HOP1995-00044 MEMORANDUM CITY OF TIGARD, OREGON TO: Bill Monahan FROM:Will D'Andrea DATE :June 20, 1995 SUBJECT:Home Occupation The City issued a Type 2 Home Occupation (HOP 95-0044) for the selling of firearms and sporting goods . The sale of firearms is an allowed Home Occupation. The application stated that this business is an order on demand business and that no inventory will be maintained on the premises . When inventory is delivered the purchaser will come to the home to pick up the order. The applicant is proposing to use 120 square feet of the residence for the business . The City received numerous telephone calls and letters expressing opposition and concern over this decision. A main concern was the potential for customers of undesireable nature coming into the neighborhood. A formal appeal was not filed. One neighbor submitted a letter requesting an appeal . The letter was submitted on June 12, 1995 . On June 13th, staff called the neighbor and explained that the City would accept the appeal, however the neighbor needed to complete an appeal form and pav the filing fee. The neighbor decided not to make a formal appeal, but still wanted to submit their concerns and opposition. Staff explained to many of the neighbors that the appeal would be a public hearing and that the review would be whether or not the applicant had met the applicable standards . Staff told neighbors that the applicant had met the standards and as such the appeal would likely be denied. The Home Occupation approval standards related to size, location, noise, number of visitors, signage, storage and allowed uses were reviewed under the Home Occupation review process . Attached is a copy of the application and approval criteria as listed in Section 13 . 142 . 040 . The total area which may be used in the accessory building for either material product storage and/or the business activity shall not exceed 528 square feet. Otherwise, the home occupation and associated storage of materials and products shall not occupy more than 25 percent of the combined residence and accessory structure gross floor area. The indoor storage of materials or products shall not exceed the limitations imposed by the provisions of the building, fire, health and housing codes; 5.) Storage shall not exceed five percent of the total lot area and shall not occur within the front yard or the required side yard setback. I object to the issuance of this permit and hereby request an appeal. Section 7. of the conditions of home occupation states: "there shall be no storage and/or distribution of toxic or flammable materials " Section 9. of the conditions of home occupation states that storage and/or sale of fireworks is not allowed. I suggest that storage and/or sale of ammunition is in direct violation of sections 7 and 9. Furthermore I strongly oppose the sale of firearms in a residential area due to the importance of registration of firearms and compliance thereof, the potential of undesirable elements seeking firearms from a home distributor, and the general sense that sale of firearms in other than tightly regulated retail facilities is counter to the gun control legislation and regulations that have been passed. Times are difficult enough for Tigard Police and law enforcement officers. Therefore, I request that the Home Occupation Permit approved in the above referenced file be immediately invalidated.
