Co�issioners Wak,em and Ball announced they fel� they had a con- fli�t` of intere�st and asked the chairman's pertnission to abstain f�.^om participation in discussion and voting on this amendment. ' A recent question from the Planning Commission dealt with the propriety af approvi�g Chapter 1? mat�ers without a public hearing« Staff contacted the City A�torney and was told that, in his opinion, such matters would not require a public hearing unless contested. If controversy were to arise, then a public hearing should be advertised and held. Staff Findin�s l. Proposed PD is a replanned portion of a previously-approved residential project approved in June, 1968, by Washin ton County. The "Planned Residential" use was, at that time (19�8�, a con- ditional use allowed in an R-7 zone. The county approved a � concept plan under the P-R ordinance and the subsequent site plans did not have to be submitted until construc�tion was at hand. The project was to include a total of 298 dwelling units (224 apartment units and 74 town houses) on 19 acres for a density of 15.68 units per gross acre. 2. While the county's original P-R approval �n.cluded the observation that the development may take place over a five year period, several factors lead staff to the belief that the P-R desig- nation has lapsed: a. No development has occurred since 1972. b. Development has not occurred according to the master plan approved. c. The proposed development is of an entire�y dif�ferent character than previous development. d. The City o� Tigard has approved a Comprehensive Plan, The Ti�ard Communit.y Plan, which identifies this area as a transition area from ��Residential-Commercial" to "Urban Low Density Residential". 3. Actual development to date has occurred on about 11 acres of the original 19, with 150 dwelling units constructed for a density (gross) of 13.56 units per acre. 4. The undeveloped nature of lands to the south ''� and west of the site, as well as the excessive grades of SW �;I 109th there, and an awkward land ownership pattern contribute �!�I to staff's concern.
