Vice President Speaker OPENED the meeting at 7:35 in the absence
of President Tepedino.
ROLL CALL:
Present: Bonn, Christen, Helmer, Herron, Kolleas, Moen, Owens,

The MINUTES of the September 8 meeting were considered. There
were no changes or corrections offered, and they were accordingly
declared approved as submitted.
There were no COMMUNICATIONS to the Planning Commission.
The Vice President then opened the PUBLIC HEARING by reading
the usual statement of authority for and procedures to be followed
in the meeting.
5.1 "0" FOOT FLOODWAY ORDINANCE DISCUSSION.
Howard reported that neither Frank Currie, Public Works Director,
nor President Tepedino, who has a deep interest in the subject
was present, and therefore it would be considered at the next meeting
when presumably both men would be present. No objection to this
procedure was offered by Commissioners or the audience.
5.2 CONDITIONAL USE CU ?.2-t81 - WEBFOOT DELI NPO #3
A request by Andrea Asbell for a Conditional Use for a
restaurant in C-3PD zone.
Howard read the STAFF REPORT and RECOMMENDATIONS.
The APPLICANT'S PRESENTATION was made by Andrea Asbell, who
briefly outlined her plans for the restaurant/delicatessen/wine shop
for which she is applying for a conditional use.
There was no PUBLIC TESTIMONY.
COMMISSION DISCUSSION AND ACTION: There appeared to be no problems
among the Commissioners with respect to the request. Moen thereupon
MOVED approval of Conditional Use CU 12-81, based on Staff Findings,
Conclusion and Recommendation. The motion was seconded by Bonn and
carried unanimously.

5.3 CONDITIONAL USE CU 13-81 - RON WICK/R.W. MURSELL NPO #2
Request by Ron Wicks and R.W. Mursell for a Conditional
Use for a duplex in R-7 zone.
Howard read thy STAFF REPORT and RECOMMENDATIONS.
The APPLICANT'S PRESENTATION was made by R.W. Mursell, Land
Surveyor, Newburg. He called attention to the in-fill this project
would accomplish, and the provision of somewhat more "affordable
housing" that the duplex construction would provide over single family
detached houses. He stated all utilities are already in and provided
to the site.
There was no PUBLIC TESTIMONY offered.
CROSS-EXAMINATION AND REBUTTAL: Bonn noted the property is quite
deep, and wondered if provision for a street to provide additional
access would be in order. Howard enumerated the development that will
take place on nearby parcels, with accompanying street improvements
to handle the increased traffic. He predicted we would see additional
similar requests from owners of other large lots in the area.
COMMISSION DISCUSSION AND ACTION: Herron MOVED approval of
Conditional Use CU 13-81, based on the Staff Findings, Conclusions,
and Recommendations. Kolleas seconded the motion. There was further
discussion of the streets situation in the area. Howard expressed the
conviction it would be pretty well taken care of as development takes
place, but agreed the situation was less than desirable, but under the
circumstances unavoidable. He recounted the very real obstacles to
using the condemnation procedure to get streets here. It was charac-
terized as a problem arising from Tigard's transition from suburban to
urban status. The motion then n passed unanimously.
5.4 DISCUSSION ON TIGARD HIGH SCHOOL AUDITORIUM.
Larry Hibbard of the Tigard School District introduced Charles
Selig, Architect for the High School Auditorium addition. Together they
put on a slide presentation (to be repeated elsewhere in the community
in the future) on what is planned for the new High School Auditorium.
They explained the factors considered in developing the plan. They
illustrated how the plan was modified to keep within the setbacks
required. This was offered to the Commission merely as information on
an important public project, since no matters requiring a hearing by
the Commission are included in the plans. There was a little discussion
of parking and improvement of traffic on Durham Road. Howard reported
certain concerns expressed would be considered in the site design
review process.

OTHER BUSINESS: The only other business to be considered was the
draft of Administrative Procedures submitted by the City Attorney for
discussion, since the audience had left, the public hearing portion of
the meeting was ADJOURNED, and after a brief recess a study session on
the draft was held.
STUDY SESSION ON ADMINISTRATIVE PROCEDURES: Numerous questions
were raised, some blanks were filled and errors noted for correction
by the attorney„ Clarifications of intent and explanations of how the
system would operate were given by Howard. It was stated the draft
would be refined and resubmitted to the Commission at a later date.

SUBJECT: "0" foot floodway
The proof copy of the Flood Insurance Study has been reviewed
by Staff and contains all of the necessary correct information
to make Tigard eligible for the regular flood insurance program.
The next step is for the City to adopt a Floodway Ordinance
which meets the requirements of the Federal Emergency Management
Agency. The Public Works Director and Planning Staff will
recommend to the Council that the City adopt a "0" Foot Floodway.
Frank Currie, Public Works Director, will make a presentation
that should explain the effects of the "0" Foot -Floodway Ordinance
on development in the Floodplain.
