APPLICATION SUMMARY FILE NAME: THE INDEPENDENCE GROUP.LLC FILE NO.: Home Occupation Permit(HOP)Type II HOP2014-00037 PROPOSAL: The proposal would allow a Type II Home Occupation (The Independence Group, LLC) at 7355 SW Hermoso Way. The home occupation is for a law office with one employee. The home occupation would occupy approximately 500 square feet of an existing residence. No external changes are proposed as part of the application. ZONING DESIGNATION: MUE: mixed-use employment. The MUE zoning district is designed to apply to a majority of the land within the Tigard Triangle,a regional mixed-use employment district bounded by Pacific Highway (Hwy. 99),Highway 217 and I-5. This zoning district permits a wide range of uses including major retail goods and services, business/professional offices, civic uses and housing;the latter includes multi- family housing at a maximum density of 25 units/acre,equivalent to the R-25 zoning district.A wide range of uses,including but not limited to community recreation facilities,medical centers, schools,utilities and transit-related park-and- ride lots, are permitted conditionally. APPLICABLE REVIEW CRITERIA: Community Development Code Sections 18.742. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to the following conditions of approval. The findings and conclusions on which the decision is based are discussed in Section IV. HOP2014-00037 THE INDEPENDENCE GROUP,LLC PAGE 1 OF 6 CONDITIONS OF APPROVAL Unless noted otherwise,the staff contact shall be Agnes Kowacz,Associate Planner;503-718-2427. 1. Customers, clients, and employees may not park in the public right of way. All parking shall be accommodated on-site. 2. The applicant shall obtain all necessary permits for any structural, mechanical, electrical, or plumbing work performed as part of the home occupation. 3. The applicant shall obtain and annually renew a City of Tigard business license and any and all State and Federal approvals,permits,and licenses. SECTION III. BACKGROUND INFORMATION & PROJECT DESCRIPTION The project site is located at 7355 SW Hermoso Way, west of SW 72nd Avenue. The property is 14,999 square feet in size and contains a single-family home, two car garage and driveway. The site is surrounded by single family homes on all four sides. This application for a Type II Home Occupation would permit the owner to operate a law office at the existing residence. The applicant does have one outside employee. All activities will be contained within a 500 square foot area of the existing 2,306 square foot residence. The business will not generate more than six daily customers. SECTION IV. APPLICABLE REVIEW CRITERIA& FINDINGS As set forth in Table 18.520.1 of the Tigard Development Code, home occupations are an allowed land use in all commercial zones, subject to the approval standards and criteria contained in Chapter 18.742 (Home Occupations). Relevant standards and approval criteria are addressed below. 18.742 Home Occupations 18.742.040 General Approval Criteria A. General criteria. All home occupations except those that have proven nonconforming status shall observe the following criteria in addition to the standards established for Type I and Type II uses described in Section 18.742.050 of this chapter. 1. Home occupations may be undertaken only by the principal occupant(s) of a residential property. The applicant is the owner and occupant of the residence that will be undertaking the proposed home occupation. The owner does have one additional employee. This criterion is met. 2. There shall be no more than three deliveries per week to the residence by suppliers. The applicant states that the home occupation will not generate any weekly deliveries. This criterion is met. 3. There shall be no offensive noise,vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of Chapter 18.725, Environmental Performance Standards. 110P2014-00037'1'111?INDEPENDENCE GROUP,1.1,C I'.\GI?2 01.6 The home occupation is a law office which does not generate any of the items listed above. All activities will be conducted indoors between the hours of 8 AM and 10 PM. This criterion is met. 4. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes. All activities associated with the home occupation will be within the primary residence. The home occupation will occupy approximately 500 square feet of the 2,306 square foot residence, approximately 22%. This criterion is met. 5. A home occupation shall not make necessary a change in the State Building Code use classification of a dwelling unit. Any accessory building that is used must meet State Building Code requirements. No changes are proposed and the home occupation is not proposed within an accessory building. This criterion is met. 6. More than one business activity constituting two or more home occupations shall be allowed on one property only if the combined floor space of the business activities does not exceed the limitation of space imposed in Subsection 4 above. Each home occupation shall apply for a separate home occupation permit, if required as per this chapter, and each shall also have separate Business Tax Certificates. A search of city records shows no other home occupations at this site. This criterion is met. 7. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable materials which in the judgment of the Fire Marshal pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal for review the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use. The home occupation will not have any storage or distribution of toxic or flammable materials. The proposal was referred to the Tualatin Valley Fire & Rescue for review and comments. TVF & R reviewed the proposal reviewed the proposal and stated no concerns. This criterion is met. 8. No home occupation shall require any on or off-street parking other than that normally required for a residence. The project will not require any additional parking than is already provided for the existing residence. The existing residence has a two car garage and a large driveway available for use by the occupants or any employees and visitors. This criterion is met. 9. Ongoing mechanical repair conducted outside of an entirely-enclosed building; c.Junk and salvage operations; d. Storage and/or sale of fireworks The proposed home occupation does not involve any of the above land uses. This criterion is met. 10. There shall be no exterior storage of vehicles of any kind used for the business except that one commercially licensed vehicle of not more than three-quarters ton gross vehicle weight (GVW) may be parked outside of a structure or screened area. The applicant stated that he will not be utilizing a vehicle for the home occupation. This criterion does not apply. 18.742.050 Type I and Type II Home Occupations Defined A. Type I and II home occupations defined. Home occupations shall be administered as either Type I or Type II uses. A separate home occupation permit and/or fee is required for each property on which a Type II home occupation is undertaken. In addition to the general criteria outlined in Section 18.742.040, home occupations shall observe the following additional standards: 2. Type II home occupations. Property on which a Type II home occupation is located may show evidence that a business is being conducted from the premises. Therefore the following is allowed for Type II home occupations: a. One non-illuminated sign, not exceeding 1.5 square feet,which shall be attached to the residence or accessory structure or placed in a window; Signage is not proposed with this application. However, if the applicant decides to have a sign, a permit will be required. This standard does not apply. b. No more than one outside volunteer or employee who is not a principal resident of the premises; The applicant indicted that there is one outside employee that will participate in the home occupation. This standard is met. c. No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; The narrative states that clients are not expected to come to the residence. Meetings with clients will be held off site. However, if there are clients coming to the residence, it will not exceed more than six daily customers,who will park on site. This standard is met. d. Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. The applicant has not proposed any outdoor storage of materials.Waste associated with the home occupation will be disposed of with normal household garbage and recycling. Type II home occupation permit. A Type II home occupation permit will be processed by means of a Type II procedure, as governed by Section 18.390.040, after a demonstration that the proposal complies with all development criteria in Sections 18.742.040.A and 18.742.050.A.2 and subject to the following approval criteria: 1. Is in conformance with the standards contained in this chapter; and As discussed in this report, the application is consistent with the standards of this chapter, or will be consistent with conditions of approval. This criterion is met. 2. Will be subordinate to the residential use of the property; and As discussed in this report, the home occupation will be subordinate to the residential use of the property. The home occupation will occupy 500 square feet of the existing residence, or approximately 22°/o of the total square footage of all structures on the property. This criterion is met. 3. Is undertaken in a manner that is not detrimental nor disruptive in terms of appearance or operation to neighboring properties and residents. As discussed in this report, the home occupation is entirely contained within the residence and will not be detrimental or disruptive in terms of appearance or operation. This criterion is met. C. Conditions of approval. The Director may impose conditions upon the approval of a Type II home occupation permit to ensure compliance with the requirements of this chapter. These conditions may include, but are not limited to, the following: 6. Requiring street right-of-way to be free at all times of vehicles associated with the home occupation; A condition of approval has been added that prohibits customers, clients, and employees from parking in the public right of way, in compliance with this criterion. 14. Any other limitations which the Director considers to be necessary or desirable to make the use comply with the purposes stated in Sections 18.745.040 and 18.742.050. A condition of approval have been added to ensure any improvements to the existing residence or property are in compliance with all building division requirements and that parking is accommodated on site. FINDING: As discussed in the analysis above, the proposal meets, or can meet with conditions of approval, all standards and approval criteria pertaining to Type II Home Occupations. SECTION V. OTHER STAFF COMMENTS The Development Engineering Division had no objections to the proposal. SECTION VI. SECTION VII. Appeal: The Director's Decision is final on the date that it is mailed. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the Notice of Decision was mailed. The appeal fee schedule and forms are available from the Planning Division of Tigard City Hall, 13125 SW Hall Boulevard,Tigard, Oregon 97223. Unless the applicant is the appellant, the hearing on an appeal from the Director's Decision shall be confined to the specific issues identified in the written comments submitted by the parties during the comment period. Additional evidence concerning issues properly raised in the Notice of Appeal may be submitted by any party during the appeal hearing, subject to any additional rules of procedure that may be adopted from time to time by the appellate body.
