Any accessory building that is used must meet Uniform Building Code requirements and be in conformance with TCDC Chapter 18.144 of this title; 6.) In an effort to apply these standards more consistently and to assist in the beautification of this area, the City planning staff has conducted an inventory of the area to locate businesses that may not be in full compliance with the Tigard Development Code. Our site visit revealed that your site is in violation of the City's sign code standards (Section 18. 114) and the Type II Home Occupation Standards (18.142.050.A.2.a). You received Home Occupation approval for your business (HOP 96-0036) which permits one non-illuminated sign, not exceeding 1.5 square feet, which shall be attached to the residence or accessory structure or placed in a window. While you are permitted to have a sign, a sign permit must be obtained. Our records do not indicate that any sign permits were obtained for this property. In addition, to having a sign without permits, there are 2 temporary signs on the site, an "A board" sign and a banner, which did not receive approval and would not be permitted under the Type II Home Occupation permit standards. Furthermore, the main sign is illuminated which is specifically prohibited in the Home Occupation standards. REQUIRED ACTION: Remove the temporary signs immediately. Within 30 days of the date of this letter, make sign permit application for a sign that meets the provisions of 18.142.050.A.2.a and 18.114 of the Tigard Development Code. Upon receiving sign permit approval, you will have an additional 30 days to have the sign installed. During our site visit we also had concerns that you have exceed the scope of your Home Occupation permit. As a reminder, you are only permitted one outside employee and no more than 6 customers per day. In addition the parking may not exceed that which is normally required for a residence and may not monopolize on-street parking. When you received the Home Occupation approval, the zoning was R 3.5. Since that time, the zoning has been changed to Mixed Use Employment (MUE), which would allow a greater amount of commercial activity than the Home Occupation permit allows. In order to increase commercial activity above and beyond that approved for the Home Occupation, you would need to go through a Site Development Review (SDR) and would likely be required to make some improvements to the site. Without SDR approval, you are limited to the standards of the Home Occupation permit.
