Planning Staff was advised to study the problem as it
relates to the City of Tigard, Tigard Water District,
Fire District and Tigard Building Department.
B. Chairman Paterson explained the current status of the
proposed Sign Ordinance,

PROPERTY INVOLVED: Northeast corner of Greenburg Road and Shady Lane
(Map 1S1 35B part of tax lot 200)
SIZE OF PROPERTY: 0.5 acres
STAFF FINDINGS AND RECOMMENDATIONS:
Staff Findings:
1. In 1969 the Planning Commission and City Council approved
a change of zone classification from R-7, single family
residential to C-3, general commercial for the subject
property, to facilitate the development of a restaurant
and delicatessen.
2. Another service station conditional use was previously
approved south of the subject site on Greenburg Road.
However, that conditional use expired on August 11, 1970
because development had not been initiated.
3. A count of service stations from the intersection of
Scholia Ferry Road and Hall Blvd. in Progress to 99W in
Tigard totals 28, most of which are less than one mile
from the Anderson site.
4. All four corners in Progress are now developed with
service stations.
5. The preliminary Comprehensive Plan designates general
office and industrial development along most of Hwy. 217
and 1-5, which will have high standards with limited
uses, low lot coverage and a great deal of landscaping.
6. The remaining corners of Hwy. 217 and Greenburg Road are
1 unincorporated and zoned R-7, single family residential.
Staff Recommendation:
Based on the following considerations and the lack of an existing land
use plan for the entire intersection, the staff recommends that the
request be denied. It is the staff's opinion that the request is
premature and that a coordinated City-County land use study of the ''
intersection be initiated.
Advantages
1. The site is well located with respect to access to the
Beaverton-Tigard Freeway and Greenburg Road.
2. The proposed site plan for the service station and adjoin-
ing
restaurant indicates a degree of harmony and compat-
ibility, although there is no gaurantee that the restaurant
will be developed.
Disadvantages
1. Public sewer does not serve the subject property. The
General Manager of the Unified Sewerage Agency indicated
a 20% possibility that hookups will be available in the
district after November 1, 1970.
2. Approval of the conditional use will set a precedent to
allow service stations on the other three quadrants.
3. The request does not appear to conform to the preliminary
comprehensive plan.
4. A land use plan for the entire intersection does not
exist at the present time.
If it is the Planning Commission's opinion that the service station
can be compatibly developed with designated future office and general
industrial development, the following provisions are recommended:
1. Frontage along Greenburg Road and Hwy. 217 shall be •
A
heavily landscaped and maintained with evergreen trees.
2. The following signing shall be permitted:
a. One non-moving free-standing business identification
sign shall be permitted, the maximum height of this
t sign to be 35 feet. Said sign shall be an unlettered ,
1> , pecten (shell) .
b. One permanently located price sign matching the
architectural design of the main building, a max-
imum of 12 square feet on each side and a maximum
height of 4 feet.
c. The two signs affixed to the station shall also be
unlettered pectens.
3. There shall be no automotive repair at the station, aside
from minor servicing.
4. There shall be no outside storage or display of merchandise
and/or motor vehicles.
5. Parspots, intermittently flashing lights, banners, pennants,
festoons of light, or other similar devices *hall not be
used in conjunction with the business.
6. Maximum hours of operation shall be from 7:00 A.M. to 10:00 P.K.
7. A detailed site plan showing structures, signing, landscaping,
topography, adequate storm drainage and access shall be sub-
mitted to and approved by the Planning Department prior to
the issuance of a building permit.
8. The conditional use permit shall automatically become null
and void one (1) year after its approval by the City Council
unless the applicant has secured a building permit prior to
that date and has actually commenced construction of the
structures authorized by the permit within said one (1) . ,
year period.
