Pacific Hihway and comprising .39 acres (Tax Map 1S1 36DB, Tax Lot 100). Applicant U. S. National Bank of Oregon Applicant's Request Approval of a .onditional use in a C-3, General Commercial zone to construct a drive-in back facility. lpplicant's Proposal To construct a drive-in bank facility. Staff Findings '°" 1. Please note the attac:hed staff repurt presented at the June 18, 1974 regular meeting and relevant to this case. Note also tlie enclosed minutes af the June 18, 1974 regulaz meeting. 2. This item was tabled at the June 18, 1974 regular meeting to allow the applicant time to conduct a more detailed traffic analysis. 3. The applicant retained Mr. Carl H. Buttke to conduct a detailed study of traffic problems that might occur by developing the subject pra, ject. Mr. Buttke did conduct such a study and his findings are summarized as follows: j . On the basis of this analysis it is concluded that the operation of a four unit drive-in bank at 71st and Pacific Highway is not expected to adversely affect traffic on the adjacent streets. , . The storage area for vehicles waiting to be serviced should contain a minimum space for 16 vehicles or a desired space for 20 vhicles. i . The bank exit into the Fred Meyer Shopping Center should be designed to minimize the traffic conflict with the entrance from Pacific Highway into the shopping center. Mr. Buttkes report is attached for your review. ' 4. The staff has reviewed Mr. Buttke's analysis and concurs with his findings. Please note Mr. Buttke did not recommend any one of his alternatives for safely accomodating traffic exiting the subject site. Alternate 2 appears to be the least confusing traffic pattern configuration, if autos can be prevented from exiting onto Pacific Highway. This configuration should r r... (cont.) be reviewed by the City Public Works and Oregon State Highway Departments as well as the Washington Cnunty Public Works Department. 5. Washington County has let the contract for improvement af S.W. 71st Avenue from Pacific Highway to Spruce Street. This improvement will create a 37 foot roadway, allowing room for lef t and right-hand turning movements for south bound a»tos entering Pacific Highway and allowing for a left turn lane into t►e subject site from S.W. 71st Avenue, Sta£f Recommenda tion It is felt the applicant has met the requirements of "Fasano", and has submitted sufficienr information to erisure that no adverse impact on adjacent properties or detriment to public safety will occur due to construction of the proposed use. However, design details must yet be completed on S.W. 71st Avenue and the exit area from the drive-in bank to ensure the puUlic safety. Consequently, it is recommended the Planning Gommission approve the applicar►t's request subject to the following conditions: . . That a traffic circulation plan for the drive-in bank exit area be approved by the City Public Works Department and the Oregon StaCe Highway Department. . That the location of the driveway entrance from S.W. 71st Avenue be placed as far north as feasible on the• subjet site and that said driveway location be approved by the Washington County Public Works Depar trnent. . That a storm drainage plan of the subject site be approved by the City ; Public Works Department. • • i . i. Walnut Street at Walnut's intersection with S.W. 124th Avenue. (Tax Map 2S1 3BC, Tax Lots 4200, 4300, 4500 & 4600). Staff Findings . 1. 'Phe Planning Commission considered this item at their March 20, 1973 and " • April 17, 1973 regular meetings. The applicant oxiginally requesed con- ; ditional use approval for five duplexes, but the request was denied by the lPlaaning Commission and the applicant was requested to resubmit his request ; as a planned residential development. The applicant did resubmit his l; project, including four duplexes, a's s plarined rsidential development. The Planning Commission on April 17, 1973 took actian to approve the I', applicnt's request for condi.ional use approval of for duplexes as a _ "planned residential'' development in a .R•7. Single Family Residential zone. i 2. On August 27, 1973, the Tigard City Council adopted a Sewer Permit Allocation ; r; policy that restricted the issuance of residential sewer permits to only ;; single family residences. ; 3. The applicant states in a June 24, 1974 leLter requsting the subject conditianal use renewal that "the reason fox this request is the sewer permit ban for multiple family dwellings in the Tigard area. The site II' plans and building plans originally submitted to the Planning Commission will remain unchanged." 4. The Planning Comm3ssion on Jume 19, 1974 approved site and landscaping I; plans as required by the applicant's conditional use approval of April T7, 1973. 1" . C 5. Section 18,72.030 states "If a conditional use is approved by the Planning ! Commission. and then is not exervised, it shail expire in one year from the t date of approval if the use has not begun and continual progress toward its ' full operation is not in evidence." , , Staff Recommendation Approval of the applicant's request far renewal of subject conditional use !' CU 7-73 based upon finding the applicant's failure to proceed with the subject F project was caused by a moratorium on the issuance of sewer permits to duplex ' dwellings. ` . The applicant proposes to farmalize approval of a pre- existing propery partitioning not acted upon by the • '; Planning Commission as required by law. The original tax lot has been split into three parcels over the last two years with no formal Planning Commission approval. II The applicant has now submitted a tentative plan for a . ; I' proposed partitioning. 2. The applicant praposes to dedicate a public right-of-way ; to serve lots created .by the proposed partitinning. ° 3. The Planning Commission, at their June 18, 1974, regular i meeing reviewed an application for Minor I,and Partition- ; ing o the same property and af-ter sa3d re4iew concluded that they conceptually approved the applicant's proposed partitioning, but felt a dedicated street was necessary to provide access to the future arcels. Consequently, the applicant was requested to resubmit his proposal as a Ma3or I,and Partitioning. pursuant Section 17.24.030,, Tiard Municipal Code. . , i 4. After reviewing the applicarit's proposal, it is felt that ;; there is no need for a future extension of the applicant's praposed street. S. W. 72nd Ave. will carry most of the northbound industrial traffic, particularly if a full " interchange is constructed at the S, W. 72nd overcrossing' of State HigYway 21'.' There is considerable interest in the full interehange proposal and if constructed, mot nrtherly bound traffic could use the full interchange • rather than a "cut-off" . street to Hunziker. The applicant's proposed street 3s located logically on the sub3ect property and' will provide safe nd adequate , access to future land parcels. 5. The Tigard Community Plan designaes the sub3ect site ; as "Genera ndustrial" and consequently intended to provide locations for a wide range of industrial uses that are compatibl8 with one another. . . . . . . . . . . . . . . .. . . ... . . . . . . .,i .,.:: . ...<. . _.._.: . .:,.:... .. .. .. . . ........ .. .. ...:._ .._.,... ........ .... .... ..,'.: ..... _ .. ... . ..... .. . ._ . . . ...., . ; 6. The subect`site is zoned M-2, CeneralIndustrial. ' Minimum lot area this zone is 6000 square feet. The proposed partitiotiing exceeds this minimum requiremert. . . 7. S. W. 72nd Ave. is designated by the Titard Communit Plan as a collector street and thus requiring a mimum ` bboot right-of-way. In addition, the City Publie Works Department is currently working with Sleavin-Bors Engineers to prepare engineering drawings for a realigned S. W. ?2nd (; Ave. The proposed realignment will straighten the exist- ing curve adacent the subect property by providing a 500 foot radius curve. Such a curve is necessary to in- ' crease public safety and will neces:sarily require addit- ional right-of-wa,y from the applicant's propertg. A local improvement district has been proposed to implement (: the realignment and improvement uf S. W. 72nd Avenue. _ 8. Sewer and water services are adacent to the subect site 9.
