Proposed hours are Monday through Saturday 9 a.m. to 8 p.m. Expected number of clients is no more than six per day. COMPREHENSIVE PLAN DESIGNATION: Low-Density Residential. ZONING DESIGNATION: R-4.5; The R-4.5 zoning district is designed to accommodate detached single-family homes with or without accessory residential units at a minimum lot size of 7,500 square feet. Duplexes and attached single-family units are permitted conditionally. Some civic and institutional uses are also permitted conditionally. LOCATION: 9505 SW 74th Avenue;Washington County Tax Map 1S125DB,Tax Lot 04100. APPLICABLE REVIEW CRITERIA: Community Development Code Chapters 18.390, 18.510 and 18.742. SECTION II. DECISION Notice is hereby given that the City of Tigard Community Development Director's designee has APPROVED the above request subject to certain conditions of approval. The findings and conclusions on which the decision is based are noted in Section IV. HOP2009-00081 Scott Home Occupation Decision 010810 Page 1 CONDITIONS OF APPROVAL UNLESS OTHERWISE NOTED,THE STAFF CONTACT SHALL BE HAP WATKINS IN THE PLANNING DIVISION AT (503) 718-2440. 1. All Home Occupation standards discussed in this decision and detailed in the Tigard Development Code Chapter 18.742 must be complied with at all times. 2. The applicant/owner shall direct the employee or any customers who visit the site to park in the driveway and not utilize on street parking. 3. The applicant shall obtain the necessary building/plumbing/electrical permits for all proposed changes to the accessory building. 4. To meet Tualatin Valley Water requirements, the applicant is conditioned to obtain a permit and install a reduced pressure backflow device at the meter on the customer side. 5. For fire safety purposes the applicant shall install a portable fire extinguisher (2A10BC rating) and hang it on the hanger provided,in an accessible location near the exit. 6. The sign for the business is restricted to one and one half square feet and must be applied for and permitted by separate application. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received two written responses and one e-mail Mr. Warren Aney sent an e-mail complimenting the applicant on the improvements and maintenance of the property and expected the business to have no discernible effect on the neighborhood. He recommended a stipulation that there be no signage. Staff responded that the signage for the business would be restricted to no more than one and one half square feet. Mr.Jimmy Khoo wrote a letter stating that he felt a business at this address would diminish property values in the neighborhood, encourage more children to play near him, and allow unsightly signs. He also stated that there would probably be parking on 74th Avenue and Elmwood Street, as no one would be actively monitoring the business. He stated that Tigard's policy of reactive enforcement, complaint driven,was a farce and relied too heavily on local residents. He preferred the business be located elsewhere such as downtown so as not to detract from his quiet neighborhood. Staff explained to Mr. Khoo at the front counter that the applicant was assured the opportunity to have a home business if the criteria of TMC 18.742.040 are met and complied with during operation of the business. Mr. and Mrs. Kris Damian, et al, wrote a common letter basically concerned with the traffic on Elmwood Street since it was developed from a dead end street to a through street to 74th Avenue. There are many issues they have concerning the under-developed Elmwood Street,but not that portion in Tigard. The street that is narrow and curved is in unincorporated Washington County. With the narrow street, parking on the street, and children playing, they are very concerned that this business sets a precedent for more businesses in the neighborhood. Staff explained that this did not set a precedent,as it is not a variance or adjustment to land use regulations,rather,it is allowed outright if the approval criteria are met and maintained.Although most of the people were beyond the 500 foot cling radius, they will be added to the list for mailing notice of decision. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.390.040 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. HOP2009-00081 Scott Home Occupation Decision 010810 Page 2 In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication is not roughly proportional to the projected impacts of the development. Section 18.390.040 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. The applicant has submitted an impact study that addresses the impacts to the public systems. As there is no additional development or construction proposed or necessary to accommodate the use, there are few impacts that will be attributable to the Home Occupation. The nature of the business (hair salon) is not expected to contribute significant additional sewage, require significant additional water supply, increase storm drainage, detract from school capacity, require additional utility service, add demand to the park system, or generate noise beyond what is typical for a single family residence. The transportation system will experience an additional 12 trips per day maximum as a result of the business, which is within the street's current capacity. Local streets are designed to carry up to 1500 vehicle trips per day. There are approximately 40 homes located on the street, which would create 400 total vehicle trips per day based on the ITE (Institute of Traffic Engineers) manual. Therefore this standard is satisfied. Section 18.742.040 states that all home occupations except those that have proven non-conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by Michelle Scott who is a principal occupant of the property.Therefore, this criterion is met. There shall be no more than three deliveries per week to the residence by suppliers; The applicant estimates there will be few to no deliveries to the home salon business. Therefore, this criterion is met. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards; No offensive noise, vibration, smoke, dust, odors, etc. are anticipated based on the proposed Home Occupation business since it will be conducted indoors and involves no manufacturing or assembly. All proposed activities will take place within the accessory building.Therefore, this criterion is met. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; The salon is proposed in an accessory building that is 284 square feet. Therefore, this criterion is met. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TMC Title 14; No changes to the use classification of the accessory building are proposed. This criterion is not applicable. The proposed floor plan shows the addition of a restroom and shampoo sink. The decision is being conditioned that the applicant obtain all required permits from the Building Division. — -1111=111111111 HOP2009-00081 Scott Home Occupation Decision 010810 Page 3 More than one (1) business activity constituting two or more home occupations shall be allowed on one property, only if the combined floor space of the business activities does not exceed 25 percent of the combined gross floor area of the residence and accessory structure. Each home occupation shall apply for a separate home occupation permit. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. Although payment for each separate business is not required, it is required that all names of the businesses which are currently in operation at that location be specifically listed on the Business Tax Certificate and be visibly posted at the business location. There are no other Home Occupations approved or requested for this site. Therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; The applicant states that any chemical based product used for hair that may be considered toxic or flammable will comply with the regulations of the Oregon Health Licensing Agency,Board of Cosmetology. Therefore, this criterion is met. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has indicated that the driveway will be accessible to clients for parking. There will be two spaces available at all times. On-street parking is not permitted due to the width of the pavement and location of the site near a street corner. A concstion of approval will insure that the applicant adheres to this requirement. . The following uses are not allowed as home occupations: (a) Auto-body repair and painting. (b) Ongoing mechanical repair conducted outside of an entirely enclosed building. (c) Junk and salvage operations. (d) Storage and/or sale of fireworks. The proposed Home Occupation does not involve any of the above uses. Therefore, this criterion does not apply. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; The applicant has indicated that there will be no vehicle owned or operated by the proposed home salon. Therefore, this criterion is met. In addition to the general approval criteria, Type-II home occupations allow the following according to the TCDC chapter 18.142.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. There will be no additional employees or volunteers. The applicant has indicated that there will be a maximum of six clients per day for the business. The hours of operation for the business will be Monday through Saturday 9 a.m. to 8 p.m. Parking will be in the driveway. On-street parking is not permitted in this area. 'There will be no outdoor storage of materials associated with the home occupation. Therefore,these criteria are satisfied. SECTION V. OTHER STAFF COMMENTS The Tigard Development Engineer and Police Department were sent copies of the proposal and had no comments. The Tigard Building Department was sent copies of the proposal and no comments were received. SECTION VI. AGENCY COMMENTS Tualatin Valley Water commented that the salon will necessitate the installation of a reduced pressure backflow device at the meter on the customer side. The applicant is conditioned to obtain a permit and install such a device. Tualatin Valley Fire and Rescue commented that if the applicant provides a portable fire extinguisher and hangs it on the hanger provided, in an accessible location; then there will be no further concern. A condition of approval will ensure this requirement is met. SECTION VII. Any party with standing as provided in Section 18.390.040.G.1. may appeal this decision in accordance with Section 18.390.040.G.2. of the Tigard Community Development Code which provides that a written appeal together with the required fee shall be filed with the Director within ten (10) business days of the date the Notice of Decision was mailed. We object to allowing an in-home beauty salon business in this residential neighborhood due to the over diminishing of our street environment. We are particularly concerned as Elmwood Street is the logical traffic feeder street for the salon. From 80th street or Hall, it is the most direct route to the proposed salon as Elmwood ends on 74th nearly into the proposed business site. Traffic conditions on residential streets can greatly affect neighborhood livability. Our objection rises from the increased traffic on our street that will be a result of this business. This is not a home hobby business or mail order business that generates little or no impact to the neighborhood. Your notice indicates the applicant will be operating twelve hours a day, 6 days a week, until 8pm. The applicant anticipates six customers a day. However, with the hours and days she will be open, the potential for increased traffic is substantially increased. This will undoubtedly decrease our sense of community and our sense of well being. Elmwood Street is a neighborhood street. It barely supports the neighborhood traffic now. It cannot and should not have to support the increased traffic, however minimal, from a business located in an area zoned as residential. Since Elmwood Street was punched through to link 74th Street with 80th Street, this neighborhood has already experienced increased traffic to the extent that it is frequently unsafe. A commercial business does nothing to improve the safety of pedestrians, bicyclists, and drivers on our street let alone addressing the undesirable driver behaviors that we frequently notice. The west end of the street is a narrow unimproved roadway. Cars and trucks park on both sides of the street, some partially into the street, making it nearly impossible for two-way traffic. One house is built so that the street curves around it. The east side of the street beginning(or ending) with the new houses is an improved street but again, as a neighborhood street, cars and trucks are parked in the street on both sides. Like most neighborhoods, we strive to improve the real and perceived safety for all that use Elmwood. Adding a business does little to promote this. The street has limited visibility due to several blind curves and hills. There is no night lighting on most of Elmwood. Yet vehicles speed around the corners but are unable to spot someone or something in the street. Crossing the street to get to the mail box as well as backing out of the driveway can be risky.Navigating Elmwood is a hazardous proposition at times. We find little comfort in the lack of plan to reduce the cut-through traffic in our neighborhood. Finally, we are also concerned that allowing one business into the residential neighborhood will set precedence and open the door for others to open businesses in their home. There are commercial areas nearby this neighborhood that would be more appropriately zoned for this business. The following are the many grounds why you and the City of Tigard should reject the Permit application outright: 1. We must remind you and the city that the applicant is NOT the owner of the said property. Even if the owner of the property,which is said to be the parents of the applicant, had they applied, we would still advise you and the city to reject this application for the many land owners in the vicinity had purchased their property to live in a quiet, low density residential district with no commercial undertaking whatsoever. 2. We appeal to you and the city NOT to turn the area from a quiet,picturesque and full of green environment to one of small businesses. It would set a precedent and in the end will surely lower the property values of this area and ultimately Tigard City value as well. One neighbor talked about how"green" it will be for the said Salon to be approved. We beg to differ. We feel that it will be much more"green" for Tigard City to persuade the applicant to open up shop in downtown Tigard. Not only convenient bus and train transportation are available downtown,many retail outlets costs are lower and available there at this time. It will be a Win Win and Win situation for the City of Tigard, the applicant, and us, if this alternative suggestion is taken up. 3. As we had discussed at Tigard City Hall recently, one of the restrictions for the Permit is the number of clients limited to six per day. The question was posed to you after that was this: "Who will be monitoring this?"And you had stated, "this condition will be enforced if the neighbors complained." This restriction is a farce! Tigard City will not be able to monitor or enforce it, and neighbors are not a monitoring or policing force! 4. As we had discussed at Tigard City Hall recently, one of the restrictions for the permit is the hours of operation, that is, Mondays to Saturdays 9.00 am to 8.00 pm. Again,the same question was posed to and you answered likewise"this condition will be enforced if the neighbors complained."Again, the neighbors are not a monitoring or policing force! 5. As we had discussed at Tigard City Hall recently, one of the restrictions for the permit is"no parking of clients cars on the city roads except on the property's driveway." It appears that this condition has been deleted in your official notice. The applicant has three cars parked in their driveway most of the time. Cars are park hazardously along narrow 74`h Avenue sometimes, when the basketball hoop in the property's driveway is used. One can assume that there will be occasions when client cars will be "conveniently" parked along 74th Avenue and especially on the north end and side of Elmwood Street. We would not want traffic congestion and indiscriminate parking along 74`h Avenue and Elmwood Street at all! 6. Please note that the son of the applicant has been playing(frisbee, football, dodgeball, basket- ball, etc) on the previously dead-end, and now through road on the north end of Elmwood Street. He has been an intransigent and a nuisance most afternoons or evenings alone or with his friends and school buddies. They treat the hoop,our pavement and road frontage as their own basketball court and public park. A through traffic road today, it is dicey to play on Elmwood Street. The less traffic and level frontage as well as the hoop on the pavement in Washington County is an attraction here. He has invited school friends and neighborhood kids as far as from four houses down Elmwood Street, Cedar Crest Blvd to the neighborhood, as far as Tigard Armory and the Fred Myer areas to create ruckus in this vicinity. One can rest assured that there will be occasions when client kids will be invited to play and add to the daily disturbance. 7. We observed that the application for this permit makes no mention of allowing or prohibiting any signage. If signage is allowed, it will be an eyesore! 8. Lastly, as I had stated in our conversation at Tigard City Hall recently,if this permit is approved, the reputation of Tigard as a fine city and great environment to bring up children will be greatly compromised. From Customer Service 101 I paraphrase this—"for every property owner affected, nine more potential buyers of property in Tigard will be told of her poor foresight and planning and thus affecting her future property development and growth." We hope you will use your sensible recommendations and bring our objections to the Tigard City to see that the application is NOT APPROVED. The applicant/owner shall direct the employee or any customers who visit the site to park in the driveway and not utilize on street parking. 3. The applicant shall obtain the necessary building/plumbing/electrical permits for all proposed changes to the accessory building. 4. To meet Tualatin Valley Water requirements, the applicant is conditioned to obtain a permit and install a reduced pressure backflow device at the meter on the customer side. 5. For fire safety purposes the applicant shall install a portable fire extinguisher (2A1OBC rating) and hang it on the hanger provided,in an accessible location near the exit. 6. The sign for the business is restricted to one and one half square feet and must be applied for and permitted by separate application. SECTION III. PUBLIC COMMENTS RECEIVED The City mailed notice to property owners within 500 feet of the subject site providing them an opportunity to comment. The City received two written responses and one e-mail. Mr. Warren Aney sent an e-mail complimenting the applicant on the improvements and maintenance of the property and expected the business to have no discernible effect on the neighborhood. He recommended a stipulation that there be no s Staff responded that the signage for the business would be restricted to no more than one and one half uare feet. Mr. imm stating Khoo wrote a letter sta that he felt a business at this address would diminish property values in the neighborhood, encourage more children to play near him, and allow unsightly signs. He also stated that there would probably be parking on 74th Avenue and Elmwood Street, as no one would be actively monitoring the business. He stated that Tigard's policy of reactive enforcement,complaint driven,was a farce and relied too heavily on local residents. He preferred the business be located elsewhere such as downtown so as not to detract from his quiet neighborhood. Staff explained to Mr. Khoo at the front counter that the applicant was assured the opportunity to have a home business if the criteria of TMC 18.742.040 are met and complied with during operation of the business. Mr. and Mrs. Kris Damiano, et al, wrote a common letter basically concerned with the traffic on Elmwood Street since it was developed from a dead end street to a through street to 74th Avenue.There are many issues they have concerning the under-developed Elmwood Street, but not that portion in Tigard. The street that is narrow and curved is in unincorporated Washington County. With the narrow street, parking on the street, and children playing, they are very concerned that this business sets a precedent for more businesses in the neighborhood. Staff explained that this did not set a precedent,as it is not a variance or adjustment to land use regulations,rather,it is allowed outright if the approval criteria are met and maintained. Although most of the people were beyond the 500 foot mailing radius,they will be added to the list for mailing notice of decision. SECTION IV. APPLICABLE REVIEW CRITERIA AND FINDINGS Section 18.390.040 states that the applicant shall provide an impact study to quantify the effect of development on public facilities and services. For each public facility system and type of impact, the study shall propose improvements necessary to meet City standard, and to minimize the impact of the development on the public at large, public facilities systems, and affected private property users. H0P2009-00081 Scott Home Occupation Decision 010810 Page 2 • In situations where the Community Development Code requires the dedication of real property interests, the applicant shall either specifically concur with a requirement for public right-of-way dedication, or provide evidence that supports that the real property dedication is not roughly proportional to the projected impacts of the development. Section 18.390.040 states that when a condition of approval requires the transfer to the public of an interest in real property, the approval authority shall adopt findings which support the conclusion that the interest in real property to be transferred is roughly proportional to the impact the proposed development will have on the public. The applicant has submitted an impact study that addresses the impacts to the public systems. As there is no additional development or construction proposed or necessary to accommodate the use, there are few impacts that will be attributable to the Home Occupation. The nature of the business (hair salon) is not expected to contribute significant additional sewage, require significant additional water supply, increase storm drainage, detract from school capacity, require additional utility service, add demand to the park system, or generate noise beyond what is typical for a single family residence. The transportation system will experience an additional 12 trips per day maximum as a result of the business, which is within the street's current capacity. Local streets are designed to carry up to 1500 vehicle trips per day. There are approximately 40 homes located on the street, which would create 400 total vehicle trips per day based on the ITE (Institute of Traffic Engineers) manual. Therefore this standard is satisfied. Section 18.742.040 states that all home occupations except those that have proven non-conforming status, shall observe the following criteria in addition to the standards established for Type I and Type II uses described in 18.742.050: Home occupations may be undertaken only by the principal occupant(s) of a residential property; The proposed Home Occupation is being undertaken by Michelle Scott who is a principal occupant of the property. Therefore,this criterion is met. There shall be no more than three deliveries per week to the residence by suppliers; The applicant estimates there will be few to no deliveries to the home salon business. Therefore, this criterion is met. There shall be no offensive noise, vibration, smoke, dust, odors, heat or glare noticeable at or beyond the property line resulting from the operation. Home occupations shall observe the provisions of the TDC Chapter 18.725, Environmental Performance Standards; No offensive noise, vibration, smoke, dust, odors, etc. are anticipated based on the proposed Home Occupation business since it will be conducted indoors and involves no manufacturing or assembly. All proposed activities will take place within the accessory building.Therefore,this criterion is met. The home occupation shall be operated entirely within the dwelling unit and a conforming accessory structure. The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25% of the combined residence and accessory structure gross floor area, but in no case shall the portion of the home occupation occupying the accessory use exceed 528 square feet. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; The salon is proposed in an accessory building that is 284 square feet. Therefore,this criterion is met. A home occupation shall not make necessary a change in the Uniform Building Code use classification of a dwelling unit. Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TMC Title 14; No changes to the use classification of the accessory building are proposed. This criterion is not applicable. The proposed floor plan shows the addition of a restroom and shampoo sink. The decision is being conditioned that the applicant obtain all required permits from the Building Division. NOTE: The Tigard Business Tax requires payment for only one (1) Business Tax if the same owner is operating more than one approved business at the same location. Although payment for each separate business is not required, it is required that all names of the businesses which are currently in operation at that location be specifically listed on the Business Tax Certificate and be visibly posted at the business location. There are no other Home Occupations approved or requested for this site. Therefore, this criterion does not apply. There shall be no storage and/or distribution of toxic or flammable materials, and spray painting or spray finishing operations that involve toxic or flammable material which in the judgment of the Fire Marshall pose a dangerous risk to the residence, its occupants, and/or surrounding properties. Those individuals which are engaged in home occupations shall make available to the Fire Marshal, for review, the Material Safety Data Sheets which pertain to all potentially toxic and/or flammable materials associated with the use; The applicant states that any chemical based product used for hair that may be considered toxic or flammable will comply with the regulations of the Oregon Health Licensing Agency, Board of Cosmetology. Therefore, this criterion is met. No home occupation shall require any on or off-street parking other than that normally required for a residence; The applicant has indicated that the driveway will be accessible to clients for parking. There will be two spaces available at all times. On-street parking is not permitted due to the width of the pavement and location of the site near a street corner. A condition of approval will insure that the applicant adheres to this requirement. . The following uses are not allowed as home occupations: (a) Auto-body repair and painting. (b) Ongoing mechanical repair conducted outside of an entirely enclosed building. �c) Junk and salvage operations. ) Storage and/or sale of fireworks. The proposed Home Occupation does not involve any of the above uses. Therefore, this criterion does not apply. There shall be no exterior storage of vehicles of any kind used for the business except one commercially licensed vehicle of not more than three-quarters ton GVW which may be parked outside of a structure or screened area; The applicant has indicated that there will be no vehicle owned or operated by the proposed home salon. Therefore, this criterion is met. In addition to the general approval criteria, Type-II home occupations allow the following according to the TCDC chapter 18.142.050: (a) One non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window; (b) No more than one outside volunteer or employee who is not a principal resident of the premises; (c) No more than six daily customers or clients. Customers and clients may not visit the business between the hours of 10:00 p.m. and 8:00 a.m. and shall not generate excessive traffic or monopolize on-street parking; (d) Storage of materials, goods, and equipment which is screened entirely from view by a solid fence. Storage shall not exceed five (5) percent of the total lot area and shall not occur within the front yard or the required side yard setback. There will be no additional employees or volunteers. The applicant has indicated that there will be a maximum of six clients per day for the business. The hours of operation for the business will be Monday through Saturday 9 a.m. to 8 p.m. Parking will be in the driveway. On-street parking is not permitted in this area. There will be no outdoor storage of materials associated with the home occupation. Therefore,these criteria are satisfied. SECTION V. OTHER STAFF COMMENTS The Tigard Development Engineer and Police Department were sent copies of the proposal and had no comments. The Tigard Building Department was sent copies of the proposal and no comments were received. SECTION VI. AGENCY COMMENTS Tualatin Valley Water commented that the salon will necessitate the installation of a reduced pressure backflow device at the meter on the customer side. The applicant is conditioned to obtain a permit and install such a device. Tualatin Valley Fire and Rescue commented that if the applicant provides a portable fire extinguisher and hangs it on the hanger provided, in an accessible location; then there will be no further concern. A condition of approval will ensure this requirement is met. SECTION VII. Multi-family dwelling units with more than ten (10) required spaces shall provide parking for the use of guests and shall consist of 15%of the total required parking. NO MORE THAN 50%OF REQUIRED SPACES MAY BE DESIGNATED AND/OR DIMENSIONED AS COMPACT SPACES. Bicycle racks shall be located in areas protected from automobile traffic and in convenient locations. ❑ SENSITIVE LANDS (Refer to Code Chapter 18.775) The Code provides REGULATIONS FOR LANDS WHICH ARE POTENTIALLY UNSUITABLE FOR DEVELOPMENT DUE TO AREAS WITHIN THE 100-YEAR FLOODPLAIN, NATURAL DRAINAGEWAYS,WETLAND AREAS,ON SLOPES IN EXCESS OF 25 PERCENT,OR ON UNSTABLE GROUND. Staff will attempt to preliminary identify sensitive lands areas at the pre-application conference based on available information. HOWEVER, the responsibility to precisely identify sensitive land areas, and their boundaries,is the responsibility of the applicant. Areas meeting the definitions of sensitive lands must be clearly indicated on plans submitted with the development application. Chapter 18.775 also provides regulations for the use, protection, or modification of sensitive lands areas. The 35 feet may be reduced to 15 feet,if a stamped geotechnical report confirms slope stability shall be maintained with the reduced setback from the top of ravine. Restrictions in the Vegetate Corridor: NO structures, development, construction activities, gardens, lawns, application of chemicals, dumping of any materials of any kind, or other activities shall be permitted which otherwise detract from the water quality protection provided by the vegetated corridor,except as provided for in the USA Design and Construction Standards. Location of Vegetated Corridor: IN ANY RESIDENTIAL DEVELOPMENT WHICH CREATES MULTIPLE PARCFT S or lots intended for separate ownership,such as a subdivision,the vegetated corridor shall be contained in a separate tract,and shall not be a part of any parcel to be used for the construction of a dwelling unit. CWS Service Provider Letter: PRIOR TO SUBMITTAL of any land use applications, the applicant must obtain a CWS Service Provider Letter which will outline the conditions necessary to comply with the CWS R&O 07-20 sensitive area requirements. If there are no sensitive areas,CWS must still issue a letter stating a CWS Service Provider Letter is not required. ® SIGNS (Refer to Code Chapter 18.780) SIGN PERMITS MUST BE OBTAINED PRIOR TO INSTALLATION OF ANY SIGN in the City of Tigard. A "Guidelines for Sign Permits" handout is available upon request. Additional sign area or height beyond Code standards may be permitted if the sign proposal is reviewed as part of a development review application. Alternatively,a Sign Code Exception application may be filed for Director's review. (l TREE REMOVAL PLAN REQUIREMENTS (Refer to Code Section 18.790.030.0 and the "Tree Plan Requirements Handout" included in your pre-application conference packet) A TREE PLAN FOR THE PLANTING,REMOVAL AND PROTECTION OF TREES prepared by a certified arborist shall be provided for any lot,parcel or combination of lots or parcels for which a development application for a subdivision, partition, site development review, planned development, or conditional use is filed. Mitigation must follow the replacement guidelines of Section 18.790.060.D according to the following standards and shall be exclusive of trees required by other development code provisions for landscaping, streets and parking lots: • Retainage of less than 25%of existing trees over 12 inches in caliper requires a mitigation program according to Section 18.150.070.D.of no net loss of trees; • Retainage of from 25 to 50%of existing trees over 12 inches in caliper requires that two-thirds of the trees to be removed be mitigated according to Section 18.790.060.D.; • Retainage of from 50 to 75% of existing trees over 12 inches in caliper requires that 50% of the trees to be removed be mitigated according to Section 18.790.060.D.; • Retainage of 75%or greater of existing trees over 12 inches in caliper requires no mitigation; • Identification of all trees which are proposed to be removed;and • A protection program defining standards and methods that will be used by the applicant to protect trees during and after construction. TREES REMOVED WITHIN THE PERIOD OF ONE (1) YEAR PRIOR TO A DEVELOPMENT APPLICATION LISTED ABOVE will be inventoried as part of the tree plan above and will be replaced according to Section 18.790.060.D. ❑ MITIGATION (Refer to Code Section 18.790.060.E.) REPLACEMENT OF A TREE shall take place according to the following guidelines: • A replacement tree shall be a substantially similar species considering site characteristics. • If a replacement tree of the species of the tree removed or damages is not reasonably available, the Director may allow replacement with a different species of equivalent natural resource value. • If a replacement tree of the size cut is not reasonably available on the local market or would not be viable, the Director shall require replacement with more than one tree in accordance with the following formula: • The number of replacement trees required shall be determined by dividing the estimated caliper size of the tree removed or damaged, by the caliper size of the largest reasonably available replacement trees. If this number of trees cannot be viably located on the subject property,the Director may require one (1) or more replacement trees to be planted on other property within the city,either public property or, with the consent of the owner,private property. • The planting of a replacement tree shall take place in a manner reasonably calculated to allow growth to maturity. IN LIEU OF TREE REPLACEMENT under Subsection D of this section, a party may,with the consent of the Director,elect to compensate the City for its costs in performing such tree replacement. ® CLEAR VISION AREA (Refer to Code Chapter 18.795) The City requires that CLEAR VISION AREAS BE MAINTAINED BETWEEN THREE (3)AND EIGHT (8) FEET IN HEIGHT at road/driveway, road/railroad, and road/road intersections. The size of the required dear vision area depends upon the abutting street's functional classification and any existing obstructions within the clear vision area. The applicant shall show the dear vision areas on the site plan, and identify any obstructions in these areas. n FUTURE STREET PLAN AND EXTENSION OF STREETS (Refer to Code Section 18.810.030.F.) A FUTURE STREET PLAN shall: • Be filed by the applicant in conjunction with an application for a subdivision or partition. The plan shall show the pattern of existing and proposed future streets from the boundaries of the proposed land division and shall include boundaries of the proposed land division and shall include other parcels within 200 feet surrounding and adjacent to the proposed land division. • Identify existing or proposed bus routes, pullouts or other transit facilities, bicycle routes and pedestrian facilities on or within 500 feet of the site. Where necessary to give access or permit a satisfactory future division of adjoining land,streets shall be extended to the boundary lines of the tract to be developed. APPLICATION SUBMITTAL PROCESS All APPLICATIONS MUST BE ACCEPTED BY A PLANNING DIVISION STAFF MEMBER of the Community Development Department at Tigard City Hall offices. PLEASE NOTE: Applications submitted by mail or dropped off at the counter without Planning Division acceptance may be returned. The Planning counter closes at 5:00 PM. Maps submitted with an application shall be folded IN ADVANCE to 8'/2" x 11". One, 81/2" x 11" map of a proposed project shall also be submitted for attachment to the staff report or administrative decision. Applications with unfolded maps shall not be accepted. The Planning Division and Engineering Department will perform a preliminary review of the application and will determine whether an application is complete within 30 days of the counter submittal. Staff will notify the applicant if additional information or additional copies of the submitted materials are required. The administrative decision or public hearing will typically occur approximately 45 to 60 days after an application is accepted as being complete by the Planning Division. Applications involving difficult or protracted issues or requiring review by other jurisdictions may take additional time to review. Written recommendations from the Planning staff are issued seven (7) days prior to the public hearing. A 10-day public appeal period follows all land use decisions. An appeal on this matter would be heard by the Tigard Hearings Officer. A basic flow chart which illustrates the review process is available from the Planning Division upon request. Land use applications requiring a public hearing must have notice posted on-site by the applicant no less than 10 days prior to the public hearing. This PRE-APPLICATION CONFERENCE AND THE NOTES OF THE CONFERENCE ARE INTENDED TO INFORM the prospective applicant of the primary Community Development Code requirements applicable to the potential development of a particular site and to allow the City staff and prospective applicant to discuss the opportunities and constraints affecting development of the site. SUBDIVISION PLAT NAME RESERVATION (Washington County Surveyor's Office: 503-648-8884) PRIOR TO SUBMIII'1NG A SUBDIVISION LAND USE APPLICATION with the City of Tigard, applicants are required to complete and file a subdivision plat naming request with the Washington County Surveyor's Office in order to obtain approval/reservation for any subdivision name. Applications will not be accepted as complete until the City receives the faxed confirmation of approval from the County of the Subdivision Name Reservation. BUILDING PERMITS PLANS FOR BUILDING AND OTHER RELATED PERMITS WILL NOT BE ACCEPTED FOR REVIEW UNTIL A LAND USE APPROVAL HAS BEEN ISSUED. Final inspection approvals by the Building Division will not be granted until there is compliance with all conditions of development approval. For proposed buildings or modifications to existing buildings, it is recommended to contact a Building Division Plans Examiner to determine if there are building code issues that would prevent the structure from being constructed, as proposed.
