A. The meeting was called to order at 8:00 P.M.
II. ROLL CALL
A. Present: Commissioners Barkhurst, Hartman, Nicoll,

III. APPROVAL OF MINUTES
A. The minutes from the September 19, 1972 regular meeting were
approved as submitted.
IV. PUBLIC HEARING
A. Zone Change (ZC 4-72, carried over from September 19 meeting)

A request for a change of zone classification from R-7,
Single Family Residential to M-4, Industrial Park for a '
parcel located on the northeast corner of S.W. 72nd Avenue
and S.W. Sandburg Street (Tax Map 2S1 1D, Tax Lot 1501)

a. The staff recommended the request be denied.
b. The City Planner stated that it was the staff's
opinion that the subject site be developed under
the Planned Development or Commercial Professional
districts, and that the boundary line for `°M°t
zoning should remain at Sandburg Street.

2. Public Hearing
a. The public hearing was opened.
b. Mr. Whittaker explained that the staff, five members
of the Planning Commission and the residents of the
Rolling Hills Subdivision held a meeting to discuss
the best land use for the area.
c. Mr. John Matthews, 7904 S.W. Crestline Drive, representing
Fought and Sievers, testified in favor of the request.
d. Mr. Matthews stated that Ace Electric had purchased the
property with the understanding that M-2 zoning would
be provided.
e. Mr. Matthews showed the Planning Commission some preliminary
plans for Ace Electric.
f. Mr. Matthews stated that Ace Electric would employ
twenty people in the office and eight service men.
g. Mr. Matthews stated that there would be twenty feet
of planting on both Sandburg and 72nd, and that the
building setback would be 50 feet from 72nd Ave.
h. Mt. Matthews stated that he felt Ace Electric would
increase the surrounding property values.
i. Mr. Whittaker asked if the building would be metal.
j. Mr. Matthews stated the building would be brick.
k. Mt. Barkhurst asked who represented the subject site
for M-2.
1. Mr. Matthews stated that Fought and Sievers represented
the site for M-2.
m. Mr. Matthews stated that the City Planner suggested
Mm4, Industrial Park.
n. Mr. Paterson asked if the sale was conditional on the
zone change.
o. Mr. Matthews stated it was.
p. Mr. Whittaker stated that if the Planning Commission
would approve the M-4 zoning, Ace Electric would
have to be the occupant of the building.
q. Mr. Matthews stated that Ace Electric would have to
apply for a conditional use if the M-4 were approved.
r. Mr. Hartman stated that if the M-4 zone were approved
th',e Commission would not have control over the type
of business that would be developed.
s. Mt. Nhtthews asked if the Planning Commission could
grant the Me4 zone change with the condition that
Ace Electric be the occupant.
t. The Planning Commission stated that no conditions
could be put on the zone change.
u. Mr. Maxim, 13565 S.W. 72nd, presented a petition to
the Planning Commission containing 65 signatures of
the surrounding residents opposing the request.

v. Tom Apperson, 4171 West Bay Rd., Lake Oswego,
testified in favor of the request.
w. Mr. Apperson stated that Ace Electric was presently
located in a residential district in Portland and that
it was very compatible with the neighborhood.
x. Mr. Warren, 13535 S.W. 72nd, stated he lived directly
across the street from the subject site, and tiet he
was not in favor of anything being developed on the
site.
y. Mrs. Warren, 13535 S.W. 72nd, asked who was applying
for the zone change (Fought and Sievers or Ace Electric)
z. Mr. Whittaker explained that Ace Electric &s buying
the land from Fought and Sievers on the condition
that the zone change was approved.
aa. Mr. Woodworth, Lake Oswego, spoke to further explain
the question.
bb. The public hearing was closed.
3. Commission Discussion and Action
a. Mr. Barkhurst asked the hours the office employees and
service men would have.
b. Nr. Apperson stated that the hours would be from
8 to 5 and that the service men would take their
trucks home at night.
c. The City Planner explained that the M-4 zone was
initially recommended because it was the most
compatible industrial zone, but that further study
revealed a lack of control in all of the 94[0° zones.
d. Mr. Hartman stated that the Planning Commission has
a responsibility to the surrounding properties even
though they are out side the City limits.
e. It was moved (Hartman), seconded (aprkhurst) and
passed by unanimous vote of the Commission present
to deny the request.
f. Mr. Whittaker informed Mr. Apperson that they could
appeal the Planning Commission's decision to the
City Council within 15 days.
g. Mr. Whittaker explained to Mr. Apperson that the
Community Plan did recognize the existing subdivision
and that it was the Planning Commission's policy to
insure the livability of the subdivision.
B. Conditional Use (CU 13-72)

A request for conditional use approval to allow a duplex on
an R-7, Single Family Residential lot located on the northeast

Chapter 250.

or above)
d. Motels and hotels
e. Restaurants
f. Theaters
g. Limited Commercial uses if integrated within office-
park, including: confectionaries, barber shops, beauty
shops, delicatessens, pharmacies, florist shops, gift
shops, shoe repair shops
h. Similar uses if approved by Planning Commission
Section 210-8-c
To permit or afford better .light, air and vision on more
heavily traveled streets and on streets of substandard width;
to protect arterial streets; and to have the location of
structures compatible with. the need for the eventual widening
of streets, a yard shall be provided abutting streets and
portions of streets hereinafter named which shall be the
number of feet set forth below in the right-hand column,
measured at right angles to the centerline of the street and,
unless other wise described, measured from the fee title
or dedicated right-of-way of the public way.

b. Mr. Clark Ens, 13505 S.W. Cresmer, stated he had
no objection as long as the use was located between
the garage and frontage road.
c. Mr. Ens expressed concern over the noise from the
loud speaker.
d. Mr, Bartmess, applicant; stated that the loud
speaker was from his father's radio and the noise
would be stopped.
e, Mr. Fred. Olson, 13450 S.W. Pacific Highway, expressed
concern for the saleability of his property with the use
located next to him.
f. Mr. Olson asked if there would be some type of screening.
g. Mr. Seiniker; 11830 S.W. Caarde, questioned the length
of time the towed cars would be on the subject property.
h. Mr. Bartmess stated that he utilized wrecking yards where
he could take inoperable cars (if be had to keep them
for any length of time.)
i. Mr. Whittaker :;sked if the cars would be on the subject
property over night.
J. Mr. Bartmess stated that the cars could remain on the
subject property a day or so.
k. The public hearing was closed.
3. Commission Discussion and Action
a. Mr. Barkhurst expressed concern over the number and
length of time cars would be kept on the property.
b. Mr. Anderson stated t4wt the Planning Commission could
not condition the parking on the frontage road.
c. Mr. Paterson asked that condition number three be
changed to six months instead of one year.
d. It was moved (Barkhurst), seconded.Oaterson) .7,nd passed
by unanimous vote of the Commission present to approve
the request with the following conditions:
1. That a site obscuring fence be extended along
the south property line.
2. That repair work be limited to hours of 7:00 A.M.
to 9:00 P.M., and be carried out completely within
the garage.
3. That the conditional use permit shall be in effect
for six months, and then may be extended with Planning
Commission approval.

4. That inoperable vehicles shall not be stored on the
subject property, except within the garage.
5. That the use shall be confined to the area between
the garage and the frontage road and on the south
side of the driveway.

3. That all cul-de-sacs be desigced to forty feet of
right-of-way, twenty-eight 'feet of pavement, and be
named.
4. That ten feet be dedicated along S.W. Tiede ca Avenue
and one-half street improvements be completed and
coordinated with the City and Tigard School District.
Applicant's share of the improvement costs shall be
based on, and equal to, a standard one-half local street.
5. That sidewalks shall be four feet wide, located next
to the curbs, and shall meander around clustered mail
boxes. Said mail boxes shall be installed by the
subdivider.

parcel located on the northeast coiner of S.W. Sandburg Street
and S.W. 72nd Avenue.
• Staff Findings and Recommendation
•
The staff finds that the subject site is designated for industrial
or office development within the Tigard Community Plan. The area
west of 72nd Avenue is designated for "Urban Low Density" residential
development.
The staff further finds that the permitted and conditional uses in
the requested zone classification range from offices to manufacturing,
warehousing, and construction related contracting uses.

It is the staff's opinion that the existing boundary line of
industrial zoning should remain at Sandburg Street, and that the
subject site be developed under the P-D, Planned Development
or C-P, Commercial Professional zones. This would allow non-retail
office development and be compatible with current land use trends
along Sandburg Street and existing residential development on the
opposite side of S.W. 72nd Avenue.

The staff further finds that the adopted Tigard Community Plan states: •

to the west of 72nd. In making this assessment the following
conditions should be considered:

during the quieter periods of the day, as would be
produced by a three shift business.

Consideration should include setbacks, screening, landscaping
and height and mass of proposed structures as well as the

The area surrounding thr subject property is vaned C-3, General
Commercial and R-7,, Single Family Residential to the southeast. •I
Adjoining lots to the north and south support single family dwellings. III
Staff Findings and Recommendation
The staff finds that the present use can be operated compatibly
with surrounding land uses. However, if the present business
volume increases substantially, the available space on the subject
property will not be adequate for the use--and may affect compatibility .
with abutting properties.
The Tigard Community Plan designates the subject site for "residential-
commercial" development.
The,applicant states that the business is approximately 75%
towing and 25% auto repair. Also, most of the towing operation ,
is connected with Police agencies and all repair work is done
completely within the garage. The present operation consists of
one tow truck, one full-time employee (Mr. Bartmess) and one
part-time employee.

CITY OF TIGARD PLANNING COMMISSION
Notice is hereby given that a public bearing will be held
by the Planning Commission of the City of Tigard within
the Twality Jr. High School lecture room, at 14650 S.W. k.
97th, Tigard, Oregon on October 17, 1972 at 8:00 P.M.,
with respect to the following:
An application for conditional use approval to
allow an auto repair and towing service on a
C-3, General Commercial parcel located on the
east side of S.W. Pacific Highway approximately
300 feet south of S.W. Park Street (Tax Map
281 2CC, Tax Lot 100)
All persons having an interest in the matter are invited to
attend and be heard.

It is recommended that preliminary approval be granted with ,

1. That engineering plans and specifications shall
be approved prior to acceptance of the Final Plat. .,
2. That utility and storm drainage easements of five "

feet be provided along all property lines.

3. That all cul-de-sacs be designed to forty feet of
right-of-way, twenty-eight feet of pavement, and be
named.
4. That ten feet be dedicated along S.W. Tiedeman Avenue and
$` one-half street improvements be completed and coordinated
with the City and Tigard School District.
The applicant's
" share of the improvement costs shall be based on, and
equal to, a standard one-half local street.
5• That sidewalks shall be four feet wide, located next to
the curbs, and shall meander around clustered mail boxes.
Said mail boxes shall be installed by the subdivider.
6. That Tract "A" shall be dedicated to the City as part of
the Community's greenway system.
7. That $2.50 per square yard be deposited with the City for
the future continuation of the 5 foot-wide greenway
path system through Tract "A" (Total deposit to be
determined by Public Works Dept.)
8. That the 6-foot wide pedestrian and bicycle path .
easement on lots 10 and 11 be paved and shown as
a public easement.
