ment plans, subject to appeal to the Planning Commission.
The Director o_f Public Works shall act as the agent for control �

and final approval of submitted ronstruction plans. j

Section 5. Criteria �
5-1 Plan Submittal and Waiver of Requirements
Site, subdivision, and building plans submii;ted to the

Planning Director will include plans and design calculations ;,
for each detention facility proposed. Detention facilities
shall be designed so that they do i��t bec�me h�alth or
safety hazard� . In the case that exact campliance with the
Ordinance would result in the inability to use the land as
�` a.t is permitted to be used b,y Zoning Classification, the "

applicant may appe�al to the Planning Commission for a �,�

Detention ardiriance be so coxistrued or permitted as to
allow a negative impact upon or impairment ofi the intended
effectiveness of the City 's k'lood Plain Ordinance (Chapter
18 .57) . The City Council is vested with the authority to
intPrpret �.n.d .rule thereinrE�ard.

All plans submitted �or starmwater detention systems sha11
describe an adequate procedure o:� normal maintenance �or
the detention system. Any :��.iluxe o� the stormwater system,
due tc� inadec�uate n�rmal or eapital maintenanc�, shall be
the responsibility of the owner of the property on which the
deten�tion systern is located. It shall also be the pxoperty
owner 's responsibili.�ty to xemedy any ne��igence in maint-
enance that results in �:he failure of the s,ys�em. Periodic
inspection by tiae Public Works De.paxtment wi11 be made t�
determine conformity with the ordinance. The submittal of
plans �qr such a system or the purchase o�' propexty on
which such a system is locat�d shall be deemed an acceptance
of responsibility fox normal and capita.l maintenance of the
system.

Section 6 . Penalty �.
� Any development or redevelopment in which an applicant is j',

ment shall be considered an unlawful use of land and the ';�
applicant shall be deemed in vio�ation of this ordinance . ,

Any person violating any of the pxovisions of this ordinance
shall be guilty of a misdemeaiior, and, upon convi�tion
thereof, shall be punished b,y a fine of not less than �ne
hundred dollard ($100) , nor shall it exceed ozie thousand ''

both, for each vir�lation. Where there is a continuing
