George Edens, the applicant, presented his proposal. Stated that there was a need in the area for mini-storage space. C. Public Testimony: None D. Co. Tax Map 2S1 14A, Tax Lot 1100) . A. Staff Report: Read by Selby B. Applicant's Presentation: George Edens stated that the location of the proposed mini-storage was a good one due to the adjacent housing. `? Tom Whittaker, Architect for the project explained some of the benefits of the proposal. C. Public Testimony: None D. Staff Recommendations: Staff recommended approval with the following condition: 1. That the construction and traffic circulation plans with landscaping be approved by the site design planner prior to issuance of building permits. E. Commission Discussion & Action: o Seeber asked about the garbage buildup from the development? o Edens stated that the submittal was only preliminary. o Smith asked if the plans could be submitted to the Site Design Review Board? Passed unanimously. 5.3 Implementation of the Housing Plan A. Staff Report Svart summarized Items A & B and read the staff report with each. B. Applicant's Presentation: None C. Public Testimony: John Butler, 9760 S.W. O'Mara, asked why the proposal had not gone to the NPO groups for consideration before being heard at the Planning Commission level? Thought that smaller lots did not necessarily mean cheaper houses. . Smith stated that the Commission was setting up policy and framework for the NPO's to work within. Bill Clark, 7175 S.W. Baylor (Tigard Triangle) , complained about the undependability of the notification process. Stated that the water accessibility and traffic situation made the possibility of a high density zone in that area unfeasible. Jerry Scott of the Tigard Triangle Area stated that he did not want apartments in that area. Hugh Mayon, Bob Mullen and Marjory Sethger concurred with the ideas of Jerry Scott and Bill Clark concerning the development of the Tigard Triangle Area. D. Staff Recommendations: Staff recommends the tabling of Item A and Item B pending work with the NPO's, with the goals contained in the memorandum dated November ;I 17th to guide their deliberations. Commission Discussion & Action continued: Items A & B: o Wood thought the proposal was too strong and that staff should work with the NPO's. Also thought the figure of 60% was too ' high for the percentage of people in the Tigard area who could not afford the cost of a new home today, and that the proposed density was too great. Agreed with staff proposal B and thought that there was probably a need for more apartments in the area, but not at the density staff proposed. •Did not think that smaller lots would decrease housing costs. o Funk agreed with Wood. o Seeber thought that some lots should be 5,000 square feet but not 60%. Thought that apartment density was good. o Speaker asked what the outcome would be if the NPO's and the Planning Commission did not meet housing goals. o Svart corrected the 60% figure and stated that 33% could afford . 5,000 square foot lots who could not afford the larger lot size. o Brian stated that staff and the Commission should be careful with statistics and a "phantom market." Thought that Planned Development Districts took care of smaller lots. Questioned the medium income figure. o Smith stated that the Planned Development did not take care of smaller availability. In that the base zoning for the development and the overall density was based on R-7 zoning and its corresponding larger lots. o Smith stated that the smaller lots in a Planned Development were not answering the problem of low cost housing in that their smaller size was allowed due to open space areas and the additional cost of that unbuilt open land. Spoke on the quality of the community with allowing the smaller lot sizes, Portland had poor quality neighborhoods and high quality neighborhoods with 5,000 square foot lots. Thought that staff figures were accurate in that most people would buy a lower cost home if it were available. Thought that if it did provide smaller lots, should decrease proposed multifamily. Thought that all areas could be considered as R-5 zones which were currently R-7 and allow the NPO's to decide which would not be R-5 zones. The market could also dictate the cost of saleable homes. o Weaver presented an outline of procedure for dealing with the citizen participation groups. o Wood presented motion: "That approximately 20-40% of the estimated 1 1; } !j ,MINUTES $$ TIGARD PLANNING COMMISSION i t November 21, 1978 - 7:30 P.M. tt Page 5 o Wood continued - total of new single family dwelling units that t can be built in the future on buildable land in the Tigard area should be available on lot sizes of 5,000 square feet. All R-7 and R-l0 zoned land in each NPO area should be considered, but C each parcel that has been designated for this use by the staff should be discussed individually by the NPO's. o Smith suggested that the NPO's designate areas for smaller lots by preference (i.e. least desirable to most desirable) . Thought ,; that the percentage should be one figure and not a range. o Wood modified the second sentence of the motion to read "The relative suitability of all R-7 and R-1O land in each NPO area should be considered, but each parcel that has been designated for this use by the staff should be discussed individually by the NPO's." o Brian seconded. Passed unanimously. o Wood moved that approximately 30-35% of the total new dwelling units in the Tigard Plan area shall be multifamily in keeping with the relative proportion and in view of the strong regional trend towards an even greater percentage of households living in these areas. The NPO's should address the question of whether an increase to this percentage in apartment dwellings should be accomplished through an increase in the amount of land zoned for apartment use or through higher density development or both. o Smith asked for a modification of the motion? o Wood modified the percentages of the first sentence to read "25-35%" and added a final sentence, "The NPO's in recommending the the appropriate percentage also should take into account the percentage of land that is recommended to be zoned for R-5." o Smith seconded. Presented photographs demonstrating the similarity between mobile homes and stick built homes. Preferred that skirting be eliminated and that the dwelling be placed directly on foundations. John Butler, S.W. O'Mara, was against mobile homes as an outright permitted use. Thought mobile homes should be allowed, but with the same standards as stick built homes and allowed as a conditional use. Thoughtthe NPO's should be involved. Bill Fahr, Mobile Home Dealer, spoke on the standards for mobile homes, arterials and construction. Alan Paterson asked about the densities that would be allowed? D. Staff Recommendations: None E. Commission Discussion & Action: o Brian thought planned developments would be a way of providing for mobile homes. o Wood thought conditional uses or planned development requirement was a solution. o Smith agreed with Wood & Brian, thought that mobile homes as an outright permitted use was too great a step for the area. a Requested a good definition of mobile homes. o Brian posed the question, doesthe planning commission endorse the staff recommendation that individual mobile homes be permitted as an outright permitted use in an R-5 and R-7 zone and conditional uses in R-10 zones. o Smith posed the question of, if the commission would support mobile homes as a planned development? o Five in favor of mobile homes as a planned development. ti •MINUTES TIGARD PI.,PNNING COMMISSION November 21, 1978 - 7:30 P.M. f1 Page 7 o Tepedino stated that the proposal should go to the NPO's prior to action by the Planning Commission. o Joe Bailey, City Attorney, stated that it was safe to create an ordinance prohibiting discrimination against children in housing. o Brian asked if there was a legal distinction between housing discrimination based on sex, religion, marital status, creed or race vs. marital status and children? o Tepedino thought the issu should be postponed until there is a demonstrated problem or need. o Wood stated that it was next to imposs"1)1e to find apartments that rented to families with children over 2 years of age. o Smith requested some sort of survey information and a copy of other ordinances as examples. o Tepedino requested additional data of staff. Tax Map 2S1 14A, Tax Lot 1100) Applicant: George Eden I . Findings of Fact: 1 . The site is a recently annexed 4 . 39 acre parcel currently zoned RU-4 "Washington County Agricultural" . 2 . The proposed zoning is in conformance with the NPO #6 Plan designation of institutional development. 3. There exists a public need to assign city zoning to annexed parcels. 4 . The site is presently occupied with a single family, storage and corral shed with the remaining open space having high chaparrel vegetation with no agriculture use. The parcel has a gentle slope moving from west to the east. 5 . The surrounding land uses are Tigard High School grounds on the north and west side, the United Sewer Treatment Plant on the east across 85th and a single family parcel of three (3) acres to the south. 6 . The site fronts S .W. 85th which is a county road in substandard condition, having 30 feet of right-of-way with approximately 20 feet paved. 7 . The site will be served by USA having its interceptor at the intersection of S .W. 85th and S .W. Durham. Water will also be provided with adequate facility. 8. The applicant proposes to develop industrial use buildings as permitted by the institutional development designation with conditional use mini storage units (See CU 29-78) . II . Conclusionary Findings: 1 . The right-of-way along S.W. 85th Street is inadequate. Ten additional feet are needed. The site is zoned City of Tigard M-4, compatible with NPO #6 Plan "Institutional Development" . 2 . The parcel ' s present condition, surrounded uses and public services are the same as stated in staff report ZC 29-78 . 3. The applicant is proposing to construct mini storage building on part of the 4 . 39 acres (see attached blue print) . 4 . The mini storage buildings will be separated from the M-4 uses by a security fence and driveway area (see attached letter by applicant' s architect dated October 11, 1978) . II . Conclusionary Findings: 1 . The mini storage use would be permitted if granted by the planning commission in accordance with subsection 13 of the Tigard Municipal Code 18 . 52 .020 "Any other use held similar to the above uses, as approved by the Planning Commission" . 2 . The ingress/egress accesses shown on the plan are adequate for the traffic type and circulation use requested . 3. The security fence and building placement appear to be adequate for visual and sound deterrent. However, landscaping to blend appearance of natural elements with the construction is desirable . III. Staff Recommendation: Staff recommends approval subject to the following condition: 1 . I Koch, Sachs &Whittaker Architects,AIA 620 SOUTHWEST FIFTH AVENUE PORTLAND,OR. 97204 229 7571 • fI i1 October 11, 1978 Tigard Planning Commission 12420 SW Main Street Tigard, OR 97223 Gentlemen: Mr. George Edens, the developer, is applying for a Conditional Use permit to allow construction of a mini-storage complex on a 4.39 acre parcel of land at 16285 SW 85th, Tigard; also known as Tax Lot 1100 on tax map 2S-1-14-A. The land has been recently annexed to the city. The proposed use will be in conformance with the City of Tigard' s Adopted Comprehensive Plan, amended by neighborhood plan No. 6, August 1977, which shows the property in an institutional zone. The developer feels that the proposed use is not incompatible with the institutional activities surrounding it. The develop- ment would be low occupancy and low keyed with only light vehicular traffic added to SW 85th. The site is buffered on four sides with open space, two sides of which (north and west) are the playing fields of Tigard High School.,a.d one side (east) the parking and landscaped areas of the Unified Sewerage Agency's treatment plant. Given the inherent need for security in a mini-storage complex, the exterior aspect of the complex would largely be a blank wall, softened by landscaping. With the large areas of urban and suburban low density housing in the immediate vicinity, as well as apartment and retirement complexes nearby, Mr. Edens feels that his project will answer both a public and community need for extra storage space. Sto- rage will be available for boats and recreational vehicles, as well as general use storage. The property is in an area recently annexed by the City of Tigard and all city services are now available to the site. The proposed location for the developer ' s use is more suitable than other areas in the city already zoned M-4 because the amount of land required for such a storage complex is not avail- able at an economically feasible price in such areas. Given the need for security above high visibility of such projects, the distance from other structures is ideal. Tigard Planning Commission Page 2 October 11, 1978 The proposed development will have low impact on the adjacent .. properties. The mini-storage buildings will "turn their backs" toward the property lines and so will provide automatic screen- ing augmented by landscaping for the activity inside. The three shop buildings at the east side of the property will be visually more interesting, with more visible activity, but are directed away from the school buildings toward the Unified Sewerage Agency buildings. No objectionable sounds are envis- ioned as being emanating from the project. Sounds generated would be mainly automotive, occasional, and dampened in part by the shapes of the buildings themselves. The automotive traffic would be light enough as to cause no problems at the intersection of SW 85th & Durham Rd. The development would generate no smoke or objectionable odors and would create no additional student load on the schools. No new public services are needed for the proposed development except for the extension of construction on SW 85th Avenue. Access for city fire trucks is facilitated by the generous spacing between buildings. The buildings are planned to be better than 1-hour fire resistive construction. An on-site manager is planned which should minimize any extra load on the city police department. No public transportation will be required. Site drainage will be taken care of by catch basins in the paved areas to the existing storm sewer in SW 85th Avenue. Finally, the developer feels that due to the odors associated with the Unified Sewerage Agency' s treatment plant, most insti- tutional and other high human occupancy uses1would not want this particular location. Commission Discussion & Action: o Speaker thought proposal seemed fine. o Funk did not like the idea of the city relying on federal funds. Wanted to know what strings were attached? o Seeber did not think government ought to bait cities .into funding by allowing them a particular type of funding only if they accepted another as well. o Helmer asked what housing assistance Tigard had to supply? Stated he thought that 1272 units was too high. o Wood questioned the figure of 1272 units. Smith arrived 8:10 P.M. o Helmer wished to know the number of subsidized homes? o Wood stated that one could not use household number and population numbers interchangeably for data purposes. o Speaker asked if there was any expense for subsidized housing to the city? o Helmer stated that the figures were excessive for necessary subsidized housing. o Kolleas thought the proposal was satisfactory. o Smith did not think the City should become independent on federal funding. o Wood spoke on the restrictions of location of low-income housing. Thought only implementation policies A & C should be used. • Brian arrived at 8:30 P.M. o Speaker moved for adoption of implementation policies. 1.
