TIGARD PLANNING COMMISSION October 1, 1974 Twality Junior High School - Lecture Room 14650 S. W. 97th Avenue, Tigard, Oregon 1. CALL TO ORDER A. The meeting was called to order at 7:40 p.m. 2. ROLL CALL A. Present: Ball, Barkhurst, Hansen, Nicoli, Popp, Sakata, Chairman Whittaker; City Planner Dick Bolen B. Absent: Hartman 3. APPROVAL OF MINUTES A. The minutes of the August 20, 1974 and August 27, 1974 approved as submitted. v a o ed meetings were b 4. MINOR LAND PARTITIONING MLP 7-74 (Way Lee) Location: For property located southerly of S. W. Pacific Highway at Pacific Highway's intersection with S. W. 69th Avenue. (Tax Map 1S1 36AB, Tax Lot 6500 and 6501; Tax Map 1S1 36DA, Tax Lots 300, 400 and 500) . A. Staff Findings 1. Bolen presented the relevant findings explaining the proposal's conformance with the Tigard Community Plan and outlining the need for a public street to serve this property. B. Testimony 1. Way Lee and his engineer were present and the engineer said that they had conceived of three alternate ways of providing a public street into the property and were desirous of a Planning Commission decision con- cerning the alternative best suited to the future development of subject and surrounding properties. C. Staff Recommendation 1. Staff recommended denial of the partitioning and recommended the applicant reapply for a major land partitioning which would provide for the inclusion • of a public street. D. Commission Discussion and Action 1. Popp stated that alternate "C" , which curves to the east on the southern portion of the property, is best suited to the terrain and possibly serves the City' s future plans for development of the area most com- pletely. 2. Barkhurst stated that he concurred with alternate "C" but saw no reason to include improvement of the street to the end of the applicant's property at this time. Rather, improvements should only include that portion now serving the two proposed restaurants. 3. Barkhurst moved that the item should not be considered as a minor partitioning, but as a major land partitioning. 4. Ball seconded the motion and the motion passed by unani- mous vote of the Commission present. 5. Hansen moved to direct Way Lee that the Planning Commission would like to see alternate "C" on a sub- mitted preliminary plat for a major land partitioning. Popp seconded. 6. Hansen's motion was put to a vote and failed by a majority voting no. 7. Barkhurst moved that the street construction extend to a point where the three alternates shown on the submitted sketch map form a "Y" and that right-of- way should be dedicated for all alternate "C" . In addition, he directed staff to prepare a condition to be considered with the preliminary plat which would require all of alternate "C" to be paved when needed in the future. He also directed staff to see that some method of turn-around, whether a cul-de-sac or using the proposed restaurant parking areas, be provided as as a temporary feature. << 8. Nicoll seconded and the motion passed by majority vote, Ball and Whittaker voting no. 9. Ball suggested that a bond be used to guarantee com- pletion of the area which would not be paved in con- 'S junction with development of the restaurant property. 5. NEIGHBORHOOD PLANNING ORGANIZATION - NPO #2 - Greenburg-Brookside A. Commission Discussion 1. Whittaker said that the Planning Commission appears Page 2 - PC Minutes - October 1, 1974 i to have formed a concensus that the site shown for (`I t a park on the NPO #2 Plan is the most suitable and 4{ that a public need for such a facility does appear €i to exist at this time. Ii 2. Ball suggested that the park board should be consulted in the future on the selection of park sites for ," neighborhood plans. 3. Ball suggested that the staff notify all persons affected by the NPO #2 Plan concerning zone changes, street extensions, etc. of the upcoming City Council hearing concerning this plan. 4. Whittaker said that the land along Tigard Street which is planned for residential development could possibly be better developed as some type of light industrial or limited commercial land development. In addition, Whittaker stated that the Planning Commission emphasizes the priorities for a development included within the Plan. 5. A question arose concerning the need for pedestrian crossing between Tigard and Commercial Streets across the railroad tracks at a point where Grant and 95th St. are located. The Planning Commission concurred that they would like to see a grade crossing in the ., form of a pedestrian-bicycle path at the railroad tracks at this point. 6. Whittaker stated that the statement from NPO #1 which stated that, "When existing streets are improved, careful consideration will be given to the effects upon widening existing homes near the right-of-way. " Also to be considered in the NPO #2 planning area is ;. the previous statement. 7. Ball stated that the policies referring to multi-family development carry some implications that the plan might in some way be purporting exclusionary methods. For example, that by constructing more expensive apartment units, a more desirable type of apartment tenant would be the result. He stated his belief that the plan should include no implication that there is an attempt to exclude persons of any economic class and that the r' plan should include a statement to this effect. 8. The Planning Commission discussed Mr. Ball 's concern and concurred that they should recommend to the Council `. that a statement be included within the text of the plan clearly stating the City's position that there �f is no effort implicit in the plan to exclude persons °: of specific economic class. " Page 3 - PC Minutes - October 1, 1974 t 9. Whittaker stated that policy 7 should read that, "Within the low density residential area, duplexes will be considered, " rather than "be allowed". 6. ADJOURNMENT A. W. 97th Avenue, Tigard, Oregon, on October 1, 1974, at 7:30 p.m. with respect to the following: A request by Melvin Knight and Arthur Remen for a con- ditional use permit to allow auto repair in the C-3, General Commercial zone on property located at 12455 S. W. Main Street. All persons having an interest in these matters are invited to attend and be heard. • Publish TT September 26, 1974 TIGARD PLANNING COMMISSION Staff Report October 1, 1974 Agenda Item 4.1 MLP 7-74 (Way Lee) Minor Land Partitioning For property located southerly of S. W. Pacific Highway at Pacific Highway's intersection with S. W. 69th Avenue. (Tax Map 1S1 36AD, Tax Lot 6500 and 6501; Tax Map 1S1 36DA, Tax Lot 300, 400 & 500) . Staff Findings 1. The site is currently vacant. The applicant proposes to construct and lease two restaurants as first phase develop- ment of the property. 2. The total site comprises16.9 acres. Tax Lots 6500 and 6501 are located within a C-3, General Commercial zone and Tax Lots 300, 400 and 500 are located within an R-7, Single Family Residential zone. 3. The Tigard Community Plan designates the subject site ( appropriate for "General Commercial"use, said Plan stating, "The development of individual properties in these areas should take into account the traffic safety and visual problems associated with 'strip commercial development' . The present pattern of development along Highway 99W is not desirable. It is dangerous, inefficient, confusing and unsightly. " Policy and Standard #5 of the General Commercial Section of the Tigard Community Plan states, "development will coincide with the provision of public streets, water and sewerage facilities.. These facilities shall be (a) cap- able of adequately serving all intervening properties as well as the proposed development and (b) designed to meet City or county standards. " Objective #2 of the General Commercial Section of the Tigard Community Plan states it is a plan objective "to minimize the inherent conflict between the safe, rapid movement of through traffic and shopper traffic on major streets". 4. The unadopted. Tigard Triangle Development Plan designates the subject site "Urban Medium Density Residential", said development being "characterized by single family homes clustered on small lots such as patio houses, duplexes, townhouses and garden apartments. Densities will range from 6 to 12 dwellings per gross acre. Mt J The Tigard Triangle Development Plan indicates a collector street connecting the subject property with S. W. Pacific Highway and the Oregon Education Association Office com- plex. This roadway is necessary to adequately serve the subject site as well as intervening properties as re- quired by Policy #5 of the General Commercial Section of the Tigard Community Plan. 5. The subject proposed collector street requires a minimum 60 feet of right-of-way and 44 feet of paving, assuming the parking of automobiles on the street. The subject collector street should generally follow the natural contours of the land and spur streets should be con- structed to serve adjacent properties. 6. Tigard has historically developed without an adequate traffic circulation system. The subject site provides a natural entrance to a large developable area of land from S. W. Pacific Highway at an existing intersection with S. W. 69th Avenue. 7. As the subject property and street abut the Oregon Edu- cation Association complex and through traffic cir- culation is a community need, the Oregon Education Association should be required to continue subject road through their property prior to or in conjunction with further development or land partitioning.
