A major portion of the Fanno Creek floodplain area between Main I Street and Ha11 Blvd. has been designated for a park. "Retain the 100-year floodplain of Fanno CrEek, its tributaries and the Tualatin River as an open preserve (Greenway) . The Greenway shall be established as the backbone of the open space network and when a direct public benefit can be derived, i.e. , adjacent residential development, the I Greenway should be developed fcrr passive recreation and pedestrian/bike I travel". 3. Ordinance 79-73 defines Greenway. (See Exhibit D) 4. Section 18.57,040 of Ordinance 79-73 allows "off street parking" if a Special Use Permit is granted by the Planning Commission. 5. Applicant has agraed to dedicate a certain portion of the floodplain to the City. (See site plan) 6. Statemenfi #4 in the Applicant's Narrative needs to be clarified. CU 7-75, Condition #6 states "no outside storage of materials, vehicles, waste or ' �.,. debries wi11 be permitted on site'°. The record is not clear as to whether or not this prohibition was intended for the buildings only or for •the entire site. If the latter is the case, then this use woul.d not be allowed. II. CONCLUSIONARY FINDINGS: l. Area has been designated "Greenway" along the 100 year floodplain elevation. 2. A major downtown park area is planned; a portion of this land is includeci in this plan. 3. The Tigard Senior Citizen Center will be constructed to the south and east of this property across Fanno Creek. 4. There is some question whether or not this should be a Conditional Use in this zone from the recoxd contained in CU 7--75. III. STAFF RECOMMENDATION: Staff recommends approval of this request with the following conditions: 1. That the actual area used for R.V. storage be approximately 28,000 square �'eet and that no portion of the 100 year floodplain be used except for the landscaping and fence construction. 'Phis study is to include details on re-alignment of Johnson Street to Ash Avenue, Ash Avenue through to CommerciaZ Street and the re-alignment of Main .Street into Johnson Street within this development. Various alternatives should be clearly indicated and addressed. 2. Applicant to address specifically the fact that a portion of the land he has included in his project is not now under his control. A method of resolving this fact must be presented. (Applicant to provide adequate facilities for public transportation (TriMet) within this development.) 3. Attention to be given to reducing �he impact of large structures to imrnediate surrounding areas of residential developments and the proposed Fanno Creek Aark and Gre�nway area. .A.pplicant to relate this proposal more specifiaally to the "intent" of the Planned Development Section of the Code included ` herein; "PD/18.56.010 Purpose" (See Exhibit "A") r �. 4. The Public Works Director and the Planning Director have repeatedly asked for Johnson 5treet to be continued through �this development to eventually conneat Ash Street with a connection to the noxth to Main Street crossing Fanno Creek. Compounding these difficulties is the fact that the applicant has a lease on the Western Oregon Marine ]�uilding which will be in effect for a certain length of time, pos.sib:ly until Octobe.r of this year, Added to this, is the problem of ownership of the land immediately west of the project to 99N1• The addition of traffic signals at the southern bounc�ary of this site on 99W is questionaY�le also. Ini�ially Waremart was not included in this project. When this tennant was found, the "warrents" could then be iliet for the traffic signals to the south, Obviously, changes had ta then be made to the traffic study. The site plan now shows ingress/egress onto Main Street on Tax Lot 1200. � The traffic study does not provide the necessary details which we feel we should ' � have, to a.dequately address traf�ic circulation. The applicant has told us that he feels we should provide the details. The onus is totally boin by the de�eloper and, until Staff, Planning Commission, and City Council, is in total agreement with the traffic plans as submitted by the applicant, this project should not be approved. It is anti.cipated that the applicant will tell you that ^, he does not control the land to the east of his proposal and that he cannot provide the necessary right-of-way through to l�sh Street. Staff has recently discussed this issue with Mr. Bensen, a future developer of property on Ash Avenue directly east of this proposed development. Mr. Bensen would be ;; conditioned to pxovide the connecting link. for Johnson Street to Ash Avenue at the time he develops. The U.S. IIank at Scoffins and Main is proposing to rebuild soon which wi11 mean elimination of a major traffic problem in that area. What is being sugge,ted throughout this narrative is that the entire area from this development to Scoffins is changing very rapidly. We have a chance now to align streets, to revitalize the area, to plan ahead for the improvement of this community. NPO #1 has filed the enclosed document with the Planning 5taff. (See Exhibit "B") Under Heading I. , South Main Development, the NPO states - "The need has not been adequately identified for the re-alignment of Main Street and the Johnson Street extension to Ash Avenue �hrough the development�'. In the next paragraph we read, "careful consid,eration be given for the traffic impact of such develop- ment". Heading IT states the NPO's priznary concern, primary priority - the extension of Hi11 5treet to O'Mara. Heading III, Ash Aveazue Extension - the NPO does not see the need to extend Ash Avenue across Fanno Creek to Burnham and wish their neighborhood protected. Staff was very specifa.c in its presenta- tion to this group on April 2, 1980. The time for a transportation system is now and it inaludes Ash Avenue to Burnham. This has been a topic of considerable � � discussion for years. It is our feeling that Ash A�enue should be extended to Burnham and then to Commercial Street. The NPO #1 meznbers avoided the real issues by placing priority nn the Hill Street extension to O'Mara. Note that they wanted the Ash Street right-of-way "preserved" and their neighborhood's "residential character" protected. i. The real issue is the "greater public need". If we do, in fact, place a civic complex on Ash Avenue where the Public Works area is now, and if we do develnp a park from Main Street to Hall Boulevard, then it seems logical to assume that this entire area will change. Ash Avenue wi.11 be extended to Burnham. 'I'he NPO #1 members realize this fact. The Planning Commission may be asked to re-design this project at a Public Hearing. Staff feels that thi� is less than appropriate. A greater public must be served.
