� He stated that there is a community need for this
proposal as indicated by the granting of a charter

. The facility is to be purely oriented to auto- -
mobile traffic and is based upon a need for this
type of facility adjacent Pacific Highway. U. S.
' National �ank's Tigard branch drive-in banking
facility located on Main Street is now con�ested
and based upon the projected clientele growth in
the Tigard area, an additional drive-in banking
°� facility is greatly needed to lessen. the load on
�.,;
U. S. National's Main Street branch. "
Mr. Chillis continued by stating most customers
would use the proposed banking facility between .
the hours of 5 and 6 p,m. when going home from '
work. He said that U. S. Bank has retained Carl
Buttke to eva�.uate the traffic related problems
which could occur at the site. He presented the
� results of a 3 day study of traffic movements at
the corn�r of S. W. `7�st Street and Pacific Hwy. •
The resul�;s of this study showed that no more than
three cars were backed up at any one time waiting
to get onto Pacific Highway. He recalled Mr.
But�tke�s assumpt9_on that there are not a great
number of cars turning at S. W. 71st and that it
� does not appear �that any traffic related problems
''�' , will occur at this intersection which can not be
a�leviated.
B. Hartman asked Mr. Chillis how many cars would be
using the site.,per day.
C. Mr. Chillis said that approximately 180 per day
acaording to a mar�et survey conducted of the
commuters on Pacific Highway.
D. Ball asked how lang it would take to serve each ,
customer.
E. Mr. Chillis said from 30 seconds to 1� minutes.
F. Ball said if the number of cars �rojected durin� �
� the peak hour would be 100, that based upnn the time
needed to service each customer, there is the poss-
ibility of serious stacking problems resulting and
in�erfering with trazfic movements on S. W. 71st.
G. The architect pointed out that stacking room for 22
cars has been provided on the site.•
� H. Mickelson asked Mr'. Chillis if Mr. Bu�tke had ex-
pressed any concern about the mingling of traffic
leaving the drive-in banking facili.ty and tra�fic
entering the Fred Meyer Parking lot from Pacific
, Highway.

I. Mr, Chillis said ��yes" this is one point which Mr.
Buttke said could cause traffic problems.
� J. Brooks stated the traffic should be clearly channele:d
between the access for the Fred Meyer parking lot ,
and the e�ress from the drive-in bank.
'.,., K. Mickelson stated that, based upon the potential
' conflict of high speed traffic coming off o� Pac-
ific Highway and low speed traffic leaving the bank
facility, the access to the Fred Meyer par�kin� lat
from Pacific Highway should be closed at this point. •
L. No one was present to speak in opposition to this
request. .
Sta�f Recommendation
A. Brooks recommended tabling the iteni to a�1ow the
applicant to do further work toward developing a
traffic ci�rculation system to serve the site; of
particu�ar concern is the mingling of traffic
entering the Fred Meyer parking lot and traffic
� exiting for the bank.

Commission Discussion and Action
A. Barkhurst stated his agreement with Brooks ' re-
. commendation stating his belief �that a more de-
' tailed traffic study is needed. Barkhurst then
moved to table the item to allow the applicant . '
� to conduct a more detailed traffic analysis.

C. Mickelson stated his a reement with the staff

recommendation and expressed his feelin,g that the
applicant had met the Fasano requirements, but that
more detailed information was needed concerning
� potential traffic problems. .
D. Ba11 said that, based up�n the amount of traffic
wh,ich will be entering the bank at S. W. 71st, he
feels there would be a potential traffic hazard re-
sulting from waiting vehicles during the peak hour •
of u.sage.
E. The motion was put to a vote and p�ssed by unanimous

5. PUBLIC HEARINGS - Variance
5.1 V 2-74 (Portland Gymnastic Center)
A request to vary visiox� clearance standards of Title
18 (Tigard Municipal Code) from a required 10 feet
above the ground to 7 feet. Site is located adjacent
�, S. W. Pacific Highway and immediately soutZz of the
existing Family Drive-In sign, �1632 S. W. Pacific
Highway. .
Staff Findings .
A. Brpoks presented the staff findings relevant to
this case which included a history of past Planning
Commission action concerning the applicant's requested
sign location.
Testimony and Cross Examination
A. Gary Reddaway, the project architect, sta•ted the reason
for the variance from 10 to 7 feet was to allow
visibility of existing signs in the area, especially
�� the Family Drive-in sign. In addition, he stated
. that the public safety would not be jeopardized by
lowering the sign from ten to 7 feet because the
10 foot requirement is to allow visibility for trucks
. and this driveway woul.d be used exclusively by auto-
mobiles. � `.Phe seven foot clearance from the street
would be more than adequate to provide the necessary �
visibility. ;

B. Mickelson asked Dr. W�ebber, the owner of the gymnastic �
center, if the drive-in theatre was in agreement with �
, their proposal to place the sign at a height of seven
feet above ground. �
C. Dr. Webber said yes the owner would very adamantly
like to see th� sign where it does m t obscure his
� sign. In addition, the drive-in theatre would block '
the gymnastic center sign if the sign was placed at
10 feet rather than 7 feet.
D. No one appeared in opposition to this proposal.
Staff Recommendation �
� A. Brooks said it was his � judgment that the public safe- ,
ty would not be jeopardized by placing this sign at

whether or not the varianae should be granted, Brooks
stated this depenc�ed on the judgment of the Planning
� Commission as to whether the applicant has m8t. the

Municipal Code..

A. Mickelson moved to approve the request based upon
the finding that the four requirements listed in
the Tigard Munici.pal Code have been met and that .
the public safety would not be impaired.
. B. Barkhurst asked if the drive-in sign is legal or non-
' conforming and, if non-conforming, would therefore
be removed by 1980. �

C. Bolen stated that the drive-in sign is a legal sign !
based upon extensive footage on S. W. 72nd Avenue. j

D. Barkhurst seconded the motion and it passed by �
unanimous vote of the cammission present.

owner concerning the effects of this ordinance upon f

B. Brooks presented the revised ordinance and explained i
that its content had been changed from the originally ?
� submitted document, removing the 2 year moratorium �
provision and inclu�.ing a special review and permit �
section. This special review section was .fashioned �
' after the Washington Co�unty proposed ordinanae arad
would allow certain filling and devel.opment to take
� place in the flood plain as a result of the plar►ning �
� commission's determination that no adverse impacts
would re�ult. Brooks also raised the question of
� property which has been assessed for street or sewer
improvements, but as a result of this ordinance, n►ay

not be allowed to develop and thereby benefit from a

C. Fred Anderson said by adopting a flood plain ordinance �

A. Wally Johnson, who owns property on Fanno Creek at "
Grant and Tigard Streets, was present and stated �
his objection to what he considered a restrictive i
ordinance which could deny him the use of his prop- I
erty and part of h�s retirement income. He said j
the flood problems on Fanno Creek should be approached '
from the standpoint of f�.00d control rather thari making
� the land along Fanno Creek useless. He said the city
• of Tualatin has a flood ordinance which allows build�-
ings in the flood plain if constructed 1� feet above
the 100 year level.
Staff Recommendation
A. Brooks recommended tabling this item to allaw staff �
time to assess the magnitude of the assessment prob- �
lem. He recommended that this item be reconsidered
at the July 2nd meeting.

Commission Discussion and. Action

A. Fred Anderson stated such an ordinance must consider
the rights of both the property owner who would be
� affected by filling and development in the flood plain �
and also the interest of the property owner who wishes
, to fill and develop the flood plain.
B. Mickelson asked the staff if property owners 'along
Fanno Creek had been notified of the meeting. G

jec�; sign site location is adjacent the Pacific Highway
frontage r.oad at the Canterbury Square Shopping Center,
14455 S. W. Pacific Highway.

� A. Brooks presented the staff findings relevant to this
case.

Staff Recommendation �
A. Brooks recommended denial of the request based upon '�
� the fact that a wall sign would be va.sible from �
Pacific Highway, thereby alleviating the applicant's
� difficulty without necessitating a uariance from the
requirements of the ordinance.
Testimony ' .
A. Mr. Fleming was present and stated that he had taken
over a business which had failed twice before and
there was a 'very great need for visibility to pass-
ing motorists. He said 65 to 70� of their business
� was based upon transient traffic and it was not
possible for traffic from Pacifi_c Highwdy to see

their restaurant soon enough to a11ow them to get off I
the highway. �
. Commission Discussion and Action
A. Barkhurst said that the day care sign a-� the entrance
to the shopping center precludes the addition of a
� free-standing sign for Fleming�s restaurant, should
probably be of a lower priori�ty for using•the avail-
able sign area and suggested tha�t the center's mer-
chant association be persuaded to give the restaurant
sign precedence over the day eare center sign. Bark- .
hurst then stated that without evidence to the Plan-
ning Commission that ail alternatives for alleviating
the applicant's problem have already been pursued,
that the ordinance should not be varied and he there-
• fore moveci for denial for the requested variance.
Sakata seconded and the motion passed by unanimous
vote of the members present.
8. MINOR LAND PARTITIONING

A. Brooks presented the staff findings relevant to this

Testimony �
A. Mike McGee of Sabre Construction Cq. was present
and asked that the Minor Land Partitioning be approved �
in order that they might obtain a building permit and
begin immediate construction of a pending project.
He said that following approval of the Mi:nor Land
�� Partitioning, Sabre Construction will agree to makP � ;
application for a subdivision.
B. Hartman asked Brooks if he thought the Minor Land
Partitioning couldn't be granted with condition
requiring later applica tion for a subdivision.
C. Brooks said that, no, he did not feel that kind of
condition could be attached and no guarantee could
� be provided that they would come back for a sub-

D. Barkhurst stated his belief that all lats in the
`' development should be serwed by public access and this
would require the application for a major rather than
a Minor Larid Partitioning.
E. Ball said he did not see this as a Minor Land Partition-
ing and that it should be considered as �a Major Land
� Partitioning or Subdivision; however, the Planning
Commission could help alleviate the applicant's time �
scheduling difficulta.es by allowing this item to go �
directly �o the Design Review Board on Thursday, June
20th, where they could approve the subject project
to later approval of a Major Land Partitioning by �
the Planning Commission. The Planning Commission I
could then consider this item at next week's June �

1. On May 21, 1974, the Planning Commissian took action to vary ,
a prnvision of. Title 16, TMC and allow an off-prem�.se sign
. at the sub�ect loca.tian. Please note the attached minutes
of the May 21, 1974, Planning Cominission meeting.

2. Section 18.08.560, TMC, ' states " 'Vision clearance� area' means
I
a triangular area on a lot at the intersecti.on of two streets �
� or a street and a railroad, two sides of which are lot lines �
measureci from the corner intersection of the lot lines for a
distance specified in these regulations. The third side of the �
triangle is a line across the corner of the lot �oining the �
ends of the other two �sides. Where the lot lines at inter- �
sections have rounded corners, the lot lines will be extended l
in a straight line to a point of intersect�ion. The vision �
clearance area contains no plailting, walls, structures or �
temporary or permanent obstructions exceeding three feet in y
height, except occasional tree trunks or poles. The vision �
clearance area shall be measured from the top of the curb or, �
if there is no curb, from• the centerline street grade and ex= i
tend upward ten feet. " ;

3. Section 18.76.O1U (Tigard Municipal Code) states ". . .the
planning commission may authorize variances from the require-
ments of this title w�here it can be shown that, owing to
� special and unusual circumstances related to a specific piece
of property, the literal interpretation of this title would .
cause an undue to unnecessary hardship. In granting a variance
the planning commission may attach conditions which it find:s
necessary to protec't the best interests of the surrounding
�
= property or neighborhood and to otherwise achieve the
p�urposes of this title".
�"� In addition Section 18.76.020 (Tigard Municipal Code) states
�:k that "no var�.ance shall be granted by the planning commission
unless it can be shown that all the following conditions
exist:
(a) Exceptional or extraordinary conditions applying to the
property that do notapply generally to other properties
in the same zone or vicinity, which conditions are a
result of lot size or shape, topography, or othPr cir-
cumstances over which the appYicant has no control;
(b) The variance is necessary to the preservation of a
property ra.ght of the applicant substantislly the same
as is possessed by owrxers of other property in the same
zone or vicinity; ,
(c) The authorization of the variance sY�all not be materi.ally
� detrimental to the purposes o:f this title, be in�urtous
to property in the zone or vicinity in wh�.ch the proper�y
� is located, or be otherwise detrimen.tal to the ob�ectives
of any city development plan or golicy;
(d) The variance requested is the mini�mum variance from the
provisions and standards of this title which will allevi-
ate the hardship.'�
�� 4. Section 16.36.040, TMC, states "The Yninimum clearance below
the lowest portion of a free=standing sign and the ground be-
low shall be fourteen feet in any driveway or parking �rea."
5. Upon rev3.ewing the Planning Commission's previous approval of
the subject sign's location, it appeaars the sign is located
within a driveway area. See attacY�ed documents.
Staff Recommendation �
Withhold pending testimony by the applicant relative to the in-
tended location and design of the sign. Staff feels sign should
be located out of any driveway area and a minimum of l� feet be-
hind a curb.

Minor Land Partitioning
For property located on the westerly sfde of S. W. 72nd Ave., 1200 feet
north of S. W. Bonita Road. (Tax Map 2S1 12A Tax Lots 600 and 602).
Staff Findings
1. The subject property has been split into �ao separate tax lots without
Pla�ning Commission approval. The applicant wishes formal approval of
the proposed partitionirig so a building permit may be fssued for con-
struction of a warehouse facility on a portion of the subject property.

' 2. Access to the rear portion of the subject property is provided by a
� private street. Said street has a 40 foot paved sur£ace and is abutted
on the northerly side by a 10 foot utility easement. Said street is
proposed to dead end at the partitioned parcel. �
3. The applicant proposes to divide the remaining land into four more �
parcels, each parcel averaging a size of 1.2 acres.

4. Section 17.24.030, TMC, states, "A sketch map shall be submitted to the �
planning commission for revfew and determinati.on that the propos�d minor �
land partition shall be consistent with the comprehens�ve deveiopment
plan. If the proposal includes or should the planning commission re-
quire the dedication of land and easements for roads or streets, the
propasal shall not be processed as a minor land partition but may only
be resubmitted pursuant to requirements of this title with respect to ;
major land partition or subdivision." �

S. Section 17.24.040, TMC, states, "If the parcel of land to be partitioned
exceeds two acres and within a year is being partitioned into more than
two parcels, any one of which is less than one acre, f.ull compliance �,
with all requirements for subdivision may be required if the planning �,
, commission should deternnine that the entire parcel being partitioned
is in the process of being divided inta small parcels." ;�

6. The Ti�ard Community Plan designates the subject site as "General In• ;'
dustrial" and consequently int�nded "to provide locations for a wide �
range of industrial uses that are compatible with one another." ''

7. The subject site is zoned M-2, general industrial. Minimum lot area in E
this zone is 6000 square :Eeet. The proposed partitioning exceeds this �
requirement. �

8. As the existing private access street will serve several parcels, it is '�
- felt that the existing private street should be dedicated to the ubli ��

Hawever, the Planning Commission should consider the appropriate time
for said street to be dedicated.

That the Planning Commission determine the approptiateraess of a street
dedication. If t4�e Planning Commission so determines that a street dedication
is necessary at this time, the application may only be resubmitted a.s a
major level partition or subdivision.
