Adjournment i', ti 1 MINUTES TIGARD PLANNING COMMISSION September 16, 1980 - 7:30 p.m. Fowler Junior High - Lecture Room 10865 SW Walnut Street, Tigard President Tepedino called the meeting to order at 7:35 p.m. ROLL CALL: Present: Bonn, Helmer, Kolleas, ,Speaker, Tepedino Absent: Funk, Herron, Moen Vacant: One seat Staff: Howard The MINUTES of the September 2 meeting were considered, and on motion of Bonn, seconded by Kolleas, they were approved as submitted. Under COMMUNICATIONS, Commissioner Kolleas reported she had been called by one of the Highland Court residents (who are interested in the Brookside Condos matter heard at the last meeting). No repre- sentative from Highland Court would be present this evening because they had not yet heard from Joe Bailey, City Attorney, on matters referred to him. President Tepedino read the usual notice of authority for and procedure to be followed in the meeting, and thereupon opened the PUBLIC HEARINGS portion of the meeting. 5.1 MISCELLANEOUS, M 6-80 (T.D'.C./Summerfield Sensitive Lands Permit) NPO #6 A request by the Tualatin Development Company for a Sensi- tive Lands Permit to construct a sanitary sewer line from Durham Road at 108th Avenue south to the Tualatin Valley Interceptor line between King City and the Durham Waste Treatment Plant. (Wash. Co. Tax Map 2S1 15A, Tax Lots 1000, 1100, 1101, 1200, 1300, 1500, 1501, 1900, 1901 & 2100). Howard read the STAFF REPORT and RECOMMENDATIONS. He referrer( to a rough sketch on the blackboard showing land ownerships, topography, etc. , and indicated the area which this sewer would serve. The APPLICANT'S PRESENTATION was made by Bill McMonigle, 8905 SW Commercial Street. He agreed with the staff recommendations except for Recommendation 2 requiring a review by city staff to mark trees to be preserved, etc. He stated they have easements or agreements in principle for all properties except the Elton property at Durham Road, and have agreed with the property owners just where the line shall go across their property. Accordingly he did not feel it proper at this t v MINUTES TIGARD PLANNING COMMISSION September 16, 1980 Page 2 point to have a third party intrude. Howard stated this is negotiable, and saw no problem, but that the provision might be very appropriate on the Elton property, on which no agreement has been reached as yet. There was no PUBLIC TESTIMONY. COMMISSION DISCUSSION AND ACTION: No commissioner had problems or questions. Bonn thereupon MOVED approval ofeM 6-80 (T.D.C./Summer- field Sensitive Lands Permit) based on staff findings and recommenda- tions. Helmer seconded the motion, which passed unanimously. 5.2 CONDITIONAL USE, CU 12-80 (Richard Cochran Tire Shop) NPO #1 A request by Richard Cochran for a Conditional Use for a Tire Shop located at 12533 SW Main Street (Wash. Co. Tax Map 251 2AB, Tax Lot 2100) . Howard read the STAFF REPORT and RECOMMENDATIONS. He then told of happenings subsequent to the preparation of the staff report for the September 2 meeting (which was adjourned before this item was heard). The staff report on the site design review includes ten conditions, some of which are aimed at having the landlord upgrade the appearance of the building. Howard asked the commission to make the site design review conditions part of the motion of approval of the conditional use, since the conditional use carries more weight than site design review in such a situation, and might conceivably be appealed, in which case it could come back to the commission anyway. The APPLICANT'S PRESENTATION was made by Richard Cochran, 11400 SW Bel Aire Lane, Beaverton. He agreed to the conditions, although the site design review conditions were new to him. His concern was that he be allowed to operate his tire shop, which Howard told him was not a problem: any problem would be between Mr. Finke (Cochran's landlord) and Howard. There was no PUBLIC TESTIMONY. COMMISSION DISCUSSION AND ACTION: Speaker MOVED approval of Conditional Use CU 12-80 based on staff findings and recommendation for site design review, together with Conditions 1 through 10 of the Site Design Review No. 23-80. Helmer seconded the motion, which carried unanimously. OLD BUSINESS: T.D.C./Brookside Condos: Howard explained the progress on negotiations between T.D.C. and adjoining residents on Highland Court, and expressed some confidence a resolution can be MINUTES TIGA1D PLANNING COMMISSION September 16, 1980 Page 3 reached within two weeks. He asked the matter be taken from the table and referred to him as Planning Director. If a resolution between the parties can be worked out, the stop work order on the project can be lifted; if not, the matter would be brought to the commission at its October 12 meeting. The motion was seconded by Helmer. In further discussion it was pointed out the stop work order on the two-story building is in effect until the matter is resolved with the complaining residents. It was the sense of the commission that a written agreement from both parties should be secured before the stop work order is lifted. The motion carried four to one, with Kolleas voting no. OTHER BUSINESS: *** Study Session on Kittelson/Brown Planned Development, ZCPD 13-80, carried over at the adjournment of the September 2 meeting: Howard sketched the project and the surroundings on the blackboard, and outlined possibilities for circulation to the area, together with recent developments and prospects for development across the tracks which would have a bearing on a railroad crossing. This crossing would be a virtual must for Phase II of this project. Howard outlined the Park Board's plans for the floodplain. There was a little discussion among members of the commission and the applicant's representative. Speaker appeared to express the sentiment of the commission when he stated that if the Planning Director felt the applicant had adequately addressed the several concerns expressed at the original hearing, there was no reason why the commission should not hear the applicant at the preliminary and general plan stage. The applicant, who was prepared to make a presentation, agreed this should be done at a future public hearing. *** ZOA 7-80 - Planned Development Ordinance; Howard read the proposed ordinance, framed in ,fairly simple language, and explained the rationale for many of the provisions. In general the proposed ordinance calls for much more detailed information from the applicant. Howard explained this should substantially reduce the time of staff required to work with applicants before a hearing before the commission. If the preparation is well done, it could enable the commission to process a planned development at one hearing. With respect to the requirement (as proposed) that the plan shall have been reviewed by the fire marshall before submission, J. B. Bishop from the audience highly approved this provision, asserting it would save trouble and mo:lvy farther down the line. immgmenimmonOMONIIMMINIIM MINUTES TIGARD PLANNING COMMISSION September 16, 1960 Page 4 questions were asked by commissioners at numerous points, but only two or three very minor changes in wording resulted from the discussion. Howard reported this document would go out to the NPOS before submission to Council, and suggested further study on the part of the commissionera.
