CALL TO ORDER: The meeting was called to order at 7: 30 by Chairman Popp. 2 . ROLL CALL: Present : Moore, Nicoll, Phillips, Popp, Sakata, Tepedino, and Goldbach Excused Absence: Krause 3. APPROVAL OF MINUTES: Minutes of 9-21-76 were approved as read with the correction that the roll should list Phillips under excused absence. 4. COMMUNICATIONS : Popp read Mr. Porter ' s letter of resignation. Sakata moved and Phillips seconded to accept Porter 's resignation. The motion was approved by unanimous voice vote. Popp informed the Commission that the Vice Chairman' s position was now open. 5. PUBLIC HEARINGS : 5.1 ZONE CHANGE ZC 9-76 (Killian) A request by George Killian for a preliminary plan and program review of a proposed industrial-commercial planned development in a M-3 zone (light industrial) at the inter- section of S .W. 72nd and Upper Boones Ferry Road. Applicant 's Presentation : Mr. Jose Cruz, Parametrics: o explained the planned development concept and the proposed traffic patterns and stressed the need for a development in the area. o protested against the landscape setback required in the code. C. Public Testimony: None D. Staff Recommendations: 1 . The site plan be revised to reflect o A 20 ' front yard setback along S .W. 72nd Avenue and a 10 ' setback on Boones Ferry Road. o A 5 ' landscape buffer around the south and east perimeter. o The area marked "landscape storage" be replaced with parking. o The loading spaces for the warehouses be shown. o The bank drive-up window be moved to the east side of the building with a two lane drive. o A 20 ' landscape buffer be provided along the north side of the warehouse building along the Durham Road realignment . o Parking spaces be provided on the north end of the warehouse building. o The parking spaces on the south side of the warehouse building be changed. o Access drives be widened to 24 ' fully paved. 2. The site be annexed to and served by the Tigard Water District . 3. Land necessary to provide a 40' from center tight- of-way be dedicated to the city for S .W. 72nd Avenue and Upper Boones Ferry Road. 4 . An agreement to participate in the improvement of S.W. 72nd Avenue be filed with the City Recorder. 5. The uses allowed in the office/warehouse building be limited to those not requiring large truck deliveries. 6 . The applicant secure a statement from the Washington County Director .of Public Works stating that the • building locations will not conflict with the Durham Road realignment . Cross Examination: o Commissioners and staff discussed water district 's responsibilities and service capabilities. o Staff and Cruz presented different possibilities for drive-in bank window. o Croz objected to: o 5 ' buffer around the south and east property lines o removal of a portion of the building on north side o 1 ' access control easement along the north property line E. Commission Discussion: o Goldbach questioned the need for a 1 ' control strip. o Staff stated that with the easement the Planning Commission could review any future curb cuts onto S .W. Durham Road from this site. o Nicoli stated that it would be unfair for the appli- cant to have to construct a new water line when water was available on the site. o Staff stated that this was the recommendation by the water and fire district . o Sakata stated that the required landscaping would necessitate rearrangement of the buildings. o Nicoli suggested that the applicant re-submit the plan taking into consideration the staff recommendations. Moore moved and Sakata seconded that the motion be tabled until a new plan could be worked out with staff. The motion was approved by unanimous voice vote. 5,2 ZONING ORDINANCE AMENDMENT ZOA 6-76 Amends Chapter 18.76 of the Tigard Municipal Code by adding an expiration date of one year for variances not exercised. Staff Recommendations : Staff presented the wording prepared by the City Attorney, Expiration when unexercised When the Planning Commission (or , in the case of an appeal the City Council) approves a variance the rights thereby given to the applicant shall continue to exist and to be- long to the applicant or any other owner of the land for a period of one year from the date of final approval . If at the expiration of one year from the date of approval construction of the structure giving rise to the need for the variance has not begun, the rights given by the variance approval shall terminate without further action by the City, the Planning Commission, or the City Council . Such rights shall also terminate at or after the expira- tion of one year from approval if, though commenced with- ( in one year, construction ceases and is not resumed with- in 60 days. D. Commisson I)iscu.ssion: o Phillips questioned the use of the word "structure" , o Tepedino suggested that the wording be "construction of structure or intention of the use" . Tepedino moved and Moore seconded that the City Attorney 's recommendation be accepted with the addition of the words "or initiation of the use" after the words "construction of structure" . The motion was approved by unanimous voice vote. 6. SUBDIVISION: None 7. Applicant 's Presentation o Jerry Scott of Sign Craft stated Georgia Pacific ' s need for identification, that the area around the sign would be landscaped, and the owner of the pro- perty had given permission . Sakata questioned the appropriateness of Georgia Pacific listing their separate units . C. Public Testimony: None D. Staff Recommendations: Based on the findings in the staff report staff recommends approval with the following conditions : 1 . The existing sign be removed identifying the Wall Street Industrial Park. 2 . Location, composition, and size of sign to be approved by Design Review Board. ( 3. The area surrounding the sign be landscaped. 4 . If the need arises to identify the tenants of the Wall Street Industrial Park it be done by replacing the off premise sign. E. Commission Discussion: Moore moved and Goldbach seconded to accept the proposed with the staff recommendations. o Sakata stated that the sign should be only for identification. The motion was passed 5 to 2 with Phillips and Sakata dissenting. 7.2 CONDITIONAL USE CU 15-72 Tigard Request by Willamette Industries for review of a compliance schedule for satisfying conditions attached in 1972 but not fulfilled. A. Staff Report: Read by Daniels: Hm B. Applicant 's Presentation o George Swindell of Willamette Industries presented compliance schedule and stated that the conditions would be complied with by either Willamette Industries or Mr. Aitken. MINUTES Tigard Planning Commission October 5, 1976 Page 6 o Mr. Chuck Rouse, Willamette Industries, asked that item J be changed to read 12 ' instead of 8' . o Staff stated that a minimum of 10 ' was necessary for pedestrian/bicycle path and room for maintenance vehicles. o Nicoli stated that the owner should not be forced to dedicate usable land. o Swindell stated that at a future date a compatible use would be put in where the carpet store presently exists, o Staff and Commission discussed different traffic circulation patterns on the site. C. Public Testimony: None D. Staff Recommendations: o Staff had no formal recommendation but to ask the Commisson to inform the applicant whether the pro- k jected timetable was acceptable and requested a site plan providing for no access from Pacific Hwy . k for north bound traffic, a deceleration lane for south bound traffic, proposed access from Pacific Highway and showing the 10' bicycle/pedestrian easement . t' E. Commission Discussion o Swindell protested dedication of the pedestrian/ bicycle path. o Staff informed the Commission that all of the benefits of the conditional use permit have now been exercised but the obligation of the property owner to fulfill conditions of that permit remain. o Moore asked if as new members of the community Willamette Industries would voluntarily donate the 10 ' to the community for its transportation and recreation needs. o Swindell stated that it was not his company' s obliga- tion. o Staff stated that the pedestrian/bicycle transportation network which crosses this property is a responsibility of this property owner much the same as streets and !A sidewalks are. �`1 MINUTES R;I Tigard Planning Commission October 5, 1976 Page 7 o Mr. Jim Aitken, Tigard Lumber, offered to build a bridge so that pedestrians could use the other side of Fanno Creek. o Swindell informed the Commission that Mr. Aitken would replace the trees where necessary to screen the adjacent apartments. o Phillips moved and Nicoli seconded that the time- table be accepted as set out in the letter . o Tepedino asked that a detailed site plan showing traffic circulation be presented to the Planning Commission. o Moore asked that Design Review Board review the proposed sign. o Phillips amended the motion to include that the sign be subject to Design Review. The motion was approved by unanimous voice vote. 8. OTHER BUSINESS: 8.1 Dick Kl.uempke, chairman of NPO #3 read a letter from the Neighborhood Planning Organization (NPO) to the Washington County Planning Commission concerning the Bull Mountain hearing concerning the extension of Murray Blvd. Moore moved and Sakata seconded to fully support the letter from NPO #3 to Washington County Planning Commission. The motion was approved by unanimous voice vote. 8.2 Discussion of Economic Development Administration applica- tion for federal funds . o Staff presented the proposed plans for the City Hall office buildings. 8 . 3 Consideration of a resolution regarding the statewide land use planning program and Ballot Measure 10. o Staff read the proposed resolution. o Popp stated that defeat of this ballot measure is crucial to the planning program in Tigard. o Tepedino moved and Moore seconded to approve the resolu- tion submitted by staff with the addition that the City of Tigard and L.C.D.C. are on a friendly working basis, MINUTES Tigard Planning Commission October 5, 1976 Page 8 and mention of the encouragement and statewide recognition given to the City 's NPO process. The motion was approved by unanimous voice vote. 8.4 Sign Code Study Session o The following aspects of the sign code were discussed: window sign display, bench signs, revolving signs, flashing signs, non-conforming signs, and free-standing signs. 8.5 Sakata moved and Phillips seconded that Tepedino be installed as Vice Chairman. The motion was approved by unanimous voice vote. 9. ADJOURNMENT: There being no other business the meeting was adjourned at 11 : 15 P.M. ,. LOCATION: Southeast corner of S .W. Hunziker Street and S.W. Wall St. (Wash. Co. Tax Map 2S1 1 Tax Lot 800 and 1201) . APPLICANT: Georgia Pacific Corporation/Sign Craft I . BASIC FACTS 1 . The site is designated "General Industrial" on the Tigard Community Plan and zoned "M-3, Light Industrial" . Y � Light Section 16.40.040 (E) of the Tigard Municipal Code states "No off-pr.emisesign shall be permitted in any commercial or industrial zone, except outdoor advertising signs, as regulated in Section 16.40 .090" . II . FINDINGS 1 . The applicant is requesting to replace the Wall Street pp �. g industrial park sign with a wooden off-premise sign identifying Georgia Pacific. 2. The existing sign identifying the industrial park is per- mitted by Section 16. 36 .050 (2) which allows one free- standing industrial park sign with spaces for each tenant to be identified. 3. The proposed location does not violate setback or vision clearance requirements of the Tigard Municipal Code. III . STAFF RECOMMENDATION To be advised.
