economic--he seekcs the ability to spread h3,s development costs ov�r an
additional lot. Speaker asked what is the property ri.ght ta be preserved
' substantially the same as owners in tho vicinity. Dlount replied the
neighboring residences are built on �ubstant�ally s�a'ller 10�,� wi�Gh
correspondingly smaller development costs per lot. Speaker asked what
excep�ional or extraordinary conditions applied to this property. Blou.nt
listed the shape of t.he property and the require�sent thd� Garden Park
Place �o through his property, since he cauld h�ve �erved his propexty
very adequately off 110th; h� is inheritin� a situata.on ca7.ling for a ;�
certain �attern of development because of prior city approvala on sur- �,:'
rounding proper�y. Moez� and Funk had questions about the development
of the other hal� of Garden Park P].ace adjacent to the undeveloped Wirth
proper�y, responded to by Howard.
COMMTSSION DI�O� USSIQN AND AC'PION: Bonn felt tMe conditi.ons applicabl.e
at the time of the pre�vious hearing on this parcel have not mater�.ally
changed. Moen reported talking with some of the neighbors� who appeared
tU F)�ppSe the duplex or sin�lo family attachede but who seemed not to
oppose sin�J.e family detached even on sma].ler lots. b'unk had aao problezns
with the request, stating he �hinlcs ttxe area shows compromise� and he
is �ympathotic to the econamic aspect. Owens had v3.s�.ted the psoperty j
and x�,ther agreed w�.th staff, but felt �he applicant had present@d an �;
excellent case for his requeat;. The other commisaioners agreed with the
appl�.c ant.
Funk MOVED approval. of Variaz�ce V 1�-F�1 on the findin� by the comaris-
sior� �that the conditions for the roquested variance are met i� thia case,
and acaordingly that the Heidi Park Subdivi.sion consist of seven lots as "'
requested by the applicant; ar►d that the eleven co�ditiaazs racomm�nded

acaess to a cul-de-sac off Fannn Creek Drive, and while fronting Ha�l
Boulevard, would have no aacess to that street. Howard illustrated the
features of the development on �he map on the Wall.
The APPZTCANT'S PRESFNTATION w�as made b� Dave Evans of Dav3d Evans
and .pssoaiates Inc., �00 SW Market �5tx�eet, Portland. He bra.efly descra.bed
�he changes made in the ori�inal presentation, whict� was approved more
�han two years a�o. In Phase IT they ask for y.0 units versus ,38 originally.
Allowed density ie 60 to 62 units, Fie discusBed the bus turnou� in
relation to the present temporary access for Phase I. He felt tl�e latter
location is the better location for the bus �urnout. Staff had no problems
wi�h �h�s relocation when the �emporary access i.s cJ.osed.

adjoining the southeast cul-de-sac in Phas� III. He had been pramised
access in 19?8 by the thon ow'ners when the property was developed. This F

wi.11 give him access to the cul-deAsaE for a pxice whiah he feels is
unreasonable. Funk asked hovr the �j17.,000 figure asked by th.e developer
was asrived at. Steve B�.eek of 2201. NE Cornell Road, kIillsboxoo stated
it was the engineex�s estima�e of total developmont coet for the project
divided by the number of units, which came to �Z0,999• It wae loft �hat
this is a matter to be woz�ked out between Mr. Cash and the developer. I

CO�iMISSION DISCUSSION AND AC�ION: Funk questioned the 25 for�� private
drive in Phase II. Howard explained some of the factars whi.ch had been
consi.dered e�rlier� in thi� devel.opm.ent o Funk ob j ected to the compromis�.n�
of standards which he sees reflected in this development. Bonn expressed
thQ same conaern, especial.ly wa.th the townhouse area. Staff .rsported the
fira marshal7. approved this plan. Evans rqsponded that this was basically
wha� had px�ev�iously been approved, with some realignment of the pub].ic
streets as requested by the public works director. Moen expressed concerz�
far the narrow streets and drives. Howard reported he, the publlc wcrks'
director and the fire marshal.l were going to work on a revissd standarcl
fox streets in planned developments, to be reviewed by the commission and
then passed on to t.he council for adoption. He characterized narrower
streets in develo�,men� as "the coming thing". Moen expressed coz�cern for
acaess by omer�ancy vehicles if any parking accurs on the 25 foot street.
Evans detailed what a'Gher nearby �ixri.sdictions have approved in �he way f`
of narrovrer stredts. Boran advocated wider streets. Owex�.s raised the �
qu�stion of retention of the large trees, many of which �vans reported are �
in �h,e open �pace and will not be removed. 4

discussed the open space. Helmer felt �he 25 foo�t private dr3.ve should

record a letter from Mr. and Mrs. W. Sykes, who enuwerated reasons wY�y
th�y approved Mr. Chatterley's approacla r�n,d hopec�l to buy in�o hi.s projecto
Howard stated the commission should set the de-nsity; that he and the public
works director had carefully gon� over the 79th-Bonita iz�tersection, and
this was the best arrangement possible considering the constraiz�ts due
to prior deve].opment.
The president asked for and secured a motion to raise the matter from
the table. The mota.on was secondsd an.d carried.

attached homes with solar t'eatu�er wt�uld make for more e�ficient housing
and a successful project.

*** Mrs. Gilmare, 1463o SW 79th, who inquired what of her property
would be taken (for Bonit�, Road} . Staff explain�d nothixig would be taken
from her property until she developed. She expl��ned the visual impedi- ;
ments due �o the vertical curves in B�nita, whicY� she felt is hazardaus
to tho unwary. She expresAed hope that the setb�acks, pax�ticularly on
BoniGa, would be su�ficient to provide safe pedestr�an uss. Howard exp].�,ir��d
the �ros�ect of an LIA in the area as the manner in which the a,mprovemen�s
sh.e percea.ves as needed w3.11 came.

family nature of the project. Their association would prefer single
�ami7.y residences in order to protect the integrity of �he neighborhaod.

approval of the concept of the project, and is lookin� fo�ward to moving

�** Rita C.hat�erley, co-qwner with the app�.ic�nt, who secal,led thQ
oppasition of the Waverly M�adows people to renters` at the 7.ast meeting.
She related the sha�bles the propex�ty was in when they bought it from the
owner-resident, yet apparantly no one had complained. The poin� was that
hame ownershi� does not necessarily mean good care for a prope�ty.
�** Mrs. James Weaver, �.�.67o sw 79tn, who agr,esd the pxoperty was in
poor coz�d3.tion. She opposed attached dwellings on..the pr��tise that peaple
in detached homes are more permanent,

shown on his plan wo�ld receive. Chatterley thought A homeowners associ-

inquixed what prov3.s3.ons can be made for a homoowners association,

�MMISSTON AISCUSSION 1�.ND ACTION: Moen wondered if �he maintanance
on �he common park waixld not become a �roblem, and whether it might be
preferable to spread the square footage of the park among the un3.ts to
giee slightly larger yards. Bonn felt �he concerns ex�reased at the
previous meeting had been properly addressed� and that the plan as pre-
sentad is a good one. Owens felt that the density is quite acceptabl�
on thie rather small site. Helmex• agresd with the density as proposed�
but expressed cozacern over maintenance o�' the common park� feel,ing it
should be e1im3.nated. KolJ.eas and Her�ron agreed to the d�naity but felt
the maintenance of the park would be a prob'lem.

nate��; that it is a qusstion whether the city�s need is greater for more
commercia�.-re�ail space or residentia7. s.pace; tha.t only a modest percentage
of tha proposed retaiJ. spaae is .for small businesses; that a l.asge
traffic-generating aevolopment at that intearsection would "produce unde-
�+irable con.gestion and patterns,i' and �h�,t the traffic analysis, in his

full circulation an an exte�dad Johnson Street and across Fanno Creek on
