CALL TO ORDER: The Meeting was called to order at 7:35 p.m. 2. ROLL CALL: Members present: Ems, Nicoli, Sakata, Popp, Porter, Wakem; staff: Powell 3. MINUTES: Minutes of November 4 approved with the correction of Wakem's vote on item 5.3 on page 5 to reflect that Wakem voted "aye" on the motion. Correction of addendum to Minutes of October 7 meeting were approved. 4. COMMUNICATIONS: Letter of resignation from Harris Hansen was read and accepted. 5. PUBLIC HEARINGS: Chairman Porter asked concurrence with an agenda change to the following order: 5.2, 5.5, 5.3, 5.4. The Commission concurred. 5.2 ZONE CHANGE ZC 15-75 (Hawes/St. Clair on behalf of Lyle Van Dyke) A. Staff Report: read by Powell. B. Applicant's Testimony: o Jack St. Clair presented his prepared responses to the "Fasano questions" o Dick Hawes spoke in favor of the project and answered further questions regarding need for this type of project. C. Staff Recommendations: staff recommended approval based on findings, on the conditions: 1. That applicant agree to improve SW 67th from the centerline to his property line and coordinate that improvement with that proposed opposite. 2. That there be no access to SW Hampton 3. 'J• . • r.. • d .s. • . a C , 4, • FF t A . • STAFF REPORT Tigard Planning Commission November 18, 1975 ZC 15-75 (Hawes & St. Claire for Lyle Van Dyke/office building) Agenda Item 5.2 ZONE CHANGE A request by Hawes and St. Clair on behalf of Lyle Van Dyke to zone a parcel at SW 67th and Hampton Streets, presently zoned Tigard R-7, single family residential, to C-P, commer- cial-professional. (Wash. Co. tax map 2S1 lAd, tax lot 400) . STAFF FINDINGS 1. Site proposed is designated on the Tigard Community Plan and the Tigard Triangle Plan (not adopted) as "commercial- residential" and "office park" respectively. 2. The site was annexed to the City of Tigard in September, 1975, by Boundary Commission Order No. 846. Subsequently, the lands subject to that order were recommended to be rezoned R-7 by the Tigard Planning Commission (ZC 11-75) on November 2, 1975. 3. The site presently is vacant, but adjacent parcels are used ° for single family residences. Across Hampton Street is the Lamb-Weston Office Park and' acr. oss 67th is a site recently approved for a commercial building. 4. Both the Tigard Community Plan and the Triangle Plan assume that SW Hampton St. (or part of it) and SW 68th will be the major streets in this area. Neither plan shows Hampton extending easterly of 68th as it now does, but rather advocate vacation of that portion of Hampton. 5. Staff, in its presentation of findings with respect to ZC 3-75 . (Schultz property, across 67th from this proposal) , discussed the staff' s concern about access to interior sites in the proposed "super blocks" . The Planning Commission, in that case, opted to provide half street improvements which would not foreclose the future option of closing Hampton St. east of 67th. This project will necessitate some decision with respect to that proposed street closure and vacation as the site fronts on both 67th and on Hampton in the area that would be vacated. It appears that actual vacation at this time would not be advisable in view of the fact that the southerly extension of the SW 68th Parkway has not yet been built. Staff has contacted Farmer's, through their architect, and found that they may agree to vacation of Hampton between 67th and 66th, as long as the extension of 68th is built first. y Y Page 2 is PC Staff Report November 18, 1975 ! Agenda Item 5.2 I J. 6. The proposed project would gain its access from SW 67th, (' which is not adequate, at present, to serve a commercial building, although adequate right-of-way is there. 7. Co. tax map 2S1 2AD, tax lots 200 and 300) . STAFF FINDINGS 1. Applicant has stated that his intent is to use an existing greenhouse and shed immediately for a greenhouse as a home occupation. He further intends, if this request is approved, to add from 1 to 3 additional greenhouses on the site to expand his operations. Additionall, he would intend to conduct "limited" retail sales from the site. 2. The surrounding present land uses are commercial, industrial, apartment residential and single family homes. 3. The site is presently zoned A-2, multi-family residential. 4. The Tigard Community Plan, as amended by N.P.O. #1, desig- nates this area as "Urban Medium Density Residential" . 5. "Conditional Use Greenhouses" , apparently including retail sales, and "Conditional Use Home Occupations" are both permitted conditionally in an A-2 zone. 6. The site has access onto SW Hall Boulevard and SW Scoffins St. 7. There are no present provisions made for parking or commer- cial access. In view of recent developments at the north end of SW Scoffins Street and the usually congested nature of Hall Blvd. , it appears that access from Scoffins St. may be preferable. 8. Staff sees no particular community impact from this pro- posal and feels that an area where transitional land use is the rule is better suited than a district committed to a particular economic function or development for this kind of independent activity. 9. The proposed use is not specified in any other zoning district than "residential" , although, by conditional use, it would be allowable in commercial zone districts. page 2 PC Staff Report November 18, 1975 Agenda Item 5.3 10. Co. tax map 2S1 11CC, tax lot 222) . Staff Findings 1. Tualatin Development's letter (October 21, 1975) requests a variance of the 10' required "front" yard --required under the conditions of approval for the Summerfield project. 2. Applicant alleg; that an engineering error caused the subject site to be undersized and th3 site opposite, on the other side of SW Greens Way, to be oversized. Applicant further states that said undersized lot has been sold to an in- dividual who now wishes to build a "MK V" house on the site, but that there is inadequate lot width for that particular house due to the dimensions and configuration of the site. 3. The variance requested would diminish the front yard setback facing SW Greens Way to 6' . 4. There are no adjacent buildings on that side of SW Greens Way that would establish a uniform setback, or with which a reduced setback would interfere; however, a reduced setback in this location will tend to make the proposed dwelling loom very close to the street as there will be open space t: both in front and in back of the house. 5. The requested variance would put the foundation 6' .from the property line and approximately 17' from the curb. The eaves , of the house would apparently project into this. 6. The proposed dwelling is approximately 42' wide. Other models built by Tualatin Development Co. vary from approximately 38' to 44' in width, according to information on file with the City. 7. Chapter 18.76 (Variances) of the Tigard Municipal Code states, in part that: "No variance shall be granted by the Planning Com- , mission unless it can be shown that all of the following conditions exist: 41. (1) Exceptional or extraordinary conditions applying to the. property that do not apply generally to other properties in the same zone or vicinity, which k conditions are a result of lot size or shape, topography, 4, .r, Page 2 PC Staff Report November 18, 1975 Agenda Item 5.4 or other circumstances over which the applicant has no control; (2) The variance is necessary for, the pre- servation of a property right of the applicant substantially the same as is possessed by owners of other property in the same zone or vicinity; (3) The authorization of the variance shall not be materially detrimental to the purposes of this title, be injurious to property in the zone or vicinity in which the property is located, or be otherwise detrimental to the objectives of any City development plan or policy; (4) The variance requested is the minimum variance from the provisions and standards of this title which will alleviate the hardship" (Ord, 70-32 S240-2, 1970) . W. Stewart to construct a bulkhead in the Flood Plain at 11880 SW 116th (Wash. Co. tax map 1S1 34CD, tax lot 1202) . Staff Findings 1. Applicant's house is built within the flood plain of Summer Creek toward the lower end of the Summer Creek drainage basin. 2. The Summer Creek drainage basin drains a large area north of Bull Mountain and is largely undeveloped. 3. Flooding on the applicant's site has, in recent years, flooded his carport, but has apparently not entered the house. 4. The site and the vicinity are primarily in single family residential use. Considerable land has been left open 4 along the creek due to flood hazard and ample overbank flood storage capacity exists to handle presently forecast flood volumes, providing adequate channel maintenance is undertaken (clearing of obstructing fallen trees and other debris) . 5. The proposed design for a concrete bulkhead is stamped by a registered professional engineer and may be assumed to be adequate structurally; however, staff questions the hydraulic effect of the wall, not addressed in the appli- cant's submitted materials. Staff's questions deal with basicly four, areas: (1) is the bulkhead high enough to prevent overtopping, (2) does it extend far enough upstream to prevent washing out from the upstream end, (3) will the bulkhead sustain undermining under flood velocities, and (4) what provisions are there to allow surface water to escape from behind the bulkhead. 6. Location of the proposed bulkhead will most likely cause some deflection of flood waters and result in a realignment downstream; however, it appears that, other than presenting a temporary silting problem, minor changes in the channel in this area will not much affect existing or probably future uses downstream. According to the Planning Com- mission minutes of November 17, 1970, the preliminary plat in this subdivision was approved with one of the conditions being that the extension of 110th St. be dedicated and improved to the standards of the Department of Public Works before development was initiated. However, the final approved plan indicates that a sidewalk would not be required on that side of 110th. In order to establish the reason- ing behind this final decision which deleted the preliminary plat condition, staff discovered, by speaking with former Public Works Director Nick Hiebert, that the slope of the terrain at this location would have been so severe that the construction of a sidewalk did not appear feasible. This, however, did not prove to be the case because later, when this area was graded, the slope was minimized to accommo- date sidewalk construction. Unfortunately, this was after-the-fact, being as the subdivision had already been approved, deleting this condition. According to Nick Hiebert, the Planning Commission was not consulted on this matter and that the final approval came from the Engineering Dept. This appeared to be an "unwritten policy" at that time. Perhaps the decision not to construct a sidewalk may have been correct, but clearly this matter should have been considered by the Planning Commission, or at least brought to their attention. An example of this type of decision making, which detours from the norm (in this case the subdivision code) to deal with a particular situation, ends up creating a greater problem in the long run. An unnecessary financial burden is placed on the purchaser of the property, who must rectify the matter at his own expense, when this cost should have been borne by the developer in the first place. Mira Court. Mr. Harald Wick built the home. There is a sidewalk on S. W. Mira Court, but none on S. W. 110th street. Dear Mr. & Mrs. Edwards: Please accept my apologies for not having responded to your. letter.of September 24 at an earlier time. I had set the letter aside in order that I might make a speedy response to you. I was subsequently called out of town for a week and your letter got buried, again my apologies. I, like you, do not understand why the Planning Commission did not require the builder/subdivider to complete the sidewalk on 110th Street. At the time of consideration of that matter by the Planning Commission the Engineering Department (City staff) recommended strongly that this side- walk be completed. However, the Planning Commission which is an appointed body, in its deliberations on that subdivision determined to not require the installation of the sidewalk on 110th Street. I have referred your letter to the Planning Commission for its further consideration however, I must advise you that it would appear to me that the Planning Commission having given its approval to that subdivision without the sidewalk probably cannot at this late date lay such a requirement against the subdivider at this time.
