Page 3, the last full paragra�h, the duplication of the words "they are owned,
as Mr. Vail inferred, by developers; at the present time!' , is deleted. On
page 5, first line, the nam� is "Krause" instead of "Drause". On page 7, fifth
line should read in part: "that the applicant is properly Tualatin Development
Company. .. " Upon motion r,tiade and seconded, the minutes as corrected were approv-
ed unanimously.
Staff reported that COMMUNICATIONS will be considered later in the meeting.
The President asked if there has been any response to the request of the City
At:torney in connection with whether other public agencies are subject to Tigard's
greenway orclinances. Howard reported there has heen none to 'date. The President

� application which he felt justified a recommendation t� the City Council that the
Planned Development designation for this property be continued. Therefore he �i
moved for denial, which failed for lack of a second. Smith inquired what contact ;�;
Staff had had with the applicant recently. Se'.by stated the applicant had cnme 'l
in prior to the expiration of A,pril 13, 1978 action, anfl stated he had not been
able to secure financing. He thereupon filed a letter requesting an extension of
the PD designation for another year. Se1by ex�lained an on-site review did not
indica�te any adverse impact nn the neighborhood if this PD designation were con-
tinued for another year.

from the expiration date, basedon Staff Findings and Recommendations (including
the standard "no changes" provisiqn) . He explained in view of the Staff's repre-
sentations it is unlikely the Commission would rule differently on a new applica- �
tion for t�he same project should this application be denied and a hearing held
on a new application. The znotion was seconded by Bonn. In discussion Smith
favored a six-month extension. Tepedino reaffirmed opposition to any extension
on the basis of fairness to all other similar applicants. ��lood asserted there is
na evidence conditions affecting the original application have changed to malce the
Commission's action of Ap ri1, 1�78, inappropriate at this time. After some fur-
ther discussion the motion passed, with Tepedinc� voting no.

COMMISSION DISCUSSIOIQ AND ACTION: Speaker raised the question of avail-
ability of�wer in the light of Condition No. 3 and the assertion in Findings of
Fact t1o. 6 that sewer service is available off S.TnT. Ash Street. Selby explained
�that because of delays sometimes amounting to several months in sewer hookups,
Recommendation 3 v�as included to insure that adequate sewer ca�acity was indeed
awailable when the property was actually developed. Smith inquired as to the
ultimate configuration of the site development. Selby replied a subdivision
aprlication on the basis of a cul-de-sac is pending.
Kolleas MOVED approval of Zone Ghange ZC 20-79 based on Staff Findings and
Reoommendations. Herron seconded, and the motion passed unanimously.

Iioward read the STAFF FINDINGS and RECOMMENDATIONS, asking the addition of
Cnndition 6 the standard "no changes" provision.
The APPLICANT'S PE2ESENTATION was made by Dale Rohl of Cambridge Interna-
tional Corp. of Milwaukie, He outlined the zoning, the individually-owned,
homeowner-association-maintained character of the development; the nature of
the neighborhood for which this would provide effective buffering; the accom-
panying improvement to the adjoining streets. He then displayed a preliminary
architectural rendering of the proposed develoL�ment.
PUBLIC TESTIMONY in opposition was presented by the following:
Mabel Desdimoni questioned the lot referenc�, the future plans for Com-
mercial Street, and the nature of buffers, all responded to by Selby.
Mr. Doles, a resident of 98th Avenue, voiced concern about the traffic to
be generated on 98th, the legality of the lot size (which is i.n acco�dance with
the Code for the area) , and the meaning of "condomi.nium-style" (responded to
later) . Howard explained that roads in this community are put in by develoPers,

and therefore until surrounding property is developed, 98th would provide the
access to this development.
Less Riggins asked why the street cannot be improved prior to development,
explainecl again by Howard, who enlarged on the funding sources for Tigard streets
and problems connected therewith. In response to a question, Staff explained
plans for the extension of Commercial Street as the property is developed.
The President asked Mr. Rohl to explain the phrase "condominium=.style°. The
phrase, he thought, might be a misnomer. In discussion with and among the
Commissioners it was brought out that what is contemplated is 40 townhouses in
buildings containinc� from three to seven or eight units each, with Common areas
owned and maintainecl by a townhouse association. In the sense that each house�
holder will own a lot only sligh�ly larger than the ground on� which his eommon-
wall unit is sit;uated, it would be more accurate to call them simply townhouses.
Mr. Rohl in REBUTTAII then respondea to the various points voiced in opposi-
tion public testimony.
John I-iavery of Tigard inquired in general whether the developsr of a Plann-
ed i�velopment approved for a density less than permi�tted by zoning �ould later
develop to the maximum densi.ty all.owed by the zone. A.fter some discussion the
answer was that he could do so only after another hearing before the Planning
�;, Commission, It was observed by Commissioner Smith this would most likely be a
very unprofitable move for the developer. �
COMMISSION DISCUSSION: Smith ra.ised the question of the distinction between I!
what is ap�roved in the preliminary plan and program review, and the subsequent �
general develapment plan and program. Selby stated the preliminaxy plan review �
is concerned with (a) conce�t, and (b) density. 'I'he general plan is very specific
and includes such items as landscaping, drainage plans, building heights and
locations, exterior finish---all within the concept and density approved in the
�reliminary plan.
Speaker objected to the mathematics as stated in the Findings of Fact No.4,
and raised the ques�tion o� what open space was contemplated to be dedicated which
would justify all or part of the 20 percent density imcrease �ermitted for
deciication nf open space. 6Vood felt the intent of the ordinance in awarding of a
up to a 20 percent density increase for dedicati�n of open space did not apply here.
Smith MOVED for ap�roval, of Zone Change ZC 21-79 PD based on S�aff Findings
and Recommenda�ions, with the portion of Findings of Fact No. 4 beginning with the
words "Additional .2Q� may be parmitted. . .. "deleted, �nd with the inclusion as
Recommended Condition 6 the standard "no chan ges" provision. Kolleas seconded,
and the motion carried unanimously.

�n the APPLICANT'S PRESENTATTON, Paul Farrell of Salem simply rec�uested
approval of the conditional use pernu.t.
Under PUBLIC TESTIMON'Y, Paul idiilita, representing Pacific Realty Trust, ��
owner of the property, explained only one of the 62 tenants in the industrial ^�
park had their own fuel su�ply; that many of the tenants were interested in the
keylock fueT pump concept, which worl�s well in other industrial �a.rks.
John Havery of NPO #5 had questions about whether self-service fuel s�tations
are legal, and expressed the concern of NPO #5 over the safety of a self-servi.ce :{
gas station in the surroundings of the industrial complex. Wood questi.oned
whether NPO #5 had taken a forraal stand on this matter. Mr, Havery statec7. no ����I
meeting had been held, but ttiat concern over the sa£ety aspects of a self-serviee
station was expressed in conversations with NPO #5 members.
�- COMMISSION DISCUSSION AND ACTION: Questions by Commissioner Kolleas
developed these f.acts on the facility: that the appraval of the Fire Protection tx.
District people had been secured before application was made to the Gity; that z�
there are four-hour fire walls protecting nearby buildings, and fire protection i
equipment on site and sumps for spillage; there will be a 12 ,000 gallon steel �
underground tank for diesel fuel; that included wi11 be the new va�or recovary
system for the hose-to-truck connection.
�;nith asked if the facility would be used also by empl�yees. It was point-
ed out that regular and unleasded gasoline, �nd diesel fuel would be available
to whoever had one of the 90 keys.

The APPLICANT'S PRESENTATION was made by Bud Smith o£' Iiarry Russell Associates,
who stated he had �icked •up the Staff Report on Monday (yesterday) , and that they
had not had time to do �roper homework. He therefore asked the opportunity to ap-
pe ar before the Commission at a later date when they would be �repared. The Pre-
sident ascertained from Staff that the schedule would permit another appearance on
July 17.

COMMISSTON DISCUSSION AND ACTION: There followed a taide-ranging discussion
of various aspects of the re�uest. Smith received confirmation that the p resent
fi11 is illegal, and stated he felt there was wholly inadequate infor_tnation sub-
mitted with this appli.cation t� arrive at an intelligent decision. He specifical-
ly mentioned detailed tapographic maps for the project, Bonn wanted more informa-
tion on topography and water levels. Speake.r expressed concern for impedence of ^
the flow l�ecause of the present fill, which applicant's engineer has stated would
incre ase the flood level by one-half a foot; and the holding capacity of the flopd
plain at this paint. He felt the applicant should show how these concerns wi11 be
addressed, and also what, if any, improvement to the landscaping will be made to
�, make the site approach compliance with the present City Code. ti

Tepedino severe.ly criticized the applicant for filling the floodplain �
illegally, even after knowledge of the import of the City ordinances to the eon- �
trary. He expressed concern for the effect �f this £ill on riparian: landowners; �
of the effect of this case as a preoedent in future floodplain cases; and felt
the City should, through the City Attorney, require the ��plicant to remove all
the fill and only then come in with an engineerinq study supporting a special use
permit reque�t before the Commi.ssion. He favored a flat denial of the present
request.

Wood asked for a response from th� a�plicant as to what filling was done with s
what knowledge of the City ordinanaes. Mr. Smith stated the area was a fill area
used �ver the last 20 years, e�-en }�y the City. V7hen his firm was retained he cal-
led attention to the owner he was in violation of the f2oodplain ordinance, and
accorc3ingly filling was Yialted. ��7ood felt three �eriods of fill had occun�'� and
might have to be separately dealt with: prior to �assage of the City ordinance;
between that time and the time the owner was aware of it; and fill made since that
time. He Eelt the ap�licant should be allowed t� come before the Commission on
July ],7 with the full burden of proof to sh�w among other things why he should not ,:
remove the �resent f�ll, and 2-iow he would propose to meet the cancerns exhressed ,;

the motion. After some further discussion in which Commissioner Smith asked
for much more accurate maPs of the area and what is �roposed, which Mr. Smith
acknowledged on behalf of the applicant, the mntion carried, with Tepedino vot-
ing no.
OLD BUSINESS: Howard reviewed past action in connectian with the request of
Ko11 Business Center at two hearings before the Commission. They will appear
again. He questianed the feeling of the Commission as to whether Ko11's next
appearance should be under the old floodplain ordinance, under which their pre-
vious appearances were made, or the revised ordinance recently approved by the
_ Commission. The consensus was they should appear under the canditions of the
old ordinance.
Howard reported that Ken Bowman has appealed the denial by the Planning
Director o:E a minor land partition.
NEW BU5INESS: Howard raised the question of the necessity or desirability
of two Y.�earings--for a preliminary development plan axid program, followed by a
general development plan and program. He felt one hearing should be sufficient
.' in view of the numerous reviews any plan receives, Wood felt two hearings are
1�� desirable. Smith stated t�wo hearings can be very useful for a developer, since
the aoncept (which may be out of the ordinary) can be reviewed before the expen-
sive detailed woxk is completed. If the conce�t is not acaepted the developer
knows that developing the information necessary for the general development plan
and program is of no avail. Speaker wondered if there could not be some leeway
allowed the Staff: that if the concept is usual and there appear to be no re asons
for rejection, one hearing could suffice.
Smith felt there should be a clear definition of what is required ix� the
�reliminary hearing, and that it be confined only to those poin�ts. It was
agreed this is something which might well be worked out in a future study ses-
sion.
The President declared the meeting adjourned at 10:20 p.m.

7. Traffic movement to and from the site will be served by S.V7. 100th
Ave. , S.°�7. Kable Street and S.W. Sattler.
S.W. Kable Street will be continued on east through the site having
City local street improvements. S.W. 100th Avenue and S.4J. Sattler
are county streets. They are presently in substandard con dition hav-
ing inadequate paving width and no curbs or gutters. S.6V. Sattle r
is designated as a collector street and the others are local streets.
II. Conclusionary Findings:
1. There e xists a need to zone oarcels that are within the City limits
to the City of Tigard Comprehensive Plan designation.
2. Ten feet af dedication along S.W. Sattler on the north end of the
property and twenty five feet of dedication along the southwest side
of the site on S.��V. 100th is necessary with half street improvements.
III. Staff Recommendations:
Staff recommends approval subject to the following aonditions:

of building permits.
2. That ten feet of right-of-way along S.W. Sattler be dedicated to the

Previous Action: On October 24, 1977, the Planning Director approved a site
plan and architectura.l review of a storage building. On
February 14, 1978, the Planning Commission gave an opinion
as to further clevelopment of the site. On April 11, 1979,
the Planning Director denied an application for design re-
view of an additional storage building on the rear portion
of the lot. ;.�

2. Findings of P'act: �}'

The subject site has been filled c�nsiderably. The e xact dates of the �,
fill deposits are uncertain but qualities have been de�osited within the
past year. The property to the north has been filled also but the
properties across the stream to the east are substantially below the grade
of Columbia Hardwooc�'s lot, It would appear that these lots (to the east)
if they have been filled, have been only slightly. The applicant is not
requesting to place additional fill on the lot but would like appr�val i'
for the �ill that has already been deposited.
It was Staff's opinion in October of 1977 that with the approval of the
starage building the site would be developed to its fullest capacity and
further development would require that the parking and landsca�ing be �

brought up to code requirements.
The Planning Commission upheld that opinion half a year later and stated
an additional concern with the floofl �lain issue.

II. Staff Recommendations:
Staff recommends approval of the permit with the following conditions:
1. That the ap�licant remove as much fill as is nec�ssary to retum the
storage capacity of the floodplain to its original volume prior to
the filling of the site.
2. That the excavation and/or fill not impede the ilow of floodwaters
and that the fill areas be protected :Erom erosion.
3. That any further development on this site is to be app roved by the
Planning Commission and subject to the requirements of Design Review
and the Tigard Municipal Code.
