ROLL CALL A. Present: Commissioners Barkhurst, Hartman, Lewis, Nicoli, Severson, Whittaker and Chairman Paterson: Fred Anderson, City Attorney: Ray Rangila, City Planner f B. Absent: Commissioner Paulat " III. APPROVAL OF MINUTES A. The minutes for the May 16, 1972 meeting were approved as submitted. IV.. PUBLIC HEARING A. Conditional Use and Variance (CU 6-72 & V 3-72) LEO D, WHITE,Applicant A request for sideyard and access variance approval and conditional use approval to permit a silkscreen operation on an M-4, Industrial Park parcel located on the southwest side of S.W. Burnham Street approximately 110 feet south of S.W. Ash Street (Tax Map 2S1 2AD, Tax Lot 2700) 1. Staff Recommendation a. The staff recommended approval with conditions. 2. Public Hearing a. The public hearing was opened. b. Mr. George Penrose testified in favor of the request. t. c. Mr. Penrose stated that the applicant agreed with the staff recommendation. d.. Mr. Woodfield, adjoining .property owner, stated that he felt that this was a good solution to the problem of small nonconforming lots. -e. Are Daniels of Daniels, Wiggins and Daniels • ( Contracting Co., stated that he may apply for a similar variance request for his adjoining property to the east. f. The public hearing was closed. 3. Commission Discussion and Action a. Chairman Paterson asked if the abutting properties would be allowed to build on the property lines. b. The City .Planner stated that they would. c. Mr. Whittaker asked if .the abutting properties were under one ownership. d. The City Planner stated that the abutting properties were under separate ownerships. e. It was moved (Lewis) , seconded (Severson) and passed by unanimous vote of the Commission present to approve the request with the following conditions: • f 1. That the building be located on the westerly property line. 2. That the Planning Commission review and approve a completed site developpeat plan prior to issuance of a building permit. B. Conditional Use (CU 7-72) RALPH J. PETERS AND ALOYS SCHULZ, Applicants A request for conditional use approval to allow three duplexes on an R-7, Single Family Residential parcel comprising 11 acres, located on the west side of S.W. Tiedeman Ave. approximately 470 feet south of -.W. Pigard Street (Tax Map 1S1 34D, part of tax lot. 5600) 1. Staff Recommendation a. The staff recommended approval with conditions. 2. Public Hearing a.'' :The public hearing was opened. b. Mr. Bastian, 11675 S.W. Tiedeman Avenue, stated that he had no objections as long as the duplexes were nice. The public hearing was closed, 3. Commission Discussion and Action a. Mr. Hartman asked how much of the property . 0 subject to flooding. b. Mr. Peters stated that 15 percent of his property is subject to flooding and 25 percent of Mr. Schulz;s property. c. Mr. Barkhurst questioned condition 4 in the staff recommendation, d, Mr. Whittaker asked if one driveway could be placed between the duplexes allowing parking in. the back. e, Mr. Peters stated that there wasn't enough apace behind the duplexes to allow parking. f. Mr. Barkhurst asked if 30 feet would be enough for the greenway, g. Chairman Paterson stated that with a school on the other side of the creek there would be-enough open space. h. It,,was moved (Barkhurst) , seconded (Nicoli) to delete condition 4 in the staff recommendation. The motion was defeated by a 4 to 3 vote. (Commissioners Barkhurst, Nicoli and Severson voting yes. Commissioners Hartman, Lewis, Whittaker and Paterson voting no) i. It was moved (Hartman) , seconded (Whittaker) a ..,passed by unanimous vote of the Commission present' to approve the request with the following conditional 1, That the duplexes not having garages each have two covered off-street parking spaces. 2. That a minimum of thirty (30) feet.be dedicated to the city along Fenno Creek as part of the Community°s greenway system. 4. That* the roofs be wood shingles or shakes, unless specifically changed through the site development plan review procedure. • 5. Mr. Lewis-stated he felt lots 7 and 15 were very narrow. c.• Mr.• Nicoli questioned the placement of houses • on the lots. • d, - Chairman Paterson asked if the developer hada house design that would fit on the narrow lots, • e.. . The developer stated that he did not have any specific plans yet. f. Mr. Barkhurst• suggested that lots .17 and 18 be combined to make a duplex lot, and make lots 15 and 16 larger. g. The-;Commission discussed the feasibility of sidewalks on the cul-de-sacs. . They decided to have sidewalks around the cul-de-sacs. h, It was moved (Lewis) , seconded (Severson) and passed by unanimous vote of the Commission present to grant preliminary approval with the' following conditions: Pg. 4 - PC Minutes - June 20, 1972 P 1. That engineering plans and specifications shall be approved: prior to acceptance of the final plat. 2. That four-foot sidewalks be located next to the Curbs, to meander around clustered mailboxes. . 3. That a five-foot utility easement be provided along all property lines. if 4. That lots 17 and 18 be combined for a duplex lot and lots 15 and 16 made larger. R. It was moved (Lewis) , seconded (Severson) and approved by unanimous vote of the Commission present .to grant the Chairman the authority to sign the public street dedication agreement for the 35 by- 205 foot parcel located on the south side of S.W. Pacific Highway across from S.W. McKenzie Street. C. "Shady Lane" Planning Study (_ 1. Staff Recommendation a. The staff recommended preliminary approval of Concept A. 2. The commission accepted Chairman Paterson's resignation and commended him for a job well done. b. Mr. Nicoli nominated Mk. Whittaker for president. Mt. Lewis seconded the nomination.
