On January 8, 1979, City Council approved a Zone Change to M-4 (Reference
� , ZC 24-78� Ordinance No. 78-85) . A Conditional U�e was granted for mini-
storage warehousing in the M-4 Zone on November 21, 1978 by the Planning
Commission (Reference CU 29-78) . The project received Site Design Approval
or� April 13, 1979 (Reference SDR 18-79) .
I. FINDIN�GS OF FACT:
1. The Code allows automobile service stations as a Conditional Use
in a M-4 Zone (Refe�ence Sec�iori 18.52,020) . The Code further states
in this Section . . . ."any other use held similar to the above uses, as
approved by the Planning Commission".
2. Auto repair is similar to auto service. In •this case, only mechanical
repairs shall be carried out, no gasoline sales, etc, shall be a part of
this facility. All work sha11 be carried out within the building. No
outside storage will be in evidence.
II. CONCZUSIONARY FINDINGS: •
l. The proposed use is compatible with the mini-storage warehouse use
approved in this zone.
III. STAFF RECOMMENDATION:
Staff recommends approval of this Conditional Use with the following conditions:

has agxeed verbally in the text to provide this dedication.

TI. CONCLUSIONARY FINDINGS:
1. Necessary right-of-way dedication on Durham Road should be made to the City.

trails, stream improvements, erosion cantrol, etc. , must be accomplished
, as a condition of acceptance of public improvements.
III. STAFF RECOMMENDATION:
Staff recommends approval of Stage I - Copper Creek with the following conditions:
1. A Homeowner�° Agreement be prepared for the maintenance of the sensitive �
land areas to the east of this site to include brushing, tree pruning, etc.
prior to issuance of Building Permits. This Agreement shall be approved
by the Public Works Director and the City Council. Should future d�velop-
ment be approved for the remaining areas (Stage II) a similar Agreemerit
shall be drawn to ensure that the complete area is maintained an d protected.
2, A restriction shal.l appear as a part of the Final Plat indicating that
each parcel owner shall not remonstr�.te against the future .formation of
a Local Improvement District to improve Durham Road.

3. All public streets shall have fifty (SO' ) Feet r_ight--of-way, thirty-four
(34') feet of paving. Sidewalks will be required on both sides of all
streets except in cul-de-sac bulbs.
4, Necessary right-of-way dedication shall be made to provide forty-five
(45' } feet from the centerline of SW Durham Ftoad to the property line
along the entire nor{:hern boundary of this property.
5. Al1 Conditions under Title 17, Tigarcl Municipal Code, shall be adhered to
in filing the Preliminary and Final Plat for review by the various depart-

In the past, we have had a difficult time with density calculation unc3er the
Planned Development District designation. In exchange for public dedication
of open space, usually floodplain, we have allowed an applicant to increase
the overall density of a project. Copper Creek Stage II presents a different
picture.
Staff has comg�uted the density as follows:
Total Site Area 39.38 acres
Less Stage I 2,.70 acres
Less Lot 145 2.50 acres
Less sensitive lands 11.50 acres

Now the only question remaining is should a "density bonus" be granted?
Nnte thai� only 1.5 acres is an outright dedica•tion to Tigard. Note also
that these calculations are for an underlying R-7 Zone . If you approve a
highe r density, you reduce the size of each lot and you app roach the H--5
Zone zninimum lot size . As it is proposed, the average Iot size is 5800
square feet in Copper Creek. Minimum allowed in •the R-7 Zone is 7500 square
feet. �

The "usable open space" issue needs attention. As no public dedication
of this land is contemplated by the app licant, Staff suggests that all
improvem�nts to the open space areas be made at the same time as the public
improvements are done. A11 underbrush, dead vegetation, etc. shall be removed,
the drainageway shall be cleared and paths shall be installed, erosion
control shall be accomplished. Staff suggests a public dedication for park
purposes of the open space to the south and a dedication �f the floodplain.
If this were done, it would be possible ta consider a small "density bonus"
for the remainder of the project. Open spaae and floodplain was dedica�ed to
the City in Pick's Lan ding. It is our suggestion that th� park area be
� continued �hrough Copper Creek to Cook Park.

� is concerned that access to Durham Road will become an issue and we, therefore,
suggest that a twenty-five (25' ) foot frontage road strip be de�icated to
the south of and alc�ng Durham Road to serve later development in this a�:ea.
The "temporary" aceess to Durham Road will be discantinued if a Local Tmprovement
Distrir,t for Durham Road is formed or when Kneeland Estates is developed.
'I'he setback standards vary from the underlying zone designations anc� the
Commission should examine them caref ully. Applicant has pzepared typiaal
lotting patterns and proposed building .location:s for review at the public hearing. �
The "Declaration of Conditions and Resi�rictions" is not specific enough j
relative to the deed restrictions for Non-Remonstrance Agreement for the �
: improvement of Durham Road. Specific language should be added. The "Model ;
House" Ordinance of -the City should be used as a guideline by the applicant.

R-7 and R-20. There is app roximately 1.5 acres of floodplain included

l, Tax I,ot 1400 appears to be ve ry close to eighty (8A�) percen� within the
one-hundred�-year floodplain of Fanno Creek which is a desa.gnated' qreenway
area. Z'he majority of land on Tax Lot 70Q is in the floodplain and designated
Greenwaye Tax Lot 100 is about fifty (50�) percent �iir the floodplain/'
greenway. The adopted Comprehensive Plan Map clearly defines these areas
and fu.ture reference is made to these areas in the Environmental Design
and Open Space Plan adopted by Council in August of 1977.
2. Policies 1 through 6 on pages 9 through 11 of the Environmental Design and
Open Space Plan clearly indicate that these arnas are to be protacted�
