several concerns of th� Council resulting i.n the remand to the Commis-
sion. He emphas�zed tihe return to the Commis�sion of each separate
devel.opment as a PD far' the full heaxing process. He stated one parcel.
of 10 acres is requesting only A-12 instead of 1#-20 pr�viously. Because
of the tapography he figured the eventual density wauld eome out about
8 to 1Q units per acre.

agent capacity. He s�ated �hat aince the previque bearing in March

Iie revieWed the Graphic Supplement submitted. He. too, stated t'�e
evsntual denaity wouZd be batrveen 8 e�nd 10 units per acre, as compared
wi�h lt� for SuiamerField to the sou�h. The reaeon for �he considerably
h�gher zoning asked for i� that wlaea� the PD formula and the sensitive
lands restrictione are �rorked out, the reaul�ing density is �auch 7Les�
, than is at�.lowad by the nominal, zoning. He cited ae an exampl,e of �h�.s
proc�ss the Iiusvar/Ericksoa�/Peterson parcels. for which &-20 zoning
is requeated. On these parcels the actual resuZti�g denaity is only

resource to Ti,�ard; that increased density and accocnpangi.n� taffic
would be "3.ntolerable", and that the "ia�tegrity and liveability of the
whole neighborlxood would be affacted�� adversely. Speaking for the
eigners of the petition, she �aid they don�t 13.ke �he tdea of apartraents
inva@ing in what is eBeen�ially a r�sidential neighboxhood. They Rant
to protect the trees� which �he characterized as a protection �o Ti�e�rd.
She reported that 1n ane area the people signedi becaase they '�fear
ereeping condominiums could de��ray �heir are�.et The Andersons arzd
others on 109ttx tare concerned becau�e of the steep street and th�
hazards to traff3c i,t presents. The Summer�ield people signed beQausa
of their concern about 109�h, because it is the route to the freeway--
it is the easie�t way to Portland.

I have talked with the owner and rnanager of this businesw, prior
to their opening. The owner has had prior experience in the '
operation of arcadss of this nature; he plans to run this business l
under specific rules of conduct to attract families, not allowing
a rowdy environment,
As of this date th�re have been no disturbarice calls to this
business. There was a theft of empty beer bottles from a tavern �
in the vicinity by Lwo former juvenile patrons of the arcade, and i
one careless driving citatian issued to a person leaving the park-
ing lot at Center Street.
At this point in time, I see no reason for not allowing this business
to cont-inue.

Section 18.56.170 of �he zaning ordinance makes provisions for• extens�ions
of time of �he delay is justifiable. We believe that the deTay is just�ifiable
for a number o� re�sons. �'irst of all Century 2� Homes just pruchased the � I
property and has not had enough time to da the required surveying, enginer�ring
and ptatting necessary to start construction on the site. Secondly the econom�i�� lil
canditions at the present time have slowed clown the home bui'lding industry
which ha� cfelayed numerous projects. But, the biggest obstacle to deve{opmsnt ��'
of this site t�as been the sewer line capacity. A sanitary sewer is. availiable ',
to the site,. but the trunk lin� is undersized from S.W. 122nd Avenue, east �o '
the �anno Crsek interceptor line. �'he Unified Sewerage Agen�y in the last
cauple of weeks has just approved the funding for the upsizin.g of this sewE�r
line and should �be under construction this swmmer.

PREVIOUS ACTION:Parcel was annexed to the City by Boundary
Commission final order #1518 and '1'igard
Ordinance 80-20 approved on. February 25, 1980.
The owners of the parcel approached the staff relative to
development approximately one year ago. The Park Board was
asked to comment on the proposed "tradeoff" of higher density
in exchange for tlze dedication of approximately four acres
for Summerlake Park. The Sununerlake Park plan shows that
tennis courts are proposed on a portion of this property.
The plan also envisions the dedication of approximately
three acres of this parcel which is with the floodplain.
The Park Board adopted a policy which stated that in cases
such as this they would support increased density in
exchange for dedicated park areas.
When the Winterlake development ta the South
was approvecl, S.W. 130th Avenue was designed to continue
through this parcel to the Grabhorn piece to the North, thus
completing 130th to Scholls Ferry Fto�d.
This particular parc;el of 11 acres amounts
to about 4 acres when the floodplain is donated, the park

area is donated and 130th Avenue is extended. It is tlze
opinion of Staff that these circumstances necessitate an
increase in density on the "buildable" portion remaining.
The City Council has supported this "trade-oft" policy
in the past and is familiar with the Park Board's decision
on this particular parcel.
I. FINDINGS OF FACT:
1. NPO #7 policies are appropriate as follows :
Policy 4, 5, 9,10,11,12,13 and 14. See
attached Fxhibit "A" NPO #7 Plan.
2 . A full line of urban services are available
to this site .
3 . The adopted Summerlake Park (Regional) Pl.an
has been adopted by the Park Board, Planning
Commission and City Council . A portion of

The followi:ng is a summary statement regarding the effect that the installation i
of the underground sewer pipe will have on the flood plain area: ;
The proposed work consists of constructing a major undergound sewer
pipeline. No dikes, dams, permanent fills, or permanent excavations
are required or allowed as a part o� the proposed work. Diversions
or rechanneliny of the stream will not be allowed. The physical
character of the fload plain wi'11 not be altered. Areas disturbed
ay the constructic�n will beshaped, graded, and restored as near as
practi:cable to their original ground elevations and contours. Filling
or wasti:ng of excess material within the flood plain wi11 not be
allQwed. The proposed work wi'll not hydraulically affect the flood
plain capacity. Si'nce fi:lling or wasting of excess material wi:11 not
be permitted within the flood plain, no land use no�t already permitted
wi'll be established.
Contractors are required to take whatever precautions are necessary
to prevent damage to or hazard to any structures adjacent to the
construction areas, and must aiso comply with OSHA requirements
pertaining to hazards of health, safety, and welfare. No immediate
or long-range hazards as a result o� the project wi11 affect adjacent
properties. Since no filling will be permi'tt�d within the flood plain,
no impacts or public safety problem� asso�iated w�ith subsequent high
water in the project area wi11 occur as a result of the proposed work.
Duri:ng construction in all traffi'c areas, the contractors are required
to comply wi:th the State of Oreg�on and Washi'ngtan County tra�fic controi
and safety requirements. During construction in nantraffi'c areas, the
contractors are requi'red to noti'fy� property owners 48 hours in advance
of construction on their property.
Clearing ahead of the trenchirig operations will be limited so that the
entire .9-mile lang project area will not b�e cleared w:hen the project
begins and 6e left unrestored unti7 it is comp�eted.
Backfilling, cleanup, replanti'ng, and reseeding beh,ind the pi.pe laying
will also be contro1led twithin specified li'mi�s. These limitations on
cl eari'ng and restorati on wi'l l mi�nimi ze tfi,e l ength of di sturbed area
and the amount of time which an area i:s impacted.
Considerable emphasis has been given to redeedi'ng and replanting in an
effort to reestablish essential p1ant growth necessary for wildTife
use and to minimize erosion. Areas along the project have been classi:,
fied as residenti'al pasture land, culti'vated fields, and creek banks.

Topsoil must be removed and replaced throughout the enti�re proje.ct.
All areas distur6ed 6y the contractor, whe�her presently seeded or
not, will be reseeded upon completion of the b.ackfi'lling operation
to provide for grass cover to prevent erosi'on. 7he preponderance
of land along the project route is Tigard School District property,
residenti'al , pasture land, or� cultivated fields�. Pasture lands
and cultivated fields will be reseeded and will not change from
their original use as a result of thi's pro�ect. No si;c�nificant

June 29, �.981 supported a proposal to uphold
Policy 2� o� the NPO #1 which called for the
extensi�on of �1sh Avenue across Fanno Creek.

Policy 28 has been upheld with modification
pending. In an effort to give Mr. Davis some
concrete answers we should now consider the
importance of extending Ash Avenue to
Commercial Street. Mr. Davis is understandably
frustrated, but since my first encounter with
him, perhaps two years ago, I have tried to
explain the issues. If Ash Aven.ue is extended
it must go across Mr. Davis ' property to the
railroad behind the Prairie Market to
Commercial Street.
This is a "long-range planning" issue and when
these ,issues ar�.se it is ex�remely difficult
for Staff to present �'indings af fact to support
a 11this looks logical" stanc� . How�v�r, the
City is conaidezing the formation of an Urban
Renewal/Revitalizat�.on 2�ging/Plan. One of the
major segments o� this will be a Transpnrtation
�l�n W�,th a traffic report. Staff anticipates
th�t th,is plan �voul.d endars� this proposed
change in the Comprehensive �lan. This "feeling"
�s strengthened by the Caunc,ils ' action on
,7une 29th xelated to �1sh Avenue. The question

way would escalate substantially.

SUBJECT: PARK 217 TRAMMELL CROW NPO #5 i
Western Racquet Clubs, Inc. came through this department on
May 31, 1978 for Zone Change 36-77 . This request was for a
Planned Development (PD) designation for the two zones included
in this parcel - C-3 General Commercial and M-3 Light Industrial.
This project went to the Ci"ty Council as Ordinance 78-77 on
November 27, 1978 and was approved. (Ref, file ZC PD 3-80 Park 217
Business Center.) No development took place on site and the
property changed hands .
In December of 1979, Trammell Crow, Mr. Bruce Hosford, requested
a one year extensi,on of the PD-ZC 36-77 . The Planning Commission
approved this extension.
Trammell Crow applied �or a major change in a General P1an (PD)
review in February of 1980. On March 18, 1980 the Planning Commission
approved the application and added a cond,ition "18 . Prior to the
start of construction on Phase II, a.pplicant shall submit to the
Planning Commission a list of pxoposed commercial uses. "
On May 12 , 1980, the City Council revi,ewed thi,s project and amended
Ordinance 7f3-77 which included canditions of development. This
amendment became Ordinance 80-�38.
A Site Design Review application was made (SDR 12-80) on June 6, 1980
and construction followedw The first major tennant was the SOVA
Furniture warehouse, followed by several other retailers, a
John Deer Tractar sal.es and service outlet and then Smith's Home
Furnishings warehouse. Recently Tr�.mme11 Crow notified Staff of its
intention to start con.structi.on of Phase IT, zoned M-3 Light Industrial.
Under the code section 18 .48 .010, warehousing, wholesale distribution
or sale businesses are allowed.
It is clea?- from the orig�.nal approval that the applicant asked for a
combination of uses for this site, and was granted the necessary
approvals. Condit�.on 18 was added to insure that Phase II be reviewed.
Staff recommends that you authorize uses as "adjusted" and subject
Phase II to Site Design Review.
