MINUTES
Tigard Planning and Zoning Commission
Regular Meeting, Tuesday
October 15, 1968, 8:00 P.M.
1. ROLL CALL
A. Present: Clarence Nicoll, Everett Severson, Charles Woodard,
John Perry, Jim Aitken, members, and Allan Paterson, chairman;
Keith Thompson, Director of Public Works, Art Taylor, Asst.
Fire Chief, Tualatin Fire District, and Emily Wied, Planning
Administrator.

2. APPROVAL OF MINUTES
A. Minutes for the regular meeting of September 17, 1968, were
approved as written
3. APPLICATIONS FOR ACTION:
A. Continued hearing . . . Conditional Use:
Howard Adkins, Applicant Owner
A request for a planned residential Conditional Use in the
R-7 zone on his 1.35 acre property located at 10010 SW Garrett
Street (Map #2S1 2CD, Tax Lot 3600)
1. Staff recommendation for approval with conditions •
2. Public Hearing
a. A letter in opposition to the development was
read as received from Mr. and Mrs. William Sabisch,
9995 SW Garrett Street.
b. Mr. Frank Cresmer, 9980 SW Garrett, spoke in
opposition saying there was already too much traffic
on Garrett Street, and that multiple units were not
appropriate in this location. Mr. Chester Curry,
9975 SW Garrett Streets also spoke in opposition to
additional. traffic. Mr. Adkins, applicant, explained
his proposal and stated that, by leaving the existing
house on the front of the lot, the street would appear
essentially the same as it has in the past.
Marion Sabisch, 9995 SW Garrett, also spoke in
opposition saying that, conditional use or not, the
zone is still R-7 Single Family and that 16 units is
not Single family development.
c. Mr. Paterson asked Mr. Taylor to explain the fire
district's recommendation for a hydrant to be installed
on the property on an 8" line. Mr. Taylor said that
new building development should also bring utility '
development with it, otherwise new development puts a
burden on the surrounding neighborhood utilities.
Mr. Perry asked if. the State Fire Marshall would
require fire Hydrants. Mr. Taylor said, no, that
this office is concerned with life, and the insurance
people are concerned with dollars - - than an
insufficient amount of hydrants raises the fire
insurance rates.
d. Mr. Aitken suggested that the hearing be continued
next month so that the water and fire problems could
be investigated and solved. He said that he was
faced with the same problems with his subdivision to
the south.
e. Mr. Perry asked if the fire and water conditions
weren't a problem of the building department when 1
.. issuing a permit.
Hr. Paterson asked if the Planning and Zoning Commission .
should be an enforcement agency for the Fire and Water
Districts. P`.
f. Mr. Severson said he felt it was fairer to table this
".. application until the Water District can be counsulted ;�
as to its schedule for improvement of Garrett Street.
q. Mr. Paterson asked Mr. Adkins if this was agreeable to
him. Mr. Adkins said it appeared there really was no
other alternative. ,
• 4. Commission action I.
a. It was moved (Aitken) , seconded (Severson) , and passed
by majority vote of the Commission (Mr. Nicoli descenting) ;,.
that the Public Hearing be continued to the next meeting
of the Commission on November 19.

B. Conditional Use Application: Dolores Stover, applicant owner.
A request for a Conditional Use in the R-7 zone for a day nursery
without limitations on her property located at 8845 SW Hunziker i_
Road, Tigard, Oregon (Map #251 1BC, Tax Lot 1000)

2. Public Hearing:
a. Mr. Mayes, 12450 SW Knoll Drive, stated he felt that
the parking situation was still inadequate, that
Mrs. Stover should still be limited in the number of
. children she may care for, and that traffic in the I
area has only gotten heavier during the year.
. Mr. Joe Zawaske, 12360 SW Highway 217, said additional
children would be outrageous and he already objects to
• the noise. Mrs. Stover said that she didn't realize
that she hadn't complied with the request of the Council
as to her parking; she thought she had provided all she i,
was supposed to provide. She said she now had more F.
than ten children, but that she had complied with the
Council's limit until this September. She also stated 1
that she hoped to have 25-30 children to care for under
• this application.
Mrs. Mayes, 12450 SW Knoll Drive, said she felt the
number of children also should be limited. I.
• The Public Hearing was closed.
3. Commission discussion and action
a. Mr. Paterson asked Mrs. Stover if she would be willing I-
to bus the children. Mrs. Stover said it would be L
difficult at this time.
b. Mrs. Wied explained the staff feeling that the location
was poor and asked if Mrs. Stover would plan to relocate
if a limit was put on the number of children. She said,
no, that the house would now be hard to sell because of
the changes she had made in the house for a nursery
school.
c. It was moved (Nicoli) , seconded (Aitken) and passed by I,
unanimous vote of the Commission to approve a Conditional
Use for a day nursery for two years, with four parking fib
. spaces and limiting the number of children to ten. '

•• 2. Public Hearing
a. Mr. Fennel, School District Superintendent, introduced
Chuck Selig of Broome, Selig & Oringdmlph Architects, who
explained the school proposal and commented on the staff
recommendation:
1. They would prefer no access road to the back as it
would be difficult to keep the general public out,
and when Inez Street is extended, the police would
be able to get a good view of the back of the buildings
• from this street.
2. The fire hydrant requested on the property line between
the two Schools was a good plan, however, the one
suggested behind the new classroom building should
instead be located on Inez Street, when it is extended.
3. The utility easement item, and the sewer connection
item were agreeable to them.
4. They would like a variance from the sideyard setback
if it is necessary, as the only point at which the
distance might be in question, is on the new gymnasium,
a point which abuts only Templeton School property.
3. Commission discussion and action
a. Mr. Paterson suggested that in aligning the utility
easement, property could be transferred to Twality School
from Templeton School which would eliminate any sideyard
problem.
b. It was moved (Severson) , seconded (Aitken) and unanimously
passed by the Commission to approve the Conditional Use
with the following conditions:
1. That a 15' utility easement be granted along the south
property line from Pinebrook Terrace to 97th Avenue.
2. That the school connect to the sewer.
3. That a fire hydrant be installed along the property
line, between the two schools, on an 8" line and
meeting specifications of the Tigard Water District.
4. MISCFLLANFOUS
a. Dairy Queen Parking
• 1. Mr. Stan Adkins introduced the architect for the
parking plans for the shopping center, who explained
his reasons for the layout which was installed.
2. Mr. Adkins said•there had been a lack of communication
between his brother and himself over what was requested
by the Commission.
3. Mr. Paterson, Mr. Severson and Mr. Nicoli explained
that originally the street involved was to be a 50'
dedicated public street, and that concession had been
made allowing a private road of less width and with
only parallel parking. Diagonal parking was never
considered by the Staff or the Commission to he a good
arrangement at this intersection. Mr. Paterson reminded
Mr. Adkins that this road must be considered a street
serving the apartments, and not a part of the shopping
r� area parking lot.
4. Mr. Paterson asked Mr. Thompson if a traffic count
could be made on the road, a study of the way people are
parking in the diagonal spaces, and a Staff review
made of the previously proposed plan approved by
the Commission.

b. Other Matters
1. Mr. Stan Adkins presented plans for his apartment
complex, the NE corner of Bonita and the Beaverton-
Tualatin Highway. He requested the informal opinion
.. of the Commission as to the possibility of a variance
from the setbacks required in the A-2 zone because of
the difficulty of the terrain.
The Commission suggested that Mr. Adkins either try
to purchase some land from the property on the east
or rework his plans so that the setbacks are met.
2. Mr. Paterson asked Mrs. Wied about the progress on
the proposed Zoning Ordinance revisions. She explained
that further work has been postponed on the recommendation
of the new City Administrator, because work will soon
start on the Comprehensive Plan and the revisions should
conform with the goals of the Plan.
