Approval of Minutes : The approval of minutes of July 25, 1978 were postponed until August 8, 1978 in order to give Commission time for review. 4. Communications : t None 5 . Applicant' s Presentation: pp Martin Eggert, owner of the parcel in question was in concurrence with the staff report. C. Public Testimony: {I None D. Staff Recommendation: A. Based on findings of fact and conclusionary findings staff recommends approval subject to the following condition: MINUTES TIGARD PLANNING COPMlISSION August 1, 1978 Page 2 1. That either a non-remonstrance agreement with the L.I .D. (Local Improvement District) or a half street improvement dedication be granted for S.W. 97th in order to provide future access. The applicant should work with the city and county to determine the most effective procedure. E. Commission Discussion: o Wood asked what staff intended for S.W. 97th and Greenburg. o Howard stated that they requested a non- remonstrance agreement with the L.I .D. (Local Improvement District) for S.W. 97th or that the option of ordering a half street improve- ment on S .W. 97th in the event that there is no L.I .D. Local Improvement District, and that the applicant should work with the City in determining the most effective procedure. o Wood asked how action on S.W. 97th will be carried out, and how much dedication did staff want on S .W. 97th. o Howard stated that 30 feet right-of-way for local street. Eggert would have to reserve 15 feet right-of-way and do a half street improvement on it. Wood moved for approval based on staff findings with the following condition: 1. That the applicant either file a non-remonstrance agreement with respect to an L.I .D. (Local Improvement District) if street is dedicated or make a half street improvement to either/ or both S.W. 97th & Greenburg. 1 o Corliss seconded the motion . o Howard stated that Eggert would be responsible for a curb line along Greenburg and possibly the same along S ,W. 97th. Greenburg Road (Wash. Co. Tax R. Map 1S1 35CA, Tax Lot 1500) . A. Staff Report: (, Read by Howard B. Applicant' s Presentation: Martin Eggert stated that his proposal was in !' accordance with City Ordinance, and NPO Plan. The lot in question adjoins parcels on two sides that are zoned for multi-family use. The proposed duplex would provide a buffer between single family and multi-family dwellings. Martin Eggert stated that setbacks and access were no problem. Wood asked if Eggert is planning access off S.W. 97th? Eggert stated that the driveway was laid out to !; enable cars to turn around for entrance onto >> Greenburg, but if it was deemed necessary, access could be onto S .W. 97th. C. Public Testimony: None D. Staff Recommendation: t A. Staff recommends approval subject to the following conditions: 1. That a minor land partition be completed prior to site design review. 2. That access to Greenburg Road be limited if at all possible so that it may better serve it' s primary p pose of "collecting and distributing traffic between arterial r and local streets or directly to traffic destination" . That the duplex be submitted to site design review prior to issuance of a building permit. E. Commission Discussion: o Wood asked if it would constitute a problem for the primary access to be onto S.W. 97th? o Eggert expressed a concern with the current size of S.W. 97th. Thought that with the enlarged driveway access would be possible onto Greenburg. o Quimby stated that S.W. 97th would be a better access road for safety reasons. o Wood moved for approval of staff recommendations with the condition that the applicant should agree to close off access to Greenburg Road, if and when S .W. 97th becomes dedicated and approved. o Smith stated that it would be difficult to change access once a garage was facing Greenburg Road. . o Wood amended the motion to read that the applicant agrees to close off access to Greenburg if and when S.W. 97th is dedicated and improved if practicable. o Smith seconded the motion. Motion was approved unanimously. 6. Other Business: Howard suggested that to speed up planning processes that the City annex property by zone as stated in Municipal Code Ordinance 18. 12 .020 . In the current annexation of Portland Chain and the Robertson Tract they would be annexed into the 1. city and zoned according to the NPO designation for that area. There would be a public hearing at the Council level and the annexation would go to the Boundary Commission. Wood stated that the extra steps give the Council more leverage in setting conditions to make the newly .annexed area more compatible with the city. Tepedino stated concern with reducing steps and consequently loosing control, it might not be cost effective. Wood asked if the role of the NPO was affected by the proposed short cut. ti , , MINUTES ±li TIGARD PLANNING COMMISSION k r August 1, 1978 c{ Page 5 Tepedino asked about precedent setting by using the ordinance in this inatance. q r Tepedino stated that the suggestion would be better handled `' when the new planning director took over . Planning Commission members agreed. 6 .2 Conditional Use CU 20-78 (City of Tigard) A request by the City of Tigard to relocate the historic Tigard Home to a tract of land between Pacific Highway and Frontage Road at Park Street (Wash. Co . Tax Map 2S1 26B, Tax Lot unidentified) .. o Howard stated that due to time pressure the house would have to be moved, The conditions for parking and setbacks had been met . o Wood asked if legal notice had been given and how the parking had been dealt with? o Howard stated that legal notice was not necessary . There (.. would be fifteen (15) parking spaces and one bus space . } A picket fence was to go around the property and that parking would go to the design review board for approval . 1 o Smith moved for approval with the condition that parking 1 and landscaping be reviewed by the Design Review Board. , o Quimby seconded the motion . • o Motion was approved unanimously. Tepedino requested the status on the Merestone Development and their construction on the flood plain. Would like to see the minutes from that meeting. Wood asked about a possible curb between the bike path on Greenburg Road for safety reasons . Howard stated that a stripe was planned to separate them. 7 . Adjournment: . Publish TT 7-21-78 & 7-26-78 Amr STAFF REPORT Agenda 5.2 TIGARD PLANNING COMMISSION August 1, 1978 Fowler Jr. High School - Lecture Room 10865 SW Walnut Street, Tigard, Oregon DOCKET: Zone Change ZC 20-78 REQUEST: For a zone map amendment from RU-4 "Washington County" to R-7 "Single Family Residential" for a .41 acre parcel. LOCATION: 11450 SW Greenburg Rd. (Wash. Co. Tax Map 1S1 35CA, Tax Lot 1500) fl APPLICANT: Martin Eggert 1. Findings of Fact: A. The site is designated "Urban Low Density" on NPO #2 plan and is currently zoned Washington County RU-4 (Urban. Residential). B. The applicant is requesting the application of the City of Tigard zoning ordinance to a .41 acre parcel, annexed July 15, 1978. C. City of Tigard Ordinance 78-21 (April 24, 1978) directs the Planning Commission to conduct such proceedings as may be necessary to conform the authorized zoning and land use of the parcel to the requirements of the City's Zoning Map and Code. II. Staff findings and observations: A. The site is currently occupied by a single family residence and two storage buildings. The lot is currently bounded by single family dwellings on the N, E, S and W sides. To the SE across Greenburg Rd., the land is designated Urban Medium density and zoned A-2. The land to the West of the lot is designated Urban Medium density in accord with NPO #2. B. Water service is available to the site from the Metzger Water District's 6" line in Greenburg Rd. The existing house is served by USA's 8" Sewer. C. SW 97th Street is a private drive with no right-of-way, but could be useful in later redevelopment as an access road to the lot in question, and neighboring parcels. Greenburg Rd. is designated as a "collector" Street, requiring 60 ft. right- of-way minimum. Currently there is a 60' right-of-way. At this point, Greenbur Rd. is in substandard condition, with no curbs or sidewalks. STAFF REPORT (Page 2) III. Conclusionary Findings: A. There exists a public need to apply City of Tigard zoning to all parcels of land in the City in order to ease the administration of land use regulations and assume consistency throughout the City. B. The proposed R-7 is compatible with the surrounding zoning and NPO #2 plan designation of Urban Low Density. IV. Staff Recommendations: Staff recommends approval subject to the following conditions: 1. That either a non-remonstrance agreement with the LID or a half-street improvement dedication be granted in order to provide future access. (Tax Map 1S1 35CA, i'. Tax Lot 1400) i. • APPLICANT: Martin Eggert 1 { I. Findings of Fact: F' A. The site is designated "Urban Low Density Residential" on f, NPO #2 and zoned R-7 Single Family Residential" B. Section 18.20.020(1) of the Tigard Municipal Code permits "Duplex residential, with a minimum lot of 10,000 sq.ft. : one duplex per lot; or two single family attached units with a minimum lot average of 5,000 sq. ft. per unit. In , the event it appears that it is not practical to divide a legal lot into two lots of 5,000 sq. ft. ench, the Planning '' Director may approve the division, notwithstanding the fact that one lot is less than 5,000 sq. ft. , provided, however, that no such lot shall be smaller than 4,250 sq. ft. q C. The applicable policy from the NPO #2 plan is the following: Policy 7: Within the low density residential area, duplexes will be allowed on lots less appropriate for single family i' homes to include location at street, intersections and as t buffers between multi-family and single family areas. n II. Staff Observations: i • A. The applicant is requesting a Conditional Use permit to locate one duplex on a 10,000 sq. ft. lot adjacent to SW Greenburg 1; Rd. and SW 97th, leaving at least a 7,500 sq. ft. lot for the 1 existing single family dwelling. j. B. The site is flat and surrounded by single family dwellings to 1! the E, S, & N. The land to the SE and to the West is designated Urban Medium Density in accord with NPO #2. C.
