Major Land Partitioning

For property located 800 feet westerly of S. W. 72nd Ave.
and 1200 feet northerly of S. W. Bonita Rd. (Tax Map 2S1
12A, Tax Lots 601 and 602).
Staff Findings
1. The applicant proposes to formalize approval of a pre-
existing
property partitioning not acted upon by the -
Planning Commission as required by law. The original
tax lot has been split into three parcels over the last
two years with no formal Planning Commission approval.
The applicant has now submitted a tentative plan for a
proposed partitioning.
2. The applicant proposes to dedicate a public right-of-way
to serve lots created .by the proposed partitioning.
3. The Planning Commission,, at their June 18, 1974, regular
meeting reviewed an application for Minor Land Partition-
ing on the same property and after said review concluded
that they conceptually approved the applicant's proposed
partitioning, but felt a dedicated street was necessary
to provide access to the future parcels. Consequently,
the applicant was requested to resubmit his proposal as a
Major Land Partitioning. pursuant Section 17.24.030, Tigard
Municipal Code.
4. After reviewing the applicant's proposal, it is felt that
there is no need for a future extension of the applicant's
proposed street. S. W. 72nd Ave. will carry most of the
northbound industrial traffic, particularly if a full
interchange is constructed at the S. W. 72nd overcrossing •
of State Highway 217. There is considerable interest in
the full interchange proposal and if constructed, most •
northerly bound traffic could use the full interchange -
rather than a "cut-off" street to Hunziker.
The applicant's proposed street is located logically on
the subject property and' will provide safe and adequate
access to future land parcels.

5. The Tigard Community Plan designates the subject site '
as "General Industrial" and consequently intended to
provide locations for a wide range of industrial uses
that are compatible with one another.

6. The subject site is zoned M-2, General Industrial. �y
Minimum lot area in this zone is 6000 square feet. The �k
proposed partitioning exceeds this minimum requirement.
7. S. W. 72nd Ave. is designated by the Ti and Communit
Plan as a collector street and thus requiring a m n mum
b'-Toot right-of-way. In addition, the City Public Works •
Department is currently working with Sleavin-Kors Engineers
to prepare engineering drawings for a realigned S. W. 72nd

Ave. The proposed realignment will straighten the exist-
ing curve adjacent the subject property by providing a
500 foot radius curve. Such a curve is necessary to in-
crease public safety and will necessarily require addit-
ional right-of-way from the applicant's property. A
local improvement district has been proposed to implement
the realignment and improvement of S. W. 72nd Avenue.
8. Sewer and water services are adjacent to the subject site.
9. The applicant's proposal meets the requirements of section
17.16.100 (1), (2), (3) and (4) Tigard Municipal Code.
Staff Recommendation
Approval of the applicant's proposed Major Land Partitioning
subject to the satisfaction of the following conditions:
1. That the property owner(s) shall agree to participate in
a local improvement distruct for the purpose of improving
S. W. 72nd Avenue to City collector street standards and
shall execute a recordable covenant herewith.

2. That the property owner(s) shall dedicate sufficient land
to allow a 500 foot radius curve for' the future alignment
of S. W. 72nd Avenue.
3. That the property owner(s) dedicate a street right-of-way
meeting City standards as defined by Section 17.28.040,
Tigard Municipal Code and as shown on the applicant's
tentative map of major land p artitioni ng and as approved
by the City Public Works Department.
4. That the property owner(s) construct' a street meeting City
standards as defined by Title 17, Tigard Municipal Code
within the dedicated right-of-way as shown on the appli-
cant's tentative map of Major Land Partitioning and
serving all partitioned parcels. All street construction t`
documents shall be approved by the City Public Works
Department. '
