Conditional Use - Day Nursery,
Staff report and recommendation for approval.
Public hearing opened,
James McCaffrey, representing Mrs. Stover, stated that the State
Department of Health has given approval to this location and also
the fire department. He also stated that since there was only
one licensed day nursery in Tigard, there was need for another..
Mrs. Stover listed several day nurseries in the surrounding area
and the zone they were located in. The majority were in residential
zones, Mrs. Stover stated that there would be from ten to twenty
children and that she would bus the children if necessary.
Two petitions were presented with 21 signatures of persons who
object to the proposed Conditional Use. A letter was read from
Mr, & Mrs, Craven who object to the proposed Conditional Use.
The following persons objected to the proposed conditional use:
C.H. Mayes, Tom Williams, Mrs, Martin, and Mrs, Williams, The
following reasons were discussed: it would devaluate the new
homes in this area, the noise would be objectionable, and if this
business was allowed, others would start in this area,
• Hearing closed.
Motion by Mr. Phillips to approve the Conditional Use with
following conditions: to That the applicant conform
with the parking plans as accepted on July 18, 1967, 2, That
the Conditional Use be restricted to a five year limit.
Seconded by Mr, Nicoli,
Approved by a 5-2 vote of the Commission

4, STAN ADKINS CONDITIONAL USE - Located at S.W. Pacific Hwy. & S.W. Ash
St., Part of Tax Lot 1700, 1800, & 1900,
Map 251 2AC, Present Zoning C-3 (General
Commercial) , Proposed Conditional Use -
Apartment House.
Staff report and recommendation for approval.
Public Hearing opened.
Stan Adkins explained the proposed development,
Hearing closed.
The Planning Commission discussed the application and the conditions
that would be required.
Motion by Mr. Annand for approval of the Conditional Use with
the following conditions: 1. That the hump in the driveway '4
be cut down to match the entrance level of Highway 99. 2. That
permanent curbing be laid on the Dairy Queen side of the road,
to the entrance of Highway 99. 3. That radiuses as described
on the drawing be put in at the entrance of Highway 99. 4. That
fi
concrete be laid from the Dairy Queen Curb to the Dairy Queen
wall. 5. That the parking lines, next to the driveway and
behind the Dairy Queen, be repainted. 6. That the dimensions
and all design work conform with the drawing presented to the
Commission., 7. That the proposed development conform with
the submitted plot plan using included landscaping.
Seconded by Mr. Severson.
Approved by a 6-1 vote of the Commission. Mr. Nicoli voted NO.
5. MISCELLANEOUS
1. VACATION OF CUL-DE-SAC - Located at 94th and S.W. Greenburg.

Ray Snyder presented a petition with signatures of 2/3
of the surrounding property owners who did not object
to the vacation.
Motion by Mr. Annand that the application be accepted and
tentative approval be given upon approval by the City
Attorney.
2. A special meeting will be held on November 7, 1967, at 7:30 P.M.
to discuss the Subdivision Ordinance.
3. A Planning & Zoning Consultant has been hired to work with the
staff.

The parcel under discussion is located on the corner
of Hunziker Road and Highway 217. It is abutted on • 0
either side by residential lots, and is directly across

• A. BACKGROUND

'' r' ; * 1. The request applicant, Delores Stover, made a •
previous application, which was granted by the
Planning and Zoning Commission. The same application
was denied by the City Council three weeks later.
*Attached sheet No. 1 gives more detail on the
previous application.
E. ACCESS AND TRAFFIC LOAD INCREASE
■
1. Access would be provided off of Hunziker onto
the property through a driveway cut in the above
mentioned road. .
■
2. The load on Hunziker would not increase significantly,
because the applicant intends to transport the
children in her own vehicle, both to and from
the parcel under discussion. .
C. DISTURBING INFLUENCE TO ABUTTING PARCELS r.
. • 1. The staff feels that because of a high wooden �,
fence, normal weather conditions, and the age of

pre-school children, that the disturbance would
not be signifigant.
