D. Good; A. Pietila; J. H. Schulte; C. R. Lamb; A. Mason and Mayor E. A. Woodard and City Attorney F. A. Anderson. President Phillips called the meeting to order at 7:30 P. M. and requested reading of the Minutes of the meeting of September q 9 9 P 19, 1963. The Minutes were then read and upon call for corrections or questions, none being offered, the Minutes were ordered approved as read. President Phillips: The first item is a request for a Variance from the Lone Oak Restaurant. Is Mr. Hess or his representative here? Attorney Glen Walker; Mr. Hempstreet, contractor for Mr. Hess; Mr. Woodcock of the Mobil Oil Company and Albert Hoffarber entered their appearance for Mr. Hess, who was called out of town by reason of illness in his family. i With respect to some comments made by Mr. Woodcock; Attorney Anderson stated; "I would like to make a statement for the record, that the Code was in effect ever since Washington County had a Code." President Phillips: I would like to, at this time, make some personal comments here; 1. It is definitely going to be an improvement to the City of Tigard; 2. It is going to cause no hardship on any one and 3, I see no reason why, personally, a Variance should not be granted to allow him to go ahead and construct. Do I hear any comments from the Commission? I think we have had a fair discussion on this matter. A. Mason: I move the Variance be granted. Motion seconded by J. H. Schulte. Upon call for vote, motion was unanimously approved by the Commission. President Phillips: The Planning and Zoning Commission will recommend to the City Council that a Variance be granted on Mr. Hess' project. Next on the Agenda is the request for Zone Change from Mr. Randall, 8975 S. W. Burnham Street. (President Phillips stated the position of the Commission and read a letter from Attorney Anderson with respect to the legality of use.) President Phillips: I would like to make a motion that the Zone Change from M-3 to A-2 at 8975 S. W. Burnham Street be denied. Motion seconded by L. D. Good. Upon call for vote, the motion was approved with majority members being present. (The position of the Commission as a recommendatory body was explained for the particular benefit of Mrs. Randall, who was representing her husband.) t President Phillips then discussed briefly the necessity for a special meeting to edit the sub-division ordinance and October 31st was selected. There was a short advisory explanation I' to the Commission on the annexation plans of the Willock I property and Poulin property. 1. 1 Motion by C. R. Lamb to adjourn; seconded by A.
