulation and access to the site from 99W and Main Street as shown
on the "Proposed Conditions Map" dated November 21, 1981 has been reviewed
by the applicant, Staff, the Oregon Department of Transportation and the
Traffic Consultants. A consensus has been reached that this alternative is
the best workable solution available for traffic circulation and site access.
3. Staff and the applicant have reviewed access across the site from Main Street
to Ash as it relates to traffic circulation to the degree that both parties
feel a solution can be reached.
4. The applicant has submitted a Sensitive Lands Permit to fill within the
floodplain on his property and excavate on the adjoining property. However,
the applicant has not submitted complete plans for development on the
area in accordance with Section 18.57.060, but will be required to do so
at the General Plan Review. The Sensitive lands section of the City Code
allows limited development in floodplain areas. (Reference Code 18.57.040.)
STAFF RECOMMENDATION:
Staff recommends conceptual approval of the proposed traffic plan as it relates
to Main Street, 99W and site access as submitted.
Staff further recommends the following conditions be attached to approval of the
Traffic Circulation Plan:
1. Traffic volume estimates and distribution remain substanially as
presented in the CH 2M Hill Traffic Report dated February 10, 1981.

across the site from Main Street to Ash Avenue prior to General Plan Review.
Staff recommends continuance of M 2-81 Sensitive Lands to the General Plan Review
