C. Staf_f Recommendation � Staff r.ecammended approval with conditions: 1. That no portable or A-frame signs are to be located on the site and all other signs are to be brought into conformance with Tigard code. 2. There is to be no outside storage or display of tires or other automobile accessories. 3. Tra.sh and debris is to be confined to the collection area to the rear of the building, as provided on the general station plan. • 4. Applicant is to provide and maintain landscaping and � screening per code requirements. 5. Sight obscuring screening along the west line is to be replaced and the area to the rear of the service station is to be neatly landscaped and covered with appropriate groundcover materials. i D. The reasons given for not changing the zone from A-2 to R-7, as proposed by the NPO #2 Plan, , can be summarized as follows: 1. The surrounding properties are developed into primarily ; multi-family uses. ! � 2. The county has recently approved a zone change to multi- � family use, permitting 20 units to the acre on property � to the northwest of the Davis property. j i � 3. Due to surrounding deuelopment and increasing traffie � vo7_umes on Greenburg Rd. , the Davis proper�;y is no t longer suitable for single family residential use. i Following the testimony regarding Mr. Davis ' property, the staff ; ��_ was asked to explain why this property is proposed for single family use on the NPO �2 Plan. Staff explained that a major objective of the Plan was to conserve tlle existing single family residential development in the Greenburg area. Apartments were therefore proposed to be located on the peri.phery of the s�ngle family area, in � locations directly accessible to major arterials and shopping. Tn addition, staff pointed out that this peri�heral lacation E of mu�.ti-family development would provide a transition of t: use from the commercial development into the single family areas: ; The decision now before the Planning Commission is whether the ob- �!: jectives and criteria used by the Np0 to clefine a boundary between �j sin.gle family and multi-family areas were appropriately app�.ied to ^ the properties in quesi�ion. The staff sees this property as being � within an area of transition and is not able to determine clearly, �i as proposed by Dr. Davis, that this property has been "surrounded" �� by apartments. There are single family homes to th:e west and north „ and apartmens to the south and east (see attached rnap) . � It is the staff's opinion that a decision on this matter should � depend upon the degree to which the surroundings have been con- j verted to multi-family use. " An additional issue concerned the county's action in approving a zone change on a piece of property directly to the north and west for a hagher density t�an the multi-family density prescribed by the adopted Tigard Plan. The question arose that if the City's plans were not going to be honored by the county:, was it possible that the land in county zon.ing jurisdietion to the north and 'west would also be rezoned for multi-family use, in spite of Tigard' s �,, adopted Plan? The county has been ;written a letter regarding this ' pr�ablem of con�licting plans an.d once again copies of the adopted �' ' City plans (with adopting ordinances) have been forwarded to the Planning Department in Washington County. At this writing, no response has been received. In order t'o have some response for the Commission, this mat-ter was discussed with the county planners with the foll�wing re:ult. The co�r�ty planning staff assured .us ' { that at any time a rezoning is considered within the City's p�.anning i'. area, the City plan is consulted. They stated the unwritten policy to be one of coordinatin� the City and county plans as much as j ` possible in order that the integrity of neither is jeopardized. � Zn addition, they informed us that the Tigard-Metzger-Bull Mountain � P�.an is of top priority on their work schedul.e and suggested that �:TA work closely over the next few months to see that our separ�te plans can be properly coordinated. Colonial Texaco was annexed to the City of Tigard in 1973 and was zoried C-3. A service station is ordinarily a conditional use in a C-3 zone; however, an existing conditional use subject to an annexation is annexed as a permitted use. 2. Land use in the area is highway oriented commercial along Pacific Hwy. , although a more '�urban arterial commercial�� character is beginning to be evident. The lots behind the Pacific Hwy. frontage support mixed single family homes and apartments which here seem to be compatibly ` arranged. A general impression is of a pleasant, well- maintained, residential area. The site adjacent the ser- vice station on the west is presently under construction for two restaurants, "Shakey's Pizza" and "Country Kitchen". 3. The undeveloped area i�. the rear of the site provides an excellent buffer between the adjacent commercial and resi- dential uses, but needs to be maintained and perhaps modest-� ly landscaped. 4. The sight obscuring fencing formerly located near the property line adjacent "Shakey's" has been taken down. No informa�ion has been yet received whether the fence or a suitable sight obscuring hedge will �e replaced. 5. Access to the site appears very good with adequate sight distances for ingress and egress ,,due to appropriate set� backs being present. Traffic conflict with the driveway as located would be expected only during periods of heavy south bound traffic (evening rush hour) . 6. Proposed carwash (aceording to applicant) may slightly increase patronage and consequently the t�affic generation of the station. Applicant states that that could be a side effect. Staff's eva�.uation of the noise added by this instal�ation is that it is within acceptable limits (simiiar unit at �T :Barbur and Ca itol H p ' wy. She�.l Station) . 8. Site proposed is behind existing stati�n building, approxi- mately 45 ft. from the rear lot line. (It would be a proxi- mately 60 ft. from the n.earest sin�le family dwelling�. 9. Several existing, al�though comparatively minor vio�ations, of Tigard code were noted on staff inspection. These were outside storage and disp�.ay of tires, excessive signs, illegal "A frame" signs and banners. 10. The Tigard Community Plan designates -the area as "general commercial" and n.o NPO organization has yet been formed in 'this area to p�ovide other input. 11. Waste water disposal will be accepted by U.S.A. , but a sand and grease trap will likely be required. "Lot 82, Leron Heights #3" appears to l.ie near�y entirely within the area of the F].00d P�ain District as defined by Tigard Ordinance 74-50 and Washington County Public Works maps titled "F1ood Plain", Washington County, Oregon. 2. The Tigard Community Plan shows the wetlands adjacent Summer Creek on this site as "greenway'�. 3. Recent flooding has been rec�rded by nei hbors at approxi- � mately 162 ft. el.evation (mean sea. level�. According to the �- aerial planime�ric maps developed for the City of Tigard, the parcel proposed for segregation is nearly entire.ly less than that elevation. 4. Development within the Summer Creek drainage basin has been slow recently due to limited line capacity of the existing sewer and due to the large size and consequently high de- velopment costs af the remaining developable lands. Since most of the Summer Creek drainage basin is upstream of this site, the impact of future development will be felt in the o i io i in term of hi her over- area of this prop sed part t n ng s g . bank flows, increased velocities and shorter peaks. 5. Access to the parcel proposed would be from the northerly part of 116th, which should terminate in a cul-de-sac rathe.r than the present dead end ar�angement. Any such street improvements should be kept above flood levels by a sufficient height to ensure the aUai�.ability of emergency access. An alternative cou.l�d be to put 116th th,rough, crossing Summer Creek. Staff finds this alternative not acceptable due to the necessity of fil�ing across th� flood way and due to the potential for increased through traffic. 6.
