a. Maurice Sussman, Attorney for Irvington-
Moore, Mr, Howard Barnard, Mr, Jack Price
and E. W. DeKoning testified in favor of
the request,
b_ Mr. Sussman stated that one trailer housed
the planning department, the second housed
the purchasing department, and the third
housed a computer.
c. Mr. Sussman stated that the present parking
lot is heavily graveled.
d. Mr. DeKoning stated they had planned to
landscape the front 10 feet,
e. Mr. DeKoning stated that Irvington-Moore,
had tried to buy some of the property to
the west in order to plant some trees,
but the property owners had refused to sell.

the first condition.

time limit.

of one year the Commission would review the
application to determine if satisfactory

fencing of the outside storage.
jo The City Planner explained that the intent
of the condition was to insure orderly arrange-
ment of all outside material; to confine out-
side storage areas; and to screen storage as
much as possible.

that the outside storage was not in a neat and
orderly manner and that they were not notified
when the retaining wall was installed.
no Mr. DeKoning stated that the retaining wall
was installed to protect the abutting property.

another condition could be added stating that
storage must be orderly.
po Commissioner Fletcher asked if the scrap could
be picked up more often.
q0 Mr. Price stated that the scrap could be picked
up more often and that the storage area could
be moved to the east side of the building.
r4 Mr. Sussman asked how much of the parking lot
had to be paved.
s, The City Planner stated that all of the parking
lot, as well as driveways and maneuvering areas,
would be required to be paved.

3. Commission Discussion and Action

passed by a unanimous vote of the Commission
present to approve the request for temporary
offices and outside storage and to deny the
request for a temporary gravel parking lot,
with the following conditions:

addition, the front 10 feet of the subject

showing the location, varieties and size'

The staff further finds that the requested variance meets

It is recommended that the request be approved subject

The subject property is located on the north side of
S.W. Hunziker St. approximately 800 feet east of S.W.
Hall Blvd. and is developed with three buildings
utilized by the Irvington-Moore Co. Three noncomplying
mobile homes are located on the property and are being
utilized for office space.
Surrounding Zonin , and Land Use
The abutting parcels to the west are zoned R-7, Single

Family Residential and support residences. The area
surrounding the subject site to the north, east and
south is zoned M-3, Light Industrial and developed with
light industrial uses. The Beaverton-Tigard expressway
is located just to the northeast.
Applicant' s Justification
"AYp'1 i cants, Edwin W. DeKoning and Patricia DeKoning,
owners, and Irvington-Moore a division of U.S.N.R. ,
lessee of property owned by said DeKonings, request
conditional uses of property with respect to the
alleged apparent violations referred to in letter •
of October 15, 1.971 addressed to Irvington-Moore by
Ray Rangila, City Planner of City of Tigard.
Said letter makes specific reference to Section
170-2, 210-`6, 245-1 and 190-6 of the zoning ordinance
of the City of Tigard.

Irvington-Moore is the successor of Irvington Machine
Works, Inc. which moved its plant from Portland to the
present site in 1959.
Irvington-Moore is engaged in the manufacturing of
machinery used in the forest products industry. It
employes 150 to 160 persons. Its annual payroll
approximates $1,500,000. This manufacturing plant
was first established in a building approximately
38,000 square feet constructed 1959. It has just
completed two new buildings. The square footage of all
buildings total 78,000 square feet. The total plant is
located on a tract of land approximately fifteen acres.
The DeKonings plan to construct an additional building
to be used by Irvington-Moore as an office building
which will contain approximately 25,000 square feet.
• Conditional use is requested for the following:
(References are made to the sections in October 15, 1971
letter in the order set forth therein. )
1. Section 170-2. Outside Storage. Outside storage
of steel beams used in the manufacturing of saw-
mill and lumber manufacturing machinery, and
outside storage of prototype of lumber sorter and
stacker used for display, demonstration sad.

to have same in an enclosed building.
2. Section 210-6-B. Sgreenin . Temporary storage
of scrap metal and removable waste resulting from
operation of manufacturing plant and which is removed
periodically. The location of this area is 'far re owed,
approximately 400 feet, from pedestrian and vehicular
traffic. It is not adjacent to such traffic. There
are residential unite to the west of this area, none
of which is closer than approximately 175 feet.
Said residences are on elevated ground and a fence .
as required by the ordinance would not obstruct the
view of this area by the residents approximately {
175 feet away on elevated ground, Applicants would
be willing to plant trees on the adjacent land to 1'
the west to serve as a screen if permission were
granted by owners of said land, or applicants are
willing to purchase a strip of said adjacent prop-
erty from said owners and plant such trees. Appli-

3. Section '245-1. 222.29.4ry strue wu 'es. Irvington-
Moore is presently using three terl:porary structures as
offices. They are adjacent to h ,lain plant and are
approximately 300 feet from the closest road. Although
such temporary structures were constructed originally
as trailers they are in reality temporary buildings
and are not trailers and can be made into permanent
buildings by slight modifications. Their use is
absolutely necessary to the operation of this business.
It is contemplated that when the new office building
• is constructed said buildings will be removed.
4. Section 190-6. Off street parkin area. This
present off street par ing area exclusive of building
site is approximately 30,000 square feet and is heavily
graveled and will be maintained in good condition for
parking necessary and required for employees and visitors.
It is contemplated to build a new office building a part
of said area. The exact size and location of the new
office building has not yet been determined and will
be constructed either to the west of the present off
street parking area or on part or all of the present
off street parking area. When said new building is
constructed the remainder of said area used as an
off street parking area will be covered with asphalt."
Staff Findings and Recommendation
The staff finds that Section 190-6 of the City of Tigard ;!
Zoning Ordinance requires that " . . . all areas used for
the standing or maneuvering of vehicles shall be improved
according to the same specifications as required for city
streets. " It is the staff's opinion that the request
for temporary (3 to 5 years) gravel parking lot does
not meet the intent of the conditional use provisions
for temporary uses or temporary structures within Section
245 of the Zoning Ordinance. Also, approval of such a
permit could set a precedent for other industrial or,
commercial uses. 1'
The request for the temporary use of three mobile homes
as offices also does not appear to meet the intent of the
Zoning Ordinance, Section 245-3 (e. ) states:
"That the purpose for which the temporary use or occu-
pancy permit is sought is compatible with and incident
to the completion of the basic purpose for which the
land is being developed, and the duration of such use
is limited by the period of development, such as, temp-
orary sales office in a residential district."

It is the staff' s opinion that outside storage areas
should always be fenced in order to provide both visual .
screening and to confine storage areas.
The staff further finds that desirable screening from the '
abutting residential properties can only be accomplished .
with dense tree planting along the westerly property line. '
Such a screen will provide both a visual and noise buffer. -'
It is recommended that the request for outside storage
and the temporary offices be approved, and the temporary
gravel parking lot be denied, with the following conditions:
1. The use of the three temporary offices shall be .
limited to a period of one year, at the end of
which time permanent or alternative office space !
shall be utilized.
2. The outside storage area shall be located behind
the building and fenced, plans to be approved by - '
the Oity staff. If the existing lumber sorter
and stacker is no longer in use it shall be
dismantled and removed. Otherwise, it shall be
maintained in good condition.
3. A dense strip of trees shall be planted along the '
westerly property line if an agreement for an
easement or purchase is accepted by the adjoining
property owners. In addition, the front 10 feet of 1

"These features are necessary to insure good placement
of homes in relation to the topography and to preserve
as many trees in the existing holly grove as possible.
This will complement the undisturbed .92 acre wooded
open space at the west end of the subdivision. We
respectfully request approval of the proposed design."
Staff Findings and Recommendation
The staff finds that the standard 34 foot street for
cul-de-sacs is unnecessary, wasteful and detracts from
the residential appearance of most subdivisions. However,
it is the staff's Opinions that a minimum street width
of 28 feet is dee40Able in order to provide enough space
for emergency vehicle accese. Also, it is the staff's
opinion that sidewalks are not always necessary within },
cul-de-sacs for pedestrian traffic.
The staff further finds that local streets within urban
subdivisions should be provided with sidewalks on both
sides, with alternative pedestrian circulation systems
possible through planned development zoning. The staff
feels that sidewalks can be located next to the curbs and
it
looped around street light and mailbox clusters if
desitrned in coordination with utility companies.
The staff finds that the radius variances for the
cul-de-sacs and the 34 foot street are features which
will not impede vehicular circulation or safety.
The staff recommends approval of the following variances
and conditions :
1. Cul-de-sac street widths of 28 feet.
2. Cul-de-sac right-of-way radius of 45 feet and
street surfacing centerline radius of 80 feet on

3. The design and location of sidewalks shall be
coordinated with the utility companies and the City. '
